TOWN OF WEYMOUTH SPECIAL TOWN MEETING JUNE 10, 1963


Pursuant to a Warrant duly issued, the Special Town Meeting of the inhabitants of the Town of Weymouth, represented by their duly elected and qualified Town Meeting Members, was held in the auditorium of the Weymouth High School on Monday, June 10, 1963.


The Meeting was called to order at 7:35 o'clock in the evening by the Annual Moderator, Mr. Philip T. Jones.


The Town Clerk, Mr. Harry Christensen, read the Call of the Meet- ing.


Upon motion duly made, it was


UNANIMOUSLY VOTED: That the reading of the Articles in the War- rant be suspended.


Prayer for Divine Guidance at this Special Town Meeting was offered by Rev. Arthur W. Dycer, Pastor Emeritus of the Pilgrim Congregational Church, North Weymouth.


Town Meeting Members, not previously sworn, were administered the oath by the Moderator.


There were 170 Town Meeting Members present.


The Moderator declared a quorum present.


We now continue with consideration of the Articles in the Warrant.


ARTICLE 1. (By request of the Daniel L. O'Donnell Memorial Com- mittee). To see if the Town will accept the report of the Daniel L. O'Donnell Memorial Committee, appointed under Resolution of the Annual Town Meeting of 1962, and dedicate the auditorium of the Weymouth High School as the "DANIEL L. O'DONNELL MEMORIAL AUDITORIUM".


THE MODERATOR: Mr. Lane, Chairman of the Committee.


MR.' GEORGE E. LANE: Reverend Clergy, distinguished guests, members of the Town Meeting, relatives and friends of our beloved past Moderator. Tonight in your behalf as spokesman for all the people of Weymouth I have the high honor and privilege to submit in accordance with your wishes the report of a Special Committee to commemorate the words and deeds of a great public servant and officer. In keeping with the devo- tion of the community and people, the dignity and humility of our servant, counselor and friend, we tender this report with deepest sincerity of pur- pose and lasting memory of Mr. Moderator, the Hon. Daniel L. O'Donnell, Dan O'Donnell.


In your behalf we present at this time an old and valued friend of our late servant. Ladies and gentlemen of the Town Meeting, the Reverend Dr. Arthur Dycer, Emeritus. Reverend Arthur.

REV. ARTHUR W. DYCER: Now, our Heavenly Father, for Thy Glory and in the Name of Thy Son, our Lord Jesus Christ, we come to this part of our sacred service of loving remembrance. Here as neighbors we pray as official representatives of our entire community, united in the sense of profound obligation and inescapable gratitude to our beloved Moderator and counselor, Mr. Daniel L. O'Donnell, for his magnificent leadership and all the myriad forms of his talented service in the interest of our Town of Weymouth, that this our official Town Meeting presents this tangible tribute of love and appreciation.


We reverently pray that the gracious influence of his spirit and the sacred memory of our beloved Dan will inspire all of us to a new dedica- tion of ourselves with continuing the unfinished work for good government, for social justice and for Christian service.


We ask this in the Name of Christ, Thy Son, our Lord, for Thine is the Kingdom and the Power and the Glory. Amen.

MR. E. LEO MADDEN: Members of the Clergy, guests and friends of Dan. It is with great pride and a great deal of honor that I accept this task which the Committee has given to me to perform this evening. I was told to be very brief but I could not let this occasion go by without saying one or two words about Dan because I am one of very few people I know that knew Dan in his high school and his college days when his great am- bition was to make a success of his life and Dan always had those goals as the achievement to which he was always striving, and I had the pleasure of living through those days with him.


So to you, Danny, I would like to present this plaque and pray God that you will be given strength and the same ambitions that were the goals of your dad, Daniel L. O'Donnell.


MR." DANIEL L. O'DONNELL, JR. : Thank you very much. (Applause)


MR. GEORGE E. LANE: Now, Mr. Daniel L. O'Donnell, Jr., on behalf of this Town Meeting and all the people of Weymouth will you do us the honor of unveiling this memorial to one whom we will always love and whose memory we will always cherish.

