ARTICLE 32. (At Request of By-Law Committee). To see if the Town will vote to revise, amend and/or add to the By-Laws of the Town of Weymouth or take any other action in relation thereto, and more particularly to the following:


A. Amend Section 201 of the By-Laws by striking out in lines 2 and 3 of Paragraph 1 the words "on or before the 15th of January" and in line 4 the word "preceding" and inserting in place thereof the words "on or before the 31st of December" so as to read as follows: Section 201. The head of each town department, and every committee or board appointed or elected shall on or before the 31st of December report in writing to the Selectmen on their doings during the calendar year and their recom- mendations for action by the Town.


B. Amend Section 301 of the By-Laws by striking out in line 6 the words "Neither the Town Clerk, Town Treasurer, Chief of Police, Chief of the Fire Dept., Supt. of the Water Works or any member of the Board of Selectmen, Assessors, or School Committee" and inserting in place thereof the words: "No elected or appointed official other than Town Meeting Member or members of a committee appointed by the Annual Moderator" so as to read as follows: No elected or appointed official other than Town Meeting Member or member of a committee appointed by the Annual Moderator shall be eligible to serve on said committee.


C. Amend Section 302 Paragraph 2 by striking out in line 4 the words "Town Engineer and Supt. of Streets" and in line 6 the words "Board of

Survey" and inserting in place thereof the words "Supt. of Public Works" and "Planning Board" so as to read as follows: "Before recommending to the town the acceptance of any street which has been laid out as a town way by the Selectmen on petition of the abutters, the committee shall require a report from the Supt. of Public Works as to whether the provisions of law, of these by-laws and of the rules of the Planning Board applicable to such streets have been complied with.


D. Amend Section 303 of the By-Laws by striking out in line 3 the words "81J" and inserting in place thereof the words "81GG" so as to read as follows: The Planning Board is hereby re-established under the provisions of General Laws (Ter. Ed.), Chapter 41, Section 81A to 81GG inclusive.


E. Amend Section 305 of the By-Laws by adding atfer the word "town" in line 3, Paragraph 1 the words "except as otherwise provided by Statute" so as to read as follows. The Board of Selectmen shall exercise general supervision over all matters affecting the interests or welfare of the town, except as otherwise provided by Statute. Paragraph 5 is amended by crossing out the words "and Board of Survey" so this paragraph will read as follows: They shall act as Overseers of the Poor.


F. Amend Section 405 of the By-Laws by striking out in line 14, of par- agraph 1, the figure $300.00 and inserting in place thereof the figure $500.00 so as to read as follows: Section 405. The Selectmen, when in their judgment it is for the interests of the town so do it, may bring on behalf of the town any proceedings before any court, legislative commit- tee, administrative board or other public official and may answer and defend any such proceedings brought against the town and may appear on behalf of the town in any such proceedings instituted by others in which the town has an interest. They may prosecute such suits to final judgment or may compromise any claims by and against the town on such terms as shall seem to them for the best interest of the town. whether or not such claims are in litigation, provided that they shall not, without vote of the town, compromise any tort claim against the town, not in litigation, for a greater sum than $500.00.


G. Amend Section 501 by striking out in line 3 the words "Board of Selectmen" and inserting in place thereof, the words "Department of Public Works" so as to read as follows: Section 501. No person or cor- poration shall make any excavation within the limits of any public way in the town except upon and in accordance with the conditions of a permit to be issued by the Department of Public Works, such permit to be issued only upon the written application stating the location and ex- tent of the proposed excavation and a fee of one dollar shall be charged for each permit issued.


H. Amend Section 503 of the By-Laws by striking out in line 9 the words "Superintendent of Streets" and by inserting in place thereof the words "Superintendent of Public Works" so as to read as follows: Section 503. No private way, lane or alley shall connect with a public highway of the town unless at its junction with each highway it shall have a sign reading "Private Way" or "Not a Public Way" provided that this provision shall not apply to such private driveways not exceeding twelve feet in width as have a gate, gateway or barway at their junction with the public highway or are otherwise so constructed and located that in the opinion of the Department of Public Works, they cannot reasonably be mistaken for public highways.

