ARTICLE 63. (On Petition of the Industrial Development Com- mission). To see if the Town will vote to amend its Zoning Laws and Zoning Map, Article X of the Town By-Laws, by making the following changes:


Change of District


From Residential to Limited Industry-A, land shown on the Town of Weymouth Assessors Maps revised to Jan. 1, 1961 as a portion of Lots 2, 3, 18, 19 and 23, Block 447, Sheet 35; also a portion of Lots 1 and 10, Block 448, Sheet 35; said land being a 260' strip between the 240' strip of Limited Business District on the southerly side of Wash- ington Street and the Limited Industrial District-B 500' back from said sideline on Washington Street and the remaining portion on said Lot 18, Block 447 as shown on the Town Zoning Map of Limited Industrial Districts that is not within the existing said Limited Industrial Dis- trict-B.

ARTICLE 66. (By Request of the Rezoning Committee). To see if the Town will amend its zoning By-Laws and zoning map by making the following change:


Change of District from Residential to Limited Business, the area comprising Lots 8, 9, 10, 11, 12, 13 and 14, to a depth of three hundred feet from Ralph Talbot Street, said lots being shown on Block 533, Sheet 46 on the Atlas of the Town of Weymouth and approximately opposite lands of McIntyre and the Weymouth Fair Grounds.

UNANIMOUSLY VOTED: That the subject mater of this Article be referred to the Rezoning Committee for study and report and the next Special or Annual Town Meeting.


ARTICLE 67. (By Request of the Rezoning Committee and the Committee appointed under Article #34 of the 1961 Annual Town Meeting to study and report on the By-Laws relative to Apartment Buildings). To see if the Town will accept the report of the Commit- tee and make the following changes in Article X of the By-Laws rela- tive to Zoning or take any other action with relation thereto:


1. Strike out the clause in Sec. III, Paragraph 2, which states "Apartment House of first or second class construction."


2. Insert in Section III, after Paragraph 2, the following new paragraph:


2A. Apartment Buildings. Apartment Building shall mean any structure hereinafter constructed or altered so that it contains family units for four or more families; the building to contain nothing but family units.

No apartment building shall be permitted which exceeds two and one half or thirty-five (35) feet in height, nor with the front of said building less than thirty feet from the street line and the side and rear of said building less than fifteen feet from the adjoining property line. Signs shall be permitted only when attached to or flush with the front of the building, not above the first floor, and shall in no case be of neon or electric activating type. The Board of Zoning Appeal shall approve the design and appearance of the building and shall determine that it is in harmony with and not detrimental to the surrounding area.


3. Amend Section VIA by inserting at the end of the first sen- tence and make a part of said sentence the following: "Except in the case of multi-family or apartment buildings there shall be space for two motor vehicles per family unit."


4. Amend Section VII, Paragraph 3 by adding the following sen- tence: "If said application is for any variance in lot size, the applicant shall file a plan, drawn to scale, and in a form approved by the Board of Zoning Appeal, which plan shall remain in the custody of said Board.

To see if the Town will vote to accept a gift of a parcel of land shown as that portion of Lot 2, Block 215, Sheets 16 and 20 of the Weymouth Town Atlas, which is the area around Cranberry Pond left after approval of subdivision by the Board of Zoning Appeals and the Planning Board, for park purposes; or take any other action in relation thereto.


