To see what sum of money the Town will vote to raise and appropriate by taxation, transfer and/or borrowing for the purpose of preparing complete plans, drawings, and detailed specifications for the construc- tion of a new main library building on land on Broad Street transferred from the Park Department to the Trustees of Tufts Library, or take any other action in relation thereto.

That the town vote to raise and appropriate by tax levy the sum of $26,850 for the purpose of preparing plans, drawings and specifica- tions for the construction of a new main library and that the Annual Moderator appoint a Committee of 7, to include two members of the Tufts Library Board, to review a site or sites for the proposed building and make recommendation for a site other than the Weston Park and playground location and report to the next special or annual town meet- ing.

ARTICLE 10. (At Request of Personnel Board). To see if the Town will vote to amend the Classification and Compensation Plan By- Law by striking out Section 409, (Sub) Section 5, Paragraph 2 (which concerns appeals from decision of the Personnel Officer), and inserting in place thereof the following, or take any other action in relation thereto.


Any person aggrieved by a decision of the personnel officer or the appointing authority or head of the department of the person aggrieved, may appeal a decision of the personnel officer to the personnel board by filing a notice of appeal, in writing, with the personnel board within ten days after receipt of decision of personnel officer. The notice of appeal shall be on a form prescribed by the personnel officer, who shall furnish them to any interested party.


The personnel board upon receipt, in writing, of a notice of appeal shall fix a reasonable time, but not later than thirty days, excluding Saturdays, Sundays and Holidays, for the hearing of any appeal, and shall cause notice of the time and place of such hearing thereof to be given to the appellant, appointing authority, personnel officer and de- partment head, said notice to be not less than seven days before the hearing, Saturday, Sunday and holidays excluded. Any notice herein provided for shall be by mail, postage prepaid. The personnel board may adopt rules and regulations, not inconsistent with the provisions of the By-Laws of the town, for the iconduct of any hearing before it.


After hearing, the personnel board shall affirm, reverse or amend, in whole or in part, the decision of the personnel officer, and its decision shall be final, conclusive and binding upon all parties, and a notice and copy of its decision shall be forwarded to all interested parties forthwith.

ARTICLE 11. (At Request of Board of Public Works). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer and/or borrowing to reconstruct, resurface, widen, straighten, relocate or work Commecial and/or any other streets or any portion of said streets and for building of any bridges, drains and conduits, or securing easements which may be necessary in connection therewith,

and to see whether the Town will authorize the Board of Selectmen to ac- cept deeds of any reservation strips existing in connection with said street provided the State or County, or both, will appropriate a sum of money to help defray the expenses of such work; and transfer from surplus funds that the Town may have, the County and State share of said cost, the amount of this transfer or reimbursement to be credited to the account from which it came; and will authorize the Board of Selectmen to acquire by gift, purchase, or take by right of eminent domain, in fee or otherwise, for all purposes of a public street and high- way in and over said street and such property as may be necessary, or take any other action in relation thereto.


MOVED by the Appropriation Committee:


That the sum of $96,000.00 be appropriated to the Board of Public Works from available funds (Excess and Deficiency) to reconstruct, resurface, widen, straighten, relocate and work Commercial Street and/or any other street, or any portion of conduits of said ways and for the building of any bridges, drains or securing any easements which cept any deed of any reservation strips in connection with said streets; may be necessary and that the Board of Selectmen is authorized to ac- and provided further, that all damages resulting or occasioned by the construction shall be a charge against the sums appropriated; the Board of Selectmen are hereby authorized to acquire by gift or purchase, or take by Right of Eminent Domain, in fee or otherwise, for all purposes of public streets or highways in and over said street; that the above sum named shall be made available only if the State or County, or both under Genearl Laws (Ter. Ed.) Chapter 90, will pay a sum of money pro- portionate to the cost of construction under the provisions of said chap- ter; all payments from State and County to revert to the Excess and Deficiency Account; provided further, that such work shall be done by private contract under the direction of the Board of Public Works and/or the State Department of Public Works. 96,000.00

ARTICLE 12. (At Request of Board of Public Works). To see if the Town will vote to raise and appropriate by taxation, transfer and/or borrowing, the sum of $250,000.00 for the continuation of the Major Highway Program for construction and/or reconstruction of main streets and roads including Broad, Commercial, Winter and Midddle Streets, provided that Chapter 90 funds, if any, may be used for this purpose or take any other action in relation thereto.