Amend Section 509 of the By-Laws by striking out in line 2 the I. words "Superintendent of Streets" and inserting in place thereof the words "Superintendent of Public Works" so as to read as follows: Section 509. When it is necessary in the opinion of the Superintendent of Public Works to construct catch-basins on any street or way, and lay drains to connect with a permanent outlet, such catch-basins and drains may be constructed and laid out, and the cost of such work shall be considered as a part of the total cost of constructing said street or way.


J. Amend Section 510 of the By-Laws by striking out in line 3 the words "Superintendent of Streets" and inserting in place thereof the words "Superintendent of Public Works" so as to read as follows: Section 510. Side gutters on any such street or way having a grade of five per cent, or over, may, if in the opinion of the Superintendent of Public Works it be necessary, be paved four feet wide, with stone or concrete the cost of such work shall be considered as a part of the total cost of constructing said street or way.


K. Amend Section 511 of the By-Ways by striking out in lines 8 and 9 of Paragraph 1 the words "Sewer, Water, Street, Health and Engineer- ing Departments" and inserting in place thereof the words "Superintend- ent of Public Works and Health Department" so that the last sentence will read as follows: He will clear his plans with the Superintendent of Public Works and the Health Department who in approving the plan will sign the linen in the appropriate spaces provided.


L. Amend Section 513 of the By-Laws by striking out in lines 1 and 21 of Paragraph 1 and line 2 of Paragraph 2 the words "Board of Water Commissioners" and inserting in place thereof the words "Board of Public Works".


M. Recommend that Article 29 as voted at the 1955 Annual Town Meeting and subsequently approved by the Office of the Attorney Gen- eral be listed under Article VI of the By-Laws to be called Section 603B.


N. Amend Section 608 of the By-Laws by striking out in lines 5 and 6 the words "Superintendent of Streets" and inserting in place thereof the words "Superintendent of Public Works" so as to read as follows: Section 608. No person shall place or cause to be placed any obstruction in any public street, footpath or sidewalk, or suffer any such obstruction placed or controlled by him to remain for more than one hour after being notified by a Selectman, Police Officer or the Superintendent of Public Works to remove the same.


O. Amend Section 622 of the By-Laws as follows:


1. Strike out in line 2 Paragraph 1 the words "Section 30 and 32".


2. Add in line 3 of Item (a) the word "State" so as to read as follows (a) The person erecting or maintaining shall file with the Town Clerk a copy of his license, if any, and permit from the State Department of Public Works, to maintain said billboard and the name and address of a person or persons upon whom any notices or other papers relating to said billboard may be served.


3. Delete Item (c).


4. Strike out in lines 7 and 8, Paragraph 2 of Item (d) the words "Sec- tions 30 and 32".

P. Delete Section 626 of the By-Laws which now reads, if a person is employed by the Town and receives as salary and compensation for such employment a sum in excess of two thousand dollars ($2,000), he shall not receive any other compensation or salary from the Town derived from any other office, posision or employment by the Town unless other- wise authorized by vote of the Town.


Q. Amend Section 629 of the By-Laws by striking out in line 6 the words "Board of Selectmen" and "sewer, highway and water departments" and inserting in place thereof the words "Board of Public Works" so as to read as follows: Prior to reconstruction, rebuilding or relocation of any street, road or highway, the Board of Public Works shall notify the telephone, gas and electric companies not less than three months before actual work will be started.


R. Recommend that Section 628 (Medical Examinations) adopted un- der Article 60 of the 1956 Annual Town Meeting be changed to Section 632.


S. Amend Section 724 of the Building Code (By-Laws) by adding after the word "Board" in line 1 of the last sentence of Paragraph one the words "and the clerk, who may be a town employee' so that the sentence will read as follows: "Members of the Board and the clerk, who may be a town employee shall receive five ($5.00) for each meeting attended by them; payable from the appropriation of the Building Department."


T. Amend Item 3, Section VII of the Zoning By-Laws by adding at the end of Paragraph one a new paragraph to read as follows: "Members of the Board and the clerk, who may be a town employee, shall receive ($5.00) for each meeting of the Board attended by them; payable from the appropriation for the Building Department".


