ARTICLE 30. ARTICLE 37. To see if the Town will vote to raise and appro- priate the sum of $1,860.00 or any other sum, to extend the 6- inch water main on South Main Street a distance of 135 feet more or less with a 12-inch main which will ultimately become

a part of a main extension to serve the south end of town, and will be made under the provisions of Article 27 approved at the Annual Town Meeting on March 14, 1959 providing for better- ment assessments on such extensions, and that betterment assess- ments be levied in accordance with the provisions of Chapter 40 of the General Laws, Sections 42G, 42H, and 42I, or take any other action relative thereto.

(2) A building, structure or establishment, the major object of which shall be to store and display goods for sale at retail on the premises or to furnish a service or services intended primarily for the residents of the vicinity and shall be limited to the following: retail stores, barber and beauty shops, restaurant, luncheonette, tearoom, general business offices, professional offices, bank and post office.

ARTICLE 44. To see if the Town will vote to amend the Zon- ing By-Laws by striking out Paragraph 7 of Section 4 and adding a new Paragraph 7 as follows:


7. SIGNS


A. Bulletin boards or signs necessary to uses specified in paragraphs 3 and 5 of this section or customarily used therewith.


B. Real estate sign of not over 6 square feet in area advertis- ing the sale of real estate in a subdivision or real estate development under written annual permit from the build- ing inspector.


C. A permanent sign of not over 18 inches by 24 inches in size, approved by the building inspector, identifying only by name an existing subdivision or real estate develop- ment or area and intended to replace the sign of subpara- graph B above after all lots in the subdivision have been sold.


D. General Provisions:


1. Signs under subparagraphs B and C above are to be located within the subdivision or if located outside the original subdivision they must be within 25 feet of the side lines of the nearest outlet street from said subdivision at its intersection with any main thorough- fare or way.


2. If a subdivision has nearby outlets to more than one main thoroughfare or more than one outlet from streets within the subdivision into a main thorough- fare, more than one sign may be permitted or approved by the building inspector under subparagraphs B and C above.


3. No permit or approval shall be granted for a sign or signs under subparagraphs B and C above to be located on premises not owned by the applicant for permit or approval unless written permission from the owner of record of the premises is furnished to the building

inspector or adequate proof of other legal right to such use of the premises.


4. Signs under subparagraphs A, B, and C above shall be hung a minimum of 8 feet from the ground level to the bottom of the sign if said sign is located within 25 feet of the side line of any public or private way. This article was amended in the following respect:

8. A. The office or studio of a physician or surgeon, dentist, artist, musician, lawyer, architect, teacher, insurance broker, real estate broker, or other similar professional person residing on the premises.


B. A sign on the premises of 8A above no larger than 18 inches by 24 inches in size stating only the name and/or profession of the resident.

ARTICLE 47. To see if the Town will vote to rescind its action under Article 2 of the Warrant for the Special Town Meeting of June 10, 1954 regarding compromise of a dispute over title to "The Green" at Tinkham Road and Main Street, Wilbraham.

ARTICLE 48. To see if the Town will vote to authorize the Board of Selectmen to take in fee by eminent domain for park and recreation purposes and/or for the purpose of possible future public buildings and to confirm and clear the present title of the Town in and to a certain parcel of land at the Northeasterly corner of Main Street and Tinkham Road in Wilbraham, being Parcel 1 as described in and subject to restrictions and reservations as set forth in a document entitled "The Green" Tinkham Road, Wilbraham, Massachusetts, dated February 9, 1963 and filed with the Town Clerk.

ARTICLE 49. To see if the Town will vote to convey Parcel 2 as described in the above-mentioned document entitled "The Green" to the present record Owners in the Hampden County Registry of Deeds of the land lying Northerly of the Old Road, as shown on said plan, adjoining said Parcel 2, without payment therefor.

ARTICLE 50. To see if the Town will vote to discontinue as a town way in its entirety the road along the Northerly line of Parcel 1 and 2 as described in the above-mentioned document entitled "The Green."

ARTICLE 51. To see if the Town will authorize the Board of Selectmen, in their discretion, to discontinue action of the Town to register its title to "The Green" so-called as set forth in petition filed in the Land Court as Case No. 18738, or as to any portion thereof, or take any other action relative thereto.