MOVED by the Appropriation Committee:


That the sum of $250,000.00 be raised and appropriated to the Board of Public Works for the continuation of the major highway pro- gram to be expended for the reconstruction or widening of Broad Street and Commercial Street, and Winter and Middle Streets and other streets or portions of streets, including sidewalks and curbing, land damages and the cost of pavement laid at the time of said construction or widen- ing, and the construction or permanent pavement in connection with

such reconstruction or widening under specifications approved by the Department of Public Works, all subject to the limitations of Clause 5, Section 7, Chapter 44 of the General Laws as amended; and the Board of Selectmen be authorized to accept any deeds or any reservation strips in connection with said streets and to acquire by gift, or purchase, or take by Right of Eminent Domain for all purposes of public streets or highways such as may be necessary; to meet said appropriation $50,000.00 shall be appropriated from the Excess and Deficiency Ac- count; and the Treasurer with the approval of the Board of Selectmen, is hereby authorized to borrow the sum of $200,000.00 and to issue bonds or notes under Clause (5) of Section 7 of Chapter 44 of the General Laws, as amended, payable in accordance with said Chapter 44 in not more than 10 years from their respective dates; provided, that any and all construction may be done under the provisions of Chapter 90 of the General Laws and that all construction shall be done by private con- tract under the direction of the Board of Public Works and/or the State Department of Public Works and that the streets to be constructed other than those specifically designated above, are to be selected by the Board of Public Works. 50,000.00

To see if the Town will vote to raise and appropriate by taxation, transfer and/or borrowing, a sum of money for the construction of sidewalks and curb- ing and repairs of existing sidewalks and curbing and any retaning walls necessitated by construction of said sidewalks, under a Sidewalk Build- ing Program to be set up by the Board of Public Works; said money to be under the jurisdiction of the Board of Public Works, or take any other action in relation thereto.

UNANIMOUSLY VOTED: That the Town vote to raise and appro- priate from tax levy the sum of $40,000.00 for the construction of side- walks and curbing and for repair of old sidewalks and curbing, under the Sidewalk Building program set up by the Board of Public Works, and that the sum of $2,500.00 may be used for retaining walls in the Sidewalk Building program, under the jurisdiction of the Board of Public Works. 40,000.00


ARTICLE 14. (At Request of Board of Public Works). To see if the Town will vote to raise and appropriate a sum of money for the construction of particular sewers and determine whether the money shall be provided for by taxation, by apppropriation from available funds in- cluding sewer assessment funds, and by borrowing under authority of Chapter 44 of the General Laws, or take any other action in relation thereto.


Upon motion duly made by the Appropriation Committee, it was


UNANIMOUSLY VOTED: That the sum of $120,000.00 be raised and appropriated for the construction of Particular Sewers under the

jurisdiction of the Board of Public Works, and of the total sum, $87,380.33 shall be appropriated from the Common and Particular Sewer Account, and $32,619.67 from the Excess and Deficiency Account. 87,380.33 32,619.67


ARTICLE 15. (At Request of Board of Public Works). To see if the Town will vote to raise and appropriate a sum of money for the construction of common sewers and determine whether the money shall be provided for by taxation, transfer, by appropriation from available funds including sewer assessment funds, and/or borrowing under author- ity of Chapter 44 of the General Laws, or take any other action in re- lation thereto.


MOVED by the Appropriation Committee:


That the sum of $443,900.00 shall be raised and appropriated for the construction of Common Sewers, to be expended under the direction of the Board of Public Works, and of this sum, $143,900.00 shall be ap- propriated from Excess and Deficiency Account, and the Treasurer, with the approval of the Board of Selectmen, is hereby authorized to borrow a sum not to exceed $300,000.00 for new construction and to issue bonds and notes to be payable in accordance with the General Laws (Ter. Ed.) Chapter 44, so that the entire sum shall be payable in not more than thirty (30) years from their dates.

ARTICLE 18. (At Request of Board of Public Works). To see what sum of money the Town will vote to raise and appropriate, by taxation, transfer, and/or borrowing, for drainage purposes (for stream improvement) from Weymouth Back River to Whitman's Pond, consist- ing of flood-flow conduit and channel and works at dams, as recom- mended by Metcalf and Eddy, Engineers, in report to Weymouth Drain- age Committee dated March 11, 1957.


