A letter was received from Mr. Holker, Consul of France, in- closing a sett of exchange, (4 bills) drawn agreeable to a request of the Board, in favour of the President, for eleven thousand four hundred and twenty-eight Livres eleven Sols Tournois, which were endorsed in favour of James Searle, Esq'r, for the purpose afore- said, and for which a receipt was given in the following words :

An order was drawn on the Treasurer in favour of Jesse Bonsall, for the sum of 14,400 dollars, for five head of cattle purchased by Algernon Roberts, Commissioner of purchases in Philadelphia county, for the use of the army, agreeable to act of Assembly, passed the first day of June last.


An order was drawn on the Treasurer in favour of Isaac Serrall, for the sum of 19,106 dollars, in full, for fourteen head of beef cattle, purchased by Mess'rs Bull and Armstrong, Commissioners of purchases in the county of Philadelphia, and John Crosby, Junior, Commissioner of purchases in the county of Chester, for the use of the army, agreeable to the said act.


An order was drawn on the Treasurer in favour of the Honb'e William Moore, Esq'r, Vice President, for the sum of £3,000, in part of his salary, for which he is to account.


An order was drawn on the Treasurer in favour of the Honb'e John Lacey, Jun'r, for the sum of fifteen hundred dollars, in part of his pay as a Member of this Board, for which he is to ac- . count.


The petition of Elizabeth Powers was read ; and on considera- tion,


Ordered, That she be released from confinement, on condition that she depart the State in 2 weeks from this day.


A deed was examined & signed by his Excellency the President to Alexander Oliver, conveying a certain tract or parcel of land situate in lower Providence township, in the county of Chester, Beginning at a stone by the road leading from Providence to Edge- mont; thence by Edward Vernon's land north fifty-seven degrees

west eighty-six perches and three-quarters, to a stone, & south thirty degrees west seventy-eight perches, to a post ; thence by land late of Nathaniel Vernon south fifty seven degrees east eighty perches and three-quarters, to a stone by the said Road ; thence by the same north thirty degrees east seventy-eight perches, to the place of beginning; containing forty-two acres and thirty perches. Seized as the estate late of Gideon Vernon ; forfeited & sold agree- able to law, for the sum of £1,307 16 3, to the said Alexander Oliver, which sum he hath paid to the agents of the said county. Deed dated the fifth day of August, 1779.


A deed was examined and signed by his Excellency the Presi- dent to James Hendry, conveying one full, equal and undivided moiety or half part of a certain lott or piece of ground situate on the north side of Plumb street, in the district of Southwark, and county of Philad'a, containing in breadth on the said Plumb street fifteen feet eight inches and a quarter, and in length ninety feet, be the same more or less ; Bounded southward by the said Plumb street ; westward by ground then of Alexander Lavid, now of John Williams ; northward by an alley leading to George street; and eastward by ground late of John Fullerton, now of the widow Read. Seized as the estate late of Peter Arthur; forfeited and sold, agreeable to law, to the said James Hendry, for the sum of one hundred and ten pounds, which sum he hath paid the agents of forfeited estates in the said county. Deed dated the 30th day of June last.


A letter was read from General St. Clair, acknowledging the re- ceipt of forty-eight recruits by Lieutenant Honeyman, and seventy- eight by Captain McIlhatton, and also recommending the Rev'd Mr. M'Murdie as Chaplain to the first regiment.


Resolved, That Major General Armstrong be furnished with a suit of light cloaths and trimmings, and two pair of silk stockings, to be charged in account, and that his son, Major Armstrong, Aid- du-Camp to General Gates, suddenly ordered into service, be sup- plied with one hat, drilling for two pair of breeches, and linnen for four shirts, and that Colonel Lewis Farmer issue the same.


A letter was read from Jacob Eichelberger, Esq'r, one of the Justices of the peace of York county, signifying that he had been accused before the General Assembly of mal-practice in his office, and criminality as a private person, and praying that if the Board shall deem the said accusation of weight and consequence, they would proceed to a hearing, or if they deem it frivolous & unsup- ported, they would accept his resignation of his office as a Justice of the peace;


Whereupon,


Resolved, That the terms of the said resignation cannot be com- plied with, as this Board cannot pronounce an accusation frivolous or unsupported, which the complainants have not been called on to support, but if such resignation is made generally, farther conside-

ration will be had; otherwise that the indictment against the said petitioner be first determined, and that in the meantime it is the sense of this Board that the said Jacob Eichelberger do not act in his office of Justice of the peace while the charges against him re- main undetermined.

