ARTICLE 84. (By Petition). To see what sum of money the Town will vote to raise and appropriate for the purpose of building a new Foot Bridge between Lakeshore Drive and Lakeview Road, said Foot Bridge to be constructed on the present site of the old one that was destroyed by fire or take any other action in relation thereto.

ARTICLE 88. (By Petition). To see if the Town will vote to appoint and instruct a committee to prepare and submit to the Legis- lature a properly drawn RECALL BY-LAW to be approved by the 1963 annual town meeting or take any other action in relation thereto.


ARTICLE 89. (By Petition). To see what sum of money the Town will vote to raise and appropriate for a course in Town Government under trained and competent instructors or take any other action in relation thereto. .

ARTICLE 90. (By Petition). To see if the Town will vote to amend Article 4, Sec. 409 of the Town By-Laws by accepting the fol- lowing change in the classification and pay plan under Item entitled Vacations. Paid vacation time shall be granted to all regular full time employees in accordance with the following table:


6 months to 1 year one week


1 year to 10 years two weeks


10 years to 15 years three weeks


Over 15 years four weeks


Vacation time shall be taken within each calendar year and shall not be cumulative from one year to another.


ARTICLE 91. (By Petition). To see if the Town will vote to amend its By-Laws by adding a new section, said section to read as follows:


Restraint of Dogs


Any person owning or harboring a dog shall not suffer or allow it to run at large in any of the streets or public places in the Town of Weymouth, or upon the premises of anyone other than the owner or keeper, unless the owner or occupant of such premises grants per- mission; and no dog shall be permitted in any public place or street within the Town of Weymouth, unless it be effectively restrained by a chain or leash not exceeding six feet in length, and unless it be attended by a person of adequate age and discretion properly to con- trol its actions. The maximum penalty for a violation of this ordinance shall be $25.00 to be recovered in a civil action in the name of the Town of Weymouth.


ARTICLE 92. (By Petition). To see what sum of money the Town of Weymouth will vote to raise and appropriate by taxation or otherwise for the purpose of maintaining and improving the two Little League fields at Central Junior High School, or take any other action in relation thereto.


ARTICLE 93. (By Petition). To see what action the Town will take to obtain an improvement to the existing channel in the Weymouth Fore River, south and east of the Boston Edison Co. station, and a harbor of refuge adjacent to town owned property at Woronocco Rd., to wit:


A channel to be dredged 100 ft. wide by 6 ft. deep at mean low water starting at the south west corner of the Boston Edison Co. bulkhead and extending approximately 1300 yds. due east to a point off Woronocco Rd., North Weymouth. A rectangular harbor of refuge to be dredged from the easterly end of said channel, off Woronocco Rd., extending 250 ft. due south and 300 ft. west.


ARTICLE 94. (By Direction of Board of Selectmen). To see if the Town will vote to accept a gift of $10,000 from the Estate of. Alice Humphrey Taylor, said sum to be held, managed, invested, re- invested and the income thereof to be used for the maintenance of or the purchase of books for Tufts Public Library of said Town or any other public library which may succeed the Tufts Library as the prin- cipal library of said Town, or take any other action in relation thereto:

ARTICLE 95. (By Direction of Board of Selectmen). To see if the Town will vote to adopt the following By-Law regulating the premises of holders of Class III licenses for sale or purchase of second hand motor vehicles, as provided and authorized under Chapter 140, Section 59, General Laws, or take any other action in relation thereto:


Proposed By-Law


1. All applicants for a Class III license, under Chapter 140, Sec- tion 59, General Laws, shall submit to the Licensing Authority a plot plan of the premises to be licensed, in triplicate, said plan to show dimensions of the premises, location of existing structure or struc- tures, and names of all abutting owners of land according to latest records of the Assessors of the Town of Weymouth.


2. No motor vehicle shall be kept, stored, placed or maintained on the licensed premises within 150 feet from the street or property line.


3. The Licensing Authority may require the holder of a Class III license to erect a fence, not less than 4 feet high, around the whole or any portion of the licensed premises if such is deemed necessary and in the best interests of the public good.


4. The Licensing Authority shall regulate the maximum number of motor vehicles that may be kept, stored, placed or maintained on the licensed premises.


5. Violation of any of the foregoing By-Laws shall be cause for suspension or revocation by the Licensing Authority of the license granted.


