VOTED: Unanimously to approve all items in the General Budget, not marked for discussion, and that they be and are hereby raised and appropriated in the amounts recommended by the Finance Committee. (3-4 at 3:15 P. M.)


The following action was taken on debatable items:


Item 12-Assessors, Operating Expenses: After explanations, the Finance recommendation was voted in the sum of $2.300.00.


Item 15-Town Clerk, Operating Expenses: Originial and recommended amount of $1,669.00 was voted as there was no question on this item. The query was on Article 15, not item 15 of Article 9.


Item 29-Planning Board, Salaries: Voted the sum of $1,000.00 as moved by Mr. Green by voice majority. Motion for $900.00 by Finance was declared lost.


Item 30-Planning Board, Operating Expenses: Again Finance figure was lost in voice vote for $3,900.00. Through motion by Mr. Greene the sum of $5,455.00 was carried. (3-4 at 3:32 P. M.)


Item 40-Fire Department, Salaries: On one motion, the sum as recom- mended carried: $183,732.53.

Item 56 - Building Inspector, Operating Expenses: Voice Majority assured the sum of $1,550.00 as recommended.


Item 58-Board of Health, Salaries: With debate withdrawn, the sum of $13,166.00 was voted without dissent.


Item 77-Library, Salaries: Accepting explanation by Mr. Abbott, Chairman Library Trustees, Finance recommended the figure of $13,775.00 which was so voted.


Item 78-Library, Operating Expenses: Voted the sum of $6,945.00 without dissent, as the total picture had been explained above. Chapter 760 monies were forthcoming.


Item 88-Water Dept., Capital Outlay: No monies were voted on this item. Move by Mr. Carter, Chairman Water Commissioners, for $4,263.77 (for a new truck) was defeated by the assembly.


VOTED: Unanimously to adopt Article 9 in its entirety as amended and voted upon motion by Mr. W. Hurton of Finance (3-4 at 3:50 P. M.)


ARTICLE 10. To determine what sum the Town will authorize and direct the Assessors to take from available funds to reduce the tax levy for the current year, or take any action relative thereto. -Board of Selectmen


VOTED: To transfer the sum of $30,000.00 from E & D to reduce the tax levy for the current year in voice majority. The vote to take from-the- table by voice was not clear and the ensuing count revealed 178 to 37 in favor. The Article had been tabled upon motion by Mr .Mclaughlin on 3-4. (3-20 at 10:51 P. M.)


ARTICLE 11. To see what sum of money the town will vote to raise and appropriate and/or transfer from Overlay Reserve for a reserve fund, pursuant to the provisions of Chapter 40, Section 6.

VOTED: To transfer the sum of $13,992.00 from Overlay Reserve and raise and appropriate $6,008.00 for a Reserve Fund. (3-4 at 3:56 P. M.)


ARTICLE 12. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1967 and January 1, 1968, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws. -Board of Selectmen

ARTICLE 13. To see if the Town will authorize the Selectmen to institute suits on behalf of the town or defend any suits that are, or may be brought against the town, and to sign any contracts or agreements in behalf of the -Board of Selectmen town.


VOTED: To authorize the Selectmen to institute suits or defend suits or sign contracts and agreements.


ARTICLE 14. To see if the Town will vote to authorize the Board of Selectmen and the Treasurer to foreclose, either through the land court or by affidavit of the Commissioner of Corporations and Taxation, any tax title held by the Town for more than two years, and see what sum of money the Town will vote to raise and appropriate therefor. -Board of Selectmen


VOTED: Unanimously to foreclose any tax title held by the Town for more than two years.


ARTICLE 15. To see if the Town will vote to authorize the Selectmen to sell, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town and adver- tising for three successive weeks at least fourteen days before the sale, property taken by the Town under tax title procedure, provided that the Selectmen or whomsoever they may authorize to hold such public auction may reject any bid which they deem inadequate, or take any action relative thereto.

VOTED: To indefinitely postpone this Article which concernes the sale of property under tax title foreclousure approval. The move for recon- sideration by Mr. Shea failed to gain support minutes after the original vote.


