ARTICLE 2. (At the Request of the Cemetery Committee). To see if the Town will vote to instruct the Cemetery Committee, appointed under Article 39 of the Annual Town Meeting of 1963, to petition the General Court for authority to accept conveyances of real properties of the Elmwood Cem- etery and the Mount Hope Cemetery, and to accept any and all trust funds held by the said cemeteries and to hold and maintain the same for cemetery purposes, subject to all rights and purposes heretofore existing in any burial lot or lots or trust funds; or to take any other action in relation there- to.
ARTICLE 3. (At the Request of the Director of Civilian Defense and School Committee). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer and/or borrowing, or otherwise, for the purchase of a radio communcations system for use in the public school system of the Town in connection with civilian defense, or take any other action in relation thereto.

TOWN OF WEYMOUTH SPECIAL TOWN MEETING MONDAY, JANUARY 14, 1963
Pursuant to Warrant duly issued, the Special Town Meeting of the in- habitants of the Town of Weymouth, represented by their duly elected and qualified Town Meeting Members, was held in the auditorium of the Old Weymouth High School on Monday, January 14, 1963.
The Meeting was called to order at 7:45 o'clock in the evening by the Moderator, Mr. Philip T. Jones.
The Town Clerk, Mr. Harry Christensen, read the Call of the Meeting.
Upon motion duly made, it was
UNANIMOUSLY VOTED: That the reading of the Articles in the Warrant be suspended.
Prayer for Divine Guidance at this Special Town Meeting was offered by the Rev. Dr. William F. Knox, Pastor of the Old South Union Congregational Church, South Weymouth.
Town Meeting Members, not previously sworn, were administered the oath by the Moderator.
The Moderator declared a quorum present, there being 186 members in attendance.
We now continue with consideration of the Articles in the Warrant.
ARTICLE 1. (At the Request of the Incinerator Committee). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer and/or borrowing for the purpose of preparing complete plans, drawings and detailed specification for the construction of an incinerator on the land owned by the Town of Weymouth and located in the vicinity of the present dump site off Wharf Street, or take any action in relation thereto.

That the Town vote to raise and appropriate from tax levy the sum of $54, 450. 00 for the use of the Incinerator Committee appointed under Article 29 of the Annual Town Meeting of 1962 for the purpose of preparing complete plans, drawings and detailed specifications, for the construction of an in- cinerator on the land owned by the Town of Weymouth and located in the vicinity of the present dump site off Wharf Street, shown on Plot Plan, being Figure 2 of Metcalf and Eddy Report to the Town of Weymouth dated Decem- ber 28, 1962.

MOVED the following substitute motion by Mr. G. Lane:
That the Annual Moderator appoint a committee of five, including three present Members, to make a comprehensive study of a Cemetery Depart- ment for the Town of Weymouth, the taking over of certain cemeteries, or- ganizational requirements, costs of management and maintenance and other related items including trusts and other funds and to report at an Annual Town Meeting; and that the sum of $2, 500 be appropriated for the work of this committee which shall submit a complete report to all Town Meeting Members.

The Moderator ruled that no money could be appropriated through this Article and Mr. Lane's motion was amended as follows:
That the Annual Moderator appoint a committee of five, including three present members, to make a comprehensive study of a Cemetery Depart- ment for the Town of Weymouth, the taking over of certain cemeteries, or- ganizational requirements, costs of management and maintenance and other related items including trusts and other funds and to report at an Annual Town Meeting.
Comes now the question on the substitute motion by Mr. G. Lane.
The Moderator ordered a teller count. Tellers were appointed by the Moderator and sworn as follows:

ANNUAL VOTES
ARTICLE 2. (By Direction of Selectmen). To take any action the Town may desire upon the reports of the several Town Boards and Com- mittees and to appoint or change any Committee that the Town may think proper.
ARTICLE 3. (By Direction of Selectmen). To see if the Town will vote to authorize its Treasurer with the approval of the Selectmen, on and after January 1, 1964, to borrow in anticipation of the revenue of the year of 1964.
ARTICLE 4. (By Direction of Selectmen). To see what sum of money the Town will vote from surplus for the use of the Assessors in determin- ing the tax rate for the year 1963 or take any other action in relation thereto.
ARTICLE 5. (By Direction of Selectmen). That the Selectmen be authorized to sell or otherwise dispose of personal property and any real estate of which the Town has possession or title, including all property taken for non-payment of taxes, all such cases of sale to be made by public auction or private sale as the Selectmen may deem for the best in- terest of the Town, and that the Board or Officer in charge of any other Town Department may, with the approval of the Board of Selectmen, sell at public auction or private sale, as the Board of Selectmen may approve, any personal property belonging to said Department which in the opinion of the Officer or Board in charge of the Department is no longer needed by the Town and which in the opinion of the Selectmen is not needed by any other Department, provided that in each case involving real estate,

