An order was drawn on the Treasurer in favour of James Loug- head, Paymaster of the militia of the city and liberties of Philad'a, for the sum of £2,800 of the money emitted by an act of Gen'l Assembly, passed the 25th day of March last, for paying the mi- litia of the said city and liberties lately called into service, for which he is to account; the same to be charged to Colonel William Henry, Lieutenant, and to be repaid by him out of the monies arising from militia fines.
Resolved, That Robert Jewell, Esq'r, keeper of the new prison, be directed to release from confinement Captain Joel, committed to prison by order of this Board on the 3d instant, as a suspicious person.
The Council taking into consideration the situation of David Franks & William Hamilton, confined in the new prison by an order of the third instant, as persons inimical to the American cause, on the act of Assembly passed the 10th day of October last, entitled " An Act to impower the Supreme Executive Coun- cil and Justices of the Supreme Court to apprehend suspected persons, and to increase the fines to which persons are liable for neglecting to perform their tour of militia duty ;" and after some time spent thereon,
Resolved, That the said David Franks and William Hamilton, do depart this State within fourteen days from the date hereof, and that they give security, each in the sum of £200,000, to go within the enemies lines, and not return again to any of these United States during the continuance of the present war.

A letter from his Excellency the President of Congress, of the seventh instant, was read, requesting that a supply of flour may be sent forward to the army as soon as possible.
A letter of the 6th instant was also read, inclosing a new arrange- ment of the army, as established by Congress, on the 21st of Sep- tember last, as follows, vizt :
"IN CONGRESS, September 21st, 1780.
" Resolved, That the regular army of the United States, from and after the first day of January next, consist of four regiments of cavalry or light dragoons, four regiments of artillery, forty-nine regiments of infantry, exclusive of Colonel Hasen's regiment, here- after mentioned, one regiment of artificers. That each regiment of cavalry or light dragoons consist of six troops, and that each troop consist of sixty-four non-commissioned officers and privates, with the same number of commissioned officers as at present.
"That each regiment of artillery consist of nine companies, and that each company consist of sixty-five non-commissioned officers and matrosses, with the same number of commissioned officers as at present.
" That each regiment of infantry consist of nine companies, and each company of sixty-four non-commissioned officers and privates; and that the regiment of artificers consist of eight companies, & each company of non-commissioned officers & privates.
" That the several States furnish the following quotas, vizt :- New Hampshire, 2 regiments of infantry; Massachusetts Bay, 10 do., & 1 of artillery ; Rhode Island, &c., one regiment of infantry ; Connecticutt, five do., and one of cavalry ; New York, 2 do., & one of artillery; New Jersey, 2 regiments of infantry ; Pennsylvania, six regiments of infantry, one of artillery, one of cavalry, & one of artificers ; Delaware one regiment of infantry ; Maryland, 5 do .; Virginia, eight do., 1 of artillery, and 2 of cavalry ; North Caro- lina, four regiments of infantry; South Carolina, 2 do .; Georgia, one do: That the States select from the line of the army a proper number of officers to command the several regiments to them re- spectively assigned, taking notice that no new appointment is to be made of a higher rank than that of Lieutenant-Colonel Comman-

dant: That the States be and they are hereby called upon, in the most pressing manner, to have their regiments compleated in the field by the first day of January next, at farthest.
" That it be recommended to the States to fill up their respective regiments by enlistments for and during the war; but in case the full quota of any of the States cannot be compleated with such recruits, by the first day of December next, that it be recommended to such State or States to supply the deficiency with men engaged to serve for not less than one year, unless sooner relieved by recruits en- listed for the war, which they are requested to exert their utmost endeavors to obtain as speedily as possible ; and in order thereto, it is further recommended that the officers at camp be impowered and directed to use every prudent measure, and improve every favoura- ble opportunity, to enlist for the continuance of the war, such of the men belonging to their respective States as are not engaged for that period, whether now in the field or hereafter, from time to time, joining the army; and that a recruiting officer from each corps be kept in the State to which the regiments respectively be- long, to enlist recruits for the war, as well as to relieve those who are engaged for a shorter or limited term, as to supply casual de- ficiencies.
" That two dollars be granted to the recruiting officer for every able-bodied soldier he shall enlist for the war, who shall join the army, and that a sum not exceeding fifty dollars, be allowed as a bounty to every such recruit.

