ARTICLE 26. To see if the Town will vote to accept as a public way the private way now known as Fox Hill Drive, as laid out by the Selectmen on February 16, 1965 and authorize the Board of Selectmen to take said way by eminent domain, no appropria- tion being necessary therefor.

ARTICLE 27. To see if the Town will vote to authorize the Selectmen to make application to the Community Facilities Ad- ministration of the Housing and Home Finance Agency under the terms of Public Law 560 for an interest free loan to finance a sewer study for the Town, and that the Selectmen be author- ized to enter into an agreement with the Housing and Home Finance Agency for said loan. Sirois, Inc. in the Town of Wilbraham, Hampden County, Massachusetts with 577', more or less, front- age on the northerly side of River Road bounded northerly and easterly by Western Mass. Electric Co. and westerly by other land of R. L. Sirois, Inc. from Industrial District to Multiple Dwelling District, or take any other action relative thereto.

ARTICLE 32. To see if the Town will vote to raise and appro- priate the sum of $5,870.00, or any other sum, to purchase addressograph equipment for billing use in the Town Offices, or take any other action relative thereto.

ARTICLE 33. To see if the Town will vote to rescind its action on Article 2 of the Special Town Meeting of June 18, 1963 authorizing the Selectmen to convey on behalf of the Town to Frank P. Nowak and Anna C. Nowak a certain parcel of land situated southerly of River Road and westerly of Bridge Street, as the Nowaks no longer wish to purchase this piece of property, or take any other action relative thereto.

ARTICLE 34. Whereas Charles J. Labody and Stella A. Labody by deed dated September 21, 1963 conveyed a certain parcel of land lying 1925 feet, more or less, easterly of Stony Hill Road in Wilbraham, Hampden County, Massachusetts as further bounded and described in said deed, for conservation or other municipal purposes.


Whereas this land was conveyed to the Town to help the Town in its case in opposition to the electric transmission line

and is no longer needed for this purpose or for conservation pur- poses.


Therefore it is now desirable:


To see if the Town will vote to accept the deed from Labodys and to authorize the Board of Selectmen to convey the land back to the said Labodys with the thanks of the Town and without cost to the said Labodys.

ARTICLE 35. To see if the Town will vote to appropriate the sum of $30,000.00, or any other sum, for a Reserve Fund; $20,000.00 to be raised by taxation and $10,000.00 to be trans- ferred from the Overlay Surplus Account, or take any other action relative thereto.

ARTICLE 36. To see if the Town will vote to raise and appro priate a sum of money for the purpose of increasing the Stabiliza- tion Fund, or take any other action relative thereto.

ARTICLE 37. To see if the Town will vote to amend the By- Laws entitled "Personnel Program" dated February 10, 1964 and filed with the Town Clerk, as set forth in "Amendments to the Personnel Program" dated February 10, 1965 and filed with the Town Clerk, or take any other action relative thereto.

ARTICLE 38. To see if the Town will vote to accept the provi- sions of Chapter 403 of the Acts of 1936 of the Commonwealth entitled "An Act Providing for the Inclusion of Additional Public Employees within the Provisions of the Workmen's Compensa- tion Law" and to cover all employees of the Town under said Workmen's Compensation Law except members of the police or fire force, regardless of the nature of their work, or take any other action relative thereto.

ARTICLE 39. To see if the Town will vote to provide for pay- ments under the Workmen's Compensation Law by the purchase of insurance, or take any other action relative thereto.

ARTICLE 40. To see if the Town will vote to appropriate and transfer from unappropriated available funds in the treasury the sum of $6,000.00, or any other sum, to pay the garbage collector, with receipts from garbage collection subscribers to be restored as received by the Town Collector to unappropriated available funds in the treasury, or take any other action relative thereto.

ARTICLE 41. To see if the Town will vote to raise and appro- priate or transfer from available funds in the treasury the sum of $227.60 representing prior year's bills for Veterans' Services, or take any other action relative thereto.

ARTICLE 42. To see if the Town will vote to authorize the Selectmen to appoint a Town Building Survey Committee for the purpose of making a study of the need for future Town buildings such as town hall, town library, and any other needed town build- ings; and a study of possible sites for such buildings.


Said committee shall hold a public hearing at least 30 days prior to the next Annual Town Meeting and submit to such meeting its recommendations which shall contain at least two possible sites for each of the buildings it may recommend as being needed.


