In addition to the foregoing cases, proceedings were instituted against the owners of sixteen (16) parcels of real estate of low value (under One Thousand Dollars ($1,000. 00) , no real estate taxes having been paid on any of these parcels for four (4) years or longer. These cases were dis- posed of as follows: (1) seven (7) cases were redeemed by their owners, resulting in a recovery by the town of unpaid taxes, interest and costs of Six Hundred Twenty and 91/100 Dollars ($620. 91); (2) four (4) parcels were sold at public auction to the highest bidder, resulting in the receipt by the town of Six Hundred Five and 09/100 ($605. 09); (3) on the remaining five (5) parcels, no bid being received at auction, title to the same were fore- closed by the town. Seven (7) other petitions were filed in the Land Court, Boston, to foreclose tax liens on real estate (seven (7) parcels)) of over One Thousand Dollars ($1, 000. 00) in value. As a result, owners redeemed during the proceedings and paid into the Town Treasury the total sum of Three Thousand Nine and 80/100 Dollars ($3, 009. 80).
The sum of Twenty Five Thousand Two Hundred Fifty-Five and 61/100 Dollars ($25, 255. 61) was expended during the year in payment of actions

and claims arising out of the Taking of Real Property by power of Eminent Domain. All Takings were made pursuant to votes of the Town Meetings of the past three or four years, or by vote of the Board of Public Works for sewer or drainage easements.
During the year this office forwarded to the Town Treasurer the sum of Nineteen Thousand Forty-Nine and 54/100 Dollars ($19, 049. 54) received or collected from settlement or prosecution of claims, or actions instituted by this office on behalf of the town.
At the present time there are pending thirty-nine (39) cases by or against the town which represent an increase of approximately 44% over cor- responding period last year.
During the year one hundred fifty-four (154) contracts were presented to this office for approval as provided by the By-Laws of the Town, having a total cost of Two Million Nine Hundred Seventeen Thousand Nine Hundred Ninety-Six and 18/100 Dollars ($2, 917, 996. 18).
Fifteen (15) Orders of Taking of easements in real property by the De- partment of Public Works were prepared, executed and recorded in the Land Court or Registry of Deeds in Dedham. In connection therewith, approxi- mately fifty (50) titles to real estate were examined to determine current ownership and outstanding mortgagees of record.
The 1963 Annual Town Meeting voted under Articles 18 and 19 to in- struct the Board of Selectmen to Take by Power of Eminent Domain, in fee, three (3) parcels of land for the protection of the water supply. Orders of Taking were prepared, executed by the Board of Selectmen and recorded in the Land Court or Registry of Deeds. In accordance with said vote, the town did take from Mr. August J. Ducker seventy-one hundred (7100) square feet of land and the resulting claim for damages was negotiated by my office, and the Board of Selectmen approved an award of One Hundred Dollars ($100. 00); from Mrs. Marie. Rice the town did take twelve thousand two hundred eighty (12, 280) square feet of land and the resulting claim for dam- ages was negotiated and settled, with approbation of the Board of Selectmen, for One Hundred Dollars ($100. 00); from Catherine A. Adler the town did take thirty-four thousand (34, 000) square feet of land and this claim was negotiated by my office and, with the approval of the Board of Selectmen, settled for Six Hundred Dollars ($600. 00).
In connection with the Annual Street Acceptance program, the office prepared twenty-seven (27) Lay Out Reports for execution by the Board of Selectmen, and, as a result of the action of the Annual Town Meeting, did prepare fourteen (14) Orders of Taking, in fee, by Eminent Domain for street layout purposes. These Orders were executed by the Board of Select- men and recorded in the Land Court or Registry of Deeds, within the time provided by law. In connection therewith, the titles to two hundred and forty-seven (247) parcels of real estate were examined to determine cur- rent ownership and mortgagees of record.

During the course of the year various legal services and many written legal opinions were rendered to the Police and Fire Departments, School Department, Department of Public Works, Personnel Board or Officer, Town Treasurer, Department of Public Welfare and Park Commissioners.

In cases involving payment of town funds for any purpose the Honorable members of the Board of Selectmen were consulted and their approval se- cured in all cases.
With reference to tort claims against the town of any nature or descrip- tion due consideration of liability was given and settlement made only when in the best interest of the town.
In conclusion, may I take this opportunity to express my profound appre- ciation to all town officials and employees for the excellent cooperation and assistance extended to me this past year. In particular, I wish to take this opportunity to offer my appreciation to the members of the Board of Select- men for the implicit confidence placed in me and for the sincere and earnest cooperation each and every member extended to me in connection with the performance of my many and varied public duties.
