1 ing to arrest or imprison him, and he, so making resistance, shall happen to be killed, or if any of them shall fly from any pemm or persons endeavouring to apprehend him, and in the pursuit the said party so flying shall be killed, where he cannot be othervim overtaken, he or they so killing shall be, and hereby are justifel; and in case any prosecution shall be commenced against any person or persons for the same, he or they, may thereto plead the gemen) issue, and give this act in evidence ; and moreover, be or they killing any of the before named offenders, (on proof thereof, made at any Court of General Quarter Sessions of the Peace and Gad Delivery for the county where such killing shall happen, and the same being certified by the Justices, or any three of them, who are hereby authorised and required to certify the same,) shall, on pr ducing such certificate to the President or Vice President io Com cil, receive an order on the Treasurer of the State for the som d three hundred pounds. That if any person or persons shall be el led on by any Justice of the Peace, Sheriff, or his Deputy, amy Militia officer, Constable, or person robbed, to go in pursuit of either of the said felons or offenders, their aiders and abettors, harbour- ers or conceallors, and shall refuse, be or they severally, oa comrie tion before any Justice of the Peace where he or they shall reside. shall pay a fine of five pounds to the use of the Commonwealth, to be recovered as debts of five pounds and ander are recoverable by Jaw.


We do hereby charge and require all Judges, Justices, Sherifa. and Constables, to make dirigent search and inquiry after, and # use their utmost endeavours, and all other persons, when called upon as aforesaid, to give their assistance for apprehending and curing the aforesaid felons or offenders, their aiders, abettors, and comforters, and every of them, so that they may be dealt with se cording to law.

Upon the Comptroller General's reports, the following orders were drawn on the Treasurer, vizt :


In favor of John Nicholson, Esquire, for the sum of five bandred pounds, State money of the seventh of April, 1781, for paying one-third of depreciation to officers and soldiers of the Penasyl- vania line, for which he is to account.


In favor of Alexander Brown, two orders, one for forty-two pounds fourteen shillings and two pence, and the other for forty one pounds eight shillings and four pence, like money, being pri- cipal and interest due upon two certificates for two horses fu. nished by him for public use.


In favor of Alexander Dobbins, for forty-eight pounds ten chil- lings and three pence, in like money. being principal and interest due upon his certificate for a horse furnished for public use.


The sums mentioned in the two last orders to be paid agree bly to resolution of the Assembly of 8th of April, 1782.


In favor of Griffith Evans, for the sum of thirteen pounds ff teen shillings, in full for his wages for assisting the Comptroller General in the duties of his office, till the seventh instant.


In favor of Thomas Strawbridge, for ten pounds two shilling and five pence specie, ballance of his account as Sub Lieutenant d the county of Chester, to be paid out of the money arising fres militia fines in the said county.

Deed dated this day.


"o Charles Gobin, for a tract of land containing one hundred eighty-four acres and one hundred and twenty-eight perches of I, situate in Brunswick township, Berks county, late the estate John Hoster : Sold agrecably to law, for three hundred and aty-seven pounds six shillings and eleven pence; one-fourth of ch sum is reduced to a ground rent, payable to the trustees of University of this State; the remaining three-fourths the said arles Gobin bath paid to the Agents of said county. Deed dated mty.fifth day of July, 1783.

SUPREME EXECUTIVE COUNCIL.


Agreeably to s resolution of Assembly of the twenty-second instant, Council proceeded to the election of one field officer, two captains, and four subalterns of the Pennsylvania line, for the pur- pose of commanding the two companies of State troops provided for by the said resolution. Upon which, (the votes being taken,) it appeared that James Moore, Esquire, was appointed Major; James Chrystie and Philip Schrawder, Esquires, Captains ;


Blackall, William Ball, John Armstrong, Samuel Reid, and Andrew Henderson, Esquires, Lieutenants.