Ordered, That Captain Joseph Stiles, Commissary of military stores, be directed to deliver to Mr. John Patton, or his order, the gun powder belonging to the brigg George, now in the publick magazine.
Doctor Adam Kuhn having lately arrived in this port from St. Croix by the way of New York, in the Sloop Elizabeth, comman- ded by Captain William Westcoat, under a pass from Sir George Bridges Rodney; and the said Adam Kuhn being examined before this Board, it appears that he is a very suspicious character, whose going at large is dangerous to the Commonwealth ; thereupon,
- Resolved, That the said Adam Kuhn be committed to the new prison untill the further order of this Board, pursuant to the act of Assembly, passed the 10th day of October, 1779, intitled "An Act to impower the Supreme Executive Council & Justices of the Su- preme Court, to apprehend suspected persons, and to increase the fines to which persons are liable for neglecting to perform their tour of militia duty ;" and the keeper of the said prison be di- rected to receive and keep him accordingly.
The petition of Doctor John Baker, John Henry, jun'r, Joseph Wharton, and Mrs. Griffith, setting fourth that four Negroes, to

wit : Jem, Nat, Cato, and James, belonging to them, have been convicted, at a court of Oyer and Terminer and General Goal De- livery, held at Philadelphia the 25th day of September last, of stealing a large quantity of rum, and sentenced by the said court, each of them to be whipped on their bare backs, to restore the value of the goods stolen, and to pay four several fines to the use of the State, amounting to the sum of £10,000, was read, praying remission of the said fines. A recommendation from the Justices of the said court, and a further representation of the said Doctor John Baker, respecting his negro James, being also read; on con- sideration,
Resolved, That the fines to the use of the State be remitted, and that the said negro James' punishment of whipping be also remitted.
Resolved, That the Naval Officer be directed to take into his custody the Sloop Elizabeth, William Westcoat, Master, lately ar- rived in this port with Doctor Kuhn and his family. That she be brought to some convenient wharf, and he be authorized to unload and examine her cargo, taking to his assistance Messrs. William Heysham and Alexander Boyd; that the expense attending the said business be paid by Dr. Kuhn ; and the said Naval Officer is also directed to report to this Board.

An order was drawn on the Treasurer in favour of Frederick Sneyder, Doorkeeper, for the sum of £382 16 3, to pay for a box of candles purchased by him for the use of the Council.
The petition of Nathan Tyson, late of New York, and now con- fined in the new prison, praying to be permitted to go at large on parole, was read and dismissed.
A memorial from William Constable was read; and thereupon,
Ordered, That William Constable become bound himself in the sum of £50,000, and two sufficient sureties, each in the sum of £25,000, condition that he be of good behaviour during the pre- sent war.
The Council taking into consideration the case of Doctor Adam Kuhn,
Resolved, That the said Doctor Adam Kuhn, with his wife and family, do depart this State in three days from the date hereof, in the sloop Elizabeth, belonging to St. Croix, William Westcoat, Master ; and that he give security, himself in the sum of £100,- 000, and two surities in the sum of fifty thousand pounds each, not to return during this war to any part of America, or to any part of the dominions of the King of Great Britain.
On motion,
Resolved, That a warrant issue to the Sheriff of the city and county of Philadelphia, for apprehending a certain Joshua Edwards, late an apprentice to Doctor Anthony Yeldall, he being a person whom there is just reason to suspect to be an enemy to the Ameri- can cause, and to hold an unlawfull and dangerous correspondence and intercourse with the enemy at New York; and that he bring him before this Board for examination, pursuant to an act of the General Assembly, passed the 10th day of October, 1779, entitled "An Act to impower the Supreme Executive Council and Justices of the Supreme Court to apprehend suspected persons, and to in- crease the fines to which persons are liable for neglecting to perform their tour of militia duty."
On consideration,
Resolved, That Henry Osborne, Esq'r, be appointed and com- missioned to be Judge Advocate of the militia of the Common- wealth of Penn'a.

