15. By making the following additions to the Schedule of Heights and Area Regulations, attached to and made a part of the Zoning By-Law, per- taining to the Residence C-1 District:


Residence C-1, Height Limitation: 75 feet.

See particularly the requirements for Parking and Landscaping and Recreation Area in Residence Districts C, C-1 and D."


17. By adding to "n" in the Schedule of Heights and Area Regula- tions" the following sentence "In Business A districts adjacent to Residence C-1 Districts, buildings used exclusively for residential purposes may rise to 75 feet." so that said "n", as amended, will read as follows:


"Except that where a particular business district has a maximum dimension of less than 500 feet and is bounded on all sides by a Residence A and/or Residence B district, the height limitation shall be 40 feet and 3 stories. In Business A districts adjacent to Residence C-1 districts, build- ings used exclusively for residential purposes may rise to 75 feet."

1. Southwesterly of Massachusetts Avenue, from Boulevard Road to Whittemore Street, the area between the present Business A and B Dis- tricts, and a line 300 ft. southwesterly of, parallel to and concentric with, the southwesterly side line of Massachusetts Avenue.


2. Northeasterly of Massachusetts Avenue, from the northwesterly side of the Industrial District at Sunapee Road to Broadway near Franklin Street, the area between the present Business A and Residence C Districts and a line 300 ft. northeasterly of, parallel to and concentric with, the north- easterly side line of Massachusetts Avenue.


3. Southwesterly of Massachusetts Avenue, from Academy Street to Davis Road, the area between the present Business A and Residence C Districts and a line 300 ft. southwesterly of, parallel to and concentric with, the southwesterly side line of Massachusetts Avenue and to include the present Residence A District east and west of Appleton Street and excluding the School property known as the Cutter School, between Robbins Road and School Street.


There being no further business under Article 71, the Moderator declared it disposed of.

ADJOURNED ANNUAL TOWN MEETING - MARCH 26, 1962


Pursuant to the vote of adjournment of March 21, 1962, and written notices sent by mail by the Town Clerk, the town meeting members met in the Town Hall on Monday evening March 26, 1962, to act upon the remaining articles set forth in the Warrant for the Annual Town Meeting.


Certificates were filed with the Town Clerk by the Chairman and Clerk of Precincts 2, 9 and 11 relative to the meeting held on this date and of the elections to fill town meeting vacancies until the next annual election, as follows:


Precinct 2 - Robert E. Burke, 96 Orvis Circle, to fill the vacancy arising from the removal from the precinct of Mildred E. Del Gaizo, whose term was to expire in 1963.


Precinct 9 - Ethel Y. Blackwood, 96 Columbia Road, to fill the vacancy arising from the resignation of John N. Loud, whose term was to expire in 1965.

Precinct 11 - Daniel C. Whitney, 16 Fabyan Street, to fill the vacancy arising from the resignation of Philip G. Whitney, whose term was to expire in 1963.


Lists of the duly qualified town meeting members were used at the entrances of the meeting place and were in charge of Mary A. Farrington and Charlotte E. Emerson. The lists contained the names of two hundred forty-three (243) elected town meeting members and seven (7) town meeting members at large qualified to participate in and vote in town meetings in Arlington.


The check lists filed with the Town Clerk at the close of the meeting by the checkers showed that two hundred thirteen (213) elected town meeting members and seven (7) town meeting members at large (88% of total 250) attended the meeting.


The Moderator, Lawrence E. Corcoran, declaring a quorum present, called the meeting to order at 8:05 o'clock P.M.


The meeting opened with the singing of the "Star Spangled Banner" by the Assembly, accompanied by Mr. Anton Kovar, pianist, and Mr. Richard Laman, trumpeter, both of the School Department.


The invocation was given by Rev. Guy Meyer of the First Universalist Church.


Town meeting members who had not previously been sworn were there- upon sworn by the Moderator.


On motion of Selectman Homer, duly seconded, it was


VOTED: That if all the business of the meeting as set forth in the Warrant is not disposed of at this session, when the meeting adjourns, it adjourn to Wednesday evening, March 28, 1962, at 8:00 o'clock.


A motion of David A. Hunt, town meeting member from Precinct 14, duly seconded, that Article 31, Budget Item 40, be reconsidered by the town meeting, was declared lost by the moderator on a roll call vote, 117 in the affirmative and 88 in the negative, lacking the required two-thirds vote.


Article 72. (Amendment of Zoning By-Laws Re: Fallout or Blast Shelters.)


Chairman Murdena A. Campbell reported for the Planning Board and on her motion, duly made and seconded, it was


VOTED: That the report be received.


Thereupon, on the motion of Miss Campbell, duly made and seconded, it was


VOTED: (Unanimously) That the Town amend the Zoning By-Laws to permit the construction of underground fallout or blast shelters within required yard areas by adding Section 21a to the Zoning By-Laws.


21a - Fallout or Blast Shelters


1. The construction of a fallout or blast shelter of a design approved by the local Director of Civil Defense and the local Building Inspector shall not be deemed to be in violation of the yard regulations provided such shelter is completely below the finished grade of the adjoining land after such construc- tion and is covered by earth to a depth of not less than two feet, except that

an entrance and/or exit way may be substantially flush with the ground and ventilating pipes and covers may protrude above the ground if they are no greater size and height than is reasonably required for the purpose.

Article 73. ZONING (Area in vicinity of Summer Street, Victoria Road and Edgehill Road.)

There being no further business under Article 73, the Moderator declared it disposed of.


Article 74. ZONING (Area in vicinity of Edith and Burch Streets.)

NORTHWESTERLY by land now or formerly of Cullinane and Meyer as shown on a plan hereinafter mentioned, 193 feet;


NORTHEASTERLY by land now or formerly of Ronayne, as shown on Said plan, 145 feet; and


SOUTHEASTERLY by land of the Boston & Maine R.R. as shown on said plan, 197 feet.

The invocation was given by Rev. Paul McLaughlin, curate of St. Agnes' Church.

Ashton of the Planning Board has asked that the record show that he neither voted on nor participated in the Planning Board's discussion of the article because of a possible conflict of interest. On the motion of Miss Campbell, duly made and seconded, it was
