ARTICLE 26. (At Request of Greenbriar Improvement Association Inc.). To see what sum of money the Town will vote to raise and appro- priate to install a catchbasin at the corner of Moreland Road with Don- nellan Circle, near No. 153 Donnellan Circle, and to connect the over- flow to existing street drains, or take any other action in relation thereto.


ARTICLE 27. (At Request of George E. Lane and Others and By Direction of Selectmen). To see what sum of money the Town will vote to raise and appropriate or appropriate for a town wide drainage pro- gram of construction in accordance with the engineering report ordered under Article 24 of the warrant for the annual town meeting of 1955, or take any other action in relation thereto.

ARTICLE 29. (On Petition of Patricia H. Sheehy and others and by Direction of Selectmen). To see if the Town will vote to raise and appro- priate by taxation or otherwise a sum of money for the construction of a retaining wall on Great Hill Drive, from Lindale Avenue to Regatta Road, or take any other action in relation thereto.


SEWER


ARTICLE 30. (At Request of Sewer Commissioners). To see if the Town will vote to raise and appropriate a sum of money for the con- struction of common sewers and determine whether the money shall be provided for by taxation, by appropriation from available funds including sewer assessment funds, and by borrowing under authority of Chapter 44 of the General Laws, or take any other action in relation thereto.


ARTICLE 31. (At Request of Sewer Commissioners). To see if the Town will vote to raise and appropriate a sum of money for the con- struction of particular sewers and determine whether the money shall be provided for by taxation, by appropriation from available funds in- cluding sewer assessment funds, and by borrowing under authority of Chapter 44 of the General Laws, or take any other action in relation thereto.


ARTICLE 32. (By Direction of Selectmen). To see if the Town will vote to instruct the Sewer Department to install side line laterals in streets where sewer trunk lines are being constructed.

WATER


ARTICLE 33. (At Request of the Board of Water Commissioners) To see if the Town will vote to authorizee the Board of Water Commis- sioners to acquire by gift or purchase or take by right of eminent domain, in fee or otherwise, for the purpose of the public water supply such land as may be necessary for the construction of a standpipe off Main Street in that part of Weymouth known as South Weymouth, or take any other action in relation thereto.


ARTICLE 34. (At Request of the Board of Water Commissioners) To see what sum of money the Town will vote to raise by borrowing or otherwise and appropriate for the construction of a standpipe, and also for the installation of water mains of not less than six inches in diameter and all necessary appurtenances as may be necessary for these purposes, or to act on anything relating thereto.


ARTICLE 35. (At Request of the Board of Water Commissioners). To see what sum of money the Town will vote to raise and appropriate for an addition and alterations to the Hollis Street Garage of the Water Department, or take any other action in relation thereto.


ARTICLE 36. (At Request of the Board of Water Commissioners). To see if the Town will vote to instruct its Board of Selectmen to transfer to the custody of the Board of Water Commissioners for water works pur- poses, a certain parcel of land owned by the Town and designated as Lot 17, Block 429, on Plan 33 of the Town Atlas of 1954, by Russell H. Whiting or take any other action in relation thereto.


ARTICLE 37. (At Request of the Board of Water Commissioners). To see what the sum of money the Town will vote to raise and appropriate from the tax levy to provide for that portion of expense to the Water Department for installation and maintenance of fire protection, or to take any other action in relation thereto.


ARTICLE 38. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate a sufficient sum of money to install a water main along Thicket Street, beginning at a point where the present water main ends at about No. 310 Thicket Street, and extending approximately 2800 feet in a southerly direction to the Abington Town line, or take any other action in relation thereto.


EDUCATION


ARTICLE 39. (At Request of the School Committee). To see what sum of money the Town will vote to raise by taxation, or otherwise, and appropriate, for the purpose of acquiring by gift, purchase, or eminent domain in fee, Lot 15, Block 236, containing 14,800 sq. ft. of land, as ap- pears on Sheet 18 of the Atlas of the Town of Weymouth for the year 1954 together with the building thereon, viz., the former telephone ex- change building at 111 Middle Street, same to be used as an administra- tion building for the public schools, or take any other action in relation thereto.