An order was drawn on the Treasurer in favour of Francis Mc- Henry, for the amount of £435 19 6, in State money, at 60 for one, amount of his account of the wages and expences of a guard bringing to this city sundry British prisoners.
The petition of Samuel Jeffries, praying a pass to England by the way of New York, was read ; on consideration,
Ordered, That a pass be granted, on condition that he enter into security, himself & two sufficient surities, in the sum of £50,000, to depart the city of New York for England, on or before the first day of December next, and not to return to any part of America during the present war.
A petition from Thomas Mendenhall, for a pass to New York, in order to take shipping from thence to Ireland, was read ; and there- upon,
Ordered, That a pass be granted him, on condition that he enter into security as aforesaid, to leave the city of New York by the first of December next, and not return again to any part of America during the present war.
A petition from David Franks, for a pass to New York, for him- self, his daughter, one man servant and two maid servants, was read; and, on consideration,
Ordered, That a pass be granted to the said David Franks and his daughter to go into the city of New York, and also for one maid servant, provided she be an indented servant.
Joshua Edwards having been brought before this Board, agree- able to the order of yesterday, on the act of Assembly entitled " An Act to empower the Supreme Executive Council and Justices of the Supreme Court to apprehend suspected persons, and to in- crease the fines to which persons are liable for neglecting to per- form their tour of militia duty;" and an examination having been had, it appears that he made use of some imprudent language in the presence of Robert Smith, Esq'r, agent, &c., signifying his in- tention to go into New York at the risk of his life, &c.,

Resolved, That if the said Joshua Edwards become bound in se- curity, himself and two sufficient sureties, in the sum of £15,000, conditioned that he be of good behaviour during the present war, and that he do not go into the city of New York without the per- mission of this Board.

Captain Westcoat having represented to this Board that the mast of the sloop Elizabeth, a Flag of Truce belonging to St. Croix, is so damaged that he will be under the necessity of getting a new one ; therefore,
Resolved, That he be permitted to remain in this port untill Thursday next, the resolution of the twelfth instant notwithstanding.
Ordered, That Doctor James Hutchinson be directed to deliver to Colonel Lewis Farmer all the hospital stores now in his posses- sion belonging to the State, instruments and medicines excepted, taking his receipt for the same.

Ordered, That Colonel Lewis Farmer be directed to deliver to Captain Finley fifty-two pair of hose, for the use of the officers of the Pennsylvania troops now at Fort Pitt.
The returns of the general election of the city and county of Philadelphia were received and read, by which it appears that the following gentlemen were duly elected, vizt :

Ordered, That Esther Yeldall, wife of Doctor Anthony Yeldall, an attainted traitor, depart this State within seven days from the date hereof, with her five children, and go within the enemies' lines, and that she give security in the sum of £20,000, not to return again to any of these United States during the present war, and the Secretary is directed to make out a pass accordingly.
Passes were granted to James Gibson & Susanna, his wife, and to Christiana George, to go into the city of New York, on condi- tion that they do not return again during the present war.
On application,
Ordered, That a pass be granted to Miss Hannah Arnold, and her nephew, with their baggage, to go to the State of Connecticut.
The Council taking into consideration the application from the Board of War for the loan of a number of the arms of this State for the southern army, they engaging to return a like number, in good order ; Thereupon,
Resolved, That the Commissary of Military Stores be directed to deliver to the Hon'ble Board of War, or their order, 400 stand of the arms belonging to this State, taking their receipt to return the like number in good order when demanded.
