ANNUAL TOWN MEETING MARCH 5, 1962


Pursuant to a Warrant duly issued, the Annual Town Meeting of the in- habitants of the Town of Weymouth represented by their duly elected and qualified Town Meeting Members, was held in the auditorium of the Wey- mouth High School on Monday, March 5, 1962.


The Meeting was called to order at 7:45 o'clock in the evening by the Annual Moderator, Mr. Philip T. Jones.


The Town Clerk, Mr. Harry Christensen, read the Call of the Meeting. There were 208 Town Meeting Members present.


Upon motion duly made, it was


UNANIMOUSLY VOTED: That the reading of the Articles in the War- rant be suspended.


Prayer for Divine Guidance at this Annual Town Meeting was offered by the Rev. Hugh A. Gillis, Pastor of the Congregational Church, East Wey- mouth.


Town Meeting Members, not previously sworn, were administered the oath by the Moderator.


The Moderator declared a quorum present.


The Moderator recognized the presence of a group of students from Wey- mouth High School and from Waltham High School who were present as part of the Student Government Exchange Program sponsored by the State Department of Education.


We now continue with consideration of the Articles in the Warrant.


Upon request by Mr. Lane for unanimous consent to consider Article 37 at this time and there being no objection, the Moderator ruled that Article 37 would be considered at this time.


ARTICLE 37. (By Direction of Board of Selectmen). To see if the Town will vote to name the auditorium in the New Senior High School the Daniel L. O'Donnell Memorial in honor of our late Moderator and authorize the appoint- ment of a committee to plan a fitting dedicatory ceremony at the first town meeting assembly held in this new school or take any other action in relation thereto.

Mr. Lane presented the following resolution:


WHEREAS a man lived a simple, peaceful and dignified life, loved by all his neighbors, greatly respected by his associates and esteemed by his community and people, and


WHEREAS his 57 years of life were more than generously sprinkled with countless good deeds, recorded only in the Book of Judgment that has brought eternal happiness, and


WHEREAS he maintained a deep and continuous devotion to God, a life-long, never-ceasing concern for his Government and a warm hand for all, and


WHEREAS as an educator, attorney, legislator, soldier counsel and civic leader, his deep convictions and courage were a great source of strong ideals and beliefs for all, and


WHEREAS he served as Mr. Moderator for a quarter of a century and did discharge his duties with true understanding and high respect for his fellow officers and townsmen and with deep sincerity and concern for the highest stand- ards of public office, and


WHEREAS he will long be remembered as one of the outstanding personalities of our community, a part of its history and life, and


WHEREAS he has been called and summoned to a just and eternal reward for a most faithful, decent and successful performance on earth,


IT IS THEREBY RESOLVED that the Town Meeting Members, representing all of the citizens of our great community on this 5th Day of March, 1962 hereby resolve their wish to state and record a grateful and everlasting appreciation of the wise leadership, strong counsel and stewardship of Daniel L. O'Donnell during his private civic and public life as friend and gentleman, educator, Moderator, counsel, attorney, soldier and legislator, and


IT IS FURTHER RESOLVED that the people of Weymouth desire to have their deep appreciation and everlasting thanks inscribed upon the records of the Town to the end that all future Town Meetings, Town Officers and citizens may have and hold the same inspiration for public service as Daniel L. O'Donnell.


IT IS THEREFORE MOVED that the name and deeds of our great and honor- able servant, Daniel L. O'Donnell, shall be inscribed in the hearts and minds of all future Town Meetings by naming the North High School Auditorium, the Daniel L. O'Donnell Memorial Auditorium, and


IT IS FURTHER MOVED that the Annual Moderator shall appoint a committee of five Town Meeting Members to plan and provide a fitting memorial to be dedi- cated at the first Town Meeting held in the Daniel L. O'Donnell Memorial Audito- rium and that the sum of $1, 000 shall be raised and appropriated for this high pur- pose. $1,000.00


Upon motion duly made by Mr. Lane, it was


UNANIMOUSLY VOTED: That this resolution be adopted and motion accepted by a standing vote of this Town Meeting.


The Town Meeting stood for a minute of silent tribute to the memory of the late beloved Daniel L. O'Donnell.

ARTICLE 2. (By Direction of Wessagusset Beach Commission). To see if the Town will vote to take by gift, purchase or by eminent domain, for beach parking purposes, a public purpose, certain parcels of land shown as Lots 55 and 56, Bock 3, Sheet 2 of the Atlas of the Town of Weymouth, 1963, on file in the Town Clerk's Office, and located on the Southeasterly side of River Street and owned by Domenica Tocchio, or take any other action in relation thereto.


