To see if the Town will vote to raise and appro- priate the sum of $8,140.00, or any other sum, for the purpose of installing a drainage system in Ridge Road to run southerly from the vicinity of Cone Trail, a distance of 700 feet, more or less; and northerly from the vicinity of Cadwell Drive, a distance of 350 feet, more or less, or take any other action relative thereto.

ARTICLE 16. To see if the Town will vote to raise and appro- priate or otherwise provide the sum of $170,000.00, or any other sum, for the reconstruction of the road and installation of drain- age on Tinkham Road from Main Street running westerly to Stony Hill Road for a distance of 7,300 feet, more or less, and authorize the Board of Selectmen to take by eminent domain drainage easements where necessary; and that to meet said appro- priation the sum of $12,750.00 be transferred from the Resurface Tinkham Road Appropriation; $32,000.00 to be transferred from Drainage - Tinkham Road Appropriation; that the sum of $25,250.00 be raised by taxation and that the Treasurer, with the approval of the Selectmen, be authorized to borrow the sum of $100,000.00 under authority of Chapter 44 of the General Laws and issue notes of the Town therefor so that the whole

loan shall be paid in one year from the date of issue of the first note, or take any other action relative thereto.

To see if the Town will vote to raise and appropriate the sum of $16,500.00, or any other sum, to repair the road where the water main is to be installed on Tinkham Road for a distance of 11,000 feet, more or less, or take any other action relative thereto.

ARTICLE 21. To see if the Town will vote to raise and appro- priate the sum of $8,000.00, or any other sum, to install an 8-inch

water main on Meadow View Road, from Soule Road to Pleas- ant View Road, a distance of 200 feet ±; and on Pleasant View Road from Meadow View Road to Tall Timber Drive, a distance of 1300 feet ±, or take any other action relative thereto.

ARTICLE 22. To see if the Town will vote to accept as a pub- lic way the private way now known as Pearl Drive, as laid out by the Selectmen on February 15, 1966 and authorize the Board of Selectmen to take said way by eminent domain, and that the sum of $8,300.00, or any other sum, be raised and appropriated for the construction of said Pearl Drive, and that betterment assessments be levied in accordance with the provisions of Chap- ter 80 of the General Laws, or take any other action relative thereto.

ARTICLE 23. To see if the Town will vote to raise and appro- priate the sum of $12,000.00, or any other sum, for the Con- servation Fund, to be used by the Conservation Commission with the approval of the Selectmen, or take any other action relative thereto.

ARTICLE 24. To see if the Town will vote to approve the purchase of the Lesco Corporation property of 46 acres ± on Peak Road as set forth and described in deed dated October 21, 1955 from Thyra V. Calkins to said Lesco Corporation recorded in the Hampden County Registry of Deeds Book 2426, Page 503, for Conservation purposes for $8,000.00, to be transferred from the Conservation Fund, or take any other action relative thereto.

ARTICLE 25. To see if the Town will vote to amend the Zon- ing By-Laws from "Neighborhood Shopping District," parking only, to "Neighborhood Office District," land located on the Westerly side of Main Street in said Wilbraham and being num- bered 455 to 457 Main Street with a frontage on Main Street of 156.75 feet as more particularly bounded and described in a deed from Everett W. Graham, et al to Maitland K. Shults, et al dated May 21, 1958 and recorded in the Hampden County

Registry of Deeds Book 2608, Page 329, or take any other action relative thereto.


ARTICLE 26. Not recommended.


ARTICLE 26. To see if the Town will vote to provide trans- portation for all children who live over a mile away from school, or take any other action relative thereto.


ARTICLE 27. To see if the Town will vote to instruct the Selectmen to pass a restraining order to prohibit dogs from run- ning at large in the Town and to provide for the enforcement thereof as set forth in General Laws, Chapter 140, Sections 167, 168 and 169, or take any other action relative thereto.


ARTICLE 28. To see if the Town will vote to adopt the fol- lowing By Law: No person shall operate a motor boat or a boat propelled by an outboard motor on any lake or pond within the Town of Wilbraham, except at a safe and reasonable speed at all times, and no person shall operate a motor boat with open throttle within one hundred and fifty feet of the shore of any such lake or pond. A speed in excess of ten miles per hour shall be prima facie evidence of unsafe operation. Violations of this by law shall be punished by a fine of not less than ten nor more than twenty dollars, or take any other action relative thereto.


ARTICLE 29. To see if the Town will vote to amend the By- Laws entitled "Personnel Program" dated February 10, 1964 and filed with the Town Clerk, as set forth in "Amendments to the Personnel Program" dated February 10, 1966 and filed with the Town Clerk, or take any other action relative thereto.


ARTICLE 30. To see if the Town will vote to extend the term of office of the Town Clerk, Town Treasurer, Town Collector, and Tree Warden to three years, or take any other action relative thereto.


