SPECIAL TOWN MEETING Monday, December 10, 1956


Pursuant to a Warrant duly issued, the Special Town Meeting of the inhabitants of the Town of Weymouth, represented by their duly elected and qualified Town Meeting Members, was held in the auditorium of the Weymouth High School on Monday, December 10, 1956.


The Meeting was called to order at 7:45 o'clock in the evening by the Annual Moderator, Mr. Daniel L. O'Donnell.


The Town Clerk, Mr. Harry Christensen, read the call of the meeting.


Upon motion duly made, it was


UNANIMOUSLY VOTED: That the reading of the Articles in the Warrant be suspended.


Prayer for Divine Guidance at this Special Town Meeting was offered by Rev. Fr. Raymond Valle, Assistant Pastor, St. Francis Xavier Roman Catholic Church of South Weymouth.


Town Meeting Members not sworn in were administered the oath by the Moderator.


The Chair being in doubt as to the presence of a quorum a teller count was ordered and tellers were appointed by the Chair and sworn in as follows

Count was taken and the tellers reported 139 Town Meeting Members present. The Chair then declared a quorum present which consisted of 139 in attendance at this time. Prior to adjournment a total of 169 Town Meeting Members were present.


We now continue with consideration of the Articles in the Warrant.

UNANIMOUSLY VOTED: That the sum of $8,633.17 be appropriated from the Excess and Deficiency Account of the Town for the payment of interest on the General Town Debt and that the sum of $755.50 be appropriated from the Excess and Deficiency Account of the Water De- partment for the payment of interest on the Water Debt.

MOVED by the Appropriation Committee:


That the Town vote to accept the report and recommendations of the Department of Public Works Committee and instruct the Moderator to appoint a committee consisting of the Senator and Representatives from this District to introduce legislation in the General Court for all Act authorizing the Town of Weymouth to establish a Department of Public Works exercising the powers of certain other Departments and Town Officials.


REPORT OF THE PUBLIC WORKS DEPARTMENT COMMITTEE TO THE TOWN MEETING MEMBERS


In accordance with the vote of the Special Town Meeting held on June 18, 1956 the Committee appointed by the Moderator under Article 8. to make a study and report relative to a Department of Public Works, herewith submits its report and recommendations for your consideration.


The Committee met and organized on August 26th electing Joseph M. Nover, Jr., Chairman, and Harry Christensen, Clerk. Plans were for- mulated to best cover all phases of the question of a Department of Pub- lic Works for Weymouth and to recommend the acceptance or rejection of such a proposal. Subsequent meetings were he'd with representatives of outside towns including Wellesley, which had recently adopted Chap. 41, Sec. 69C through 69F of the General Laws; Arlington, under a Depart- ment of Public Works since 1905; Quincy and Belmont with whom some of the individual members of the Committee had spoken, and reports on

approximately fifteen other towns obtained from the Massachusetts Fed- eration of Taxpayers Association. Meetings were also held with our Water, Sewer and Park Commissioners, Superintendent of Streets, Town Engineer and Tree Warden.


Based upon many hours of discussion and exchange of ideas from among the groups with whom the Committee met, the following opinions have been expressed:


(1) A Department of Public Works would provide for the utilization of similar skills, materials, equipment and methods of administration.


(2) Most Departments of Public Works centralize the elements of en- gineering and planning.


(3) Under a Department of Public Works planned coordinated work programs and long range planning are more likely to result.


(4) A Department of Public Works provides for a beneficial inter- change of personnel and pooling of equipment thereby providing better distribution of work loads of different departments.


(5) Personnel policies and practices may be standardized to utilize to a greater degree available manpower and work programs.


(6) Under a Department of Public Works there is a greater chance for maximum efficiency, more value for each dollar spent which in turn would result in better service and more completed projects.


(7) All Department of Public Works activities would be coordinated and under one authority, thereby rendering better service for solving the individual problems of the taxpayers.


(8) Under a Department of Public Works there may be centralized purchasing for the various divisions which could result in monetary savings.


Long and careful consideration has been given to the proposed act, Its basic principles are similar to those drawn by other towns but con- tains variations which the Committee feels are better adaptable to the needs of the town. A commission of seven members is recommended on the basis that such number would provide for nearly equal representation throughout the town and yet would not be too cumbersome. The Com- mittee suggests a salary of $600.00 for the Commissioners with an addi- tional $100.00 for the Chairman.