Said committee shall consist of one Selectman, one member of the Planning Board, and not less than three other persons, or take any other action relative thereto.

ARTICLE 43. To see if the Town will vote to authorize the Board of Selectmen to purchase a bond to dissolve the attachment of the real estate in the lawsuit against certain Planning Board members as individuals, when such action may in their discretion become necessary, or take any other action relative thereto.

ARTICLE 44. To see if the Town will vote to accept various deeds of easement rights to the Town recorded at the Hampden County Registry of Deeds since the date of the last Annual Town Meeting, or take any other action relative thereto.

To see if the Town will vote to authorize the Town Treasurer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1965, and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a period of less than one year in accord- ance with Section 17, Chapter 44 of the General Laws.

ARTICLE 48. To transact such other business as may properly come before said meeting.


Voted unanimously that all appropriations made at this meeting unless otherwise provided for, be raised by assess- ment against the personal property and real estate of the Town. Voted unanimously to adjourn the meeting at 11:45 p.m., March 15, 1965 until 8:30 a.m., Saturday, March 20, 1965 at Memorial School when the Annual Town Elec- tions will be held, polls closing at 6:30 p.m.

Report of Special Town Meeting SEPTEMBER 20, 1965


In accordance with the Warrant as posted, the voters of the Town assembled at the Minnechaug Regional High School, Wil- braham at eight o'clock in the evening.


The meeting was called to order by Moderator Kenneth R. Bunten, Jr. and a quorum declared present. A recess was called until people in the hall could be seated. Meeting reopened at 8:35 p.m.


The following tellers were appointed and sworn in by the Moderator: William J. Miller, head teller; Charles L. Merrick, Roger W. Folsom, Thomas F. Gallagher, Henry P. Bausch, and John C. Howard.

ARTICLE 1. To see if the Town will vote to appropriate and transfer from available funds in the treasury the sum of $48.75 representing prior year's bills for Veterans' Services, or take any other action relative thereto.


Voted unanimously.


ARTICLE 2. To see if the Town will vote to authorize the Board of Selectmen to take by eminent domain, land for the loca- tion, relocation, alteration and construction of Soule Road from Stony Hill Road running easterly to Main Street, or take any other action relative thereto.


Voted by more than two thirds majority required.


ARTICLE 3. To see if the Town will vote to authorize the Board of Selectmen to appoint a chain of command for the Civil Defense, or take any other action relative thereto.


Voted unanimously to take no action on this Article.


ARTICLE 4. To see if the Town will vote to appropriate and transfer from available funds in the treasury the sum of $6,100.00 representing insurance premiums from October 1, 1965 to De- cember 31, 1965 for a plan of Group Life Insurance, Group Acci- dental Death and Dismemberment Insurance, and Group Gen- eral or Blanket Hospital, Surgical and Medical Insurance for certain Town employees as authorized under Chapter 32B of the General Laws and voted for at the election of March 20, 1965, or take any other action relative thereto.

ARTICLE 5. To see if the Town will vote to amend the Agree' ment between the Towns of Wilbraham and Hampden, Massa- chusetts, with respect to the Formation of a Regional School District so as to include grades seven through twelve in said Regional School District. The details of the amendments being contained in a document entitled "Form of Proposed Amend- ments to the Agreement Between the Towns of Wilbraham and Hampden, Massachusetts, With Respect to the Formation of a Regional School District As Adopted By Each of Said Towns on October 22, 1956" as filed with the Wilbraham Board of Selectmen on February 12, 1965 and with the Wilbraham Town Clerk, or take any other action relative thereto.

ARTICLE 6. (Conditional upon the outcome of the vote on regionalization of a junior high school, Article 5.)


To see if the Town will vote to appropriate and transfer from unappropriated available funds in the treasury the following sum for a Wilbraham Junior High School for architect's fees, preliminary plans and studies, test borings, and topography maps, for the total sum of $25,500.00, or any other sum;


And to authorize the Wilbraham Junior High School Building Committee to employ an architect and contract for the above items, or take any other action relative thereto.