ARTICLE 16. To see if the Town will vote the money arising from licensing dogs for the ensuing year to aid in support of the Public Library.

VOTED: To transfer the sum of $1,452.66 received from the County from dog licenses to the support of the Public Library, Operating Account.


ARTICLE 17. To see if the Town will vote the money received from the Commonwealth of Massachusetts under Chapter 760 to aid in the support of the Public Library or take any other action relative thereto.


-Board of Library Trustees VOTED: To transfer by unanimous vote to the support of the Public Library monies received from the State under Chapter 760: $2,975.50 to the Library Operating Account: $1,000.00 to the Library Equipment Fund. (3-27 at 8:19 P. M.) The above followed approval by the assembly to take from-the-table this Article which had been tabled on March 4th. (Chapter 760, Acts of 1960)


ARTICLE 18. To see what sum of money the Town will vote to transfer from E & D to the Stabilization Fund under the Provisions of Chapter 40, Section 5B of the General Laws. -Board of Selectmen

VOTED: To increase the Stabilization Fund by the sum of $3,000.00 by transferring this amount from E & D. Unanimous approval was given.


ARTICLE 19. To see if the Town will vote to raise and appropriate the sum of $500.00 for the purpose of purchasing traffic signs.

VOTED: On the basis of a motion to postpone indefinitely the assembly upheld the move and refused to raise and appropriate $500.00 for the purchase of traffic signs.


ARTICLE 20. To see if the Town will vote to authorize the Board of Selectmen and the Treasurer to foreclose, either through the land court or by affidavit of the Commissioners of Corporations and Taxation, 63 tax titles held by the Town for more than two years, and vote to raise and appro- priate the sum of $5,250.00 therefor. -Board of Selectmen


VOTED: To authorize the Selectmen and the Treasurer to foreclose 63 tax titles held for more than two years and to raise and appropriate the sum of $5,250.00 therefor. (3-4 at 4:05 P. M.)


ARTICLE 21. To see if the Town will vote to raise and appropriate, or transfer from available funds, the sum of $3,800.00 for the purpose of taking, in the name of the Town of Tewksbury, all parcels of land on which 1965 taxes remain unpaid. -Treasurer-Collector


VOTED: To raise and appropriate the sum of $3,800.00 for the purpose of taking all land for 1965 taxes. (3-4 at 4:06 P. M.)


ARTICLE 22. To see if the Town will vote to adopt the following by-law: Article V, Section 2: No written contract by any town officer, board or com- mittee, excepting the School Committee, involving the expenditure of $1,000.00 or more, shall be valid unless countersigned and approved by a majority of the Board of Selectmen. A copy of every such contract shall be deposited with the Town Auditor prior to the commencement of any such action thereon, and shall be made available for inspection by the public at reasonable times.

VOTED: To indefinitely postpone on voice majority. The question had been moved following a number of amendments which did not prevail as the main motion was defeated.


ARTICLE 23. To see if the Town will vote to raise and appropriate the sum of $2,000 for the training, feeding, care and equipment of two police dogs, which have been offered to the Town without cost, or take any other action relative thereto. -Board of Selectmen


VOTED: Following the defeat of the earlier motion to indefinitely postpone, the motion by Mr. Montague to raise and appropriate the sum of $2,000.00 for the maintenance of two police dogs was declared carried by the Moderator on voice vote. (3-4 at 4:35 P. M.)

ARTICLE 24. To see if the Town will authorize the Board of Selectmen to secure from the United States Department of Agriculture, Soil Conservation Service, a detailed soil survey for the Town of Tewksbury, including an interpretive report, to raise and appropriate the sum of $3,943 for such purpose and to take any other action relative thereto.

VOTED: For a soil survey of the Town the sum of $3,943.00 was raised and appropriated on voice vote.


ARTICLE 26. To see if the Town will vote to authorize the Board of Selectmen to designate a person to act in its interest in dealing with munici- pal employees under and in accordance with Chapter 763 of the Acts of 1965, and to take any other action relative thereto.

VOTED: As amended, to authorize the chairman of the Personnel Board to act in the interest of the Town in dealing with municipal employees under and in accordance with Chapter 763 of the Acts of 1965 by voice majority. (3-4 at 4:46 P. M.)


