On consideration,
Resolved, Mr. John Miller, late Commissioner of Purchases in Lancaster county, be directed to settle with Colonel Adam Hubley, Lieutenant of the said county, for money advanced by the said Lieutenant in supplying the militia marched to Northumberland county, and that the said Commissioner charge the same in his account with the publick.
The petition of John Howard was read, praying . remission of certain fines laid upon himself, his son Thomas and Mathew Shaw, of twenty-five pounds each, by the Court of Quarter Sessions of the Peace for the city of Philadelphia; and the same being con- sidered,
Ordered, That the fine of twenty-five pounds imposed on Mat- thew Shaw be remitted.
The petition of Bethian Sonmams was read, praying that her claim to certain lots, &ca., may be heard ; and
Ordered, To lie on the table.
The petition of Elizabeth Mooncy, convicted of felony upon law indictments, before the City Court was read, and the transcripts of the sentences of the court being read and considered, and also a certificate of her being at present very ill with a remitting fever;
Ordered, That the said Elizabeth Mooney be pardoned, and that . pardon be made out accordingly.
A letter from Robert Morris, Esquire, dated the thirtieth in- stant, was read.
The potition of James Packer, in the name of Thomas Light foot, James Packer, Michael Holman, John Lauback, George Emery, Peter Hartman and John Urmy, in behalf of themselves and others, &ca., was read, setting forth " That they are intitled " to divers lots of ground in the city of Philadelphia in right of " Richard Pyke, who was an original purchaser of ten thousand " acres of land in this State, and confiding in the wisdom and justice "of the Hon'ble Board, pray that their title may be examined, and " the lots appurtenant to the said purchase laid off to them, and " your petitioners, as in duty bound, will ever pray."
Ordered, That this Board will hear the said claim on Friday, seventeenth of August next.

An order was drawn on the Treasurer in favour of Mr. William Bonham, for the sum of five pounds fifteen shillings, State money, dated the seventh of April last; and the sum of four pounds twelve shillings specie, amount of his account for five reams of writing paper, bought at publick vendue, for the use of the Council.
Ordered, That Captain Joseph Stiles, Commissary of Military Stores, do immediately have fifty stand of arms repaired, and pro- vide two thousand cartridges and one hundred flints, to be for- warded to Lancaster, under the direction of the Hon'ble Mr. Cun- ningham, for the use of the militia on duty as guards at Lancas- ter.
Ordered, That Captain Stiles do purchase two thousand flints.
The Board resumed the consideration of the papers transmitted by William Henry and Paul Zantzinger, Esquires, respecting the ostate of John Ruby; and thereupon, .
Resolved, First, That the said papers be transmitted to the Es- cheator General, in order that proper measures may be taken to vest the said estate in the Commonwealth, subject to the claim of the heirs of said John Ruby, if made within twenty-one years, agreeable to the act of Assembly.
Secondly, That it is the opinion of this Board that the interposi- tion of the claim of this Commonwealth in the dispute between the landlord and tenant, is premature and improper, it being indifferent to the State in whom such temporary possesion rests, and the said claim is hereby disavowed, so that the said Justices may proceed in the said suit, the claim made on the part of the Commonwealth notwithstanding.
WHEREAS, It has been represented to this Board that the re- cords of the Mayor's office of this city still remain in the hands of of Samuel Powell, Esquire, late Mayor.
WHEREAS, The Lieutenant of the county of Northampton hath represented that from the deficiency of the classes called forth for the defence of the frontiers, he apprehends it will be necessary to call a farther class.
Resolved, That in case such deficiency shall happen and continue, the said Lieutenant be authorized to call forth a farther class, agreeable to the request contained in his letter of the thirteenth instant.