ARTICLE 31. To see if the Town will vote to authorize the Selectmen to appoint a committee to put the recommendations of the Study Committee on Town Government Administration into specific operating form and to recommend specific limita- tions as well as the extent of authority and scope of duties and obligations of: (1) A Board of Public Works; (2) A Commission of Public Safety; and to report to the next Annual Town Meet-

ing for a vote thereon; and to raise and appropriate the sum of $50.00, or any other sum, for expenses for said Committee, or take any other action relative thereto.


ARTICLE 31. Recommended.


ARTICLE 32. To see if the Town will approve and authorize a Town Agent whose function it shall be: (1) to stay abreast of various Federal and/or State aid programs; (2) to ascertain which of these programs are applicable to this Town; (3) to advise the Board of Selectmen of procedures to be followed in applying for such aid; (4) to process correctly those applications which are prepared and submitted in the behalf of the town; (5) to institute and maintain whatever follow up actions are required. An agent employed for the functions of this duty will be ap- pointed by the Board of Selectmen on a voluntary basis. As the work load increases for such agent, consideration will be given to a remunerative classification, or take any other action relative thereto.


ARTICLE 33. To see if the Town will vote to amend the Zon- ing By-Laws from "Residence District R-15" to "General Busi- ness District" land in Wilbraham, Hampden County, Massachu- setts bounded and described as follows: Northeasterly by Stony Hill Road; Easterly by Stony Hill Road; Southerly by Acton Street and Westerly by the Springfield-Wilbraham town line, or take any other action relative thereto.


ARTICLE 34. To see if the Town will vote to accept a deed of land from the Trustees of the Wilbraham Library Foundation under agreement of trust dated November 30, 1962, as amended, for the purposes of a site for a public library, municipal office building, wooded or garden park and parking and other uses inci- dental thereto and subject to the restrictions, conditions and obligations as set forth in a deed dated December 21, 1965 to said Trustees recorded in the Hampden County Registry of Deeds Book 3162, Page 648, to which deed reference may be had for a description of the land which lies in the vicinity of Crane Park Drive and Woodland Dell Road, Wilbraham as shown on a plan recorded with said deed to said trustees, or take any other action relative thereto.

ARTICLE 35. To see if the Town will vote to appropriate or transfer from unappropriated available funds in the treasury the sum of $6,000.00, or any other sum, for consultants fees, pre- liminary plans and architects fees for a new library building. Said appropriation to be conditional upon prior approval of a Federal or State grant for said purpose. Federal and/or State contributions to be restored upon receipt to unappropriated avail- able funds in the treasury, or take any other action relative thereto.


ARTICLE 35. Recommended.


ARTICLE 36. To see if the Town will vote to authorize the Trustees of the Public Library to apply for a grant of Federal funds, under "Title II, Library Services and Construction Act, Public Law 88-269," for construction of a new public library in Wilbraham, or take any other action relative thereto.


ARTICLE 37. To see if the Town will vote to amend the Zon- ing By-Laws of the Town of Wilbraham, 1964 Revision by deleting sections 7.4.1, 7.4.3, 7.4.3.1, 7.4.3.2, 7.4.6.1 and 7.4.7 and substituting therefor the following sections; and by adding the following section 7.4.8, or take any other action relative thereto.


7.4.1 Except as otherwise provided in this section, there shall be no removal from the premises in any district of earth, loam, sand, gravel, clay or quarry stone ex- cept as follows:


7.4.1.1 The Board of Appeals may issue permits for the removal of surplus material resulting from bona fide construction on one lot for a residence and accessory buildings, driveways and walks without a public hear- ing.


7.4.1.2 The Board of Appeals may, after a public hearing, issue permits for the removal of surplus material re- sulting from other bona fide construction, landscape or agricultural operation being executed on the prem- ises, provided that no permanent damage is done to the landscape.


7.4.2 In connection with 7.4.1 above, the Board of Appeals shall impose the conditions set forth in Section 7.4.3.1 through 7.4.7 where appropriate and such others which are necessary for the protection of the health,

safety and welfare of the inhabitants of the Town.


(Two section 7.4.3 proposals appear below, that marked (FIRST) is by petition and that marked (SECOND) is by the Planning Board. It is proposed that one or the other be adopted.)


(FIRST)


7.4.3 The Board of Appeals may, after a public hearing and a report by the Conservation Commission, permit the removal of sand, gravel, clay or quarry stone in any zone (but not a Residence District except as may be permitted in 7.4.1) under the following conditions:


(SECOND)


7.4.3 The Board of Appeals may, after a public hearing and a report by the Conservation Commission, permit the removal of earth, loam, sand, gravel, clay or quarry stone in any zone under the following condi- tions:


7.4.3.1 The applicant shall submit a plan prepared by a regis- tered professional engineer or land surveyor. This plan must show existing grades on the parcel of land from which the above material is to be removed, and essential grades on abutting parcels of land, together with proposed grades at the conclusion of the opera- tion.


7.4.3.2 The plan shall provide for proper drainage of the area during the period of operation and after completion. In residence districts, every slope or bank above or below natural grade must be prepared at the end of each working day so that it does not exceed one foot of vertical distance in each two feet of horizontal distance. In other districts, on completion of the oper- ation, no bank shall exceed a slope of one of vertical distance in each two feet of horizontal distance.


