In Consequence of the representation to Congress, by their Com- mittee at Camp, of the extreme want of Provisions, communicated to this Board, the most pressing letters from Camp to his Excel- lency, and the earnest desire of Council to give every possible assistance to the Army, not only in general, but especially in this distressing emergency, the Council requested a conferrence with a committee of Congress, and a committee of the Hon'ble House of General Assembly.


A Committee of three (Mr. Huston, Mr. Muhlenburgh, and Mr. Ellsworth,) Members of Congress, and a Committee of thirteen, in- cluding the Speaker of the Hon'ble House of General Assembly, attended in Council, and the Extracts of letters from Camp were read and the whole subject very fully considered, and the Committee of Congress were informed, that altho' the Council had, as soon as it was possible, exerted their utmost efforts, there was not the least prospect of any considerable supply of meat, as the Cattle did not exist within the State : otherwise, that the State would have been exceedingly pleased to have given a supply of meat instead of Bread, as being much for the interest of the State, as well as per- fectly consistent with their earnest wishes to supply the Army, as it would save the expence of Carriage, which has exceedingly dis- tressed the People of Pennsylvania.


The Petition of George Meade, Thomas Franklin, and William White, praying this Board to take into consideration the case of Mrs. Ferguson, was read; and on consideration,


Ordered, That as the case of Mrs. Ferguson has been repeatedly under the consideration of the Hon'ble House of Assembly, who

are best entitled to dispose of the property of the State, and as they have not thought proper to make any special allowance for Mrs. Ferguson, the Council refer her to the Agents of the County, upon whose justice and humanity in the execution of the Law, they fully confide.


The application of Mrs. Shoemaker, wife of Samuel Shoemaker, for leave to go into New York and return again in one year, being considered :


Ordered, That Mrs. Shoemaker be permitted to go into New York, she giving security not to return again at any time, without leave first obtained from this Council.


A letter from his Excellency General Washington, dated Morris Town, May 11th, 1780, was read, wherein he recommends that Michael Everly, a Serjeant in the tenth Pennsylvania Regiment, be promoted to be an Ensign in that Regiment, " for his extraordinary exertions in inducing the soldiers to re-enlist, and upon many other services ; and that his Commission bear date as of the first of Oc- tober, 1779."


On consideration, on this special case :


Ordered, That the said Michael Everly be accordingly appointed an Ensign in the said Regiment, and that his Commission bear date the first day of October, 1779, agreeable to his Excellency General Washington's recommendation.

A deed was examined and signed by his Excellency the Presi- dent to William Kerline, of the county of Chester, yeoman, con- veying a certain piece of land and Marsh, (part of a larger tract of two hundred and twelve acres,) late the estate of Joseph Galloway, situate on Tinicum Island, in the said County of Chester, bounded as follows, Vizt: beginning at a stake standing in the middle of Bow Creek, being also a corner of Jacob Rudolph's land and Marsh; thence by the said Joseph Rudolph's land and Marsh south twen- ty-nine degress east one hundred perches to a stake in Tinicum road; thence along the middle of the said Road north sixty-three degrees east thirty-four perches to another stake in the said road ;

thence by other part of the said two hundred & twelve acres; Sold to James Budden and others, North twenty-six degrees west sev- enty-six perches to a stake in Bow Creek aforesaid; thence up the several courses thereof fifty-five perches and one half of a perch to the place of the beginning; containing twenty acres one quarter and twenty-six perches : Seized & sold, forfeited to the use of the State, & sold agreeable to law, to the said William Kerline, for the sum of four thousand six hundred and thirteen pounds four shil- lings and sixpence, which sum he hath paid to the Agents for for- feited estates in the said County. Deed dated the seventeenth day of May instant.


'T'he remonstrance of Richard Wolls was read, praying permis- sion to hold a lott of ground on Arch Street, the resolve of Con- gress of the twelfth instant notwithstanding; on consideration,


Ordered, That the said remonstrance be rejected.


A letter from John Patrick Lynch, dated the sixteenth instant, was read; & on consideration,


Ordered, That John Patrick Lynch be removed from the Old Goal to the New Goal, the Council considering him in the Character of a prisoner of War ; and that Mr. Thomas Bradford, Commissary of Prisoners, be informed thereof, that he may have charge of him untill the cause now before the Court of appeal, relative to the Vessel and Cargo claimed by the said Lynch, be decided.


A return of Justices of the Peace Elect for Letterkenny Town- ship, in the County of Cumberland, was read, by which it appears that Josiah Crawford and James McConnell were duly elected. On consideration,


Ordered, That Josiah Crawford be appointed and Commissioned to be a Justice of the peace for the County of Cumberland.


A return of Justices of the peace for the Townships of Straban and Mount Pleasants, in the County of York, was read, by which it appears that David Beatty and David Simpson were duly elected.


On consideration,


Ordered, That David Beatty be appointed and Commissioned to be a Justice for the County of York.