Resolved, That Plunket Fleeson, Esquire, President of the Court of Common Pleas and Quarter Sessions of this city, do receive the said records, and that the receipt of the said Plunket Fleeson, or any person by his appointment therefor, shall be a sufficient voucher and authority to the said Samuel Powell, Require, in the premises.
A deed was examined and signed by his Excellency the Presi- dent to Captain Jacob Bunner, conveying a lot or piece of ground nituate on the east side of Water street, between Sassafras and Mulberry streets; containing in breadth north and south twenty- six feet six inches, and extending in depth into the river Delaware as far as low water mark : Seized and sold agreeable to law, as the cetate late of John Parrock, an attainted traitor, to the said Cap- tain Jacob Bunner, for the sum of one thousand and ninety, sub- jest to the yearly rent of thirty-two bushels and seven-tenths of good merchantable wheat, payable to the Trustees of the Univer- city of this State, three-fourths of which sum he hath pail into the hands of the Agents of Confiscated Estates in the city of Philadel- phia, the remaining one-fourth being reserved for the purpose aforo- mid. WHEREAS, Divers Justices of the Peace, thro' misapprehension of the act of Assembly intitled "An Act for recruiting the Penn- "sylvania line, in the army of the United States," or otherwise have given certificates to persons bringing recruits under the said act, in behalf and at the expense of the class to which such persons respectively belong, by which they may claim exemption from the militia : Whereas, Such exemption is by law only ex- tended to those who shall inlist a recruit in their own private right, and deliver him to the proper officers, exclusive of any connection with the class, and such certificates tending to create confusion and dispute in the execution of the militia law :
Resolved, That the said Justices of the Peace do forbear to give sach certificates of exemption, except in cases warranted by law, as above set forth, and that they as far as possible recall such as have been already granted, or certify the same to the Lieutenant, so as to prevent future dispute.
An order was drawn on the Treasurer in favour of Mr. James Longhead, for the sum of six hundred and twenty-five pounds, specie, for the purpose of paying the militia of the city of Phila- delphia now in service, the same to be charged to Colonel William Henry, Lieutenant of the city and liberties of Philadelphia, and to be repaid out of the monies arising from militia fines.

An order was drawn on the Treasurer in favour of Mr. John Hart, for the sum of one hundred and fifty-five pounds eight shil- lings and six pence, State money, dated the seventh of April, 1781, ballance of his account of bounties paid to recruits and the gratui- tics allowed by the Assembly to the retained soldiers.
Ordered, That William Will, Esquire, Sheriff of the city and county of Philadelphia, be directed to deliver to Captain Jeremiah Jackson, of the sixth Pennsylvania regiment, or bis order, a cer- taiu James Wilson, now confined in the old gaol, in order to stand his trial for desertion, before a Court Martial ; the said James Wil- son to be returned to the Sheriff as soon as the trial is ended.
'The potition of Mr. Samuel Bryan, was read, wherein many other things he states his having been made prisoner by the enemy on his voyage to Hlavannah, and carried to the Island of New Provi- donco ; that himself and two other gentlemen, prisoners, had been furnished with necessarys while there, and the means of returning to their homes by Mr. John Baldwin, of New Providence ; that boing unwilling to export gold or silver, and bills not being nego- tiable at Now Providence, requests that he may be permitted to export six tiorces of sugar, an article of luxury at all times, and remarkably plentiful at present, for the purpose of repaying the monies received by the said prisoners. Ordered, That the Escheator of the State do take possesion of such estates as may appear to be escheated the Commonwealth, and that he bo authorized to let the same for the best rent that can be obtained therefor, not exceeding the term of one year, and that he be allowed for his trouble five per centum on the proceeds, and five per cent. on the amount of sale of such as shall be sold, with rea- sonable charges.
Ordered, That the Surveyor General be requested to attend the Council to-morrow at twelve o'clock, to give information concerning the claim of Major Parr to a city lot, in right of Richard Waln.
The Council taking into consideration the seizure by the Agents for Forfeited Estates of an house and lot in Second street, as be- ing the property of Benjamin Booth, and on inquiry, the same ap- pearing to have been assigned by James Steele, late of this city, for the payment of his debts, and the said Benjamin Booth not ap- pearing to have any right or title therein,
Ordered, That the Agents for Forfeited Estates do withdraw the claim of the State against the said house and lot.
An order was drawn on the Treasurer in favour of John Hamell, for the sum of three pounds, specie, for apprehending and securing a deserter, agrecable to advertizement, as certified by Lieu- tenant Colonel Mentges.
An order was drawn on the Treasurer in favour of Colonel Lewis Farmer, for the sum of-one hundred pounds, specie, for paying persons employed in making up cloathing for the use of the troops of the Pennsylvania line.
A petition from Ludwig Fohrer, was read, setting forth that the Collector of Excise hath seized two pipes of Teneriffe wine belong- ing to him, he having neglected to enter the same in due form of law, and praying remission for such part thereof as is forfeited to the State ; thereupon,