ARTICLE 7. To see if the Town will vote to authorize the Board of Selectmen to take by eminent domain or acquire by purchase, land of Elizabeth C. P. Bacon, on the Easterly side of Stony Hill Road, as set forth and described in Exhibit A, dated September 8, 1965 and entitled "Property of Elizabeth C. P. Bacon for School Purposes," and filed with the Town Clerk, and to appropriate the sum of $19,500.00, or any other sum, therefor; and that to meet said appropriation the sum of $508.04 be trans- ferred from the Pines School Addition account; $14,504.64 be transferred from the Mile Tree School Building account; and $4,487.32, or any other sum be transferred from unappropriated available funds in the treasury, or take any other action relative thereto.

Voted unanimously at 11:45 p.m., on a motion duly made and seconded, to adjourn this meeting until September 21, 1965 at 8:00 p.m. at Minnechaug Regional High School.


The adjourned session of the Special Town Meeting of Sep- tember 20, 1965 was called to order by Moderator Kenneth R. Bunten, Jr. at 8:00 p.m. and a quorum declared present. Gordon R. Long replaced William J. Miller, and was duly sworn by Moderator. Charles L. Merrick became head teller.


ARTICLE 8. To see if the Town will vote to authorize the Board of Selectmen to take by eminent domain, at an agreed price or acquire by purchase, the following described parcels of land for the purpose of a Town dump and for use thereafter as a Town yard for the purposes of the Highway Department and/or other departments; and appropriate and transfer from available funds in the treasury the following sums:


a. Land in Wilbraham of Edward P. Lindsay of Wilbraham

conveyed to him by deed dated July 28, 1960 recorded in the Hampden County Registry of Deeds Book 2758, Page 16 and by deed dated September 14, 1959 so recorded Book 2701, Page 280 together with all of said Lindsay's rights of access to said land, to which deeds reference may be had for a more particular description.


For the sum of $8,500.00, or any other sum.


b. Land in Wilbraham of Francis O. Bready and Isabelle M. Bready of Palmer, and Edwin M. Bready and Ruth H. Bready, of Wilbraham as set forth and described in a lease between said Breadys and the Town of Wilbraham dated June 12, 1964. Said land shall include parcels designated in said lease as Parcels #1 and #3 and the right of way designated as "50' Wide Right of Way" all as shown on a plan of land entitled "Board of Select- men, Town of Wilbraham, Plan of Property of Vicinity of Town Dump, June 1964 by C. E. Anderson Associates, Plan #1545- 01." Reference may be had to said lease for a more particular description.


For the sum of $3,080.00, or any other sum.


All of the land described in a. and b. above lies Easterly of Railroad Avenue; and Northerly of Boston Road.

ARTICLE 9. To see if the Town will vote to see if there is a need in the Town of Wilbraham for a Housing Authority under General Laws Chapter 121, Section 26K for the provision of housing for families or elderly persons of low income, or take any other action relative thereto.

To see if the Town will vote to amend the zon- ing of the land of Nicholas C. and Stefania Moroz in the Town of Wilbraham, Hampden County, Massachusetts located on the Southwesterly corner of Boston Road and Crane Hill Road bounded Northerly by Boston Road 569.20 feet more or less; Easterly by Crane Hill Road 260.84 feet more or less; Southerly by land now or formerly of Boston and Albany Railroad 586.60 feet more or less, and Westerly by land now or formerly of Wil- braham Realty Corporation 268.75 feet more or less from Resi- dence District R-26 to General Business District (GB), or take any other action relative thereto.

ARTICLE 11. Whereas the Board of Water Commissioners has conditionally adopted certain rules and regulations at its meeting on September 7, 1965, entitled "Board of Water Com- missioners Rules and Regulations for Extensions of Water Mains and Allocation of Installation Costs for Same," a copy of which is filed with the Town Clerk, and


Whereas these rules and regulations are not in accordance with rules adopted "as a matter of future policy" under Article 27 of the Town Meeting of March, 1959, and


Whereas the rules adopted September 7, 1965, are conditional upon a vote of the Town rescinding said rules of said Article 27;


Therefore: it is now desirable to see if the Town will vote to rescind its action taken under Article 27 of the Town Meeting of March, 1959, or take any other action relative thereto.

ARTICLE 12. To see if the Town will vote to appropriate and borrow the sum of $280,000.00 or any other sum under authority of Chapter 44 of the General Laws as amended for the laying of water mains as set forth below, or take any other action relative thereto:


1. Tinkham Road, from Main Street to Stony Hill Road, a distance of 6,800 feet ±. 12 inch pipe.


2. Tinkham Road, from Stony Hill Road to Springfield-Wil- braham line, a distance of 4,000 feet ±. 12 inch pipe.


3. Stony Hill Road, from the Southerly end of the presently existing 12 inch main South to Soule Road, a distance of 10,900 feet ±. 12 inch pipe.