ARTICLE 52. To see if the Town will vote to adopt an ordi- nance as follows, or take any other action relative thereto:


TRANSIENT VENDORS, HAWKERS AND PEDLERS


No transient vendor, hawker or pedler as defined in Chapter 101 of the General Laws shall sell or barter, or carry for sale or barter, or expose therefor any goods, wares, or merchandise in the Town of Wilbraham on any day or days of Special Town Celebration so proclaimed by the Board of Selectmen unless a permit has been issued by said Board or its delegate therefor when deemed to be for the good of said Celebration; and under such terms and conditions and for such a fee as said Board or its dele- gate shall determine.


Violations of this ordinance shall be punished by a fine not exceeding $20 for each violation thereof.


Such ordinance shall become effective immediately.

ARTICLE 53. To see if the Town will vote to authorize the Selectmen to sell at public auction, after first giving notice of the time and place of sale by posting such notice of sale in some con- venient and public place in the Town 14 days at least before the sale, property taken by the Town under tax title procedure, pro- vided the Selectmen, or whomsoever they authorize to hold such public auction, may reject any bid which they deem inadequate, or take any other action relative thereto.

ARTICLE 54. To see if the Town will authorize the Selectmen to institute or defend suits and employ counsel for the purpose of protecting the interests of the Town, or take any other action relative thereto.

ARTICLE 55. To see if the Town will vote to authorize the Town Treasurer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1963, and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws.

ARTICLE 56. To transact such other business as may properly come before said meeting.


Voted unanimously that all appropriations made at this meet- ing unless otherwise provided for, be raised by assessment against the polls, personal properties and real estate of the Town.


At this point Roger T. Hintze paid tribute to Mr. Richard L. Danforth who was serving at his last town meeting as Selectman of Wilbraham, for his long and dedicated service to the Town, as a member of the finance Committee for many years, as a member of various committees, and as Selectman for the past six years.


Voted unanimously to adjourn the meeting at 1:15 a.m., March 19, 1963 until 8:30 a.m., Saturday, March 23, 1963 at Memorial School when the Annual Town Elections will be held.

Report of Special Town Meeting JUNE 18, 1963


In accordance with the Warrant as posted, the voters of the Town assembled in the Hampden-Wilbraham Regional High School Auditorium.


The meeting was called to order by the Moderator, Mr. Ernest W. Furnans, Jr. at 8 p.m. with more than 20 voters present which constituted a quorum.


ARTICLE 1. To see if the Town will vote to authorize the Hampden-Wilbraham Regional School District Committee to transfer $25,000.00 or any other sum, from the District Surplus Revenue Account to the District Construction Budget for work- ing plans and specifications and any surplus that may be left therefrom to be used in the construction of the addition to Minne- chaug Regional High School, or take any other action relative thereto.


Voted unanimously.


At this point the following tellers were appointed and sworn in by the Moderator: George Canney, William J. Miller, Francis H. Scott Smith and Mary Strycharz.


ARTICLE 2. To see if the Town will vote to authorize the Selectmen to convey in the name of and on behalf of the Town

to Frank P. Nowak and Anna C. Nowak a certain parcel of land for the sum of $500 or any other sum, land situated Southerly of River Road and Westerly of Bridge Street as further bounded and described in "Exhibit A" dated June 4, 1963 and filed with the Town Clerk, or take any other other action relative thereto. Said land is a small part of the Pines Elementary School land and is no longer needed for school purposes.


Voted unanimously.


ARTICLE 3. To see if the Town will vote to authorize the Board of Selectmen to convey to Elsie M. Samble without any payment therefor, all of its right, title and interest, if any, in land on the Westerly side of Glendale Road lying Northerly of the Northerly line of the Glendale Cemetery as shown on a plan thereof dated February, 1963, revised April, 1963 by C. E. An- derson Associates, numbered 1463-01 and recorded in the Hamp- den County Registry of Deeds, or take any other action relative thereto.


Said conveyance being a part of a compromise settlement re- garding the boundaries of said cemetery.


Voted unanimously.


ARTICLE 4. To see whether the Town will vote to accept the provisions of Chapter 40 of the General Laws, Section 8C, authorizing the Board of Selectmen to appoint a conservation commission; and the provisions of said Chapter 40, Section 5, clause (51), providing for the operation and maintenance of said conservation commission; and the Board of Selectmen are hereby directed, within thirty days of the acceptance of this article, by vote of the town meeting, to appoint a conservation commission composed of seven members, or take any other action relative thereto.

ARTICLE 5. To see if the Town will vote to transfer from available funds in the Treasury the sum of $40.37 representing a previous year's bill, or take any other action relative thereto.
