Resolved, That the Treasurer of the State do receive from John Thompson, of Burlington County, New Jersey, the sum of fifteen thousand pounds, the purchase money of the Salt Works of Pen- sylvania in the State of New Jersey; and that upon a certificate thereof being presented to this Board, a deed be executed by the President, under the great seal.

SUPREME EXECUTIVE COUNCIL.


WHEREAS, By the late Act of Assembly, this Board is autho- rised and required to reserve such and so many of the Confiscated Estates as may be necessary to Create a fund for the support of the Provost, and other officers of the University of the State:


Resolved, therefore, That the Agents Postpone any further sales of the said Estates, untill the above reservation is made, or farther order given in the premises.


Resolved, That the agents compleat the sales already made, and if any persons have failed to comply with the Terms of sale, the Premisses be deemed the property of the State, as specified in the said Terms, and taken into possession by the Agents accordingly.


And Whereas, The State is bound to Warrantee the Lands and real Estate sold under its authority ; it is therefore, our indispen- sible duty to have such Estates duly and properly described, that future litigation may be prevented, and the State not farther re- sponsible than for the Estates actually sold and value received ; Wherefore,


Resolved, That the Agents, together with a certificate of the re- ceipt of the purchase Money, send a particular description of the Lands, or other premisses, duly signed by them, and in case of doubt or difficulty, surveyors to be employed and return to be made accordingly, in which case their Deeds will be immediately exe- cuted.

Owen Faries laid before the Council a Certificate of the Pay- ment of Seventeen thousand and ten Pounds to Colonel George Smith, Agent for forfieted Estates in the County of Philadelphia, being the Purchase money of a Tract of Land, late the Property of Henry Jounkin, forfieted to the State and sold by the said Agent.


And a draft of Survey of the said Land, signed by Robert Lol- ler, and certified by Thomas Hale, one of the Agents for said coun- ty, and a Deed granting the same to the said Owen Faries, being read,

Ordered, That the same be Executed according to Law.


John Thompson, of Burlington County, New Jersey, laid before the Council a receipt signed by David Rittenhouse, Esquire, Trea- surer, for fifteen thousand Pounds, the sum for which the salt works belonging to the State of Pensylvania, in New Jersey, was sold to him for; and thereupon,


Ordered, That his Excellency the President, do Execute a Deed conveying the said salt works to the said Thompson, his heirs and Assigns.


WHEREAS, It has been represented to this Board, as well by the Magistrates as others, reputable Inhabitants of the City, that many abuses and frauds are committed in the Measure, as well as Quality of Wood, brought to Public Market; and also, that the Corders and Carters engross the same, so as to accumulate the price, to the great prejudice of the Inhabitants Generally, and distress of the poor in particular,


Resolved, therefore, That it be earnestly recommended to the Justices of the Peace of the City, and Wardens under whose care the Publick wharves are placed, to cause immediate enquiry to be made into these complaints, and to remove from office, and other- wise Punish, the offenders herein, reporting to this Board what regulations may be farther necessary to be made to prevent the like impositions in future.


Resolved, Also, that the Clerk of the Market do give Publick Notice that he is ordered and directed to proceed with severity against all persons forestalling the Markets; that Tavern Keepers suffering provisions to be purchased out of Market, will be deprived of their Licenses, and such purchasers will. be punished according to Law.


WHEREAS, A number of the Non-Commissioned officers, and Men of the Gallies, in the service of the State, have signified their desire to be discharged, Vizt : Thirty-four from the Franklin Gal- ley; Twenty-three from the Handcock Galley ; Twenty-one from the Chatham Galley ; Twelve from the Lion Guard Boat, and Nine from the Viper Guard Boat.


Resolved, That Captain Boys, Commander of the Gallies, be and he is hereby authorised to discharge the said officers and Men, agreeable to the list delivered.


The Petition of Mary Miller, convicted of Larceny, and ad- judged to pay a ffine to the use of the State, was read, setting forth that she is unable to pay the said fine, and praying remission of the same,


Ordered, That the said Fine be remitted, and the said Mary Miller discharged from confinement.

PHILADELPHIA, December 6th, 1779.

The Adjudication of the Supreme Court on the case of Sarah Growdon, Widow of Lawrence Growdon, and a Claimant on the Estate of Joseph Galloway, having been laid before the Board,


Resolved, That the same be confirmed, and that an Order be drawn for the sum of six hundred and fifty pounds, the ballance of Money due on the said report.


A Petition from Henry W. Archer, Esq'r, Volunteer Aid-du Camp to General Wayne, and a Captain by Brevet, was laid before the Board.


Whereupon, the Secretary is directed to inform Mr. Archer that the act of Assembly particularly describes the Officers entitled to the benefits thereby given, and that if Mr. Archer is by law enti- tled, an order will be given him accordingly.


Resolved, That the Secretary write to the Agents of the State Ship for their accounts, &ca., settlement thereof.