4. Soule Road, from Stony Hill Road to Main Street, a dis- tance of 7,800 feet ±. 12 inch pipe.


5. Main Street, from Soule Road to Tinkham Road, a distance of 5,500 feet ±. 12 inch pipe.


Conditional upon the action taken on Article 11, betterment assessments will be charged as follows:


Abutters will be assessed for two-thirds of the cost of the water extensions and the Town will bear one third of the cost. The cost so assessed will be based on eight inch pipe,

and on a per foot frontage basis. The Town will bear the proportionate cost of Town property and the balance of the costs. Abutters may pay for their assessments over 10 years in equal installments at four percent interest.

Being the fourth parcel of land in deed dated June 23, 1949 to Charles Dietz, et ux recorded in Hampden County Registry of Deeds Book 1997, Page 15 to which deed reference may be had for a more particular description; and to authorize payment therefor in the amount of $825.00, or any other sum, to be made from unexpended funds in the Conservation Fund. Any funds reimbursed by the Commonwealth shall be returned to available funds in the treasury.

GREETING:


In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of the Town of Wilbraham qualified to vote in elections of Town Officers, to meet in Wilbraham Memorial School in said Town on Saturday, the twenty sixth day of March, A.D., 1966 at 8:30 o'clock in the forenoon, then and there to give in their votes on one ballot to the election of officers of said Town, for the following offices, to wit:


To choose a Moderator, a Town Clerk, a Town Treasurer, a Town Collector, and a Tree Warden for the ensuing year; one Selectman for three years who shall be a member of the Board of Public Welfare and Board of Health; one Assessor for two years; one Assessor for three years; one Water Commissioner for three years; one Cemetery Commissioner for three years; one Library Trustee for three years; two School Committee Members for three years; one Member of the Regional School Committee for three years; one Member of the Planning Board for one year; one member of the Planning Board for five years; four Members of the Housing Authority. The polls shall open at 8:30 a.m. and shall close at 6:30 p.m.

ARTICLE 3. To fix the compensation of all elected Town Offi- cers for the year beginning April 1, 1966 and ending March 31, 1967.


ARTICLE 3. Recommend that compensation for elected Town Officers be fixed as follows: Town Clerk, $2,860.00 per year (all fees to revert to the Town Treasury); Town Treasurer, $2,860.00 per year; Moderator, $50.00 Annual Town Meeting, $15.00 Special Town Meeting; Town Collector, $4,680.00 per year (all fees to revert to the Town Treasury) ; Tree Warden, $2.25 per hour ($2.00 per hour for use of truck when needed); Selectmen, 2 members $600.00 per year, Chairman, $650.00; Assessors, $1.75 per hour; Constables, $1.50 per hour when called on duty by Selectmen, plus fees; School Committee, no salary; Cemetery Commissioners, no salary, $1.50 per hour for time spent at work; Water Commissioners, $150.00 per year; Library Trustees, no salary; Planning Board Mem- bers, no salary; Poundkeeper, Field Drivers, Weighers of Grain, Sur- veyors of Lumber, Measurers of Wood and Charcoal (all Town Offi- cers elected otherwise than by official ballot) fees only as fixed by General Laws.


ARTICLE 4. To see what disposition the Town will make of the Dog Tax of 1965.


ARTICLE 4. Recommend $1,393.97 be added to the Library Appropriation.


ARTICLE 5. To hear and act on the report of the Finance Committee together with the appropriations recommended by them and to raise such sums of money as may be deemed necessary for defraying the expenses of the Town for the ensuing year and appropriate the same and vote how the same shall be raised. (See pages 110 to 120 inclusive.)


ARTICLE 6. To see if the Town will vote to appropriate the sum of $1,846.75 for Library purposes, or take any other action relative thereto.


This sum representing the Grant received from the State for Library purposes.

ARTICLE 7. To see if the Town will vote to appropriate and transfer from the Road Machinery Fund the sum of $5,500.00, or any other sum, for the purchase of a Backhoe for the use of the Highway Department, or take any other action relative there- to.