PHILAD'A, Thursday, July 13th, 1780. PRESENT :

WHEREAS, it is represented to this Board that the Hon'ble the Congress have instructed the Hon'ble Henry Laurens, Esq'r, their agent, for procuring a foreign loan, to offer an interest of six per cent , from which there is reason to apprehend that difficulties may arise in effecting the proposed loan in behalf of the State, at the proposed rate of five per cent .; Whereupon, on full consid- eration, .


Resolved, That it be recommended to the Hon'ble James Searle, Esq'r, if he shall find it indispensibly necessary, to offer an equal interest with the above, and that this Board will at the next ses- sions communicate the same to the Hon'ble house of Assembly, for their approbation and confirmation.


An order was drawn on the Treasurer in favour of Colonel Lewis Nichola for the sum of £1190, amount of money due to the said Colonel Nichola, Captains Woelpper and McIlhatton, and Lieutenants Honeyman, Wood and Pugh, in lieu of their rations & refreshments, from the fourth day of June last to the 2d day of July last.


An order was drawn on the Treasurer in favour of Mr. Thomas Bradford, Commissary of Prisoners, for the sum of £3845 16, amount of his account as Commissary of Prisoners for this State, from the first day of May, 1779, to the 20th day of February, 1780, forty-two weeks, at &91 11 4, per week.


The Commissioners of the Continental Loan Office in this State having tendered another sett of Bills of Exchange in lieu of those received on the eleventh instant, Mr. Searle returned the latter and received the following, vizt :


Four setts, (4 in each sett,) 500 dollars each,

A letter was received from the Chief Justice, Mr. Justice Bryan, and the Attorney General, containing an opinion on the case lately referred to them by this Board, on an application from the Judge of the Admiralty.


A letter from Colonel Coxe, Assistant Quarter Master General, to Charles Pettit, Esq'r, Assistant Quarter Master General, re- questing an order for State money to pay sundry waggons im- pressed in Bucks county by General Knox, agreeable to orders from the Commander-in-Chief. The same was referred to the Vice President to make enquiry and report.


A letter from Michael Hillegas, Esq'r, Treasurer of the United States, informing this Board that he had receiv'd draughts from Congress for 1,796,950, and for 4,569,045 dollars and one third dollar, and requesting information when the whole or part will be paid.


A letter from the Hon'ble Committee at Camp, requesting a Magazine of short forage to be formed on Hudson's river, and that the supplies of this State may be forwarded, was read, and ordered to be filed.

An order was drawn on the Treasurer in favour of John Hazle- wood, Esq'r, Commissioner of purchases for the city of Philadel- phia, for five thousand pounds of the money emitted by an act of General Assembly, passed the 25th day of March last, for pur- chasing supplies for the army, for which he is to account.


An order was drawn on the Treasurer in favour of Hon'ble John Hambright for the sum of fifteen hundred pounds, in part of his pay as a member of this Board, for which he is to account.


An order was drawn on the Treasurer in favour of Colonel Lewis Farmer for the sum of £21,000, for purchasing the enumerated ar-

ticles of rum, tea, sugar, coffee, &ca., for the use of the troops of the Pennsylvania line, for which he is to account.


An application from Mr. Isaac Moses, of this city, merchant, to sell, by auction, four chests of damaged Bohea tea.


Resolved, That Messrs. William Heysham, Philip Bohm and Hillary Baker, Jun'r, be appointed to view the said goods, and re- port, on oath or affirmation, whether the same are really & bona fide damaged, agreeable to act of Assembly, the petitioner to bear the expence thereof.


Application having been made by the Lieutenant of York coun- ty, respecting the destination of the volunteers raised in that county, and the providing them with arms,


Resolved, That the said volunteers be formed into two compa- nies, the one to march to Bedford, & the other to Westmoreland, there to act under the direction of the Lieutenants of those Coun- ties, respectively, so as to afford the most effectual protection to the frontiers.


Secondly. That the Commissioners of purchases for said coun- ties, respectively, do furnish the said troops with rations, agreeable to the Continental allowance.


Thirdly, That the Lieutenants of Bedford and Westmoreland do make diligent inquiry with respect to the arms furnished last year to the Ranging companies by this State, and cause the same to be delivered, for the use of the above companies, so far as the county of York may be deficient in giving a suitable supply.


Fourthly. That the Lieutenant of York do return, as soon as may be, a list of the men, and that he take due care they be all qualified, both as to age and health, agreeable to the directions of the act of Gen'l Assembly.