That the sum of money named shall be made available only if the State, under General Laws, Chapter 91, will pay a sum of money pro- portionate to the cost of construction under the provisions of said chap- ter. Provided further, that such work shall be done by private contract under the direction of the Board of Public Works and/or the State De- partment of Public Works.


Also, to see if the Town will assume liability in the manner pro- vided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be in- curred by work to be performed by the Department of Public Works of Massachusetts, for the improvement, development, maintenance and pro- tection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores, and shores along a public beach outside of Boston Harbor, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Board of Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth; or take any other action in relation thereto.

UNANIMOUSLY VOTED: That the Town raise and appropriate the sum of $60,000.00 for drainage purposes and for stream improve- ments from Weymouth Back River to Whitman's Pond; consisting of flood-flow conduit and channel and work at dams, bridges, and walls, as recommended by Metcalf and Eddy, Engineers, in a report to the Weymouth Drainage Committee, dated March 11, 1957. Of the sum ap- propriated, $60,000.00 shall be appropriated from the Excess and Defici- ency Account. 60,000.00


Provided further, that the sum of money named shall be made avail- able only if the State, under General Laws, Chapter 91, will pay a sum of money proportionate to the cost of construction under the provisions of said chapter.


Provided further that the Town assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores, along a public beach outside of Boston Harbor, including Merrimack and Connecticut Rivers, in accordance with Sec- tion 11 of Chapter 91 of the General Laws, and the Board of Selectmen

are authorized to execute and deliver a bond of indemnity therefor to the Commonwealth.


Provided further, that such work will be done by private contract under the direction of the Board of Public Works and/or the State De- partment of Public Works.


ARTICLE 19. (At Request of Board Public Works). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer and/or borrowing for drainage improvements in the Essex St. and Academy Ave. section in accordance with recommendations of Met- calf and Eddy Engineers in report to Weymouth Drainage Committee dated March 11, 1957, or take any other action in relation thereto.


Upon motion duly made by the Appropriation Committee, it was


UNANIMOUSLY VOTED: That the Town raise and appropriate the sum of $75,000.00 for drainage improvements in Essex Street and Academy Avenue sections, in accordance with recommendations of Met- calf and Eddy, Engineers, in report to the Weymouth Drainage Com- mittee, dated March 11, 1957.


Provided further that such work shall be done by private contract under the direction of the Board of Public Works and/or State Depart- ment of Public Works and to meet said appropriation, $75,000.00 shall be raised from tax levy. 75,000.00


ARTICLE 20. (At Request of Board of Public Works). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer and/or borrowing for purposes of a flood control project in Smelt Brook Watershed to be used in conjunction with match- ing funds by the Town of Braintree, said sum to be expended under the direction of the Board of Public Works, which shall be authorized to negotiate for and purchase necessary easements therefor;


Also to see if the Town will assume liability in the manner pro- vided by Section 29 of Chapter 91, of the General Laws, as amended by Chapter 516 and 524, Acts of 1950, for all damages that may be in- curred by work to be performed by the Department of Public Works of Massachusetts, for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores, and shores along a public beach outside of Boston Harbor in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Board of Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth; or take any other action in relation thereto.

To see if the Town will vote to raise and appropriate by taxation, transfer and/or borrowing the sum of $10,000.00 for the continuation of the shore protection from the Fort Point Area to Driftway; also to see if the Town will assume liability in the manner provided by Section 29 of Chapter 91, of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be per- formed by the Department of Public Works of Massachusetts, for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores, and shores along a public beach outside of Boston Harbor, in accordance with Sec- tion 11 of Chapter 91 of the General Laws, and authorize the Board of Selectmen to execute and deliver a bond of indemnity therefore to the Commonwealth; or take any other action in relation thereto.

To see if the Town will vote to raise and appropriate by taxation, transfer and/or borrow the sum of $10,000.00 for the continuation of the 1960 Shore Protection from vicinity of Regatta Road toward River St .; also to see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Work of Massachusetts, for the improvement, development, maintenance and protection to tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores, and shores along a public beach outside of Boston Harbor in accordance with Sec- tion 11 of Chapter 91 of the General Laws, and authorize the Board of Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth; or take any other action in relation thereto.
