It is hereby determined that there is a need for a Re-development Authority in the Town of Weymouth for the purpose of engaging in Urban Renewal and land assembly and redevelopment projects and that it is in the public interest that such Authority be organized in the Town of Weymouth in accordance with the provision of Section 26QQ of Chapter 121 of the General Laws of the Commonwealth of Massachusetts, as amended, and that such Authority be organized and established and that the Selectmen be and are authorized and directed to take any and all necessary steps required for the appointment of members of said Authority and for the Authority the sum of Five Hundred Dollars ($500.00) is hereby appropriated, said sum to be transferred from the E. & D. fund, or take any other action in rela- tion thereto.


ARTICLE 44. (By Direction of Board of Selectmen). To see what action the Town will take to establish a Purchasing Committee.


ARTICLE 45. (By Direction of Board of Selectmen). To see if the Town will vote to accept a gift of a parcel of land from Peter Cugini located in the rear of the Weymouth Landing Fire Station, containing 80 square feet of land, being shown as Lot B on a plan entitled "Subdivision Plan of Land in Weymouth - Norfolk County - Mass." dated January 8, 1962, by Frank S. Lagrotteria, Town Engin- eer, being number 1246-B, or take any other action in relation thereto.


ARTICLE 46. (By Direction of Board of Selectmen). To see if the Town will vote to raise and appropriate, by taxation, transfer and/or borrowing the sum of $8,000.00 for the Town's share in the South Shore Mosquito Control District, or take any other action in relation thereto.


ARTICLE 47. (By Direction of Board of Selectmen). To see if the Town will vote to raise and appropriate, by taxation, transfer and/or borrowing the sum of $500.00 for the purpose of maintaining during the ensuing year, the mosquito control works as estimated and certified to by the State Reclamation Board in accordance with the provisions of Chapter 112, Acts of 1931, or take any other action. in relation thereto.


ARTICLE 48. (By Direction of Board of Selectmen). To see if the Town will vote to raise and appropriate, by taxation, transfer and/or borrowing the sum of $300.00 to be expended under the direc- tion of the Board of Selectmen for the purpose of stocking the ponds and inland waters, located within the Town limits, with fish and/or liberating game, all in accordance with General Laws (Ter. Ed.), Chapter 10, Section 5, Clause 41, or take any other action in relation thereto.


ARTICLE 49. (By Direction of Board of Selectmen). To see if the Town will vote to raise and appropriate, by taxation, transfer and/or borrowing a sum of money for the straightening and widening of East Street, from Hinston Road to Green Street, or take any other action in relation thereto.

ARTICLE 50. (By Direction of Board of Selectmen). To see if the Town will vote to appropriate, by taxation, transfer and/or borrowing funds for the purpose of a study, plan and recommenda- tions for the disposal of refuse through incineration, or take any other action in relation thereto.


ARTICLE 51. (By Direction of Board of Selectmen). To see what sum of money the Town will vote to raise and appropriate, by taxation, transfer and/or borrowing to be used by the Trustees of the Laban Pratt Hospital Fund for legal services, or take any other action in relation thereto.


ARTICLE 52. (On Petition and By Direction of Board of Se- lectmen). To see if the Town will vote to release from the operation of Article 64 of the Town Warrant for the year 1952 reserving a portion of the Town Infirmary Land, so-called, for the site of the Laban Pratt Hospital, that portion thereof bounded and described as follows:


Easterly by Essex Street and by land of the Town of Weymouth by two lines measuring 255 feet, more or less, and 160 feet, more or less, respectively;


Southerly bv land of Charles C. Chalmers and by land of Alvin T. Hicks and Joseph L. Lockary by two lines measuring 280 feet, more or less, and 150 feet, more or less, respectively;


Westerly bv land of the Town of Weymouth, being Central Junior High, 500 feet, more or less, and


Northerly by other land of the Town of Weymouth, 300 feet, more or less.


Said parcel being shown on a plan entitled "Plan of Land in Weymouth - Norfolk County - Mass." dated Mav 2, 1961, Frank S. Lagrotteria, Registered Professional Engineer, Weymouth, Mass., or take any other action in relation thereto.