Upon motion duly made by the Appropriation Committee, it was


UNANIMOUSLY VOTED: That the Town vote to accept as a gift, purchase, or take by Right of Eminent Domain, in fee, together with all rights therein, for Park purposes, a parcel of land shown on a plan prepared by Frank S. Lagrotteria, Town Engineer, being a portion of Lot No. 2, Block 215, Sheets 16 and 20 of the Weymouth Town Atlas, which is the area around Cranberry Pond left after approval of sub- division by the Board of Zoning Appeals and the Planning Board; said Plan to be filed with the Town Clerk, and that the sum of $1.00 be raised and appropriated from tax levy for this purpose. $ 1.00


ARTICLE 69. (At Request of Board of Zoning Appeals). To see if the Town will vote to amend Article X, Section XII, Item 3, Para- graph 2, by adding "a representative of the Inspection Deparment" after the word "Board" in the first line, so as to read as follows: "Members of the Board, a representative of the Inspection Department,

and Clerk, who may be a town employee, shall receive $10.00 for each meeting of the Board attended by them, payable from the appropria- tion of the Building Department"; or take any other action in relation thereto:

That the Town vote to amend Article X, Section VII, Item 3, Paragraph 2, so as to read as follows: "Members of the Board, a repre- sentative of the Inspection Department, and Clerk, who may be a Town employee, shall receive $10.00 for each meeting of the Board attended by them, payable from the appropriation of the Building Department.

ARTICLE 78. (At Request of Planning Board). To see what action the Town will take to adopt or accept as a By-Law the follow- ing, the same to become Section 608B of Article VI of the By-Laws: "Whoever, in disposing of garbage, refuse, bottles, cans or rubbish on a public way or withn twenty feet thereof, commits a nuisance thereby, shall be punished by a fine of not more than fifty dollars. If a motor vehicle is used in committing such nuisance a conviction under this sec- tion shall forthwith be reported to the registrar of motor vehicles .. This section shall be enforced by the Police Department."

That the Town vote to acquire by gift, purchase or take by Right of Eminent Domain, in fee, together with all rights therein for Town purposes, a parcel of land shown as Lot 10, Block 410, on Sheet 32 and Lot 11A, Block 410, on Sheet 36 of the Town Atlas and as shown on a plan prepared by Frank S. To see what action the Town will take to raise and appropriate by tax levy, borrowing or use of avail- able funds, a sum of money for the purpose of providing an access road to the Idlewell section of Weymouth, including plans, specifications and cost of construction for said access road, necessary adjoining roads and overpass, or take any other action in relation thereto.

UNANIMOUSLY VOTED: That the Town vote to raise and ap- propriate the sum of $30,000.00 by tax levy for the purpose of con- struction or reconstruction of a bridge or overpass as means of access to the Idlewell section of Weymouth as proposed in a report by Public Works in its report to the Town under Article 52 of the Annual Town Meeting of 1960, such sums to be expended by the Board of Public Works and it is further provided that the Board of Selectmen be au- thorized to accept by gift any land or rights therein in private ways necessary for said access. All gifts of land and rights therein to the Town shall be approved by the Town Counsel prior to the expenditure of any funds therein. $30,000.00


ARTICLE 84. (By Petition). To see what sum of money the Town will vote to raise and appropriate for the purpose of building a new Foot Bridge between Lakeshore Drive and Lakeview Road, said Foot Bridge to be constructed on the present site of the old one that was destroyed by fire or take any other action in relation thereto.

ARTICLE 88. (By Petition). To see if the Town will vote to ap- point and instruct a Committee to prepare and submit to the Legisla- ture a properly drawn RECALL BY-LAW to be approved by the 1963 Annual Town Meeting or take any other action in relation thereto.

ARTICLE 91. (By Petition). To see if the Town will vote to amend its By-Laws by adding a new section, said section to read as follows:


Restraint of Dogs


Any person owning or harboring a dog shall not suffer or allow it to run at large in any of the streets or public places in the Town of Weymouth, or upon the premises of anyone other than the owner or keeper, unless the owner or occupant of such premises grants permis- sion; and no dog shall be permitted on any public place or street within the Town of Weymouth, unless it be effectively restrained by a chain or leash not exceeding six feet in length, and unless it be attended by a person of adequate age and discretion properly to control its actions. The maximum penalty for a violation of this ordinance shall be $25.00 to be recovered in a civil action in the name of the Town of Weymouth.
