or any portion of said ways, and will authorize the Board of Selectmen to acquire by gift or purchase or take by right of eminent domain in fee or otherwise for all purposes of a public street and highway in and over each of said streets as laid out and accepted, and see what sum of money the Town will vote to raise and appropriate for the working of each of the above named streets, including the acquisition of the fee above re- ferred to, and for the building of any bridges, drains and conduits or securing easements which may be necessary in connection therewith, and to see whether the Town will authorize the Board of Selectmen to ac- cept deeds of any reservation strips existing in connection with any said streets, or take any other action in relation thereto.


MOVED by the Appropriation Committee:


That the Town accept the several reports of the Board of Selectmen, laying out as Town ways the following designated private ways and parts of them, to wit:

and the Board of Selectmen are hereby authorized to acquire by gift, purchase or take by right of eminent domain in fee, or otherwise for all purposes of a public street and highway in and over each of said streets as laid out and accepted and that the sum of $25,580.00 be raised and ap- propriated for materials for the working of the above named streets, in- cluding the acquisition of the fee above referred to and for the building of any bridges, drains or conduits or securing easements which may be necessary in connection therewith and that the Board of Selectmen are authorized to accept deeds of any reservation strips existing in connec- tion with any of said streets, and provided further, that no work shall be done on any of these streets until 90% of abutters, or 100%, if in the opinion of the Town Counsel that becomes necessary, have signed, exe- cuted, and delivered to the Town Counsel proper releases. Provided fur- ther, that the final naming of those streets accepted must meet with the approval of the Planning Board and the work on these streets shall be perofrmed under the direction of the Superintendent of Public Works. It is further provided that the sum of $27,673.00 be raised and appropriated for the necessary water mains in said streets and that the water mains be installed by the water department before any work is done by the street department. $25,580.00 $27,673.00

ARTICLE 10. (By Direction of Selectmen). To see if the Town will take by right of eminent domain in fee or otherwise the lands and build- ings at 1349 to 1379 Pleasant Street as shown on plan "Plan of Land in Weymouth, Mass. Proposed Land Taking" plan No. 204-B dated October 1956 made by Arthur J. Bilodeau, Town Engineer, for the purpose of widening Pleasant Street or take any other action in relation thereto.


Upon motion duly made by the Appropriation Committee, it was


UNANIMOUSLY VOTED: That the Board of Selectmen be author- ized to acquire by gift purchase, or eminent domain in fee, for highway purposes land and buildings as described in this Article and as shown on plan entitled "Plan of Land in Weymouth, Massachusetts. Proposed Land Taking" Plan No. 204-B, dated October, 1956, made by Arthur J. Bilodeau, Town Engineer, to be recorded with the Town Clerk, and the sum of $8,000.00 be reappropriated from funds previously appropriated and avail- able under Article 11 of the Annual Town Meeting of March 4, 1957.

The above taking shall include all sloping and enbankment easements necessary for construction of highway. Easement limits shown on above- mentioned plan.


ARTICLE 11. (On Petition of George E. Lane and Others). To see what sum of money the Town will raise and appropriate for the reloca- tion, widening and reconstruction of Pleasant Street from 1393 Pleasont Street to the junction of Water and Pleasant Streets, or take any other action in relation thereto.

ARTICLE 13. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate by taxation or otherwise the sum of $10 500.00 for the construction of a retaining wall on the southerly side of Oak Street, wall beginning at the intersection of Oak Street and Pine Street and ending at 27 Oak Street a distance of approximately 350 feet or take any other action in relation thereto.

That the Town raise and apropriate the sum of $10,500.00 for the construction of a retaining wall on the southerly side of Oak Street, wall beginning at the intersection of Oak Street and Pine Street and ending at 27 Oak Street a distance of approximately 350 feet, said work to be done under the direction of the Public Works Department.


Mr. Fryer of the Board of Selectmen spoke on the substitute motion. Comes now the question on the substitute motion by Mr. Pompeo.


Vote was taken and the Moderator declared the substitute motion by Mr. Pompeo LOST.

ARTICLE 14. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate by taxation or otherwise a sum of money for installing water mains and for the working of Witawamat Road, said street having been accepted at the 1957 Town Meeting or take any other action in relation thereto.

That the sum of $14,549.00 be raised and appropriated for the in- stallation of water mains and for the working of Witawamat Road from Wessagusset Road to Wadaga Road, said work to be done by the Highway and Water Departments and/or the Board of Public Works.

That the Town vote to raise and appropriate the sum of $1.00 for the purpose of acquiring by gift, purchase, or taking by right of Eminent Domain in fee, lands alon? Front, Summer and Broad Streets, Weymouth, Mass., in accordance with Chapter 79 of the General Laws of the Com- monwealth, for the purpose of alteration, widening, and reconstructing of said streets, said premises being shown on a plan prepared by Arthur J. Bilodeau, Town Engineer, to be recorded with the Town Clerk. $1.00

MOVED the following substitute motion by Mr. Whitney :


To see if the Town Meeting will vote to defer all planned action on the project of Alteration, Widening and Reconstruction of Front Street, and direct the Department of Public Works and Town Engineer to pro- vide complete plans, field survey, and other information as asked in a petition by residents of Front Street dated 2 March 1958, so that these residents will be properly informed as requested by said petition.


Further discussion ensued involving Mr. Amabile of the Board of Selectmen, Mr. Bilodeau, Town Engineer, Mr. Harlow and Mr. Powers.


Comes now the question on the substitute motion by Mr. Whitney.


Vote was taken and the Moderator declared the substitute motion by Mr. Whitney LOST.