ARTICLE 53. (On Petition and By Direction of Board of Se- lectmen). To see if the Town will vote to authorize and direct the Board of Selectmen to convey by deed to the Weymouth Housing Authority for such price and upon such terms as said Board shall fix, a parcel of Town-owned land situated on the westerly side of Essex Street and bounded and described as follows:


Easterly by Essex Street and by land of the Town of Weymouth by two lines measuring 255 feet, more or less, and 160 feet, more or less, respectively;


Southerly bv land of Charles C. Chalmers and by land of Alvin T. Hicks and Joseph L. Lockary by two lines measuring 280 feet, more or less, and 150 feet, more or less, respectively;


Westerly bv land of the Town of Weymouth, being Central Junior High, 500 feet, more or less, and


Northerly 'by other land of the Town of Weymouth, 300 feet, more or less.


Said parcel being shown on a plan entitled "Plan of Land in Weymouth - Norfolk County - Mass." dated May 2, 1961, Frank S. Lagrotteria, Registered Professional Engineer, Weymouth, Mass., or take any other action in relation thereto.

ARTICLE 54. (At Request of Board of Public Works). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer and/or borrowing for the purpose of acquiring by gift, purchase or take by right of eminent domain in fee, or as other- wise specified, land along Commercial Street and Ledgehill Road, Weymouth, Massachusetts, being shown as Parcels "A" and "B" on a plan entitled "Plan of Land in Weymouth - Norfolk County - Mass.," dated December 12, 1961, made by Frank S. Lagrotteria, Town En- gineer, in accordance with Chapter 79 of the General Laws for the purpose of alteration, widening and reconstruction of said streets, or take any other action in relation thereto.


ARTICLE 55. (At Request of School Committee). To see what sum of money the 'Town will vote to raise by taxation or otherwise, and appropriate, for the purpose of acquiring by gift, purchase, or to take by right of eminent domain, in fee, a portion of Lot o, Block 326, containing about 6,000 square feet, as shown on Sheet 28 of the Town of Weymouth Assessor's maps, revised to January 1, 1961, and as shown on a plan entitled "Plan of Proposed Walkway - Home- stead School - Weymouth, Mass." to be used for a walkway from the Homestead School grounds to Newcomb Terrace (a newly constructed street running south from Federal Street) or take any other action in relation thereto.


ARTICLE 56. (At Request of School Committee). To see what sum of money the Town will vote to raise by taxation or otherwise, and appropriate, for the purpose of constructing a walkway from the Homestead School grounds to Newcomb Terrace, a distance of ap- proximately 20 feet, or take any other action in relation thereto.


ARTICLE 57. (At Request of the Green Street School Building Committee and the High School Building Committee. To see whether the Town will vote to transfer to the High School Building Committee, to be expended under its direction in addition to the previous appro- priations for construction and equipment, the unexpended balance in the appropriation for the construction of the John F. McCulloch School as reimbursement for loam made available to this school from the high school site, or take any other action in relation thereto.


ARTICLE 58. (At the Request of the Center School Replacement Building Committee and the High School Building Committee). To see whether the Town will vote to transfer to the High School Build- ing Committee, to be expended under its direction in addition to the previous appropriations for construction and equipment, the unex- pended balance in the appropriation for the construction of the William Seach School as reimbursement for loam made available to this school from the high school site, or take any other action in relation thereto.


ARTICLE 59. (On Petition of the Industrial Development Com- mission). To see if the Town will vote to amend Article X, Zoning By-Laws of the Town of Weymouth as follows:


To amend Section IV-A, Sub-section 2, by adding, after the word "Selectmen", in the last line, the following words: "in accordance with the General Laws"; so that said paragraph, as thus amended, will read as follows: "Research, experimental and testing laboratories and manufacture which is incidental to research and experimental laboratories; subject, however, to license when required by the Board of Selectmen in accordance with the General Laws.

To amend Section IV-A, Sub-section 3, by deleting the word "now" in the last sentence and inserting, in place thereof, the word "not", so that said sentence, as thus amended, would read as follows: "There shall also be filed therewith, written authorization for such use of any land not owned by the applicant".


To amend Section IV-A, Sub-section 5, by deleting the word "eighty" in the second line and inserting, in place thereof, the word "twenty" and by deleting the word "two" in the last line, and insert- ing, in place thereof, the word "one"; and by adding, after the word "feet" in the last land for development that may require access through the lots involved, then the width will be two hundred feet"; so that said paragraph, as thus amended, will read as follows: "Re- quired lot area and width: For each establishment, not less than twenty thousand square feet, having a width of not less than one hundred feet, except in areas where there is rear land for development that may require access through the lots involved, then the width will be two hundred feet".