ARTICLE 40. (At Request of the School Committee). To see what sum of money the Town will vote to raise by taxation, or otherwise, and appropriate, for the purpose of adding to, remodeling, and furnishing the proposed School Administration Building at 111 Middle Street, or take any other action in relation thereto.

ARTICLE 41. (At Request of the School Committee). To see what sum of money the Town will vote to raise by taxation, or otherwise, and appropriate, for the purpose of acquiring by gift, purchase, or eminent domain in fee, Lot 16, Block 236, containing 43,511 sq. ft. of land, as ap- pears on Sheet 18 of the Atlas of the Town of Weymouth for the year 1954, together with the buildings thereon (103-105 Middle Street), for the purpose of enlarging the adjacent High School property, or take any other action in relation thereto.


RECREATION


ARTICLE 42. (By Direction of Selectman and At Request of the Building Inspector). To see if the Town will vote to instruct the Town Moderator to appoint a committee of five to study and prepare necessary plans for a passageway and park area from the Ralph Talbot Street School to Great Republic Avenue and Red Jacket Road, and the sum of $500.00 be raised and appropriated for the use of the committee in preparing necessary plans, or take any other action in relation thereto.


ARTICLE 43. (At Request of the Park Department). To see what sum of money the Town will vote to raise and appropriate for the pur- pose of acquiring by gift, purchase, or eminent domain in fee, for park purposes a parcel of land shown on the Town Atlas as Lot 1, Block 25, Sheets 4 and 7, 1954 containing approximately 344,800 square feet, also identified as Lot 66 on a subdivision plan of Wessagusset Village pre- pared by the Public Housing Administration containing about 6.59 acres and bounded by Wessagusset Road and Pilgrim Road, or take any other action in relation thereto.


ARTICLE 44. (At Request of the Park Department). To see if the Town will vote to raise and appropriate the sum of $3,000.00 for the pur- pose of developing a playground on the land described in the above ar- ticle at Wessagusset Village, work to be done by the Park Department and playground to be under the jurisdiction of the Park Department, or take any other action in relation thereto.


ARTICLE 45. (At Request of the Park Department). To see what sum of money the Town will vote to raise and appropriate for the further construction of a playground in North Weymouth at the foot of Julia Road, or take any other action in relation thereto.


ARTICLE 46. (At Request of the Park Department). To see what sum of money the Town will vote to raise and appropriate for the further construction of a playground at Idlewell, or take any other action in re- lation thereto.


ARTICLE 47. (At Request of the Park Department). To see if the Town will vote to acquire by gift, purchase, or eminent domain in fee, for park purposes a parcel of land shown on the 1954 Town Atlas as Lot 9, Block 297, Sheet 26 containing approximately 7,137 square feet and to raise and appropriate the sum of $1,500.00 for this purpose, or take any other action in relation thereto.


ARTICLE 48. (At Request of the Park Department). To see what sum of money the Town will vote to raise and appropriate for the repair of the bleachers at Weston Park, or take any other action in relation thereto.


ARTICLE 49. (At Request of the Park Department). To see if the Town will vote to raise and appropriate the sum of $3,200.00 for the pur- pose of developing and equipping a playground on newly acquired land in the area known as the Birches shown on the 1954 Town Atlas as Lot 1. block 348, Sheet 27, work to be done under the jurisdiction of the Park Department, or take any other action in relation thereto.

ARTICLE 50. (At Request of the Park Department). To see if the Town will vote to raise and appropriate the sum of $2,400.00 for the pur- pose of purchasing and erecting six sets of small portable bleachers to be located on various ball diamonds in the town, or take any other action in relation thereto


ARTICLE 51. (At Request of the Park Department). To see if the Town will vote to raise and appropriate the sum of $650.00 for the pur- chase of 2200 feet of snow fence to be used on the various ball fields in the Town, or take any other action in relation thereto.


ARTICLE 52. (At Request of the Park Department). To see if the Town will vote to transfer the care, custody, management and control of the land shown as Lots 6 and 8, Block 487, Sheets 40 and 44 as appears in the Atlas of the Town of Weymouth for the year 1954, to the Park De- partment to be used for park purposes, or take any other action in rela- tion thereto.