The President read a letter from Monsieur De Cornay, announc- ing the arrival of the French Fleet at Newport, Rhode Island, dated the 11th instant ; also, another, dated the 4th instant, intimating that the State money, vizt, £17,000, heretofore borrowed, did not answer his purpose, & requesting to return it.

A letter was also read from the committee of Congress at Camp, reflecting highly on this Board for not corresponding with them, agreeable to their requisition of the eighth of June last.


The said letters were ordered to remain for further consideration, & the Board proceeded to apportion the men and supplies demanded of the several counties, of which a rough draught was made, and adjourned for farther consideration.


Resolved, That the Sheriff of the city and county of Philadel- phia do apprehend Mrs. Jane Bartram, Mrs. Stark, Mrs. Volans, and Mrs. Preston, wives of Alex'r Bartram and others, late of this State, and now in the service of the enemy, and deliver them to the keeper of the workhouse, there to remain untill they respect- ively give security to leave this State forthwith, and not to return again.

An order was drawn on the Treasurer in favour of Francis Mc'- Henry, for the sum of £690, for his expences for apprehending and securing two British deserters, taken in the county of Bucks, on their way to New York.


An order was drawn on the Treasurer in favour of Philip Price, for the sum of £5,097 10, in full for five head of cattle, pur- chased by Algernon Roberts, Commissioner of purchases for Phil- ad'a county, for the use of the army, agreeable to act of Assembly passed the first day of June last.


The papers of the Schooner Flying Fish, from Bermudas, hav- ing been examined & considered, and also the act of Assembly en- titled, " an act for regulating navigation and trade in this State,


Resolved, That from the inconsistency and contradiction of the oaths and papers, there appears great reason to suspect that this is the opening of an illegal and dangerous trade, by which, under colour of indulgence to the inhabitants of said Island, commodi- ties of the growth of the British Islands at enmity with us, and prize goods taken from the subjects of these States, are likely to be introduced into this State, expressly contrary to the said act of Assembly, as well as the general interests of these States; and that therefore the Naval Officer be directed to seize the goods on board the said vessel not the growth or produce of the Island of Ber- mudas, vizt :: Twenty hogsheads of molasses, nine casks of coffee, 3 hogsheads & 5 casks of sugar.

SUPREME EXECUTIVE COUNCIL.


Commissioner of Purchases in the county of Bucks, for the Con- tinental army, agreeable to an Act of Assembly passed the first day of June last.


Resolved, That Colonel Joseph Hart, Lieutenant of the county of Bucks, be authorized and requested to send down William Earl, a rejected volunteer, to this place, to be employed in the works at Mud Island, unless he shall immediately refund the monies re- ceived by him from the company, for which he enlisted.


An order was drawn on the Treasurer in favour of Major Wil- liam Armstrong, for the sum of three hundred and seventy-one pounds five shillings, for sundry expences in seizing horses for the Continental army, on the 10th of June last.


WHEREAS, John Jones and George Montgomery, heretofore con- victed of burglary at a court of Oyer and Terminer, held for the city and county of Philadelphia, were reprieved untill the sitting of the next Gen'l Assembly, and nothing since appearing to require the execution of the sentence passed upon them, the said John Jones and George Montgomery, and their confinement being bur- thensome to the publick,


Resolved, That they receive pardons for their offences, on condi- tion that they enter on board the Saratoga Ship of War, in the ser- vice of the United States of America, & serve during the present war.


A letter from General Hand, requesting that sundry gentlemen nominated as officers in the fourth Pennsylvania Regiment may receive commissions, under the appointment of this Board, vizt : Mr. John Pratt, Ensign, from first July, 1779; Mr. Henry Henly, do. 2d do .; Mr. Andrew Henderson, do. 4th do., and Mr. Nathaniel Smith, do. 5th ditto.


Resolved, That the above gentlemen having been in actual ser- vice for more than a year, and appointed antecedent to the late re- solve of Congress against new appointments, be nominated to the Board of War in the above companies, according to the above date respectively.


John Mitchell, Esq'r, D'y Q'r M'r G'l, paid into the hands of the Vice President, the sum of £700, the rent of the bridge on Schuylkill for the month of June, and the same was accordingly paid into the hands of the Treasurer.


Messrs. Heysham, Bohm, and Baker, having, agreeable to order of the 15th, reported the tea mentioned in Isaac Moses's petition, to be damaged,


Resolved, That the city auctioneer have leave to dispose thereof, agreeable to act of Assembly, and taking care to advertize the same as damaged goods sold agreeable to law; and that a copy of this resolve be endorsed on said report, and sent to the auctioneer.