To amend Section IV-A, Sub-section 6, by deleting the word "twenty" in the second line and inserting, in place thereof, the word "sixty"; so that said paragraph, as thus amended, will read as fol- lows: "Percentage of lot coverage: All buildings, including accessory buildings, shall not cover more than sixty percent of the area of the lot".


To amend Section IV-A, Sub-section . by adding, after the word "line" in the last sentence, the following: "except when one hundred feet width is authorized, then the building shall be not less than fif- teen feet from the side property line"; so that said paragraph, as thus amended will read as follows: "Yards required: Buildings shall be not less than forty feet from any street line and fifty feet from any side property line, except when one hundred feet width is author- ized, then the building shall be not less than fifteen feet from the side property line".


Add new Sub-section "8-A": "Where an industrial area is to be developed that abuts a presently developed residential area, a six foot solid fence or screen planting may be required at the discretion of the Building Inspector".


Section IV-B: delete in its entirety.

ARTICLE 60. (On Petition of the Industrial Development Com- mission). To see if the Town will vote to amend its present Zoning Map, Article X, of the Town By-Laws, by changing the districts zoned "Industrial District-B" to "Industrial District-A"; or take any other action in relation thereto.


ARTICLE 61. (On Petition of the Industrial Development Com- mission). To see if the Town will vote to amend its Zoning Laws and Zoning Map, Article X of the Town By-Laws, by making the following changes:

ARTICLE 62. (On Petition of the Industrial Development Com- mission). To see if the Town will vote to amend its Zoning Laws and Zoning Map, Article X of the Town By-Laws, by making the following changes:

From Business and Limited Business to Limited Industrial-A, the land in its entirety bounded by Main, Washington & Winter Streets.


Also the land on the easterly side of Washington Street; com- mencing at a point on Washington Street opposite the intersection of Congress Street and extending northeasterly at right angles to Washington Street, to the division line between Precinct 10 and Precinct 6 and extending along in a southerly direction along the division line between Precinct 10 and Precinct 6 thence continuing in a southwesterly direction along the division line between Precinct 4 and Precinct 6 to a point opposite the end of the present Limited Business Zone; or take any other in relation thereto.


ARTICLE 63. (On Petition of the Industrial Development Com- mission). To see if the Town will vote to amend its Zoning Laws and Zoning Map, Article X of the Town By-Laws, by making the following changes:


Change of District


From Residential to Limited Industry-A, land shown on the Town of Weymouth Assessors Maps revised to Jan. 1, 1961 as a portion of Lots 2, 3, 18, 19 & 23, Block 447, Sheet 35; also a portion of Lots 1 & 10, Block 448, Sheet 35; said land being a 260' strip between the 240' strip of Limited Business District on the southerlv side of Washington Street and the Limited Industrial District-B 500' back from said sideline of Washington Street and the remaining portion of said Lot 18, Block 447 as shown on the Town Zoning Map of Limited Industrial Districts that is not within the existing said Limited Industrial District-B.


Said land bounded as follows: northerly by the rear of said Limited Business District 240( from the southerly sideline of Wash- ington Street; easterly by the easterly property line of said Lot 1, Block 448 extended to intersect with the northerly boundary line of said Limited Industrial District-B; southerly by the northerly bound- ary line of said Industrial District 500' from the southerly sideline of Washington Street; easterly along the westerly boundary of said Industrial District through said Lot 18, Block 447; southerly by the southerly boundary line of said Lot 18; westerly by the westerly boundary line of said Lot 18; southerly by the southerly boundary line of said Lot 18; westerly by the westerly property line of said Lot 18 extended perpendicular from the northwest corner of said Lot 18 to intersect with the southerly boundary line of said Limited Business District 240' south of Washington Street; or take any other action in relation thereto.