ARTICLE 53. (At Request of the Weymouth Small Boat Club). To see if the Town will vote to construct and maintain a public boat ramp and landing for small boats on Town owned land at the foot of North Street, North Weymouth, to be under the supervision of the Harbor Mas- ter, or take any other action in relation thereto.


ARTICLE 54. (At Request of Swimming Pool Committee). To see what sum of money the Town will vote to raise and appropriate by taxa- tion or otherwise for the construction and maintenance of a swimming pool and facilities to be located at the Stella Tirrell Playground and under the jurisdiction of the Park Department, or take any other action in re- lation thereto.


TREE WARDEN


ARTICLE 55. (At Request of Tree Warden). That the sum of $11,000.00 be raised and appropriated for Dutch Elm Disease Control Work, or take any other action in relation thereto.


ZONING


ARTICLE 56. (At Request of the Planning Board.) To see what action the Town will take to rezone from Residential to Business: Block 533, Lot 14, Sheet 46 as shown on the Weymouth Town Atlas of 1954, or take any other action in relation thereto.


ARTICLE 57. (At Request of Mary McDonald, 30 Hill Street and Others and By Direction of Selectmen). To see if the Town will vote to amend its Zoning By-laws and Zoning Map, Article X of the Town By-Laws by making the following changes: From industrial district to residential district - Block 255, Lots 24, 2, 3, 4, 5, 6, 7, 18, 19, 20, 21 and 22; Block 254, Lots 20, 21, 23 and area of Lot 1 abutting 11 Hill Street.


BY-LAWS


ARTICLE 58. (At Request of By-Law Committee). To see if the Town will vote to revise, amend and/or add to the By-Laws of the Town of Weymouth, or take any other action in relation thereto, and more par- ticularly to the following :


A. Amend Section 104 by striking out in line eight the words "Crocker's Principles of Procedure in Deliberation Bodies" and inserting in place thereof the words "Cushing's Manual of Parliamentary Practice," so as to read as follows:

In any case not covered by law, by said rules, or by these by-laws, the general principles of parliamentary law as contained in Cushing's Manual of Parliamentary Practice" shall govern.


B. Amend Section 511, Paragraph 1 of the By-Laws by deleting the words "19 inches wide by 28 inches long" and inserting in place thereof "in accordance with Land Court sizes," so as to read: "A plan and profile done in ink on tracing cloth, in accordance with Land Court sizes at a scale of not less than one inch to 40 feet of every street shall be filed in the office of the Superintendent of Streets who shall affix the grade thereon.'


C. Amend Section 623 by deleting from lines five and six the words "five hundred Dollars" and inserting in place thereof the words "one thousand dollars" so that Section 623 will read "Every officer or board in charge of a department and every committee of the Town, when authorized to do any public work, or to purchase any supplies, materials or property. or erect, construct or repair any building, the estimated cost of which exceeds one thousand dollars, shall make a written contract therefor! and before executing any such contract shall invite proposals therefor; by advertising in one or more Weymouth papers, such notice of proposals stating time and place for opening proposals provided further that such board, officer or committee shall reserve the right to reject any or all proposals.


D. Amend Section 623 by adding thereto a new section to read as fol- lows: Section 623A "The Board of Selectmen may exempt a purchase or contract from any or all of the provisions of the preceding section when in their opinion, an emergency exists requiring immediate action on such purchase or contract to protect the health and safety of persons or prop- erty, or when no reasonably suitable substitute can be obtained for the article or service to be purchased or contracted for. Evidence indicating that such an emergency exists, or that no reasonable substitute for a pur- chase of service can be obtained shall be furnished to the Selectmen in writing by the officer, board or committee making such purchase or con- tract, and shall be kept on file with other records of such transactions."


E. Delete Section 626 which now reads "If a person is employed by the Town and receives as salary and compensation for such employment a sum in excess of two thousand dollars (2000.00), he shall not receive any other compensation or salary from the town derived from any other office position or employment by the Town unless otherwise authorized by vote of the Town.


(Approved by Attorney-General 10-4-1947).