majorities of the Planning Board, Board of Public Works, and Park Com- missioners respectively vote to concur in the opinion that the property will not be needed for parks, playgrounds or other public use, or take any other action in relation thereto.
ARTICLE 6. (By Direction of Selectmen). To see if the Town will vote to authorize its Board of Selectmen to accept conveyances or mort- gages of any real or personal property belonging to persons receiving relief from the Town, and dispose of said property in the manner they may judge for the Town's best interest and to authorize them to discharge any encumbrances on said property if they consider it for the best in- terest of the Town so to do and to see what sum of money the Town will vote to raise and appropriate for the discharging of such encumbrances.
ARTICLE 7. (On Petition and by Direction of Selectmen). To see if the Town will accept the several reports of the Selectmen laying out as Town ways the following designated private ways and parts of ways or any of them, to wit:
ANNE STREET - From Holbrook Town Line (Route 139), a distance of 0. 25 of a mile, to Abington Town Line.
BACK RIVER ROAD - From River Street 308 feet southerly to dead end. BEECHER STREET - From Seaver Road at Oliver Street to 32 Beecher Street - 500 feet.
CAROLYN ROAD - From Mamie Road 775 feet southerly to Donna Road. CRANCH STREET - From 575 Middle Street to 800 feet east.
DAVID'S ISLAND ROAD - From off Neck Street to 800 feet east. DONNA ROAD - From Carolyn Road to Carolyn Road.
EDISON STREET - From off Narragansett Avenue to dead end. ELMER ROAD - From No. 87 around Circle to No. 217. EMELINE ROAD - From end of accepted way to 200 feet dead end. ERICSON ROAD - From Spring Street 437 feet northeasterly direction to dead end.
FRIEND STREET - From end of accepted way to 200 feet dead end. KLASSON LANE - From Spring Street 433 feet easterly direction to dead end.

and will authorize the Board of Selectmen to acquire by gift or purchase or take by right of eminent domain in fee or otherwise for all purposes of a public street and highway in and over each of said streets as laid out and accepted, and see what sum of money the Town will vote to raise and appropriate for the working of each of the above-named streets, including the acquisition of the fee of any interests above referred to, and for the building of any bridges, drains and conduits or securing easements which may be necessary in connection therewith, and to see whether the Town will authorize the Board of Selectmen to accept deeds of any reservation strips existing in connection with any said streets, or take any other action in relation thereto.
ARTICLE 8. (Request of the Board of Public Works). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer from available funds and/or borrowing, to reconstruct, resurface, widen, straighten, relocate or work Commercial and/or any other streets or any portion of said streets and for building of any bridges, drains and conduits, or securing easements which may be necessary in connection therewith, and to see whether the Town will authorize the Board of Select- men to accept deeds of any reservation strips existing in connection with said street provided the State or County, or both, will appropriate a sum of money to help defray the expenses of such work; and transfer from surplus funds that the Town may have, the County and State share of said cost, the amount of this transfer or reimbursement to be credited to the account from which it came; and will authorize the Board of Selectmen to acquire by gift, purchase, or take by right of eminent domain, in fee or otherwise, for all purposes of a public street and highway in and over said street and such property as may be necessary, or take any other action in relation thereto.
ARTICLE 9. (Request of the Board of Public Works). To see if the Town will vote to raise and appropriate by taxation, transfer from avail- able funds and/or borrowing, the sum of Two Hundred Fifty Thousand Dollars ($250, 000. 00) for the continuation of the Major Highway Program for construction and/or reconstruction of main streets and roads including Broad, Commercial, Winter, Middle and Pleasant Streets, provided that Chapter 90 funds, if any, may be used for this purpose or take any other action in relation thereto.

ARTICLE 10. (Request of the Board of Public Works). To see if the Town will vote to raise and appropriate by taxation, transfer from avail- able funds and/or borrowing, a sum of money for the construction of side- walks and curbing and repairs of existing sidewalks and curbing and any retaining walls necessitated by construction of said sidewalks, under a sidewalk building program to be set up by the Board of Public Works; said money to be under the jurisdiction of the Board of Public Works, or take . any other action in relation thereto.
ARTICLE 11. (Request of the Board of Public Works). To see if the Town will vote to raise and appropriate by taxation, transfer from avail- able funds including sewer assessment funds, and/or borrowing, a sum of money for the construction of particular sewers, or take any other action in relation thereto.
ARTICLE 12. (Request of the Board of Public Works). To see if the Town will vote to raise and appropriate by taxation, transfer from avail- able funds including sewer assessment funds, and/or borrowing, a sum of money for the construction of common sewers, or take any other action in relation thereto.
ARTICLE 13. (Request of the Board of Public Works). To see if the Town will vote to raise and appropriate by taxation, transfer from avail able funds and/or borrowing, a sum of money for Dutch Elm Disease Control, or take any other action in relation thereto.
ARTICLE 14. (Request of the Board of Public Works). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer from available funds and/or borrowing, for drainage improve- ments in the High Street area in accordance with recommendations of Metcalf and Eddy, Engineers, in report to Weymouth Drainage Committee dated March 11, 1957, or take any other action in relation thereto.
ARTICLE 15. (Request of the Board of Public Works). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer from available funds and/or borrowing, for drainage purposes (for stream improvement) from Weymouth Back River to Whitman's Pond consisting of flood-flow-conduit and channel and works at dams, as rec- ommended by Metcalf and Eddy, Engineers, in report to Weymouth Drainage Committee dated March 11, 1957.
That the sum of money hereby appropriated shall be made available only if the State, under General Laws, Chapter 91, will pay a sum of money proportionate to the cost of construction under the provisions of said Chapter, provided further, that such work shall be done by private contract under the direction of the Board of Public Works and/or the State Department of Public Works.
Also, to see if the Town will assume liability in the manner pro- vided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be in- curred by work to be performed by the Department of Public Works of

Massachusetts, for the improvement, development, maintenance and pro- tection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores, and shores along a public beach outside of Boston Harbor, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Board of Selectmen to execute and deliver a bond of indem- nity therefor to the Commonwealth; or take any other action in relation thereto.
