ARTICLE 43. To see if the Town will vote to adopt as a by- law the town employee personnel plan recommended by the Per- sonnel Study Committee. Said plan is entitled "Personnel Pro- gram," is dated February 10, 1964, and is filed with the Town Clerk, and covers town positions other than those filled by popu- lar election and those under the direction and control of the school committee, or take any other action relative thereto.

ARTICLE 44. To see if the Town will vote to amend the By- Laws by adding the following By Law thereto:


ARTICLE 3A PERSONNEL BOARD


SECTION 1. There shall be a Personnel Board of five members, not more than two of which shall be Finance Committee mem- bers, to be appointed by the Board of Selectmen after each annual

town meeting for a term of such duration that the term of at least one member will expire each year.


SECTION 2. Said Board shall administer all matters pertaining to personnel plans and other such provisions of or for the By- Laws regarding personnel classification, fringe benefits, and com- pensation plans, and shall hear and determine all questions aris- ing under such plans.


SECTION 3. Said Board shall periodically study and review any plans as referred to in Section 2 and shall advise and recommend to the Town as to any needed plans or amendments to existing Town adopted plans.


Said study shall include requests for recommendations from all Town department heads and a thorough study and review of any such recommendations shall be made.


(Such personnel plans under the General Laws are not appli- cable to positions filled by popular election or those under the direction and control of the School Committee.)

ARTICLE 45. To see if the Town will vote to amend the By- Laws by adding the following By Law thereto:


ARTICLE 3A PERSONNEL BOARD


SECTION 1. The Financial Committee of the Town shall serve as a Personnel Board for the Town.

ARTICLE 47. To see if the Town will vote to accept General Laws Chapter 39, Section 23 which provides that the election of Town officers shall take place at any time within 7 days before or after the Annual Town Meeting held for the transaction of other business. The time and place of holding such election and vote shall be stated in the warrant for the Annual Town Meet- ing, and such election and vote shall be deemed parts of the An- nual Town Meeting, or take any other action relative thereto.

ARTICLE 48. To see if the Town will authorize the Selectmen to institute or defend suits and employ counsel for the purpose of protecting the interests of the Town, or take any other action relative thereto.

ARTICLE 49. To see if the Town will vote to authorize the Town Treasurer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1964, and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws.

ARTICLE 50. To transact such other business as may properly come before said meeting.


Voted unanimously that all appropriations made at this meet- ing unless otherwise provided for, be raised by assessment against the personal properties and real estate of the Town. Voted unanimously to adjourn the meeting at 6:30 p.m., March 14, 1964 until 8:30 a.m., Saturday, March 21, 1964 at Memorial School when the Annual Town Elections will be held, polls closing at 6:30 p.m.

Report of Special Town Meeting JUNE 13, 1964


In accordance with the Warrant as posted, the voters of the Town assembled in the Hampden-Wilbraham Regional High School auditorium.

The meeting was called to order by the Moderator, Mr. Ernest W. Furnans, Jr. at 10 a.m. It was noted that more than twenty persons were present; therefore a quorum.


The following tellers were appointed and sworn in by the Moderator: Charles M. Merrick, Head Teller; William J. Miller, G. Walter Johnson, Henry P. Baush, S. William Whyte, and Thaddeus Wozniak.


ARTICLE 1. To see if the Town will vote to appropriate and transfer from unappropriated available funds in the Treasury the sum of $2,500.00, or any other sum, to make an engineering sur- vey and study relative to the sewer needs in the area of North Wilbraham for the purpose of disposing of sewage in conformity with the requirements of the State Department of Public Health, or take any other action relative thereto.


Voted unanimously.


ARTICLE 2. To see if the Town will vote to appropriate and transfer from unappropriated available funds in the Treasury the sum of $5,500.00, or any other sum, for the purchase of 41/2 acres of land, more or less, on the west side of Main Street and known as the Bruuer Pond Property, described in deed dated June 29, 1943 from Aletta W. Steele to Frank S. Williamson and Edith H. Williamson and recorded in the Hampden County Registry of Deeds Book 1762, Page 459; excepting therefrom land described in deed dated October 29, 1954 from Frank S. Williamson and Edith H. Williamson to Robert N. Williams and recorded in the Hampden County Registry of Deeds Book 2346, Page 526. Any funds which may be reimbursed to the Conservation Commission by the Commonwealth shall be credited to the Conservation Fund for general conservation purposes and uses. Said land to be held by the Conservation Commission for conservation purposes, or take any other action relative thereto.

Report of Special Town Meeting OCTOBER 21, 1964


In accordance with the Warrant as posted, the voters of the Town assembled in the Wilbraham Memorial School Auditorium.


The meeting was called to order by Town Clerk, Doris G. Cochran at 8 p.m. with more than 20 persons present which con- stituted a quorum. A short recess was taken until people who were at the door were seated.


The Town Clerk announced that the first order of business would be to elect a temporary Moderator to preside over this meeting only. At this point the following tellers appointed by the Town Committees were sworn in by the Town Clerk: Henry P. Baush, Thomas F. Gallagher, Harold K. Jones, and E. Donald Riddle.


Mr. Jesse L. Rice, Chairman of the Board of Selectmen, asked to be recognized. He spoke as follows: "On behalf of the Board of Selectmen and the residents of the Town of Wilbraham I wish at this time to recognize a man who has done a great deal for the Town of Wilbraham and who has acted as Moderator since 1957.

Mr. Ernest W. Furnans has done an outstanding job as a Mod- erator. We are sorry that he had to relinquish this position, but knowing what has transpired, we hope that Mr. Furnans will be able to be with us for a long while and I know he will still be a great help to us. We wish you, Mr. Furnans, a great many years of success and happiness in your endeavors here in Wilbraham."


The Clerk called for nominations for Moderator. Mr. Furnans nominated Kenneth R. Bunten, Jr. with a few words of explana- tion as to why he had chosen this individual. Other nominations were called for, but there were none. The motion was made and seconded that nominations be closed. Unanimous vote.


The vote was taken by a show of cards for Mr. Kenneth R. Bunten, Jr. as temporary Moderator. He was elected with 172 votes cast in favor, none opposed. Mr. Bunten was sworn in by the Clerk, and the articles in the Warrant were taken up.


ARTICLE 1. WHEREAS, in 1961 the Town voted to author- ize the Board of Selectmen to take by eminent domain or acquire by purchase the Spec Pond Recreational Area, and appropriated the appraised value sum of $12,000.00 therefor; and


WHEREAS, said land could not be purchased at an agreed price and it was taken by eminent domain in 1961; and


WHEREAS, a law suit was entered against the Town for assessment of damages for the value of the land taken, and


WHEREAS, said suit came on for trial in September of 1964 and a compromise settlement has been reached.


NOW therefore this article is presented to see if the Town will vote to appropriate and transfer from available funds in the Treasury the sum of $11,439.80, or any other sum, to pay the balance, not previously authorized, on said compromise settle- ment of the Spec Pond Recreational Area assessment of damages law suit, together with fees for special legal trial counsel and expert real estate appraiser required in the defense of said suit, or take any other action relative thereto.


Voted unanimously.


ARTICLE 2. To see if the Town will vote to accept the provi- sions of Chapter 40, Sections 42a through 42f inclusive, regarding collection of water rates, charges, and interest thereon, or take any other action relative thereto.