Resolved, That an order be drawn on the Treasurer in favour of Lieutenant Erb, for the sum of three hundred pounds specie, for the purpose of discharging the contracts entered into by Captain Schraw- der, for the supply of the Wyoming garrison, he, Lieutenant Erb, - to be accountable ; to be paid out of the fund appropriated to the frontier defence.


Resolved, That Mr. Erb be directed to use all possible dispatch in proceeding to Wyoming with the aforesaid sum.


Letters from Daniel Montgomery, Samuel J. Atlee, and Lawrence Keene, Esquires, respectively, praying to be appointed Prothonotary of the county of Northumberland, were read ; upon which, agree- ably to the order of yesterday, Council proceeded to the election of a person to succeed Matthew Smith, Esquire, in that office; and upon the votes being taken,. it appeared that Lawrence Keene, Esquire, was duly elected.

Ordered, That Mr. William McClay be requested to take early measures for removing the State military stores from Harris's Fer- ry to the town of Sunbury, and to make immediate report of their quantity and kind to this Board.


Ordered, That the bond of Mr. Cadwallader Morris and the late James Hamilton, Esquire, as securities of William Hamilton, be cancelled.


A letter from William McCleery, Esquire, inclosing a memorial to this Board, was read.


A draught of instructions to Major James Moore, was read and approved.


An order was drawn on the Treasurer in favor of John Caro- thers, Esquire, late Lieutenant of the county of Cumberland, for the sum of one hundred and one pounds seventeen shillings and eight pence specie, being the ballance of his account as Lieutenant, to be paid out of the money arising from the militia fines of the said county.


An order was drawn on the Treasurer in favor of the said John Carothers, for the sum of fifteen pounds, being a debt assumed by the said Carothers to Charles Cooper, for sundry articles furnished for public use ; to be paid out of the same fund as the above order.


The following orders were also drawn on the Treasurer in faror of Christopher Kucher, Esq'r, for the sum of thirteen pounds nine shillings and two pence, State money of the seventh of April, 1781, being the ballance due upon the settlement of his account as Sub. Lieutenant of Lancaster county ; to be paid out of the fund arising from the militia fines in the said county.


In favor of James Smith, Esquire, for two thousand three bun- dred and thirty three pounds nine shillings and two pence specie, ballance of his account for provisions furnished to Samuel Lyon, Esquire, late Commissioner of Purchases, for public use; to be paid, according to the resolution of the General Assembly of the twen- ty-fourth instant, out of the duties which have arisen by the late impost laws, and not then appropriated.

A letter from Captain Robinson, inclosing a muster roll of his company and a return of ordnance stores at Wyoming, was read.


An order was drawn on the Treasurer in favour of Thomas Robinson, for the sum of one hundred pounds specie, on account of the pay of himself and company ; to be paid out of the fund appropriated to the defence of the frontiers.


A return of Justices elected for the town of Pittsburg, and a let- ter stating the particular circumstances of some of the gentlemen chosen, was read.


The following orders were drawn upon the Treasurer of the State, to wit :


In favor of Isaac Jackson, for forty pounds eleven shillings and six pence State money of the seventh of April, 1781, in full of principal & interest for a horse furnished by him for public pur- poses. .


In favor of Major James Moore, for the sum of two hundred pounds specie, out of the fund which has arisen by the late impost Jaws, for the purpose of recruiting two companies of Infantry to 'be stationed at Wyoming, agreeably to resolution of Assembly of 22nd of September, 1783.


In favor of Major General Arthur St. Clair, for the sum of four hundred and fifteen dollars specie, in part of pay due to him, ad- vanced agreeably to resolution of the General Assembly of the twenty-second day of September, 1783.

The other adjoining the above on the middle branch of Juniata, sold agreeebly to law, for one hundred and seventy pounds, containing three hundred and twenty-three acres, late the estate of Harvy Gor- don, an attainted traitor, forfeited to the Commonwealth of Penn- sylvania.