F. Amend Section 703 of the Building Code (By-Laws) by striking out the present Section 703 and inserting in place thereof the following sec- tion which was voted at the 1955 Annual Town Meeting under Article 69: Section 703. The Inspector of buildings shall grant permits for the erec- tion, or alteration, removal or tearing down of buildings, and no structure or foundation shall be built, altered, or torn down without such a permit but no such permit shall be issued unless the street is on a plan duly filed and recorded, and that before the permit shall be issued, such street shall have been suitably improved to the satisfaction of the Town Planning Board as adequate in respect to public health, safety, and general wel- fare for the special circumstances of the particular street, and an affi- davit filed by a registered engineer that plans and profiles of said street have been complied with, and until the inspector has carefully examined the plans and specifications of the proposed building or alterations, and ascertained that the building has sufficient strength, that means of in-

gress and egress are sufficient and the building conforms to the require- ments of these by-laws, and the regulations of Chapter 143 of the General Laws.


G. Amend Section 704 of the Building Code (By-Laws) by adding after the word "inspector" in line three the following: "Plans may be required for construction of all buildings and shall show in every case the depth and dimensions of all footings, foundation walls, piers and columns, thickness of all walls and partitions, the size and spacing of all beams, joists, rafters or other floor construction details, all required exit facilities, the location of all soil, waste and vent lines, all sanitary equipment, with such drawings thereof as the building inspector may require.


The building inspector may also require that all plans and computations bear the name of the person designing the plans and name of owner of proposed building." So that Section 704 will read: "A copy of the plans and specifications of every public building shall be deposited in the office of the inspector. Plans may be required for construction of all buildings and shall show in every case the depth and dimensions of all footings, foundation walls, piers and columns, thickness of all walls and partitions, the size and spacing of all beams, joists, rafters or other floor construc- tion details, all required exit facilities, the location of all soil, waste and vent lines, all sanitary equipment, with such drawings thereof as the building inspector may require.

ARTICLE 59. (At Request of Town Employees). To see if the Town will vote to amend Article 4, Sec. 409 of the Town By-Laws by accepting changes in the Salary and Wage Scale designated as Schedule I, II and III, or take any other action in relation thereto.


ARTICLE 60. (At Request of George E. Lane and Others and By Direction of Selectmen). To see if the Town will amend its by-laws and vote to adopt a new by-law requiring employees, new or otherwise, to undergo a complete medical examination prior to entrance into the town's service, the by-law to be same as voted under Article 30 in the warrant for the annual town meeting of 1950.


ARTICLE 61. (At Request of George E. Lane and Others and By Direction of Selectmen). To see if the Town will vote to amend its by-laws and add a new section limiting the opening of its roads, streets and highways as follows: "No street, road or highway in the town shall be opened for installation of sewers, water mains, drains, public utilities or other purposes, except for emergency services, for three years after such street, road or highway has been reconstructed, rebuilt or relocated. Prior to reconstruction, rebuilding or relocation of any street, road or high- way the Board of Selectmen shall notify sewer, highway and water de- partments and telephone, gas and electric companies not less than three months before actual work will be started," or take any other action in relation thereto.


ARTICLE 62. (At Request of Personnel Board). To see if the Town will vote or take any other action in relation to the following:


(1) To see if the Town will vote to change the classification of Clerks in the Assessors office, made necessary by the retirement of Clerk Howley, McCarthy from S-2 to S-3, Bicknell from S-1 to S-2, and Aiken from S-1 to S-2.

(2) Vote to change the classification of Clerks Angely and Dwyer of the Welfare Department from S-1 to S-2.


(3) Vote to change the Classification of the Building Inspector from S-8 to S-9.


(4) Vote to pay members of the Police Department for time worked over five scheduled work days per week at regular rates based on a forty (40) hour work week.


(5) Vote to pay members of the Fire Department for time worked over fifty-six (56) hours per week at regular rates based on the fifty-six hour work week.


(6) Vote to pay General Public Works Foreman of the Street Depart- ment, Water Department and Sewer Department (one each department), time and one-half pay for hours worked in excess of forty hours per week


(7) Vote to pay Engineers time and one-half pay for hours worked in excess of forty (40) hours per week.


(8) Vote to approve Classification S-7 for Junior Accountant.


(9) Vote to approve Classification S-10 for Town Engineer.


(10) Vote to pay all Town Employees under Classification and Pay Plan authorized by Section 409 of the Town By-Laws, a salary increase of Five Dollars ($5.00) per week effective as of April 1, 1956.