ARTICLE 64. (On Petition of the Industrial Development Com- mission). To see if the Town will vote to amend its Zoning Laws and Zoning Map, Article X of the Town By-Laws, by making the follow- ing changes:

From Residential to Limited Industry-A, land shown on the Town of Weymouth Assessors Maps revised to Jan. 1, 1961 as Lots 2 & 3, Block 421, Sheet 32; beginning at a point on the westerly sideline of Front Street, point being the intersection of said sideline of Front Street and the northerly sideline of Charlotte Street; thence northerly by said sideline of Charlotte Street; westerly by end of Charlotte Street and the westerly property line of said Lot 2; northerly and northwesterly by the northerly and northwesterly property line of said Lot 3; westerly by the westerly property line of said Lot 3; southerly by the southerly property line of said Lot 3; easterly by the easterly sideline of said Lot 3; southerly by the southerly prop- erty line of said Lot 2; easterly by the westerly sideline of Front Street; or take any other action in relation thereto.


ARTICLE 65. (On Petition of the Industrial Development Com- mission). To see if the Town will vote to amend its Zoning Laws and Zoning Map, Article X of the Town By-Laws, by making the following changes:


Change of District


From Residential to Limited Business, Lots 1, 2, 3, 4, 24, and 25, Block 376, Sheet 29 of the Weymouth Town Atlas.


Article 66. (By Request of the Rezoning Committee). To see if the Town will amend its zoning by-laws and zoning may by making the following change:


Change of District from Residential to Limited Business, the area comprising Lots 8, 9, 10, 11, 12, 13 and 14, to a depth of three hundred feet from Ralph Talbot Street, said lots being shown on Block 533, Sheet 46 on the Atlas of the Town of Weymouth and approximately opposite lands of McIntyre and the Weymouth Fair Grounds.


ARTICLE 67. (By Request of the Rezoning Committee and the Committee appointed under Article No. 34 of the 1961 Annual Town Meeting to study and report on the By-Laws relative to Apartment Buildings). To see if the town will accept the report of the Com- mittee and make the following changes in Article X of the By-Laws relative to Zoning or take any other action with relation thereto:


1. Strike out the clause in Sec. III, Paragraph 2, which states


1 "Apartment House of first or second class construction."


2. Insert in Section III, after Paragraph 2, the following new par- agraph:


2A Apartment Buildings. Apartment Building shall mean any structure here-inafter constructed or altered so that it con- tains family units for four or more families; the building to contain nothing but family units.

No apartment building shall be permitted which exceeds two and one half stories or thirty-five (35) feet in height, nor with the front of said building less than thirty feet from the street line and the sides and rear of said building less than fifteen feet from the adjoining property line. Signs shall be permitted only when attached to or flush with the front of the building, not above the first floor, and shall in no case be of neon or electric activating type. The Board of Zoning Appeal shall approve the design and appearance of the building and shall determine that it is in harmony with and not detrimental to the surrounding area.


3. Amend Section VIA by inserting at the end of the first sentence and make a part of said sentence the following: "Except in the case of multi-family or apartment buildings there shall be space for two motor vehicles per family unit".


4. Amend Section VII, paragraph 3 by adding the following sen- tence: "If said application is for any variance in lot size, the applicant shall file a plan, drawn to scale, and in a form ap- proved by the Board of Zoning Appeal, which plan shall remain in the custody of said Board.


ARTICLE 68. (At Request of Board of Zoning Appeals). To see if the Town will vote to accept a gift of a parcel of land shown as that portion of Lot 2, Block 215, Sheets 16 and 20 of the Weymouth Town Atlas, which is the area around Cranberry Pond left after ap- proval of subdivision by the Board of Zoning Appeals and the Plan- ning Board, for park purposes; or take any other action in relation thereto.


ARTICLE 69. (At Request of Board of Zoning Appeals). To see if the Town will vote to amend Article X, Section VII, Item 3, paragraph 2, by adding "a representative of the Inspection Depart- ment" after the word "Board" in the first line, so as to read as follows: "Members of the Board, a representative of the Inspection Department, and Clerk, who may be a town employee, shall receive $10.00 for each meeting of the Board attended by them, payable from the appropriation of the Building Department"; or take any other action in relation thereto.


ARTICLE 70. (By Petition). To see if the Town will vote to amend its Zoning Laws and Zoning Map, Article X of the Town By-Laws, by making the following changes:

From Residential to Industrial, land shown on Weymouth Town Atlas as revised to Jan. 1, 1958, Sheet 30, Block 379, Lots 1-2-3-4, be- ginning at Business Zone boundary 120' northerly from Washington St., and continuing along the easterly sideline of Middle Street nor- therly to the end of the Industrial Area for a depth of 120 feet easterly off Middle Street or take any other action in relation thereto.