U. Amend Item 3A, Section VII of the Zoning By-Laws by striking out in line three the words "five dollars" and inserting in place thereof "ten dollars" so that Item 3A will read as follows: Any application for hearing before the Board of Zoning Appeals under this by-law shall be accompanied by a fee of ten dollars paid by the applicant, to apply to the cost of advertising and mailing of notices.


ARTICLE 33. (At Request of By-Law Committee). To see what sum of money the Town will vote to raise and appropriate for printing By-Laws of the Town of Weymouth, or take any other action in relation thereto.


ARTICLE 34. (On Petition of George E. Lane and Others). To see if the Town will amend section 622 of the Town By-Laws so that "the Board of Selectmen shall call a public hearing on all applications for billboards in the Town of Weymouth" or take any other action in relation thereto.


ARTICLE 35. (At the Request of Employees of Local 772). To see if the Town will vote to amend Article No. 4, Section 409 of the town by-laws by accepting changes in the Salary and Wage Scale designated as schedule No. 2 or take any other action in relation thereto.


ARTICLE 36. (At Request of Weymouth Police Association). To see what action the Town will take relative to accepting Chapter 223 of the Acts of 1955, such act granting compensatory time off or compensa- tion to Police Officers in attendance on criminal cases in the various courts of the Commonwealth.

ARTICLE 37. (On Petition of Chester L. Boyle and Others). To see if the Town will vote to amend the present vacation plan for all regular town employees under the Wage and Classification Plan or take any other action in relation thereto.


ARTICLE 38. (At Request of the Personnel Board). To see if the Town will vote to amend Article 4, Section 409 of the Town By-Laws, by accepting changes in the classification and pay plan; or take any other action in relation thereto.


ARTICLE 39. (At Request of Tree Warden). To see if the Town will vote to raise by taxation or otherwise and appropriate the sum of $22,000.00 for Dutch Elm Disease Control or take any other action in relation thereto.


ARTICLE 40. (At Request of State Reclamation Board and by Di- rection of Selectmen). To see if the Town will vote to raise and appro- priate the sum of $500.00 for the purpose of maintaining during the ensuing year, the mosquito control works as estimated and certified to by the State Reclamation Board in accordance with the provisions of Chapter 112, Acts of 1931.


ARTICLE 41. (At Request of South Shore Mosquito Control Project and By Direction of Selectmen). To see if the Town will vote to appro- priate by taxation or otherwise the sum of $8,000.00 for the Town's share in the South Shore Mosquito Control District, or take any other action in relation thereto.


ARTICLE 42. (On Petition of George E. Lane and Others). To see what sum of money the Town will vote to raise and appropriate for mosquito control work under the direction of the Public Works Depart- ment.


ARTICLE 43. (By Direction of Selectmen). To see if the Town will vote to raise or appropriate by taxation or otherwise the sum of $4,400 for the continuation of the seawall on Aspinwall Avenue, or take any other action in relation thereto.


ARTICLE 44. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate by taxation or otherwise a sum of money for the construction of a retaining wall on Great Hill Drive from Lindale Avenue to Regatta Road or take any other action in relation thereto.


ARTICLE 45. (On Petition of Robert D. Crawford and Others). To see what sum of money the town will vote to raise and appropriate for the purchase, erection and maintenance of a snow fence along the northerly side of Kirkland Road from the Nevin School Building to No. 62 or take any other action in relation thereto.


ARTICLE 46. (At Request of Wessagussett Beach Development Com- mittee). To see what sum of money the town will raise and appropriate, or appropriate, for the purpose of shore protection, sea walls, jetties, drainage, beach development and other improvements at Wessagussett Beach and Fort Point areas, or take any other action in relation thereto.


ARTICLE 47. (At Request of the Park Department). To see if the Town will vote to raise and appropriate the sum of $4,000.00 for the purpose of developing a playground on the newly acquired land at Wes- sagussett Village, or take any other action in relation thereto.

ARTICLE 48. (At Request of the Park Department). To see if the Town will vote to raise and appropriate the sum of $1,500.00 to be added to the sum voted at the last Annual Town Meeting for the purpose of resurfacing and preparing for ice skating the Stella Tirrell tennis courts, or take any other action in relation thereto.