ARTICLE 27. To see if the Town will vote to amend the vote under Article 54 of the Annual Town Meeting held on February 18, 1948 by in- creasing the total number of members of the Insurance Committee to eleven, so that the vote will read as follows: "And a committee of eleven composed of the Board of Selectmen, the School Committee, and the Town Treasurer have charge of all Municipal Building Insurance and adopt the Five Year Plan," or take any other action relative thereto. -Board of Selectmen


VOTED: To adopt Article 27 as written increasing the Insurance Committee to eleven members. (3-4 at 4:47 P. M.) Voice vote.


ARTICLE 28. To see if the Town will vote to authorize the Board of Selectmen to purchase from William Johnson, approximately 14 acres of land on the northerly side of Shawsheen Street, adjacent to the old railroad bed, for the purpose of providing a sewerage treatment plant and all other purposes incidental thereto; and to raise and appropriate the sum of $30,000.00 for such purchase, or take any other action relative thereto.

VOTED: To authorize the Selectmen to purchase from William Johnson approximately 14 acres of land for the purpose of a sewerage treatment plant and to raise and appropriate the sum of $30,000.00 for such purpose. (3-4 at 4:50 P. M.)


ARTICLE 29. To see if the Town will vote to raise and appropriate the sum of $4,000 for the repair, improvement and widening of Village Street from Clark Road to the Tewksbury-Lowell line. -Board of Selectmen

ARTICLE 30. To see if the Town will vote to amend the Town By-Laws by adding the following section to Article VI as follows:


Section 11 - No person shall stand or loiter in or on any street, side- walk or public place in such a manner as to obstruct the free passage of travelers thereon; nor shall any person on such street, sidewalk or public place, after being directed by a police officer to move on and disperse, on a same or subsequent day reassemble to loiter or remain so as to obstruct the free passage of travelers or motor vehicles; provided, however, that nothing herein contained shall be construed to deny the rights of peaceful picketing. It shall be the duty of any police officer of the Town of Tewksbury to order any persons offending against the provisions of this section to move on and disperse and if the person so ordered or requested does not forthwith obey, to remove them, or to arrest and cause them to be brought before the Justice of the District Court of Lowell, and a complaint to be made against the provisions of the preceeding sentence. -Board of Selectmen


VOTED: Unanimously to add Section 11 to Article 6 of the Town By-Laws. (3-4 at 4:51 P. M.) Approved by the Attorney General August 1, 1967.


ARTICLE 31. To see if the Town will vote to raise and appropriate the sum of $1,414.28 to settle the claim of Ruth M. Busa et al, vs. the Town of Tewksbury, arising out of the operation of a Highway Department truck, or take any other action in relation thereto. -Board of Selectmen


VOTED: To raise and appropriate the sum of $1,414.28 to settle the claim of Ruth M. Busa et al on voice vote. (3-4 at 4:52 P. M.)


ARTICLE 32. To see if the Town will vote to raise and appropriate or transfer from E & D Account the sum of $500.00 for the purpose of demolition of dangerous structures to be supervised by the Building Inspector and the Board of Selectmen or take any action relative thereto.

ARTICLE 33. To see if the Town will assume liability in the manner pro- vided by Section 29 of Chapter 91 of the General Laws, as most recently amended by Chapter 5, Acts of 1955, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachu- setts for the improvement, development, maintenance and protection of tidal and not-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth.

ARTICLE 34. To see if the Town will vote to authorize the Board of Selectmen to appoint a committee of nine (9) members to be known as the Swimming Site Committee and to authorize and empower said committee to obtain preliminary plans and specifications for the development of possible swimming facilities within the Town of Tewksbury and to ratify the appointment of the present advisory Swimming Pool Committee by the Board of Selectmen.

ARTICLE 35. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $3,000.00 to be expended by Swim- ming Site Committee for the purpose of securing engineering services, making site studies and surveying various land areas for the purpose of developing future swimming facilities for the Town or take any action relative thereto.

VOTED: To transfer on voice vote the sum of $3,000.00 from E &D to be expended by the Swimming Site Committee. (3-4 at 4:54 P. M.)