Mr. John Nixon attended in Council, and being interrogated, ac: knowledged that he had written several times to Mr. Andrew El- liott, mere letters of Friendship. Being informed that there was a mention made of "a Commission to Mr. Elliott," he declared that he had written to Mr. Elliott respecting a Vessel belonging to him, (Nixon,) which had been taken by the Enemy, and that he had desired Mr. Elliott to send him two pieces of Candonoe Hand- kerchiefs.


Mess'rs John Maxwell Nesbitt, Mathew Clarkson, and Thomas Laurence, a Committee of Merchants, appointed to confer with Council on several difficulties arising on the currency proposed to be given to the State money now issuing, attended in Council, and

The petition of Captain William Barber, now under parole as a Prisoner of War, was read, praying to be permitted to be consid- ered as a Citizen ; and, also, a representation of his- ease by Cap- tain Benjamin Wikes.


Ordered, That Captain Wikes be requested to State the case of Captain Barber, as far as he is acquainted with it, on oath.


A application by the Clothier General of the United States, for permission to sell a quantity of damaged and other Cloathing, by order of the Board of War, being considered,


Ordered, That the vendue Master be directed to sell the same, agreeable to the order of the Board of War.

The Petition of William Barton and Paul Zantzinger was read, praying that the Rev'd Mr. Thomas Barton and his wife may be permitted to return from the city of New York into this State ; and on consideration,


Ordered, That the many and great inconveniencies which must attend the examples, as well as from the impropriety of the thing itself, the Council cannot, consistent with their duty to the publick, grant the said petition.


Petition of Frederick Sneider, praying a suit of cloaths, for spe- cial services at Lancaster, promised to him by the late President, was read.


Ordered, That the State Clothier do furnish to Frederick Snei- der cloth of midling quality, sufficient for coat, Jacoat and breeches.

Please to pay to Ephraim Blaine, Esq'r, Commissary General of purchases, or order, one Million nine hundred and forty thousand eight hundred dollars, part of the monies raised in the State of Pennsylvania for the use of the United States, to be applied in the department of the said Commissary General, and for which he is to be accountable."

An order was drawn on the Treasurer in favour of the Hon'ble James Read, esquire, for the sum of Twelve hundred pounds, in part of his pay as a Member of this Board.


A Committee of Congress, Vizt : Mr. Elsworth, Mr. Henry and Mr. Houston, of the house of General Assembly, consisting of the Hon'ble the Speaker and twelve members, met in conference with Council, in the Council Chamber, and a free conference on the sub- ject of loan office Certificates was had, In which the Committee of Assembly expressed the earnest desire of their constituents to have a determination of Congress respecting the value of loan office certificates at the several periods at which they have been emitted, as a matter of the highest importance to the People of this State in particular, and on which the determination of the Bill now be- fore the General Assembly for recognizing the debt of the United States, and assuring and providing for the payment of the propor- tion of it to be paid by Pennsylvania. And also freely conferred on the subject of the Quarter Master and Commissaries' Certifi- cates, issued for provisions and other articles supplied, and services done by the people of the State.


The conference having ended, the resolves of Congress of the 19th and 20th of May instant was read, respecting supplies for the Army, and provision to be made in expectation of foreign assist- ance. And also a letter from his Excellency the President of Con- gress, dated the 19th May instant, respecting the same. By which resolves it appears that Congress now demand of this State an ad- ditional sum of one million seven hundred and ninety-six thousand nine hundred and fifty dollars, and that Bills on the Commissioners at the Courts of France and Spain will be drawn to the amount of fifty thousand dollars, of which ten thousand dollars are to be sold in this State.


Ordered, That the resolves of Congress of the Nineteenth and 20th of this instant May, and the letter from his Excellency the President of Congress of the 19th Instant, be laid before the Hon'- ble house of Gen'l Assembly.


A certificate of the payment of fourteen hundred pounds to Rob- ert Smith, Agent for confiscated estates, by John Mitchell, in full for a Negro Man called Aaron, about 25 years of age, pock marked,

The petition of Judith Doyle, convicted of Larceny, and sen- tenced to pay a fine of one hundred and twenty-one pounds ten shillings to the use of the State, was read ; and thereupon,


Ordered, That the said fine be remitted.


The petition of Mary Sharp, convicted of Larceny, and sentenced to pay a fine to the use of the State of three hundred pounds, was read ; and thereupon,

Ordered, That the same be referred to the Hon'ble house of As- sembly.


Mr. Harris, Mr. Boyd, Mr. Ralston, and Mr. Peale, a committee of the Hon'ble House of General Assembly, attended in Council, and a free conference was had on the subject of Finance.


On application of Mr. Physick, and in consideration of the rep- resentation made by him,

Mr. Gardner, and


James Wilkinson, Eso'r, Clothier General, presented to the Council an order of Congress in the following words, to wit :


IN CONGRESS, Ap'1 17th, 1780.


40,000 dollars.


Gentlemen :- Pay to James Wilkinson, Esq'r, Clothier General, or his order, the sum of forty thousand dollars, (part of the monies raised in the State of Pennsylvania for the use of the United States,) advanced for the contingent expenses of his office, and for which he is to be accountable.
