IN THE NAME OF THE COMMONWEALTH OF MASSACHUSETTS, you are hereby directed to notify and warn the inhabitants of the Town of Tewksbury, qualified to vote in Town affairs, to meet and assemble at Memorial High School in said Tewksbury on Thursday the 26th day of May, 1966 at eight o'clock P. M. to act on the following articles:

At the 8:00 and 8:30 P. M. calls to order by Moderator Qua recesses were accepted. With but 151 present at 8:50 P. M. it was moved and voted that the Special Town Meeting be adjourned to Monday, June 6th at 8:30 P. M. The adjournment was posted according to law.

Monday, June 6, 1966


The adjourned Special Town Meeting was convened at 8:30 P. M. by Moderator Alan M. Qua as the assembly numbered 377 which exceeded the quorum requirement by 43. Check lists revealed that 532 voters were admitted to this meeting.


ARTICLE 1. To see if the Town will vote to rescind the action taken under Article 93 of the Annual Town Meeting held on March 21st, 1966, and to transfer said sum of $20,000.00 to a sanitary land fill dump operation as directed by the State Department of Public Health -Board of Selectmen


VOTED: To adopt Article 1 as amended by voice majority, no dissenis. Mr. Albert proposed the following amendment which carried "that Art. 93 be amended to read (ed: refers to Art. 93 of the 1966 Annual Town Meeting): And to raise and appropriate the sum of $20,000.00 to be expended by the Highway Dept. for the purpose of hot-topping side- walk on Main St. starting at the Junior High School heading south toward Tanglewood." Move for indefinite postponement by Finance was withdrawn. Article 1 was twice tabled before enactment. Voted before Article 1, the funds raised by Article 2 eliminated the need for a transfer of funds for a sanitary land fill dump. (6-6 at 9:29 P. M.).


ARTICLE 2. To see if the Town will vote to raise and appropriate the sum of $20,000.00 for the purpose of a sanitary land fill at the town dump as ordered by the decree of the Superior Court dated March 26, 1964, and of the Supreme Judicial Court dated April 4, 1966, or take any action in relation thereto. -Board of Health

VOTED: Unanimously as amended to raise and appropriate the sum of $6,250.00 for a land-filled dump on motion by Selectman Whelan. In favor the rising vote was 474 to 0. Move by Finance for indefinite post- ponement lost. The amendment offered by Mr. DeCarolis carried and became a part of the main motion: That any new location for a dump of any kind shall have to be voted upon at a town meeting before granting approval of any site. (9:06 P. M.)


ARTICLE 3. To see if the Town will vote to raise and appropriate the sum of $37,400.00 (Thirty-seven thousand four hundred) for the expenses of the School Committee or take any action in relation thereto.


-School Committee VOTED: To raise and appropriate the sum of $28,507.00 for additional school expenses. The motion for the vote by Mr. Gaffney, Jr., Chrm. of the School Committee was unanimously adopted. The assembly had accepted the motion to lay on the table Articles 1 and 2. Public Law Funds will provide $8,893.00 to supplement the required budget of $37,400.00. (6-6 at 8:50 P. M.)


ARTICLE 4. To see if the Town will vote to amend Article IX of the present By-Laws of the Town by adding the following Section 9; Article IX, Section 9: No person shall remain upon a side-walk in such a manner as to obstruct the free passage of foot travelers nor shall any person loiter upon any sidewalk or upon any way, public or private or other area or place including parking areas, to which the public has a right or access, or upon any area designated or known as a park, or upon any other area owned or under the control of the Town after being requested to move on by a police officer of the Town. Whoever violates any provision of this section shall be liable to a penalty of not more than $20.00 for each offense; or act on any- thing relating thereto. -John F. Sullivan, Chief of Police


VOTED: Unanimously the purposes of Article 4 as amended; that the words "of the Town" be stricken and that the penalty shall read $50.00 instead of $20.00 as printed. This latter is due to change in state statute. The amendment had carried as did the main motion by Chief Sullivan upon voice majority, no negatives recorded. (6-6 at 9:30 P. M.) Dis- approved by Attorney General July 18, 1966.


ARTICLE 5. Shall the Town vote to accept within the Town of Tewksbury building law, the provisions of the Massachusetts code for installation of the gas appliances and gas piping as established under Chapter 737 of the Acts of 1960 of the Commonwealth of Massachusetts as amended or act in relation thereto.

VOTED: To indefinitely postpone Article 5. A vote on the question must be taken at an Annual Town Meeting.