A Certificate from the Honourable Mr. Holker, of his agreement with the Owners of the Ship General Mercer, to ship one hundred Barrells of Flour and four hundred Barrells of Buscuit, for the use of the Royal Navy of his most Christian Majesty, to be deliv- ered to the Governor of Dominique, and a letter from the said owners, requesting permission from this Board to ship the same, were read, and, thereupon,


Ordered, That the Naval Officer be directed to clear out the said Vessel and Cargo.


Mr. Jeremiah Warder laid before the Council a certificate of the delivery of eighty-two Bushells of Salt to Jacob Barge, for the use of the State; and thereupon,


Ordered, That the Committee appointed to procure Salt do pay Mr. Warder for the said Salt, at Thirty pounds per Bushell, they taking a receipt for the same on the said Certificate.


It having been represented to the Council that great delays have been in the collecting of Publick Taxes,


Ordered, That the Commissioners, Assessors and Collectors of the Public State Taxes within the City and Liberties, be directed to attend the President and Council, in the Council Chamber, at the State House, on Wednesday the eighth instant, at four o'clock.


An order was drawn on the Treasurer in favour of Mrs. Sarah Growdon, for the sum of six hundred and fifty pounds, Decreed her by the Supreme Court, in lieu of an annuity bequeath'd her

The Petition of Robert Story, now under sentence of death, praying a Pardon, was read, and it appearing that he had discov- ered to the Goaler of the County of Cumberland, a dangerous plott, laid by his fellow Prisoners, whereby the consequences of the said Plott were prevented,


Ordered, That the said Story be reprieved 'till the first day of March next, and a Warrant made out accordingly.


An Order was drawn on the Treasurer in favour of William C. Bradford, or his order, for the sum of Two thousand five hundred · pounds, for paying the Officers and Men of the State Fleet, for which he is to account.

A free conference, respecting the Collecting the Publick Taxes, having been made, and altho' it appears there are considerable diffi- culties from various and complicated causes, there is reason to hope that by Vigilance and perseverance, a considerable part of the Tax of Fifteen Millions may be collected within the month of January. And a disposition to Industry and application, and a great unanimi- ty of Sentiment, with respect to the necessity of it, appeared very generally to prevail:


Council adjourned to Friday Morning, at Ten o'clock.

An Order was drawn on the Treasurer in favour of Mr. Lodo- wick Sprogell, for the sum of one hundred and eighty-seven pounds ten shillings, ballance of Money due to him for his services as Muster Master of the State of Pensylvania.


An Order was drawn on the Treasurer in favour of Major John Beaton, for the sum of one hundred and thirty-five pounds, for VOL. XII .- 13.

his services as an Agent for purchasing Wheat and Flour for the State, in Chester County. Thirty days, at Four pounds ten shil- lings per day.


The Petition of John Palfrey being read and considered, the Council came to the following resolution, to Wit : It appearing that the Petitioner is a Prisoner of War, captured by the Militia of New Jersey, and not a Native or Inhabitant of this State, nor under a Parole to this State, the Board are of opinion the matter lays more properly with the State of New Jersey : added to this, we are of opinion it will be a bad precedent to admit Prisoners of War to take the oaths and release them from Captivity, while we have so many officers in that condition with the Enemy.

An order was drawn on the Treasurer in favour of Mr. Thomas Thomas, for the sum of Two hundred and forty-three pounds and ten shillings, the amount of his claim on the Estate of John Cus- tard, decreed him by the Supreme Court, with lawfull Interest on the sum of Two hundred pounds from the Tenth day of April, one thousand seven hundred and seventy-five.


An order was drawn on the Treasurer in favour of Mr. William Crispin, or his order, for the sum of Two hundred and eighty-one pounds twelve Shillings and six pence, the amount of his account for going to Bethlehem and Allentown to arrest Sigismund Les- chinskey, on suspicion of uttering Counterfeit Sixty Dollar Bills, in the likeness of the Continental Bills of Credit, advanced by the State of Pensylvania on account of the United States, to be charged to the said United States.


The resolve of Assembly proposing a settlement of the disputed Territory, was forwarded to Governor Trumbull.


Resolved, That Mr. George Henry be requested to sell, in such manner as will be most to the Publick advantage, the Broken Can- non in and about Town, belonging to the State; also, the saltpetre and sulpher in the store, with the copper Boilers, and such other articles as are not of immediate use for the Gallies, and Mr. Henry

having represented that he apprehends there is no occasion for con- tinuing him as Commissary of Naval Stores,


Resolved, That he be requested to send a General State of his accounts, and that the said office cease the last day of this month, he delivering to Colonel Farmer the Key of the Store, and taking his receipt for such articles as remain unsold.


The Board taking into their consideration the Schuylkill Bridge, the care and direction of which was recommended by the Honour- able House of Assembly to this Council, and two of their Members having visited the said Bridge and reported the State thereof to the Board, with the rates now taken, which are greatly insufficient for the common and necessary affairs,


Resolved, That the following Rates be taken untill the same be altered by the General Assembly, or by a future act of Council, vizt :


A single Person, Two Shillings & six pence.


