Report of the East Junior High School Remodelling Committee


The Committee, authorized at the 1961 Annual Town Meeting, was appointed and first met in October, 1961 to consider the problem of converting the old high and vocational school to a junior high school for East Weymouth.


Upon inspection, the Committee found that the school, now in one section over sixty years old and in others approaching forty years of age, was badly in need of overhauling with respect to heating, plumbing and electrical work. It was without an approvable fire alarm system and had many defects in exits, smoke doors, emergency lighting and other safety items, for which the State Department of Public Safety demanded correction.


Faced with substantial mechanical costs, the Committee has not attempted to do more than make the most necessary room changes. These include a sewing room, relocating the library to more adequate space, art room, health room near the office for better supervision, modernizing the girls' toilets, enlarging several small classrooms, all in the center and left buildings.


To correct a very bad situation in the girls' shower room, a small 34-foot addition is being proposed on the end of the auditorium together with a music room off the stage.


The old vocational school building will become quarters for the junior manual arts classes and industrial arts shops for the junior high school.


The Committee has devoted most of its time to the problem of costs, basing all its decisions on this important factor.


Final bids for construction will be ready for the Annual Town Meeting in March.

ANNUAL REPORT OF THE TOWN COUNSEL

Gentlemen:


I respectfully submit the following as my annual report on the activities of the office of Town Counsel for the year ending December 31, 1962.


During the year, a wide variety and great number of legal matters arising in the ordinary course of the operation of the Town Government required the attention of this office. The office engaged in litigation in the Supreme Judicial, Superior and District Courts of the Common- wealth, and advised town officers, commissions, departments and boards, The services involved, the interpretation of existing statutes and town bylaws, rendering opinions on various matters to the Board of Selectmen and to other Boards and Committees, and the handling of a great volume of business coming before the office in the ordinary course.


Many cases, claims or actions by or against the Town have been disposed of either by settlement on terms considered favorable to the Town or by trial before a single justice or superior court jury. Approxi- mately 25 claims were filed against the Town for personal injuries or property damage alleged to have arisen from negligent defects in the highways of the Town. The policy of causing an immediate police investigation of such claims and having a medical examination of the injured claimant by a competent physician, designated by this office, has been followed and this procedure has proved to be most effective and beneficial to the Town and has resulted in a new low being reached in the payment of public funds for this type of claim. In 1962, the sum of $167.42 represents the total sum paid in settlement of such cases.


During the year 1962, this office forwarded to the Town Treasurer, the sum of $26,616.24 received from the settlement or prosecution of claims of actions instituted by the office on behalf of the Town.


Pursuant to the vote of the Town Meeting and of the Board of Trustees of the Laban Pratt Hospital, a Bill in Equity was filed in the Supreme Judicial Court seeking authority to permit the transfer and delivery of the Laban Pratt Hospital Fund to the South Shore Hospital in Weymouth for the construction of a "Laban Pratt Wing" to the present South Shore Hospital facilities. The proposed wing will contain 40-50 beds for the use of resident of Weymouth and others. In connection with these proceedings, the Honorable Board of Selectmen appointed John F. Newton as Assistant Town Counsel. Mr. Newton has rendered valuable assistance in connection with the preparation and presentation of this matter to the Supreme Judicial Court. The Court has ordered the issuance of an Order of Notice to the Attorney General and all the heirs at law of the late Laban Pratt, returnable on the first Monday in January next. After this return day has come to past, this office will seek a prompt hearing before the court.

This office filed a Bill for Declaratory Judgment in the Supreme Judicial Court challenging the constitutionality of Chapter 452, Sections of 1961, and so called South Shore Transportation Bill. Although, all preparatory work has been completed in the case, including preparation and printing of a Brief for submission to the Court, the case has not been assigned for a formal hearing, and at the present time, the South Shore Transportation District is inoperative.


During the course of the year, various legal services and many written legal opinions were rendered to the Police Department, Depart- ment of Public Works, School Committee, Fire Departmnt, Town Tras- urer, Public Welfare Department, High School Building Committee and others. Many certificates of entry were prepared for the Department of Public Works in connection with street takings voted by the Town Meeting. All Orders of Street Takings and Certificates of Entry were duly recorded in the Registry of Deeds or Norfolk District Office of the Land Court.


In all cases involving the payment of public funds, the Board of Selectmen were consulted and its advice and consent secured prior to payment.


In reference to Tort Claims against the Town of any nature or description, due consideration of liability was given and settlement made only when in the best interest of the Town.


Many contracts from various Town Departments were submitted for approal by this office in accordance with provisions of the Town's Bylaws.


In conclusion, I wish to take this opportunity to express my pro- found appreciation to each and every department, board, commission, and department superintendent for the excellent cooperation, courtesies, and assistance extended to this office, without which the duties of this office would be most burdensome. I particularly wish to extend my appreciation to the members of the Board of Selectmen for the implicit confidence placed in me and for the sincere and earnest cooperation received.

