The sum of $150.00 is provided in the total sum for travel outside the Commonwealth, in ac- cordance with Clause 34, Section 5, Chapter 40 of the General Laws.

Mr. Roulston, Chairman of the Personnel Board, having been granted permission, read the following report:


Mr. Moderator and Town Meeting Members:


By a vote of the 1955 Annual Town Meeting the Personnel Board was instructed to study Article 31 of that warrant relating to the adoption of a new by-law requiring that all future prospective employees be required to undergo a complete medical examination prior to entrance into the Town's service.


Our Board has studied the proposed by-laws as given in full under Article 60 of the present warrant.


Our Board recommends the adoption of said by-law as being for the best interest of the Town of Weymouth.


In 1948 the Town of Hingham voted to adopt an identical by-law and the same was approved within a month by Attorney General Barnes.


The Chairman of the Board of Selectmen, the Superintendent of Schools and the Town Accountant of the Town of Hingham are unani- mous in their opinion that such a by-law is highly desirable and in the seven years since its adoption they can point to indisputable evidence of savings made by the Town of Hingham.


In 1950 Weymouth voted to adopt a similar by-law which later failed to be approved by Attorney General Kelley's office.


Our Board has discussed the proposed by-law with the present Attor- ney General Fingold and were led to believe that such a by-law would readily be approved if presented.


To make more definite who shall have permanent custody of the physical reports, we offer an amendment to the Appropriation Commit- tee's proposed motion.


We move that two words "selectmen or" be deleted from the second sentence of the third paragraph of the proposed by-law so that it will read: "The record in a sealed container shall be deposited with the Re- tirement Board for safe keeping", etc. etc.

ARTICLE 60. (At Request of George E. Lane and Others and By Direction of Selectmen). To see if the Town will amend its by-laws and vote to adopt a new by-law requiring employees, new or otherwise, to

undergo a complete medical examination prior to entrance into the town's service, the by-law to be same as voted under Article 30 in the warrant for the annual town meeting of 1950.


MOVED by the Appropriation Committee:


That the Town vote to amend its By-Laws and adopt a new By-Law governing the General Physical Qualifications for employment by the Town under a new Section 628.

1. Every person hereafter employed by the Town except elected offi- cials and members of the Police or Fire Departments who have passed an examination by the Civil Service Commission and occasional or substitute employees shall first be certified by a physician, approved by the Selectmen, as physically fit and without congenital or chronic disease or disability that could interfere with reasonably continuous performance of the duties of the position and also that the applicant conforms to the particular re- quirements of the position, if there are any such in force.


2. The regularly appointed school physician is approved for examina- tion of School Department employees.


3. The examination shall be recorded on the prescribed form, and the details shall, subject to the provisions hereof, be confidential to the applicaant and the examining physician. The record in a sealed con- tainer shall be deposited with the Selectmen or Retirement Board for safe keeping, the contents subject to future reference only by a physician designated by the Selectmen or Retirement Board or School Committee.


4. The examining physician shall file with the Selectmen, the town department under which the appplicant is to be employed and the Town Accountant a certificate of findings in accordance with paragraph 1 or a statement that the prospective employee does not meet the required physi- cal standards.


5. The medical examiner may request clinical consultation or lab- oratory work beyond that specified in the examination form, if in his opinion such information is necessary or advisable.


6. A reasonable interval shall be allowed between the time of exam- ination and certification or rejection for the purpose of allowing the ap- plicant to effect such correction as would make him employable under the regulations.


7. If rejected, the applicant shall be informed by the medical ex- aminer of the cause or causes of his rejection. Appeal from the findings of the medical examiner may be made in writing to the Board of Select- men, or in the case of appointees in the School Department, to the Chair- man of the School Board, one other member of the School Board to be appointed by the School Board and the Superintendent of Schools sitting as a Board of Appeals, within one week of the filing of the results of the examination. This appeal shall specifically authorize the medical ex- aminer to disclose the details of the physical examination to the Board to which the appeal is taken which may then order such further exam- ination as they deem advisable, and the Board's decision shall be final.


8. The record of the examination shall include a report of an X-ray of the lungs by a recognized Roentgenologist, hospital, laboratory or clinic. It shall also include the information that a Hinton or similar blood test has been done by a recognized, qualified laboratory. In the event of a positive blood test, the medical examiner shall allow a reason- able interval during which the applicant may undertake treatment satis- factory to the examining physician and sufficient for his safe employment.

9. No change in employment to a position for which more exacting physical standards are herein prescribed shall be made without re-exam- ination and certification of physical qualifications.


10. The following conditions shall be considered cause for rejection :


ALL APPLICANTS: In general, any condition of such degree of varia- tion from the normal that it would interfere with or be aggravated by the reasonably continuous performance of the duties of the position applied for.


Tuberculosis, active


Hypertension (Readings consistently over 150mm systolic and/or 110mm diastolic)


Hypertensive heart and kidney disease


Chronic Nephritis


Diabetes Mellitus, requiring the use of insulin


Recurrent peptic ulcer


Pernicious anemia


Malignant disease


Leukemia


Any convulsive disorder


Syphilis, cardio-vascular or central nervous system


Any acute communicable disease


Deformities, contractures, paralyses, limitation of motion of spine or joints, loss of any part of the extermities, of such degree that if would interfere with the normal performance of the duties of the position applied for.


APPLICANTS TO DRIVE MOTOR VEHICLES:


Color blindness (dominant primary colors)


Visual acuity of less than 20/30 in each eye with correction


Deafness, unless properly compensated by hearing aid.

To refer this Article back to the Personnel Board to report to the next Annual Town Meeting relative to who will pay for the various ex- aminations and also to submit budget estimates.

ARTICLE 5. (By Direction of Selectmen). That the Selectmen be authorized to sell or otherwise dispose of personal property and any real estate of which the Town has possession or title, including all property taken for non-payment of taxes, all such cases of sale to be made by public auction or private sale as the Selectmen may deem for the best interest of the Town, and that the Board or Officer in charge of any other Town Department may, with the approval of the Board of Selectmen, sell at public auction or private sale, as the Board of Selectmen may ap- prove, any personal property belonging to said Department which in the opinion of the Officer or Board in charge of the Department is no longer needed by the Town and which in the opinion of the Selectmen is not needed by any other Department, provided that in each case involving real estate, majorities of the Planning Board, Sewer Commissioners and Park Commissioners respectively vote to concur in the opinion that the property will not be needed for parks, playgrounds or other public use.