ARTICLE 96. (By Direction of Board of Selectmen). To see if the Town will vote to adopt the following By-Law regulating the premises of holders of Class II used car dealer's licenses or take any other action in relation thereto.


Proposed By-Law


1. All applicants for a Class II used car dealer's license shall submit to the Licensing Authority a plot plan of the premises to be licensed, in triplicate, said plan to show dimensions of the premises to be licensed, location of existing structure or structures, names of abutting owners of land according to latest records of the Assessors of the Town of Weymouth, and location of area where motor vehicles are to be displayed, kept or stored.


.. 2. All applicants for license must have adequate facilities to repair, maintain and service motor vehicles.


3. All areas on the licensed premises that are to be used for dis- play of motor vehicles offered for sale shall be paved or have a macadam surface.


4. The Licensing Authority shall regulate the maximum number of motor vehicles that may be kept, stored, placed or maintained on the licensed premises.


5. Violation of any of the foregoing provisions shall be cause for suspension or revocation by the Licensing Authority of the license granted.

ARTICLE 97. To see if the Town will vote to accept a gift of Five Thousand Dollars ($5.000.00) bequeath to the Town under Article 7 of the Will of the late Charles M. Taylor, said bequest is as follows:


"($5,000.00) Five Thousand dollars, in addition to the sum given by her will, to the James Humphrey Fund for the Tufts Public Library," or take any other action in relation thereto.


You are hereby required to notify and warn said inhabitants of Weymouth qualified to vote in Town affairs in case all the Articles in the foregoing warrant shall not have been acted upon at the meeting called for the Fifth day of March, 1962, to meet in adjourned session at the hall of the Weymouth High School on

In Precinct 1-in the Bicknell School Hall, 90 Sea Street;


In Precinct 2-in the American Legion Hall on Commercial Street;


In Precinct 3-in the Charles Y. Berry Auditorium in the Hunt School Building on Broad Street;


In Precinct 4-on the ground floor of the Thomas V. Nash Jr. School, 1003 Front Street;

TOWN OF WEYMOUTH ANNUAL TOWN MEETING


MARCH 5, 1962


Pursuant to a Warrant duly issued, the Annual Town Meeting of the inhabitants of the Town of Weymouth, represented by their duly elected and qualified Town Meeting Members, was held in the audito- rium of the Weymouth High School on Monday, March 5, 1962.


The Meeting was called to order at 7:45 o'clock in the evening by the Annual Moderator, Mr. Philip T. Jones.


The Town Clerk, Mr. Harry Christensen, read the Call of the Meeting.


There were 208 Town Meeting Members present.


Upon motion duly made, it was


UNANIMOUSLY VOTED: That the reading of the Articles in the Warrant be suspended.


Prayer for Divine Guidance at this Annual Town Meeting was offered by the Rev. Hugh A. Gillis, Pastor of the Congregational Church, East Weymouth.


Town Meeting Members, not previously sworn, were administered the oath by the Moderator.


The Moderator declared a quorum present.


The Moderator recognized the presence of a group of students from Weymouth High School and from Waltham High School who were present as part of the Student Government Exchange Program sponsored by the State Department of Education.


We now continue with consideration of the Articles in the War- rant.


Upon request by Mr. Lane for unanimous consent to consider Article 37 at this time, and there being no objection, the Moderator ruled that Article 37 would be considered at this time.


ARTICLE 37. (By Direction of Board of Selectmen). To see if the Town will vote to name the auditorium in the New Senior High School the Daniel L. O'Donnell Memorial in honor of our late Mod- erator and authorize the appointment of a committee to plan a fitting dedicatory ceremony at the first town meeting assembly held in this new school, or take any other action in relation thereto.


