Mr. Newton, Secretary of the Appropriation Committee, requested reconsideration of Article 1, specifically Item 31, and there being no objection the Moderator ruled that Item 31 of Article 1 would be re- considered at this time.

Upon motion duly made by the Appropriation Committee it was UNANIMOUSLY VOTED: That all committees which have not rendered a final report be continued until the work under their charge is completed.
The following report of the War Memorial Committee was sub- mitted by Mr. Maguire:
Under Article 41 of the Annual Town Meeting of 1961 the sum of $16,356.00 was appropriated for the erection of Bronze Plaques with names of all Weymouth Veterans of World War (2) and the Korean Conflict, also the refinishing of all other Plaques on wall at the High School.
This project is now completed and as Chairman I offer a motion that the War Memorial Committee be discharged.

The following report of the Transportation Committee was sub- mitted by Mr. Fryer:

The Town of Weymouth instituted and held the first meeting of officials and citizens of the South Shore area for the purpose of organ- izing a move to halt an extension of the Rapid Transit into our area. To bring this into our area would mean an assessment of 22% on a fifteen million dollar bond issue and also place an added burden on our taxpayers.
The Weymouth Board of Selectmen instructed Town Counsel, Rob- ert H. Gaughen to take necessary proceedings to question the con- stitutionality of the new Rapid Transit law. Mr. Gaughen took imme- diate action on this matter, by mapping out procedure and strategy for a joint legal action by the four communities involved to test this new Rapid Transit law.
The Appropriation Committee pledged solid financial support through their Secretary, John F. Newton, to pay for Weymouth's share in the legal battle to keep Rapid Transit out of the area.
The Town of Weymouth was also the first to challenge the con- stitutionality of the new Rapid Transit law in the Supreme Judicial Court.
The Attorney General and Federal Judge Robert P. Anderson have recognized the action of our Transportation Committee in that the Attorney General advised Governor Volpe of serious constitutional ques- tions and Judge Anderson refused to act in Federal Court until Wey- mouth and the other towns and City of Quincy are heard in the Su- preme Judicial Court. We have been so notified that the case will be heard next month before the High Court.
I submit this report so that you may be brought up-to-date re- garding this matter.
FRANKLIN FRYER Selectman and Chairman of the Towns Transportation Committee
There being no action to take on the report the Moderator ruled that the report of the Transportation Committee would be accepted, placed on file, and approved as read.
The following report relative to Little League Baseball fields was submitted by Mr. Mason:
In compliance with the request of the Town Meeting of March 1961 under Article 27 the Park Commission submits the following re- port relative to a four year capital outlav program for the construction of Little League Baseball fields on existing parks and playgrounds.
The Park Commission suggests the establishment of and the im- provement of five fields over the four year period at an estimated cost of $20,000 or an average of $5,000 each year.
The cost will include fencing, backstop additions, bleachers, some comfort stations and some grading.
Fields under consideration are Negus Park, Julia Road Playground, Idlewell Playground, Lovell Park, Central Junior Park and Weston Park.

ARTICLE 4. (By Direction of Selectmen). To see what sum of money the Town will vote from surplus for the use of the Assessors in determining the tax rate for the year 1962 or take any other action in relation thereto.

ARTICLE 5. (By Direction of Selectmen). That the Select- men be authorized to sell or otherwise dispose of personal property and any real estate of which the Town has possession or title, including all property taken for non-payment of taxes, all such cases of sale to be made by public auction or private sale as the Selectmen may deem for the best interest of the Town, and that the Board or Officer in charge of any other Town Department may, with the approval of the Board of Selectmen, sell at public auction or private sale, as the Board of Selectmen may approve, any personal property belonging to said Department which in the opinion of the Officer or Board in charge of the Department which is no longer needed by the Town and which in the opinion of the Selectmen is not needed by any other Department, provided that in each case involving real estate, majorities of the Plan- ning Board, Board of Public Works, and Park Commissioners respec- tively vote to concur in the opinion that the property will not be need- ed for parks, playgrounds or other public use, or take any other ac- tion in relation thereto.

ARTICLE 6. (By Direction of Selectmen). To see if the Town will vote to authorize its Board of Selectmen to accept conveyances or

mortgages of any real or personal property belonging to persons re- ceiving relief from the Town, and dispose of said property in the man- ner they may judge for the Town's best interest and to authorize them to discharge any encumbrances on said property if they consider it for the best interest of the Town so to do and to see what sum of money the Town will vote to raise and appropriate for the discharging of such encumbrances.

That the town accept Circuit Road from Burkhall Street 840 Linear Feet northerly to end of existing Town Way of Circuit Road and Mac- Dougall Court, and that the sum of $19,600 be raised and appropriated of which sum $6,500 shall be for materials for working of said street, $600 for necessary water lines and $12,500 for common and particular sewers so that the total sums under this item shall be $26,300 for mat- erials for working of said streets recommended, $10,530 water mains and $29,380 for necessary common and particular sewers.