This is now an appropriate moment to present one who for many years was a close and cherished friend of the man we honor tonight. It is with a deep sense of gratitude that I introduce to the members assembled Right Reverend John J. McShea, Pastor of St. Xavier Roman Catholic Church of South Weymouth. Monsignor McShea.


REV." JOHN J. McSHEA: Please be seated. (The assembly was seated. )


Reverend Dr. Dycer, Mr. Moderator, ladies and gentlemen, friends of Dan O'Donnell. I first wish to congratulate the Town Meeting Members for their thought in placing a lasting memorial here in honor of Dan O'Don- nell. I congratulate the School Committee, Board of Selectmen, who did their share in dedicating this magnificent auditorium in his memory. It is a fitting place in this magnificent edifice that he should be so honored.


I feel, my dear people, we are gathered here as friends of Dan O'Donnell in a very special way. If we weren't friends I don't think we would be here. We paid eulogy to him over a year and a half ago when he died. We said good-bye to our friend. We were the losers as death al- ways makes us because as men and women of Christian faith we believe that the departed is now in his place with God. We are the bereaved ones with sympathy due us because we have lost someone very dear to us. So for the year and a half we have held in our memory, we his friends, thoughts of many grand moments in our love, wept tears through his be- loved wife and son down through many I have mentioned who have carried his memory so dear to us.


I like this inscription. Annual Moderator for twenty-five years. That means to me that the Town Meeting Members, the Selection Committee,

the Selectmen, the School Committee, all the officials of the Town, who sanction these men who represent us as citizens of Weymouth, approved the work done by and approved this man that he should be so memorialized.


Educator. In a little, homey family group as we are tonight let me bring a little tidbit. One individual said to me years ago, "Monsignor, the incentive to my education came from Dan O'Donnell. I have never been inspired any more by any teacher than I was by this man." He certainly must have been an educator with principles of high esteem and regard for his profession.


Mrs. Wallace Driscoll, Alma, the South Junior High teacher, said to me not long ago, "Dan O'Donnell inspired me to go on for my degrees." And she is a successful teacher because of his being her mentor to teach our children in this community.


Town Counsel. I have sat in his office several times during my past several years and looked into those brilliant, brown, piercing eyes send- ing forth darts of light like a rapier and repeating a decision of yes or no without any vacillating, to the point, truly a counselor.


Mr. Leahy, my friend, has sat there with me, and I know he drank from the Pierian spring of knowledge that emanated forth from his learned mind.


U. S. Army. Monsignor Reilly's sister, a commander in the WACs during the last war, tears filled her eyes when I announced to her that Dan O'Donnell was dying. She said, "Monsignor, he was the only one of them all who cut all the red tape and gave you a yes or no answer in the Service with which I was connected. "


These little tidbits, my good friends, bring out to my mind the character of the man. They are from the ordinary people, the little people, of which Dan O'Donnell was the champion, the ordinary people like you and I, not the big shots. He was anxious to treat everyone with kindliness and gentleness. Oh, don't think that that rapier mind of his didn't know the fakirs. Let me not deceive you. He knew them all but he was a man of gentleness. He was a man of kindness. He was a man of honor.


Mr. Lane asked me as his Pastor to place the Sign of the Cross on that plaque tonight. He asked me to do it because he knew Dan, as we all do some way or another, carried a cross. We know that Dan carried his; for two years and six months before he died he knew his time was up. He carried it well and he carried it bravely. Not all of us at fifty-seven could so carry it and think of others as he did. Unselfish, unstinting in his giving, a man among men, truly we of this beloved Town of Weymouth do him honor. We know it, we are his friends and his family.


We shall pass on but the one thing that makes me so pleased and happy tonight is this, that long after we too have followed down life's path after Dan O'Donnell that your children and your children's children will read this plaque and will know that there did exist a man in this middle twentieth century whom the Town of Weymouth loved, respected, honored and revered and because of it they have dedicated an auditorium in this magnificent high school that these children will attend some day not yet

born and they shall read the plaque and see the encomiums engraved there in bronze and they shall say, "There lived a man of whom we may well be proud. "


May God be good to his soul. Thank you.