Horse, loaded or unloaded, Five Shillings.


Horse and chair, Twenty-two Shillings & six pence.


Chariot or Phaeton & pair, Thirty-seven Shillings & six pence.


Chariot & four Horses, Forty-five Shillings.


Cart & Horse, Seven Shillings & six pence.


Waggon & four Horses, Twenty-two Shillings & six pence.


Cattle, Two Shillings and six pence each.


Sheep, One Shilling and three pence each.


Swine, One Shilling and three pence each.


Sleigh or Sled, Ten Shillings.


Each Person in any Sleigh, Sled, Waggon, Chair, Chariot or Cart, beside the driver, Two Shillings & six pence.


Resolved, That General Lacy and Captain Hambright be a committee to get the old bridge valued by Judicious Carpenters, in order for sale, or that it may be taken care of for Publick use.


Resolved, That the Secretary write to Mr. Ogden, the present Tenant, and desire his attendance on the Board next Monday at Twelve O'Clock, to settle the farther Terms of his holding the said Bridge.


A Petition of David Franks to go into New York, with sundry papers accompanying it, was read ; Whereupon,


Resolved, That Colonel Smith, General Lacey and Mr. Thomp- son, be a committee to hear Mr. Franks on the said Petition, and Report to Council thereon.


The following Deeds having been examined, and Certificates of the payment of the consideration thereof read, the same were or- dered to be executed:

Deed bearing date the Twenty- seventh day of August, one thousand seven hundred and seventy- Nine.


Deed to John Compty, conveying a Lease of a certain lott of ground situate at the Corner of Catherine and Front streets, in Southwark, containing Forty feet on said two streets ; Bounded North by Anthony Duche, East by Edward Stiles, South by Cath- erine street, and West by front street, to hold so much of the said Lease as remains yet unexpired, the same commencing on the first day of January, Anno Domini one thousand seven hundred and seventy-five, and from thence to continue Twenty years, subject to a ground Rent payable to Edward Stiles; The sum of one thou- sand and five hundred pounds, consideration Money, paid to Thomas Hale, Agent for Philadelphia County. Deed bearing date the Twentieth day of September, one thousand seven hundred and seventy-nine.


Deed to the said John Compty, Conveying two Houses and lott of Ground, late the Estate of George Harding, seized and for- fieted to the use of the State, situate in the district of South wark, containing in Breadth twenty-six feet on Third street, and in depth eighty feet, Bounded Eastward by Third street, southward by a Lott late of George Harding, westward by Silas Inglis's Ground, and Northward by Benjamin Marshall's Ground, subject to seven pounds five shillings per annum Ground rent, payable to Samuel Rhoads; The sum of Nine hundred and fifty pounds Consideration Money paid to the said Thomas Hale. Deed bearing date the Twen- tieth day of September, one thousand seven hundred and Seventy- nine.


The Petition of Mary Flood, convicted of Larceny on three In- dictments, and adjudged to pay three several ffines to the Use of the State, was read, setting forth that she is unable to pay the said ffines, and praying remission of the same ; thereupon,


Ordered, That the said fines be remitted.


The Petition of William Belvin, of the County of Lancaster, convicted of Larceny, and adjudged to pay a fine to the Use of the State, was read, setting forth that he is Unable to pay the said ffine, and praying remission of the same. A recommendation from the Justices of the Peace of the Borough of Lancaster being also read,


Resolved, That the said fine be remitted, and he be discharged from Confinement.

An Order was drawn on the Treasurer in favour of the Hon- ourable Francis Hopkinson, Esquire, for the sum of Twenty thou- sand Dollars, to be paid to Joseph Borden, Esquire, Continental Treasurer of the State of New Jersey, it being Monies advanced by the said Joseph Borden to the late Navy Board of Pensyl- vania.


An order was drawn on the Treasurer in favour of Mrs. Sarah Chestnut, for the sum of Two hundred and forty-three pounds ten shillings, the amount of her claim on the Estate of Thomas Macki- ness, Decreed her by the Supreme Court, with lawfull Interest on the sum of Two hundred pounds, from the Fifteenth day of De- cember, one thousand seven hundred and seventy-six.


The Council taking into their Consideration a Certificate from the Honourable Mr. Holker, Consul of France, setting forth that the Brigg called the Trooper, Mounting Sixteen Guns, is char- tered for the purpose of lading four hundred and fifty Barrells of Beef and Pork, five hundred Barrells of Flour, and to Compleat her Cargo with Biscuit; the whole to be shipped for Martinico for the sole account and risk of his most Christian Majesty, and for the Use of the Royal Navy,


Ordered, That the Naval Officer be directed to permit the said Brigg to receive the said lading, and to clear her out accordingly.


Ordered, That the Doorkeeper be directed to call on the dif- ferent Printers of News Papers, vizt: Messrs. Hall and Sellers, Dunlap and Bradford, on each day of Publication, for Ten papers, for the Use of the Council.