VETERANS


ARTICLE 63. (At Request of George R. Bean Post No. 401). To see if the Town will vote to dedicate a square at the corner of Elmer Road and Thicket Street in honor of Lt. Elmer J. Hollis who was killed in ac- tion in World War II, or take any other action in relation thereto.


ARTICLE 64. (At Request of Wessagusset Post No. 1399, Veterans of Foreign Wars). To see if the Town will vote to appoint a committee to serve for both Memorial and Veteran's Day, 1956 and the sum of $2,000.00 be appropriated for Memorial Day and the sum of $400.00 be ap- propriated for Veteran's Day, said appropriation to be expended by the committee, or take any other action in relation thereto.


UNCLASSIFIED


ARTICLE 65. (At Request of George E. Lane and Others and By Direction of Selectmen). To see if the Town will vote to accept Chapter 41, Section 69C through 69F of the General Laws to establish a Board of Public Works.


ARTICLE 66. (By Direction of Selectmen). To see of the Town will vote to raise and appropriate by taxation or otherwise a sum of money to make the necessary repairs to Town Hall, or take any other action in relation thereto.


ARTICLE 67. (On Petition and By Direction of Selectmen). To see if the Town will vote to accept Chapter 41, Section 100A of the General Laws "Indemnification of Officers or Employees for Damages etc. In- curred on Account of Injuries Arising Out of Their Operation of Publicly Owned Vehicles or Vessels" as follows:


"A city which accepts this section by vote of its city council subject to the provisions of its charter, or a town which accepts the same by vote

of its inhabitants at an annual town meeting, may, after an appropriation has been made therefor, indemnify an officer or employee thereof for ex- penses or damages incurred by him in the defense or settlement of a claim against him for bodily injuries, including death at any time result- ing therefrom, or for damage to property, arising out of the operation of a motor or other vehicle or vessel owned by such city or town to an amount not exceeding $15,000.00 on account of injury to or death of one person, or not exceeding seventy-five thousand ($75,000) dollars for any one accident, and not exceeding five thousand ($5,000) dollars on account of damage to property, provided, that after investigation it shall appear to the Mayor or Selectmen that such officer or employee was at the time the claim arose acting within the scope of his official duties or employ- ment, and provided further, that the defense or settlement of such claim shall have been made by the City Solicitor or the Town Counsel, or, if the Town has no Town Counsel by an attorney employed for the pur- pose by the Selectmen, upon the request of said officer or employee and at the direction of the Mayor or Selectmen. This section shall not apply in respect to so much of a claim against an officer or employee as is cov- ered by a policy of an insurance effected by the city or town under clause (1) of section five of Chapter forty."


ARTICLE 68. (By Direction of Selectmen). To see if the Town will vote to appropriate by taxation or otherwise the sum of $8,000.00 for the Town's share in the South Shore Mosquito Control District, or take any other action in relation thereto.


ARTICLE 69. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate the sum of $300.00 to be expended under the direction of the Board of Selectmen for the purpose of stocking the ponds and inland waters, located within the Town limits, with fish and of liber- ating game all in accordance with General Laws (Ter. Ed.), Chapter 10, Section 5, Clause 41, or take any other action in relation thereto.


ARTICLE 70. (At Request of the Planning Board). To see if the Town will accept Chapter 40B of the General Laws as approved 5/19/55, an act to permit the establishment of a Metropolitan or Regional Plan- ning District within the Commonwealth, or take any other action in re- lation thereto.


ARTICLE 71. (At Request of the Planning Board). To see what sum of money the Town will provide to issue copies of a new Town Atlas, or take any other action in relation thereto.


ARTICLE 72. (At Request of George E. Lane and Others and By Direction of Selectmen). To see if the Town will appoint a committee of seven citizens to study and report on a plan for future expansion of our civic center in East Weymouth, or take any other action in relation thereto.


ARTICLE 73. (At Request of George E. Lane and Others and By Direction of Selectmen). To see what action the Town will take to com- plete plans and specifications and to locate a site for a new town hall to meet the demands of a community of 65,000 citizens anticipated for 1965 and to transfer to the School Department the present town hall for administrative purposes, or take any other action in relation thereto.