MR. GEORGE E. LANE: Thank you, Monsignor McShea, for a very, very wonderful memorial talk.


At this time, Mr. Moderator, I would like to offer the following mo- tion, that the auditorium of the North High School shall henceforth and forever be named the Daniel L. O'Donnell Memorial Auditorium in mem- ory of the name and deeds of a great and honorable servant.


THE MODERATOR: You have heard the motion in behalf of the Com- mittee on which I believe the Appropriation Committee concurs. Anything to be said on the question ? Those in favor say, "Aye." Opposed. The Ayes have it and it is unanimously carried.


Now I shall ask you to rise for a moment of silence.

MR. JAMES J. FASINO: Mr. Moderator, ladies and gentlemen, on behalf of the Appropriation Committee I make the following motion. That the report of the Daniel L. O'Donnell Memorial Committee be accepted as presented; that the Town Meeting extend its appreciation for such a warm and memorable dedication of this great Daniel L. O'Donnell Memo- rial Auditorium; and that the Committee, having completed the duties for which it was appointed, be dismissed.


THE MODERATOR: You have heard the motion of the Appropriation Committee. The Chair would like to add its thanks to this Committee and introduce the members: Mr. E. Leo Madden, Mr. John Field, the Clerk of the Committee, and also, unfortunately unable to be here because of illness, Mr. John F. Newton, Mr. Joseph W. Mahoney. I want to thank them all for the work they have done and I particularly want to extend my personal thanks to the Reverend Dr. Dycer and to Monsignor McShea.


Anything to be said on the motion ? All in favor of the motion of the Appropriation Committee say, "Aye." Opposed, "No." The Ayes have it and it is unanimously voted. Thank you.


MR. GEORGE E. LANE: May I just take a moment before we go on with Article 2 to extend the deepest gratitude of the Committee and also the Town Meeting Members for Mrs. Daniel L. O'Donnell coming here tonight, and Dan, Jr., and Monsignor McShea and Reverend Arthur W. Dycer. We thank them for joining with us in these ceremonies.

ARTICLE 2. (By request of the Incinerator Building Committee). To see what sum of money the Town will vote to raise and appropriate by

taxation, transfer from available funds and/or borrowing for the construc- tion of a municipal incinerator on Town owned land off Wharf Street shown on plan entitled "Plan of Incinerator Location-Town of Weymouth" dated April 25, 1963, No. 1490B duly filed in Town Clerk's Office, or take any other action in relation thereto.


MOVED by the Appropriation Committee:


That the Incinerator Building Committee appointed under Article 29 of the 1962 Annual Town Meeting be continued and that said Committee render a report at a future Town Meeting.


Lengthy discussion ensued involving Mr. Fasino, Secretary of the Appropriation Committee; Mr. Paul Moran; Mr. Reilly, Chairman of the Incinerator Building Committee; Mr. Karl Lovell; Mr. Mead; Mr. Herbert Causer; Mr. George Lane of the Board of Selectmen; and Mr. John Lynch.

ARTICLE 3. (By request of the Industrial Development Commission). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer from available funds and/or borrowing for the services of consultants to the Industrial Development Commission, said sum to be expended under written contract approved by the Town Counsel, or take any other action in relation thereto.


MOVED by the Appropriation Committee:


That the sum of $2, 000. 00 be appropriated by transfer from available funds (Excess and Deficiency Account) for the services of consultants to the Industrial Development Commission, said sum to be expended under written contract approved by the Town Counsel.

To see if the Town will vote to raise and appropriate by taxation, transfer from available funds and/or borrowing, the sum of Five Hundred Dollars ($500. 00) for the purpose of preparing complete drawing and detailed specifications for the purchase of a cast bronze plaque to be inserted on the War Memorial honoring the 2nd Nicaraguan Insurrection Veterans of the Town of Weymouth, or take any other action in relation thereto.