A deed was examined and signed by his Excellency the President of the State, to his Excellency Thomas Mckean, President of Congress, conveying a three-story brick messuage, coach house, stables, and four contiguous lots of ground, situate in the city of Philadelphia, and bounded as follows, vizt :- The lot in the hereon endorsed plan, marked No. one, whereon the said messuage is erected, situate on the east side of Third street, between Pine street and Union street, containing in breadth east and west thirty feet, and extending from Pine street to Union street, one hundred and sixty feet, bounded southward by Pine street, eastward partly by the next described lot, and partly by Andrew Duche's ground, northward by Union street aforesaid, and westward by Third street aforesaid. One other of the said lots in the said plan, marked No.

One other of the said lots in the said plan, marked No. 3, situato on the north side of Pine street aforesaid, adjoining lot No. two, containing in breadth east and west fifteen feet and ex- tending in depth ninety feet, bounded eastward by the next de- scribed lot, northward by ground late of Maurice Rodgers, deceased, westward by lot No. two, and southward by Pine street aforesaid. And the other of the said lots in the said plan, marked No. four, situate on the north side of Pine street afore said, containing in breadth east and west twenty-feet, and extending in depth ninety feet, bounded eastward by ground now or late of Charles West, northward by ground of John Grandson, westward by lot No. three, and southward by Pine street aforesaid : Seized and sold agreeable to the law, as the estate late of Jacob Duche, Jun'r, to the said Thomas Mckean, for the sum of seven thousand seven hundred and fifty pounds, lawful money of Pennsylvania, subject to the yearly rent of two hundred and thirty-two bushels and a half of good merchantable wheat, payable to the Trustees of the University of this State; three-fourths of which sum he hath paid into the bands of the Agents for Confiscated Estates in the said city, the remaining one-fourth being reserved for the purpose afore- said ; and subject also to the several rent charges issuing yearly out of the said lots. Deed dated the ninth instant.
A decd was examined and sigued by his Excellency the Presi- dent, to John Fromberger, conveying a lot or parcel of land on Province Island, marked in plan of said island No. two ; beginning at a stake in the middle of the road leading from the Ferry to Tin- nicum and Chester; thence in the middle of a ditch, by which this lot is divided from the lot No. one, North twenty-eight degrees west fifty- eight perches and two-tenths to a stake put in the ground on the inner side of the bank of Mingo creek ; thence by the said bank thirty-three perches and two-tenths to a stake; thence by lot No. three, south twelve degrees east fifty-nine perches and four-tenths to another stake in the middle of the said road, south seventy-eight degrees west seventeen perches and three-tenths to the place of be- ginning ; containing nine acres and thirty-one perches of land, strict measure: And all that bank and cripple and marsh land which lies between the said described embanked land and low water mark of Mingo creek : Sold agrecable to act of General Assem - bly, passed for the redemption of the bills of credit, dated the twenty-ninth day of April, 1780 : Consideration, four hundred and fifty-nine pounds thirteen shillings and nine pence.