ARTICLE 49. (At Request of the Park Department). To see if the Town will vote to raise and appropriate a sum of money for the purpose of providing lighting facilities for an athletic field, or take any other action in relation thereto.


ARTICLE 50. (At Request of Veteran's Housing Playground Com- mittee). To see if the Town will vote to lease for park purposes and to be under the jurisdiction of the Board of Public Works, certain land of the Weymouth Housing Authority, said land being shown on Plans 374B and 375B, dated November 11, 1957, and drawn by Arthur J. Bilodeau, Town Engineer, or to take any other action in relation thereto.


ARTICLE 51. (At Request of Veteran's Housing Playground Com- mittee). To see if the Town will vote to raise and appropriate the sum of $6,000.00 to develop and equip two playgrounds on the land to be leased from the Weymouth Housing Authority as described in the pre- vious article, or take any other action in relation thereto.


ARTICLE 52. (At Request of the Weymouth Housing Authority). To see if the town of Weymouth acting pursuant to section 7 of Chapter 550 of the Acts of 1952, will empower the Weymouth Housing Authority to erect new housing for elderly persons by accepting Chapter 667 Acts of 1954 and Acts in amendment thereof and in addition thereto to take any other action, in relation thereto.


ARTICLE 53. (On Petition of George E. Lane and Others). To see what sum of money the Town will vote to raise by taxation, or otherwise, and appropriate, for the purpose of acquiring by gift, purchase, or take by right of eminent domain, in fee, for park purposes the land shown on Plan 1058B of December 1957 by Town Engineer, Arthur J. Bilodeau, appro- ximately 187,380 square feet, owned by the Bradley Park Development, Inc., located southeastly of River Street, or to take any other action in relation thereto.


ARTILE 54. (At Request of the Weymouth Youth Commission). To see if the Town will vote to add Section 306 to the By-Laws of the Town to create a Recreation Committee in accordance with Chapter 45, Sec- tion 14 of the General Laws of the Commonwealth or take any other action in relation thereto. Said Section 306 to read as follows: SECTION 306. There shall be created in the Town of Weymouth a Recreation Com- mission with the power to conduct and to promote recreation, play, sport and physical education on playgrounds, playfields, parks, gymnasium, and swimming areas pursuant to Chapter 45, Section 14 of the General Laws of Massachusetts.


The said Recreation Commission shall consist of seven members who shall be elected at the 1959 annual town election in the following manner; The initial members thereof shall be elected to serve, three for three years, two for two years and two for one year from the date of annual town election at which they are elected and thereafter when the term of any member expires his successor shall be elected to serve for three years. In all cases the members of the Board shall serve until their successors are qualified. Vacancies shall be filled for the unexpired terms

in the same manner that full term members are elected. Immediately after election the members of the Recreation Commission shall meet and elect a Chairman and Secretary and select all other necessary officers to serve for a period of one year.


The Recreation Commission shall hold meetings regularly at least once a month and shall designate the time and place thereof. The Com- mission shall have the power to adopt rules and regulations for the conduct of business within its jurisdiction and shall keep a record of all its proceedings. Four regular members shall constitute a quorum.


The powers and duties of the Recreation Commission shall be ex- ercised and performed as herein provided and in conformity with the laws of the Commonwealth of Massachusetts.


The Recreation Commission shall study matters of recreation in re- gards to needs, advantages and benefits, and shall plan a municipal pro- gram to coordinate with the programs of other agencies.


The Recreation Commission shall have the power to conduct recrea- tion that will employ the leisure time of people in a constructive and wholesome manner. It may conduct such activities on properties under its own control, on public properties with the consent of the authorities thereof, and on private property with the consent of the owners.


The Recreation Commission shall have the power to employ a Super- intendent of Recreation, who is properly trained for the work and such other personnel as the Superintendent and Commission deem proper;


The Recreation Commission shall have the authority to conduct at reasonable charges such facilities for amusement, entertainment, refresh- ment of the public as are suitable for recreation purposes and may let privileges therefor, but such privileges shall be subject to the supervision of the Recreation Commission;


The Recreation Commission, at the regularly designated time, shall submit to the Board of Selectmen an estimate of anticipated revenue and expenditures for the ensuing fiscal year to be approved in whole or in part by the Town Meeting and included in the budget. Said Commission shall operate within the budget as approved, and the expenses thereof shall be payable by the treasury of the Town.