A letter from his Excellency the President of Congress, enclo- sing a resolution and sundry papers referring the case of Thomas Jones, and others, to this Board, who claim their discharges for that

the time of enlistment is expired, were read, and referred to Gen'l Lacey, Major Arndt, and Captain Hambright, to hear the petition- er and report to the Board.


Two letters were read, the first dated the 3d instant, the other , the fifteenth, from General Greene, Quarter Master General, sug- gesting, in the former, the necessity of branding the horses sent from this State, and proposing a brand of U. S. P .; the other re- questing such information as circumstances will admit, how far the requisition of the Committee of Congress, at Camp, will be com- plied with by this State, when the supplies will be ready, and when collected ; For which an answer was immediately prepared, to be forwarded by the first opportunity.


Petition from Meade and Company, and John Maxwell Nesbit and Company, representing their being concerned in the Schooner Flying Fish, and that they had no intentions to contravene the laws of the State, and praying the favour and indulgence of the Board with respect to the seizure ; Whereupon,


Resolved, That the said petition be farther considered to-morrow, and that the Chief Justice and Mr. Judge Bryan be requested to attend the Council to-morrow morning, to advise in said business.

A letter from Colonel Butler, of the 17th instant, was read, re- questing that the following gentlemen may be appointed ensigns in the ninth Pennsylvania Regiment, to wit: Nathaniel Smith, as first Ensign ; David McKnight, 2d Ensign ; James Erwin, 3d En- sign ; and Reed, fourth Ensign; and his Excellency Gen'l Washington having signified that the said appointments are indispensibly necessary,


Resolved, That they be appointed, and that the Hon'ble the Board of War be requested to issue the commissions accordingly.

An order was drawn on the Treasurer in favour of Mr. John Emmick, for the amount of 11,333 dollars, & one third Continen- tal money, in State money, at the rate of sixty Continental dollars for one of State money, in full for seven head of cattle and twen- ty-seven sheep, delivered to Jacob Cook, one of the Commissioners of purchases in Lancaster county, for the use of the army, agreea ble to an act of the General Assembly, passed the first day of June last.


An order was drawn on the Treasurer in favour of Serjeant George Dalzell, for the sum of £30, for his services in bringing a prisoner from York town to this icty.

A deed was examined and signed by his Excellency the Presi- dent, to Peter Wikoff, Isaac Wikoff, & James Hutchinson, of a certain tract or piece of land and meadow ground, situate on the road leading from Philadelphia to Point-no-Point, in the Northern Liberties, containing about seventy six acres, be the same more or less ; (sixteen acres whereof are banked meadow ;) bounded on the south-east by the river Delaware ; on the south-west by land of John Gibson ; on the west and north-west by land of Joseph Ball and George Emlen; and on the north-east by land late of Joseph Fox, dece'd; seized and sold agreeable to law, as the estate late of Samuel Shoemaker, during the term of his natural life, to them, the said Peter and Isaac Wikoff and James Hutchinson, for the sum of £12,400 lawfull money of Pennsylvania, which sum they have paid into the hands of the Agents for forfeited estates for the county of Philadelphia. Deed dated the 22d day of July instant.


The petition of James McCown, convicted of felony and sen- tenced to pay a fine to the use of the State of £500, was read, setting forth that he is unable to pay the said fine, and praying re- mission of the same; thereupon,


Ordered, That the said fine be remitted, on condition that the said James McCowan shall enter on board the Confederacy or Sara- toga Ships of War, in the service of the United States, and serve during the present war.

An order was drawn on the Treasurer in favour of Randle Mit- shell, for the sum of ££434, to be paid in State money, at the rate of sixty pounds Continental money for one of State money, it be- ing the allowance, including costs, made by the Supreme Court for the maintainance of Mary Campbell, (the wife of Peter Camp- bell, an attainted traitor,) from December, 1776, to the first of April, 1779, decreed to her the 4th of April last.

An order was drawn on the Treasurer in favour of Mrs. Mary Campbell, for the amount of £256, Continental money, in State money, at the rate of sixty pounds Continental money for one of State money, it being the allowance made by a decree of the Su- preme Court for the maintenance of Mary Campbell, (the wife of Peter Campbell, an attainted Traitor,) and her child, commencing the first day of April last, to be paid in quarterly paym'ts.