During discussion and motions on Article 36 the quorum question was raised, found lacking, and the meeting halted. It was then voted to adjourn to Monday, March 13th at 8:00 P. M. when the move, Tuesday, March 7th, failed to win sufficient support. The adjournment was posted according to law.


MONDAY, MARCH 13, 1967


The Moderator Alan M. Qua had been re-elected to office on March 11th and was qualified this date by the Town Clerk. Thereupon Mod- erator Qua called the meeting to order at 8:00 P. M. At 8:17 P. M. 390 voters were tallied and the meeting convened.


ARTICLE 36. To see if the Town will vote to authorize the Board of Selectmen to acquire by purchase or take by eminent domain a tract of land consisting of approximately 58.8 acres for conservation and recreational purposes in accordance with Chapter 40, Section 14 and Chapter 79 of the General Laws as amended shown on a plan of land entitled "Plan of Land in Andover and Tewksbury prepared for Alton Properties, Inc., October 18, 1964 Scale 1" equals 200 ft. Dana F. Perkins & Sons, Civil Engineers & Surveyors" which plan is to be recorded at the Middlesex Registry of Deeds: said land situated along the northerly side of Kendall Road and adjacent to a body of water known as Ames Lake being more particularly bounded and described as follows:


Beginning at a point 607.61 feet distant from but not adjacent to the northerly side of Kendall Road which point is situated at the southeasterly corner of land now or formerly owned by Alton Properties, Inc. thence;


NORTHERLY along other land of Alton Properties 966.73 ft. thence;

NORTHEASTERLY by other land of Alton Properties approximately 3000 ft. to the Tewksbury-Andover line thence;


SOUTHEASTERLY along land now or formerly of Edith W. Leighton approximately 500 feet along a stone wall, thence;


SOUTHERLY by land now or formerly of Edith W. Leighton approxi- mately 1461 feet to Kendall Road, thence;


SOUTHWESTERLY along Kendall Road approximately 1341 feet, thence;


SOUTHWESTERLY 607.61 feet to the point of beginning.


This parcel contains approximately 58.8 acres owned or formerly owned by Alton Properties, Inc.


And to transfer from available funds the sum of $2,500 for such purpose and to raise and appropriate the sum of $97,500 for the purposes of said Article, including appraisals, surveys, and legal costs, and to determine how any such sum shall be raised whether by taxation, by borrowing or other- wise and if by borrowing to authorize the issuance of bonds and notes of the Town or take any action relative thereto. -Board of Selectmen


VOTED: A move by Mr. Hurton for the previous question found a majority which directed the issue to a vote. An earlier motion to end debate failed. The amendment offered by Mr. Conlon was put to a rising vote and lost with 105 in favor and 77 opposed. The Moderator declared that 122 votes were needed to pass. The amendment reads as follows: "To authorize and direct the Treasurer, with the approval of the Board of Selectmen, to borrow a sum of money, not to exceed Ninety-Seven Thousand Five Hundred dollars ($97,500.00) by the assuance and sale, at one time or from time to time, as one or more seperate bonds or notes of the Town, under and pursuant to Chapter 40, Section 14 and Chapter 79 of the Mass. General Laws, and other applicable provisions of the Law, each such issue to be paid in not more than thirty years from its date, and to transfer from the Excess and Deficiency Account the sum of Twenty-Five Hundred dollars ($2,500.00) for the purpose of this Article and to be used in conjunction with any and all available funds from State and Federal Assistance Programs."


None of the main motions received the support in secret ballot voting of the required two-thirds:


(1) Indefinite postponement vote revealed 134 yeas, 98 nays which therefore demanded 155 for either side. (3-4).


(2) On adoption the vote was recorded as 186 in favor and 187 op- posed with 249 as the magic figure to pass. (3-13 at 8:46 P. M.)


On 3-13 Mr. Corliss questioned ruling by the Moderator on the 2/3 vote for the amendment lost on 3-4. Moderator refused to entertain question as debate had been precluded. A rising vote sustained the Moderator on this point 158 to 140. Reconsideration of Article 36, moved by Mr. Geary, was refused by a rising vote 161 to 184, 230 needed.