7.4.6.1 The Board of Appeals shall impose such additional conditions as may in its sole judgment be for the pro- tection of health, safety, and welfare of the inhabitants of the Town. Such conditions may include restric- tions on use of roads and routing of vehicles; hours of operation; storage of operating equipment; restric- tions on impoundment of water and slopes of banks;

minimum distance of the operation from any residen- tial lot line; and fences and other safety measures required during the period of operation.


7.4.7 The Town Engineer or other agent designated by the Board of Appeals shall inspect each operation at least once a month and report on his inspection to the Board of Appeals. The costs to the Town of such inspections shall be billed to and paid for by the holder of the permit.


Penalty for violation of the conditions of the per- mit shall be as follows: for the first offense, fifty dol- lars; for the second offense, one hundred dollars; and for each subsequent offense, two hundred dollars; re- coverable as provided in Chapter 40, Section 21 of the General Laws of the Commonwealth of Massa- chusetts. Any violation shall be cause for the Board of Appeals to revoke a permit at its sole discretion.


7.4.8 Such permits shall be issued for a period of one year. A public hearing shall be held before a permit is re- newed by the Board of Appeals.


ARTICLE 38. To see if the Town will vote to appropriate and transfer from unappropriated available funds in the treasury the sum of $500.00, or any other sum, to be expended by the Wilbraham Housing Authority for its incidental expenses, the same to be restored to unappropriated available funds in the treasury upon the availability of other funds to said Authority, or take any other action relative thereto.


ARTICLE 38. Recommended.


ARTICLE 39. To see if the Town will vote to appropriate the sum of $30,000.00, or any other sum, for a Reserve Fund; $10,- 000.00 to be raised by taxation and $20,000.00 to be transferred from the Overlay Surplus Account, or take any other action relative thereto.


ARTICLE 39. Recommended.


ARTICLE 40. To see if the Town will vote to raise and appro- priate a sum of money for the purpose of increasing the Stabiliza- tion Fund, or take any other action relative thereto.


ARTICLE 40. Recommend $30,000.00 be transferred from avail- able funds and $70,000.00 be raised from taxation.

To see if the Town will vote to appropriate and transfer from unappropriated available funds in the treasury the sum of $17,000.00, or any other sum, to be spent by the Water Department for additional household and business installa- tions for water service, the cost of which is to be collected by the Town from the individuals or concerns requesting installa- tions, to be restored upon receipt to unappropriated available funds in the treasury, or take any other action relative thereto.

To see if the Town will vote to accept as a pub- lic way the private way now known as Gary Drive, as laid out by the Selectmen on February 15, 1966 and authorize the Board of Selectmen to take said way by eminent domain, no appropria- tion being necessary therefor, or take any other action relative thereto.

To see if the Town will vote to accept as a pub- lic way the private way now known as Ronald Circle, as laid out by the Selectmen on February 15, 1966 and authorize the Board of Selectmen to take said way by eminent domain, no appropriation being necessary therefor, or take any other action relative thereto.


ARTICLE 44. To see if the Town will vote to accept as a pub- lic way the private way now known as Raymond Drive, as laid out by the Selectmen on February 15, 1966 and authorize the Board of Selectmen to take said way by eminent domain, no appropriation being necessary therefor, or take any other action relative thereto.


ARTICLE 45. To see if the Town will vote to accept as a pub- lic way the private way now known as Ruth Drive, as laid out by the Selectmen on February 15, 1966 and authorize the Board of Selectmen to take said way by eminent domain, no appropria- tion being necessary therefor, or take any other action relative thereto.

ARTICLE 54. To see if the Town will vote to accept various deeds of easement rights to the Town recorded at the Hampden County Registry of Deeds since the date of the last Annual Town Meeting, or take any other action relative thereto.


ARTICLE 55. To see if the Town will authorize the Selectmen to institute or defend suits and employ counsel for the purpose of protecting the interests of the Town, or take any other action relative thereto.


ARTICLE 56. To transact such other business as may properly come before said meeting.


And you are directed to serve this Warrant by posting attested copies thereof, one at the Post Office at North Wilbraham, one at the Post Office at Wilbraham, and one at Glendale Church, seven days at least, before the time for holding said election and meeting. Finance Committee Report


We have seen over the years since World War II a steady population growth in Wilbraham. This fact, coupled with the need and desire of the citizens for more and better services, has resulted in a steady increase in the cost of operating our town government - 1966 will be no exception.


It has been necessary for your Finance Committee to examine and study closely all department budget requests and the finan- cial implications of all special articles requiring the appropriation of funds. We have also evaluated carefully all other articles in

the town warrant which by their passage will mean in the future the expenditure of town funds. The appointment several years ago of Mr. J. A. Reilly as Town Accountant has made the above study and evaluation possible for without his efforts, it would have been most difficult if not impossible to give the same careful analysis to all the various requests.