ARTICLE 3. (By Direction of Wessagussett Beach Commission). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer from available funds, reappropriation and/or transfer of the whole or any portion of the unexpended funds which were appropriated under Article 24, of the Annual Town Meeting of 1961, or borrowing for the purpose of dredging a yacht basin at Wessagussett Beach, or take any other action in relation thereto.


ARTICLE 4. (By request of the Park Commission). To see if the Town will vote to ratify and confirm the action of the Park Commission in naming the existing Idlewell Playground, the "William E. Newell Play- ground" and raise and appropriate by taxation, transfer from available funds and/or borrowing a sum of money for the purchase and erection on said playground of a suitable plaque by the Park Commission, or take any other action in relation thereto.


ARTICLE 5. (By direction of the Selectmen). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer from available funds and/or borrowing for the removal of junk cars from private property, said sum to be expended by the Board of Public Works, or take any other action in relation thereto.

ARTICLE 6. (By direction of Weymouth Redevelopment Authority). To see what sum of money the Town will raise and appropriate by tax- ation, transfer of available funds, or borrowing for the use of the Wey- mouth Redevelopment Authority for the employment of consultants, initial costs and administrative expenses, preparation of plans, making surveys and the like, and for the use of the Weymouth Redevelopment Authority in accordance with the provisions of Chapter 121, as amended, of the General Laws, or take any other action in relation thereto.


ARTICLE 7. (By petition). To see if the Town will reappropriate a sufficient sum of money from the $3100. 00 withheld from the Powers Construction Company Contract to re-pave Witawaumet Road or from the E & D Account. Said work to be done under the direction of the Board of Public Works by private contract, or take any other action in relation thereto.


You are directed to serve this Warrant by posting a true copy thereof, attested by you in writing, in each of two public places in each voting pre- cinct in said Town, seven days at least before the date of holding said meeting.

Pursuant to a Warrant duly issued, the Special Town Meeting of the inhabitants of the Town of Weymouth, represented by their duly elected and qualified Town Meeting Members, was held in the auditorium of the Weymouth High School on Monday, September 16, 1963.


The Meeting was called to order at 7:30 o'clock in the evening by the Annual Moderator, Mr. Philip T. Jones.


The Town Clerk, Mr. Harry Christensen, read the Call of the Meeting.


Upon motion duly made, it was


UNANIMOUSLY VOTED: That the reading of the Articles in the Warrant be suspended.


Prayer for Divine Guidance at this Special Town Meeting was of- fered by Rev. Richard J. Norsworthy, Pastor of the Third Universalist Church, North Weymouth.


Town Meeting Members, not previously sworn, were administered the oath by the Moderator.


There were 176 Town Meeting Members present.


The presence of a quorum being doubted Tellers were appointed and sworn by the Moderator as follows:

3rd Division Mr. Hollis


Count was made and the Tellers reported 141 Town Meeting Members present at this time. The Moderator then declared that 132 being required for a quorum and 141 being present that a quorum was present.


Mr. Lane reported on the present status of the Laban Pratt fund in relation to the South Shore Hospital.

That the Town raise and appropriate the sum of $1, 356, 000. 00 for the construction of a municipal incinerator on Town owned land off Wharf Street shown on a plan entitled, "Plan of Incinerator Location-Town of Weymouth, " dated April 25, 1963, number 1490B duly filed in the Town Clerk's office, said funds to be expended under the direction of the Com- mittee appointed under Article 29 of the 1962 Annual Town Meeting, and to meet said appropriation, the sum of $3, 665. 54 shall be reappropriated from funds previously appropriated and available under Article 42 of the Annual Town Meeting of March, 1957 for the Nash School construction; $419. 84 shall be reappropriated from funds previously appropriated and available under Article 16 of the Annual Town Meeting for the Public Works Building Construction; and the sum of $51, 914. 62 shall be transferred from available funds (Excess and Deficiency Account) and the Treasurer, with the approval of the Board of Selectmen, is hereby authorized to bor- row $1, 300, 000. 00 and to issue bonds or notes under General Laws, Chap- ter 44, Sec. 7 (4A), payable in not more than 20 years from their dates.


Lengthy discussion ensued involving several Town Meeting Members and Officials of the Town.


Comes now the question on the motion by the Appropriation Committee. The Moderator ordered a Teller count. Vote and count were taken and the Tellers reported 159 votes in the affirmative and 1 vote in the nega- tive. There being more than the required two-thirds vote in the affirma- tive the Moderator declared the motion by the Appropriation Committee

The Moderator requested Town Counsel Gaughen for an opinion as to the legality of the substitute motion by Mr. Lane. Town Counsel Gaughen stated that in his opinion funds could not be appropriated for the purpose set forth in the Article. The Moderator then ruled that the substitute mo- tion by Mr. Lane was out of order.