ARTICLE 7. (By request of Board of Selectmen and Chief of Fire Department). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer from available funds and/or borrowing, for the purpose of acquiring by gift, purchase or by right of eminent do- main under General Laws, Chapter 79, as amended, a certain parcel of land located on Washington Street adjacent to the present Weymouth Land- ing Fire Station, said parcel of land being owned by Peter Cugini as shown on a plan of land entitled "Fire Station Addition, Weymouth Landing-Plan #1491B" duly filed in the Town Clerk's Office, for the use of the Fire De- partment, or take any other action in relation thereto.


MOVED by the Appropriation Committee:


That the Board of Selectmen be authorized to acquire by gift, purchase, or take by right of Eminent Domain in fee, together with all rights therein, for the use of the Fire Department, a certain parcel of land and the

buildings thereon on Washington Street, adjacent to the present Weymouth Landing Fire Station, containing 6283 square feet of land and shown as Lot B on a plan entitled "Fire Station Addition in Weymouth Landing" dated April 15, 1963, Frank S. Lagrotteria, Town Engineer, and being Plan #1491B duly filed in the Office of the Town Clerk, and that the sum of $29, 100. 00 be appropriated for said purposes by transfer from available funds (Excess and Deficiency Account) and that of the said sum not more than $27, 500. 00 shall be for the acquisition of said parcel and the buildings thereon and not more than $1, 600. 00 shall be for the demolition of build- ings and grading.


Discussion ensued involving Mr. Fasino, Secretary of the Appropri- ation Committee, and Mr. Burgess of the Board of Assessors.


MOVED the following substitute motion by Mr. John Murphy:


That the Board of Selectmen be authorized to acquire by gift, purchase, or take by right of Eminent Domain in fee, together with all rights therein, for the use of the Fire Department, a certain parcel of land and the build- ings thereon on Washington Street, adjacent to the present Weymouth Landing Fire Station, containing 6283 square feet of land and shown as Lot B on a plan entitled "Fire Station Addition in Weymouth Landing" dated April 15, 1963, Frank S. Comes now the question on the substitute motion by Mr. Tirrell.


Vote was taken and the Moderator declared the substitute motion by Mr. Tirrell LOST.


Comes now the question on the substitute motion by Mr. Murphy.


Tellers were appointed and sworn by the Moderator as follows:

Vote and count were taken and the Tellers reported 11 votes in the affirmative and 130 votes in the negative. The Moderator then declared the substitute motion by Mr. Murphy LOST.

ARTICLE 8. (By request of Board of Selectment and Chief of Fire Department). To see if the Town will vote to accept the following as a By-Law:


"Any building, or portion thereof, excepting a school or a church, hereafter erected, reconstructed, or altered, having more than 5000 square feet in any one floor area shall be provided with a complete and approved installation of automatic sprinklers, provided that this By-Law shall not apply to any building of first class construction throughout and in which no combustible materials are kept, stored, sold, manufactured, processed or handled except in such small quantities as are usual for do- mestic use or for use in connection with and as incident to some business other than such keeping, storing, selling, manufacturing, processing or handling of combustibles. Any sprinkler system installed in accordance with this By-Law shall comply with the standards of the National Board of Fire Underwriters and shall meet with the approval of the Building In- spector of the Town. Floor area shall be the area of a floor between the external walls of a building or the area of a floor between the external walls and unpierced fire walls of a building, " or take any other action in relation thereto.


MOVED by the Appropriation Committee:


That the subject matter of this article be referred to a committee for study and to report to the next Special or Annual Town Meeting and that the committee be composed of the Chief of the Fire Department, the Build- ing Inspector, the Town Counsel, and two residents of the Town to be ap- pointed by the Moderator.


Mr. Fasino, Secretary of the Appropriation Committee, spoke on the motion.


MOVED the following amendment by Mr. Nourse:


That following the words "Building Inspector" the words "Water Divi- sion Superintendent of the Department of Public Works" be added.


Mr. Fasino stated that the Appropriation Committee had no objection to the amendment.