ARTICLE 71. (By Petition). To see if the Town will vote to amend its Zoning By-Laws and Zoning Map, Article X of the Town By-Laws, by making the following changes:

From Residential to Limited Business, Lots 8, 9, 10, 11, 12 and 13 now or formerly the property of Charles C. Fortier and Helen E. Fortier, tenants by the entirety, and Lot 14 now or formerly the property of Dorothea F. Fucci, Block 533, Sheet 46, as shown in the Atlas of the Town of Weymouth, or take any other action in relation thereto.


ARTICLE 72. (At Request of Conservation Committee). To see if the Town will vote to accept the provisions of General Law, Chapter 40, Section 8C, and direct the Board of Selectmen to appoint within sixty (60) days. seven (7) members to a Conservation Com- mission for the promotion and development of the Natural Resources of the Town, or take any other action in relation thereto.


ARTICLE 73. (At Request of Conservation Committee). To see if the Town will vote to establish a Conservation Fund as auth- orized by Chapter 40, Section 5 (51), and to appropriate the sum of $500 (Five Hundred Dollars), or take any other action in relation thereto.


ARTICLE 74. (By Request of Town Clerk). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer and/or borrowing for microfilming vital statistics and other vital records in the Office of the Town Clerk for the purpose of providing protection and preservation of these records, or take any other action in relation thereto.


ARTICLE 75. (At Request of Town Clerk and Board of Regis- trars). To see what sum of money the Town will vote to raise and appropriate for the purchase and installation of air conditioning equipment in the offices of the Town Clerk and Board of Registrars.


ARTICLE 76. (On Request of the Weymouth Contributory Re- tirement Board). To see if the Town will accept the provisions of Chapter 552 of the Acts of 1961.


AN ACT ESTABLISHING MINIMUM BENEFITS FOR WIDOWS OF DECEASED MEMBERS OF RETIREMENT SYSTEMS AND FOR WIDOWS OF CERTAIN EMPLOYEES KILLED IN THE PERFORM- ANCE OF THEIR DUTIES.


ARTICLE 77. (At Request of Planning Board). To see if the Town will vote to accept the provisions of section 6H of chapter forty of the General Laws, which authorizes the making of repairs on certain private ways therein open to public use, without liability on account of any damage.


ARTICLE 78. (At Request of Planning Board). To see what action the Town will take to adopt or accept as a By-Law the follow- ing, the same to become Section 608B of Article VI of the By-Laws: "Whoever, in disposing of garbage, refuse, bottles, cans or rubbish on a public way or within twenty feet thereof, commits a nuisance thereby, shall be punished by a fine of not more than fifty dollars. If a motor vehicle is used in committing such nuisance a conviction under this section shall forthwith be reported to the registrar of motor vehicles. This section shall be enforced by the Police Department." .

ARTICLE 79. (At Request of the Park Commissioners). To see if the Town will vote to raise and appropriate by taxation, transfer and/or borrowing the sum of $1,500 for the purchase of a parcel of land known as Lot 10, Block 410 on Sheet 32 and Lot 11A, Block 410 on Sheet 36 of the Town Atlas, for a playground site or take any other action in relation thereto.


ARTICLE 80. (At Request of the Park Commissioners). To see if the Town will vote to raise and appropriate by taxation, transfer and/or borrowing the sum of $4,300 for the conversion of a section of Negus Park into a Little League Baseball Field or take any other action in relation thereto.


ARTICLE 81. (At Request of the Park Commissioners). To see if the Town will vote to raise and appropriate by taxation, transfer and/or borrowing the sum of $250 for the printing of booklets and posters displaying the regulations governing the use of beaches, parks and playgrounds under the jurisdiction of the Park Commission, or take any other action in relation thereto.


ARTICLE 82. (By Petition). To see if the Town will vote to raise and appropriate by taxation or otherwise the sum of $11,000 for the extension of the 42" drainage pipe along the marshland between North Street and Pilgrim Road to a point beyond the lands owned by Charles Indigaro and William E. Irish, 65-67 North Street.


ARTICLE 83. (By Petition). To see what action the Town will take to raise and appropriate by tax levy, borrowing or use of avail- able funds, a sum of money for the purpose of providing an access road to the Idlewell section of Weymouth, including plans, specifica- tions and cost of construction for said access road, necessary adjoining roads and overpass, or take any other action in relation thereto.