The Recreation Commission shall make an annual report to the Town, showing its operation and expenditures and shall make such other re- ports from time to time as may be requested by the Board of Selectmen.


ARTICLE 55. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate the sum of $300.00 to be expended un- der the direction of the Board of Selectmen for the purpose of stocking the ponds and inland waters, located within the Town limits, with fish and/or liberating game, all in accordance with General Laws (Ter. Ed.), Chapter 10, Section 5, Clause 41, or take any other action in relation thereto


ARTICLE 56. (At Request of Industrial Development Commission). To see what sum of money the Town will vote to raise and appropriate by taxation or otherwise for the use of the Industrial Development Com- mission.


ARTICLE 57. (At Requets of Swimming Pool Committee). To see if the Town will vote to raise by taxation, or otherwise, the sum of six-

thousand dollars ($6,000) for the purpose of preparing complete draw- ings and detailed specifications for the construction of a swimming pool and facilities to be located in the southern part of the town, or take any other action in relation thereto.


ARTICLE 58. (By Direction of Selectmen). To see if the Town will vote to re-name the new Jackson School at East Weymouth in honor of Lawrence W. Pingree who was killed in action in World War II or take any other action in relation thereto.


ARTICLE 59. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate a sufficient sum of money for the con- struction of a wall and the installing of a chain link fence along brook at the Herring Run on Commercial Street; in the netting area, or take any other action in relation thereto.


ARTICLE 60. (On Petition of George E. Lane and Others). To see if the Town will appoint a Committee of five members of the medical profession to review the administration, operation, policies, procedures and services of the Department of Public Health and to recommend and report on the establishment of a Public Health Commissioner and such other changes as may be beneficial to the health of the citizens of Wey- mouth, or take any other action in relation thereto.


ARTICLE 61. (By Direction of Selectmen and at Request of the committee to prepare preliminary plans for the memorial tablet or tablets relative to World War II and Korean War Veterans). To see what sum of money the Town will vote to raise by taxation or otherwise, and ap- propriate for the use of a Committee of seven members to be appointed by the Moderator to erect a memorial tablet or tablets providing for the names of World War II Veterans and Korean Veterans to be attached to the west side of the existing permanent brick memorial wall located on the high school grounds and to refinish and resurface the present bronze tablets on the east side of the permanent brick memorial wall and the stone tablet at the top center of the front wall and for clerical assistance and incidental expenses in preparing the necessary list of names of the veterans or take any other action in relation thereto.


You are hereby required to notify and warn said inhabitants of Wey- mouth qualified to vote in Town affairs in case all the articles in the foregoing warrant shall not have been acted upon at the meeting called for the third day of March, to meet in adjourned session at the hall of the Weymouth High Scool on


WEDNESDAY, THE FIFTH DAY OF MARCH, 1958


at seven o'clock and forty-five minutes in the evening, then and there to act upon such of the foregoing articles as shall not have been acted upon March third, or action upon which may at said meeting March third have been deferred, until said adjourned session.


You are further requested to notify and warn the inhabitants of Weymouth qualified to vote in elections to meet at the polling place of their respective precincts, to wit:


In Precinct 1 in the Bicknell School Hall;


In Precinct 2 in the American Legion Hall on Commercial Street;


In Precinct 3 in the Charles Y. Berry Auditorium in the Hunt School Building on Broad Street;

In Precinct 4 in the building of the Citizens' Association, Inc., on Front Street;


In Precinct 5 in the building of the Pond School, Pond Street;


In Precinct 6 on the ground floor of the Jackson School, 1250 Commer- cial Street;


In Precinct 7 in the Lovell's Corner Improvement Association building on Washington Street;


In Precinct 8 in the Weymouth Heights Club Building on North Street;


In Precinct 9 on the groundfloor of the Nevins School, 851 Main Street;


In Precinct 10 in the Homestead School on Front Street;


In Precinct 11 in the Elden Johnson School on Pearl Street;