ARTICLE 6. To see if the Town will vote to amend the building codes to read as follows:

ENCLOSURE OF SWIMMING POOLS


(a) Fence or wall. Every outdoor swimming pool or family pool shall be completely surrounded by a fence or wall not less than 4 feet in height, which shall be so constructed as not to have openings, holes, or gaps larger than 4 inches in dimension except for doors and gates; and if a picket fence is erected or maintained, the horizontal dimension shall not exceed 4 inches. A dwelling house or accessory building which forms a part of the enclosure need not be so equipped.


(b) Where Applicable. This requirement shall be applicable to all new swimming pools or family pools, hereafter constructed other than indoor pools, and shall apply to all existing pools which have minimum depth of 18 inches of water. No person in possession of land within the Town, either as owner, purchaser, lessee, tenant or a licensee, upon which is situated a swimming pool having a minimum depth of 18 inches shall fail to provide and maintain such fence or wall as herein provided.


(c) Modification in individual cases. The inspector of buildings may make modifications in individual cases, upon a showing of good cause with respect to the height, nature or location of the fence, wall, gate or latches, or the necessity thereof, provided the protection as sought hereunder is not reduced thereby. The inspector of buildings may permit other protective devices or structures to be used so long as the degree of protection afforded by the substitute devices or structures is not less than the protection afforded by the wall, fence, gate and latch described therein, the inspector of build- ings shall allow a reasonable period within which to comply with the requirements of this section. -- William B. VOTED: To amend the building code to include the above controls by voice majority without dissent. Approved by Attorney General July 18, 1966.


ARTICLE 7. To see if the Town will vote to expend the sum of $700.00 from the Installation Account for the purpose of installing approximately 200 feet of water pipe in Boisvert Road, provided that the cost of said installa- tion has been first deposited with the Town Treasurer and applied to esti- mated receipts and to authorize the Water Commissioners to do such work and expend such money, or take any action in relation thereto.

VOTED: To expend the sum of $700.00 for the purposes of installing 100 feet of water pipe, as amended, in Boisvert Road on voice majority.


ARTICLE 8. To see if the Town will vote to amend Article 1, Section 1 of the Town By-Laws to provide as follows: The Annual Town Meeting shall be held on the first Saturday in March commencing at 1:30 P. M. in the afternoon, or take any action relative thereto. -Board of Selectmen


VOTED: Unanimously to amend the prudential by-laws in accordance with the provisions of Article 8. (6-6 at 9:47 P. M.) Approved by Attorney General July 18, 1966.

IN THE NAME OF THE COMMONWEALTH OF MASSACHUSETTS, you are hereby directed to notify and warn the inhabitants of the Town of Tewksbury, qualified to vote in Town affairs, to meet and assemble at Memorial High School in said Tewksbury on Monday, the 5th day of December, 1966, at eight o'clock P. M. to act on the following articles:


ARTICLE 1. To see whether the Town will approve the construction of a new housing project by the Tewksbury Housing Authority, namely, a housing project for elderly persons pursuant to the provisions of Chapter 667 of Massachusetts Acts of 1954, and acts in amendment thereof and in addi- tion thereto, to be known as State-Aided Housing Project 667-2.

ARTICLE 2. To see if the Town will vote to raise and appropriate the sum of $20,300.00 for the expenses of the 1966 Elementary School Building Committee, or take any other action relative thereto.

ARTICLE 3. To see if the Town will vote that any credit arising from the installation of gas heating and ventilating in the new library be used by the Municipal Building Committee for the library construction, or take any other action relative thereto. -Municipal Building Committee


ARTICLE 4. To see if the Town will vote to raise and appropriate the sum of $24,000.00 for the purpose of completing the construction and equipping of the new library and to authorize the Municipal Building Committee to expend such sum in accordance with the authority granted under Article 19 of the 1964 Annual Town Meeting and Article 26 of the 1965 Annual Town Meeting or take any other action relative thereto.

ARTICLE 5. To see if the Town will vote to authorize the Municipal Building Committee to raze the existing fire station upon its vacancy and to level and prepare the site for a parking lot and to raise and appropriate or transfer from available funds the sum of $500.00 for this purpose or take any other action relative thereto. -Municipal Building Committee


ARTICLE 6. To see if the Town will vote to transfer from the E & D account the sum of $5,400.00 and apply this amount to the Fire Department Salaries and Wages account. -William A. Chandler, Chief


ARTICLE 7. To see if the Town will vote to appoint a committee of nine (9) members to be known as the Swimming Site Committee and to authorize

and empower said committee to obtain preliminary plans and specifications for the development of possible swimming facilities within the Town of Tewksbury. The aforesaid committee to consist of the present advisory Swimming Pool Committee appointed by the Board of Selectmen. -Swimming Pool Committee


ARTICLE 8. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $3,000.00 to be expended by Swimming Site Committee for the purpose of securing engineering services, making site studies and surveying various land areas for the purpose of developing future swimming facilities for the Town or take any action relative thereto. ARTICLE 9. To see if the Town will vote to amend the Town By-Laws by adding the following section to Article VI as follows:


Section 11 - No person shall stand or loiter in or on any street, side- walk or public place in such a manner as to obstruct the free passage of travelers thereon; nor shall any person on such a street, sidewalk or public place, after being directed by a police officer to move on and disperse, on a same or subsequent day reassemble to loiter or remain so as to obstruct the free passage of travelers or motor vehicles; provided, however, that nothing herein contained shall be construed to deny the right of peaceful picketing.