Mr. Lane presented the following resolution:


WHEREAS a man lived a simple, peaceful and dignified life, loved by all his neighbors, greatly respected by his associates and esteemed by his community and people, and


WHEREAS his 57 years of life were more than generously sprin- kled with countless good deeds, recorded only in the Book of Judgement that has brought eternal happiness, and

WHEREAS he maintained a deep and continuous devotion to God, a life-long, never-ceasing concern for his Government and a warm hand for all, and


WHEREAS as an educator, attorney, legislator, soldier, counsel and civic leader, his deep convictions and courage were a great source of strong ideals and beliefs for all, and


WHEREAS he served as Mr. Moderator for a quarter of a cen- tury and did discharge his duties with true understanding and high respect for his fellow officers and townsmen and with deep sincerity and concern for the highest standards of public office, and


WHEREAS he will long be remembered as one of the outstanding personalities of our community, a part of its history and life, and


WHEREAS he has been called and summoned to a just and eter- nal reward for a most faithful, decent and successful performance on earth,


IT IS THEREBY RESOLVED that the Town Meeting Members, representing all of the citizens of our great community on this 5th Day of March, 1962, hereby resolve their wish to state and record a greatful and everlasting appreciation of the wise leadership, strong counsel and stewardship of Daniel L. O'Donnell during his private, civic and public life as friend and gentleman, educator, Moderator, counsel, attorney, soldier and legislator, and


IT IS FURTHER RESOLVED that the people of Weymouth de- sirt to have their deep appreciation and everlasting thanks inscribed upon the records of the Town to the end that all future Town Meet- ings, Town Officers and citizens may have and hold the same inspira- tion for public service as Daniel L. O'Donnell.


IT IS THEREFORE MOVED that the name and deeds of our great and honorable servant, Daniel L. O'Donnell, shall be inscribed in the hearts and minds of all future Town Meetings by naming the North High School Auditorium, the Daniel L. O'Donnell Memorial Auditori- um, and


IT IS FURTHER MOVED that the Annual Moderator shall ap- point a committee of five Town Meeting Members to plan and provide a fitting memorial to be dedicated at the first Town Meeting held in the Daniel L. O'Donnell Memorial Auditorium and that the sum of $1,000 shall be raised and appropriated for this high purpose. $1,000.00


Upon motion duly made by Mr. Lane, it was


UNANIMOUSLY VOTED: That this resolution be adopted and motion accepted by a standing vote of this Town Meeting.


The Town Meeting stood for a minute of silent tribute to the memory of the late beloved Daniel L. O'Donnell.


Upon request by the Appropriation Committee for unanimous con- sent to consider Article 9 at this time, and there being no objection, the Moderator ruled that Article 9 would be considered at this time.


ARTICLE 9. (At Request of the Personnel Board). To see if the Town will vote to amend Article 4, Section 409, of the Town By- Laws, by accepting changes in the administration and classification and pay plan or take any other action in relation thereto.

ARTICLE 36. (By Direction of Board of Selectmen). To see if the Town will vote to adopt the following By-Law or take any other action in relation thereto:

ARTICLE X


1. The Board of Selectmen shall annually, in accordance with the provisions of Chapter 737, of the Acts of 1960, appoint an Inspec- tor of Gas Piping and Gas Appliances, who shall be a voter in the Town of Weymouth, for the term of One (1) year from the first day of April or until his successor in office has been appointed and qualified.


2. His hours of work and salary or compensation shall be fixed and determined by the Board of Selectmen within the limits of appro- priated funds.


3. He may be removed from office by the Board of Selectmen for cause; and, in event of removal or resignation from office or death, the Board of Selectmen shall appoint a successor for the remainder of the unexpired term.


4. The duties of the Inspector of Gas Piping and Gas Appliances shall be the enforcement of the rules and regulations adopted by the Board established under the provisions of Chapter 25, Section 12H, of the General Laws, as amended, and such other duties as may be assigned to or required of him by law, these By-Laws, or the Board of Select- men.


5. The Board of Selectmen shall establish a schedule of fees for the issuance of all gas fitting permits required under the pertinent provisions of Chapter 143, as amended by Chapter 737, of the Acts of 1960.


6. No permit shall be issued by the Inspector until the fee is paid. All fees received by the Inspector shall be promptly deposited with the Town Treasurer. All permits shall be numbered and in du- 1 plicate.


7. The Inspector shall keep a detailed record of all permits is- sued, fees collected and of other business of the department and shall submit an annual report to the Board. of Selectmen of all business and activities of this office.


8. The Inspector's office shall be a part and division of the Build- ing Inspector's Dept.


Upon motion duly made by the Appropriation Committee, it was UNANIMOUSLY VOTED: That the Town vote to adopt as a By- Law as set forth in this Article.


Upon request by the Appropriation Committee for unanimous consent to consider Article 95 at this time, and there being no objec- tion, the Moderator ruled that Article 95 would be considered at this time.