Further discussion ensued involving Mr. Lane and Mr. Bilodeau.


Mr. Roulston, Acting Town Accountant, suggested the following ad- dition to the motion by the Appropriation Committee:


The words "and appropriate" following the words "That the Town vote to raise."


The suggested addition by Mr. Roulston to the motion by the Appro- priation Committee was unanimously accepted by the Appropriation Com- mittee.

ARTICLE 16. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate a sum of money for construction of side- walks and curbing in the sidewalk building program; said money to be under the jurisdiction of the Board of Selectmen or take any other action in relation thereto.

UNANIMOUSLY VOTED: That the Town raise and appropriate the sum of $40,000.00 for the contsruction of sidewalks and curbing and for the repair of old sidewalks and curbing, under a Sidewalk Building Pro- gram to be set up by the Board of Public Works; said money to be under the jurisdiction of the Board of Public Works. $40,000.00


ARTICLE 17. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate by taxation or otherwise a sum of money to construct sidewalk and install curbing on the northerly side of Ralph Talbot Street, between Pleasant Street and the Hingham Line, or take any other action in relation thereto.

ARTICLE 18. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate by taxation or otherwise a sum of money for the black topping and maintenance of a sidewalk on the westerly side of Washington Street (Route No. 3) from the corner of Winter Street and Washington Streets, to the Boston Motor Court a distance of about 1150 feet provided work to be completed only if the State Department of Public Works prepares the area for black top work to be done by a contractor or take any other action in relation thereto.

ARTICLE 19. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate the sum of $4,000 for the installation of curbing on the Northerly side of Park Avenue and Ralph Talbot Street (Auto Route 128) from the Pleasant Street Intersection Easterly to the Hingham Line, a distance of approximately 6,850 feet, provided the work to be completed only if the State Department of Public Works installs the curbing and the Town of Weymouth widens the existing bituminous concrete to a minimum of 4.5 foot width, the walk surface widening to fit the new curb line, work to be done by a contractor, or take any other action in relation thereto.

ARTICLE 20. (At Request of Mrs. Charles H. Fitzgerald, 55 Essex Street and Others). To see if the Town will vote to raise and appropriate a sum of money for construction of sidewalks and curbing in the side- walk building program to include that portion of Essex Street extending from Middle Street to Spring Street; said money to be under the jurisdic- tion of the Board of Selectmen, or take any other action in relation thereto.

ARTICLE 21. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate the sum of $1,500.00 for stream clearance and diking in the vicinity of the Fitzgerald Mill End Shop at 1256 Wash- ington Street. The following items should be done. (1) to sraighten elbow in stream at point about 30' North of Culvert at Route No. 3 so that the stream will be a straight line from the culvert at Route No. 3. At present the stream heads toward the Fitzgerald Mill End Shop. (2) to bank westerly side of stream at least 12" higher than at present in the area of the shop. (3) Clear stream of brush, etc. up to a point 500' in Northerly direction from Route No. 3. Said work to be done in conjunction with the State under Chapter 91 of the General Laws, or take any other action in relation thereto.

That the subject matter of this article be referred to the Board of Public Works.


MOVED the following substitute motion by Mr. Fryer of the Board of Selectmen:


That the Town vote to raise and appropriate the sum of $1,500.00 for the purposes of Article 21 with the proviso that the State will also furnish a like amount under Chapter 91 of the General Laws.

To see if the Town will vote to raise and appropriate a sum of money for the con- struction of particular sewers and determine whether the money shall be provided for by taxation, by appropriation from available funds in- cluding sewer assesment funds, and by borrowing under authority of Chapter 44 of the General Laws, or take any other action in relation thereto.

That the sum of $100,800.00 be raised and appropriated for the con- struction of particular sewers under the direct on of the Sewer Com- missioners and/or the Board of Public W rks and of the total sum $92,025.39 shall be appropriated from the common and particular Sewer $92,025.39 Accounts and $8,774.61 by Tax Levy.

To see if the Town will vote to raise and appropriate a sum of money for the con- struction of common sewers and determine whether the money shall be provided for by taxation, by appropriation from ava lable funds including sewer assessments funds, and by borr wing under authority of Chapter 44 of the General Laws, or take any other action in relation thereto.


Upon motion duly made by the Appropriation Committee, it was


UNANIMOUSLY VOTED: That the sum of $323,963.00 be raised and appropriated for the purpose of constructing common sewers, to be ex- pended under the direction of the Sewer Commissioners and/or the Board of Public Works. Of this sum $38,938.00 shall be appropriated from the Excess and Deficiency Account; and the Treasurer, with the approval of the Board of Selectmen, is hereby authorized to borrow a sum not to ex- ceed $285,000.00 for new construction and to issue bonds or notes to be payable in accordance with the General Laws (Ter. Ed.) Chapter 44, so that the entire sum shall be payable in not more than 30 years from the date of the issue of the first bond or note. $8.968.00 $235,000.00


ARTICLE 25. (At Request of School Committee). To see what sum of money the Town will vote to raise by ta"ation or otherwise, and appro- priate, for the purpose of rerlacing the cornice and gutters of the original high school building erected in 1898, or take any other action in relation thereto.

ARTICLE 26. (At Request of Board of Water Commissioners). To see if the Town will vote to transfer to the authority and supervision of the Board of Water Commissioners or the Commissioners of Public Works, to be used for water supply purposes, a portion of Lot 21, Sheet 5. Great Hill Park, bounded on the North by a roadwav, on the East b7 Bradley Road, on the South by a stone wall and on the West by a stone wall, con- taining approximately 46,000 square feet or take any other action in re- lation thereto.