It shall be the duty of any police officer of the Town of Tewksbury to order any persons offending against the provisions of this section to move on and disperse and if the person so ordered or requested does not forthwith obey, to remove them, or to arrest and cause them to be brought before the Justice of the District Court of Lowell, and a complaint to be made against the provisions of the preceeding sentence. -Board of Selectmen


ARTICLE 10. To see if the Town will vote to raise and appropriate the sum of $2,300.00 for the purpose of paying damages for land takings from the Oblate Novitiate in connection with the widening and improvement of Chandler Street. -Board of Selectmen


ARTICLE 11. To see if the Town will vote to authorize the Board of Select- men to designate a person to act in its interest in dealing with municipal employees under and in accordance with Chapter 763 of the Acts of 1965, and to take any other action relative thereto. -Board of Selectmen


ARTICLE 12. To see if the Town will vote to amend the vote under Article 54 of the Annual Town Meeting held on February 18, 1948 by increasing the total number of members of the Insurance Committee to eleven, so that the vote will read as follows: "And a committee of eleven composed of the Board of Selectmen, the School Committee and the Town Treasurer have charge of all Municipal Building Insurance and adopt the Five Year Plan," or take any other action relative thereto.

ARTICLE 13. To see if the Town will vote to authorize the Board of Selectmen to purchase from William Johnson, approximately 14 acres of land on the northerly side of Shawsheen Street, adjacent to the old railroad bed, for the purpose of providing a sewerage treatment plant and all other purposes incidental thereto; and to raise and appropriate the sum of $30,000.00 for such purchase, or take any other action relative thereto. -Board of Selectmen and Planning Board


ARTICLE 14. To see if the Town will vote to raise and appropriate the sum of $4,000.00 for the repair, improvement and widening of Village Street from Clark Road to the Tewksbury-Lowell line. -Board of Selectmen ARTICLE 15. To see if the Town will vote to transfer the sum of $1,428.00 from the Water Well 1962 Account to a Water Well Improvement Account, for the purpose of installing fences around No. 1, No. 2 and No. 3 Well Houses, or take any action relative thereto.

ARTICLE 16. To see if the Town will vote to expend the sum of $5,650.00 from the Installation Account, for the purpose of installing approximately 1000 feet of water pipe in Eastern Avenue, provided that the cost of said installation has been first deposited with the Town Treasurer and applied to estimated receipts and to authorize the Water Commissioners to do such work and expend such money, or take any action in relation thereto.

ARTICLE 17. To see if the Town will vote to expend the sum of $6,580.00 from the Installation Account for the purpose of installing approximately 1400 feet of water pipe in Leighton Lane to service 16 one acre lots, provided that the cost of said installation has been first deposited with the Town Treasurer and applied to estimated receipts and to authorize the Water Commissioners to do such work and expend such money, or take any action in relation thereto. -Howard H. ARTICLE 18. To see if the Town of Tewksbury will vote that effective immediately, all Insurance placed by any department or committee in the Town of Tewksbury, shall be placed through local, independent, resident, Insurance Brokers operating an office in Tewksbury, who have been in business at least five years, providing their rates are competitive. -Albert D. ARTICLE 19. To see if the Town will vote to raise and appropriate or transfer from E & D the sum of $2,000.00 or any other sum for the purpose of installing a public water main in Cart Path Road for a distance of approxi- mately 400 feet, to service two one acre lots, and to authorize the Water Department to do such work and expend such money, or take any action in relation thereto. -Board of Water Commissioners

To see if the Town will vote to raise and appropriate or transfer from E & D the sum of $180.00 or any other sum for the purpose of installing approximately 60 feet of 3/4" copper tubing to service Lot 1 Cart Path Road, and to authorize the Water Department to do such work and expend such money, or take any action in relation thereto.

ARTICLE 22. To see if the Town will vote to raise and appropriate the sum of $15,000.00 for the purpose of new installations of water services to dwellings or other buildings, and provided that the cost of said installation has been first deposited with the Town Treasurer and applied to estimated receipts and to authorize the Water Department to do such work and expend such money and in the event said entire sum is not required for said installations, the unexpended balance shall likewise be credited to estimated receipts, or take any action in relation thereto.