TRUSTEES OF THE LABAN PRATT HOSPITAL

Gentlemen:


By direction of the Chairman of the Board of Trustees of the Laban Pratt Hospital, the undersigned is duly authorized to submit to your Board this Annual Report required by the provisions of Section 3, Chapter 246, an Act of the Massachusetts Legislature approved April 26, 1946, creating the Laban Pratt Hospital as a corporation.


The terms of office for the Trustees are as follows:

On January 31, 1962 the Trustees of the Laban Pratt Hospital met and passed a series of ten stipulations for transmittal to the Trustees of the South Shore Hospital as an outline of the terms under which the Laban Pratt Trustees would consider contributing the money in the Fund to the South Shore Hospital. These stipulations were as follows:


Item 1. That the Laban Pratt Hospital Fund shall be used to construct an addition to the present South Shore Hospital facilities to contain facilities for not less than forty beds, to be known as the Laban Pratt Memorial Wing.


Item 2. That if the Laban Pratt Hospital Fund is insufficent to cover the cost of the structure, it would be the plan of the Trustees of the South Shore Hospital to raise by public subscription and Federal aid or otherwise any funds necessary to complete the Laban Pratt Memorial Wing.

It is further understood that the Trustees of the South Shore Hospital will plan to raise such additional funds within the time prescribed by the Suffolk County Probate Court.


It is further understood that the Trustees of the Laban Pratt Hospital shall not transfer or deliver the Laban Pratt Hospital Fund to the Trustees of the South Shore Hospital until they (Trustees of the South Shore Hospital) have raised the nec- essary financing to construct and complete the Laban Pratt Memorial Wing.


Item 3. That a building committee shall be appointed to construct the said Laban Pratt Memorial Wing which shall be comprised of five members, two members from among the Trustees of the Laban Pratt Hospital and two members from among the number of the Trustees of the South Shore Hospital, one who shall be the Chairman of the Building Committee of the Board of Trustees of the South Shore Hospital. The fifth member shall be a member of the medical staff of the South Shore Hospital who shall be appointed by the President of the Board of Trustees of the South Shore Hospital.


Item 4. That the said Laban Pratt Memorial Wing to be constructed shall be known as the "Laban Pratt Memorial Wing" and be suitably marked by a plaque or otherwise.


Item 5. That the Laban Pratt Memorial Wing to be constructed as herein provided shall be for the use of the Inhabitants of the Town of Weymouth, although not exclusively.


Item 6. That the Town of Weymouth, acting by and through its mod- erator, shall appoint three residents and voters of the Town of Weymouth to serve on the Board of Trustees of the South Shore Hospital; one for a term of one year, one for a term of two years, and the third for a term of three years, and their successors shall be appointed each for terms of three years.


It is understood that the Trustees of the South Shore Hospital shall take whatever legal action is necessary to revise their corporative charter to provide for the foregoing appointments to its Board of Trustees by the Moderator of the Town of Weymouth.


It is understood that the Laban Pratt Hospital Fund shall not be transferred or delivered to the Trustees of the South Shore Hospital until such time as a special act has been passed by the General Court permitting the foregoing appointments.


Item 7. That the Trustees of the South Shore Hospital will furnish and maintain all equipment necessary for the operation of the Laban Pratt Memorial Wing herein provided for.


Item 8. That the Trustees of the South Shore Hospital will assume and pay all costs of maintenance, repairs and operational costs of the Laban Pratt Memorial Wing herein proposed, for both charitable and other patients.


Item 9. That the Trustees of the South Shore Hospital will provide by public subscription, Federal aid, or otherwise, such addi-

tional funds as may be necessary to meet any operational deficit or expense arising from the operation of the Laban Pratt Memorial Wing.


Item 10. That the Trustees of the South Shore Hospital will operate The Laban Pratt. Memorial Wing in conjunction with and as an integral part of the present South Shore Hospital.


At a meeting of the Board of Trustees of the South Shore Hospital, held on May 29, 1962 it was voted: "That the South Shore Hospital accepts without change or qualification the ten stipulations adopted by the Laban Pratt Trustees at their meeting on January 31, 1962. This cleared the way for the legal action necessary to secure the approval of the Courts of the stipulations themselves as a basis for making the plan effective. The Town Counsel was subsequently authorized by the Selectmen to initiate the necessary legal proceedings. At the year end a hearing has been set before the Supreme Court of the Commonwealth of Massachusetts with respect to the matter.


After the Annual Town Election in March, Mr. Franklin Fryer became ex-officio Chairman of the Laban Pratt Trustees.

The Weymouth Retirement Board, in accordance with the provisions of Section 20, 4 (b), Chapter 32, General Laws (Ter. Ed.) as amended has carried out the duties entrusted to them for the Contributory Re- tirement System of the Town of Weymouth.