The Committee is of the opinion that the departments named in the act should be the nucleus of a Public Work Department, with changes or additions from time to time as the town may determine. This is based on the fact that these departments have in many respects similar duties, interchangeable personnel and equipment, and come within the scope of public works. The act further provides for the appointment and compen- sation of a superintendent. From all information obtainable the salaries of superintendents in the various localities range from $8,000 to $14,000 depending on their duties and the size of the community which they serve. The Committee, at a joint meeting with the Personnel Board, discussed at considerable length the salary of a Superintendent of Public Works for Weymouth. By mutual agreement a salary range of $8,320 to $10,088 war tentatively established, both groups being of the belief that such a range would be within reason for the town.


The act also provides that there shall be no reduction or dismissal cf permanent personnel because of its establishment. However, the Com- mittee would suggest that considerations be given to reclassification of the office of superintendent in the various departments as vacancies oc- cur from time to time.

The Committee has devoted considerable time to the cost of a Public Works Department. Particular stress was placed on this phase of the problem during discussions with representatives of towns operating under a Department of Public Works. From all information obtained it is the considered opinion of the Committee that there would be definite savings through the establishment of such a department. This would be brought about in part by the coordination of available manpower, pooling of equipment and centralized purchasing, as well as coordinated and long range planning.


The increase in services and efficiency would tend to provide for greater economy. This appears to be borne out by the fact that no town has rescinded its action having once established a Department of Pub- lic Works.


The Committee is fully cognizant of the loyal and faithful service rendered the town by the various Departments and Commissioners and at the same time wishes to extend its thanks for their cooperation and expressions of opinions and ideas at our many meetings and suggests that the Annual Town Meeting of 1958 give consideration to the advisa- bility of the Moderator being empowered to appoint the members of the Boards of Sewer and Water Commissioners in office at that time in an advisory capacity to the Public Works Commissioners for a period of one year.


Some members of the Committee have not been in complete agree- ment on all aspects of a Department of Public Works but, being of the opinion that the question of such a department when placed on the bal- lot may be voted upon favorably by the electorate, have made every effort to obtain an act which would be best suited to the needs of the town.


A majority of the Committee, therefore, in the strong belief that a Department of Public Works is warranted, recommends the acceptance of its report and further recommends the establishment of a Dept. of Public Works for the Town of Weymouth in conformity with the fol- lowing act.

Public Works Committee


AN ACT AUTHORIZING THE TOWN OF WEYMOUTH TO ESTABLISH A DEPARTMENT OF PUBLIC WORKS EXERCISING THE POWERS OF CERTAIN OTHER DEPARTMENTS AND TOWN OFFICIALS.


SECTION I:


There shall be established a board of Public Works hereinafter called the Board, to consist of seven members. The initial members thereof shall be elected to serve, three for three years, two for two years, two for one year from date of annual town election at which they are elected and thereafter when the term of any member expires his successor shall be elected to serve for three years. In all cases the members of the Board

shall serve until their successors are qualified. The members of the Board shall forthwith after each annual town election, elect from its members a Chairman and a Clerk for the ensuing year. In case of a vacancy, the remaining members of the Board shall, jointly with the Board of Selectmen, within thirty days, fill such vacancy until the next town election, when a new member or members shall be elected to fill the unexpired term. No person shall serve on the Board who holds an- other elective or appointee office in the town other than town meeting members.


SECTION II:


Upon the qualification of the initial members of the Board of Public Works, the Board shall have all the powers and duties now and from time to time vested by general law or town by-law or special act in the following Boards, Departments and offices, or in Boards, Departments, and offices having corresponding powers and duties in the Town of Wey- mouth to wit: Water Commissioners, Sewer Commissioners, Tree War- den, Park Commissioners with respect to maintenance and construction only, Selectmen with respect to Street Department, Refuse Collection, Drainage, Engineering, and Moth Department, and such Boards, Offices and Departments shall be abolished. No contracts or liabilities then in force shall be affected by such abolition, but the Board of Public Works, shall in all respects be the lawful successor of the Boards, Departments and offices so abolished.


The Board shall have such added powers with respect to Public Works as the town may from time to time by by-law provide, any other provi- sions of the law to the contrary notwithstanding.


SECTION III:


The Board of Public Works, set up in Section two of this act shall consist of the following divisions:


SEWER DIVISION


WATER DIVISION


STREET DIVISION (including Refuse Collection and Drainage)
