An order was drawn upon the Treasurer in favor of John Buchan- nan, for sixty-one pounds one shilling, in full of his account for surveying the road layed out from Miller's Spring, in Cumber- land county, to Fort Pitt, and making a draft of the same, accord- ing to act of Assembly of 21st of September, 1785.

Peter Conrad, Esquire, was appointed and commissioned a Jus- tice of the Peace for the district of Hamilton township, in the coun- ty of Northampton, upon a return made according to law : Mr. Conrad was also appointed a Justice of the Court of Common Pleas for the said county.


Upon a letter from John Franklin and John Jenkins, praying "the protection of Council to their persons while coming to and remaining in this city, in waiting upon the Legislature as Agents for the settlers at Wyoming,"


Order was taken, that a passport under the seal of the State be made out for the said John Franklin and John Jenkins, or others, Agents as aforesaid, granting to them the desired protection, as far as the authority of the Executive will extend, but that they be ap- prized that this will not reach beyond prosecution of a criminal nature.


The following orders were drawn upon the Treasurer, vizt :


In favor of John Nicholson, Esquire, for two hundred pounds, in full for one quarter's salary as Comptroller General, ending the 13th of July last.


In favor of the Honorable Charles Pettitt, Esquire, for four hun- dred and ninety-five pounds fourteen shillings, in full for his attend- ance as a delegate from this State to Congress untill the 19th instant, inclusively, and his mileage.

Ordered, That the resolution of Council of the 24th of Septem- ber, 1785, upon the claims of Mr. Edward Williams to commuta- tion of half pay as Clerk and Paymaster in the late general hos- pital, be reconsidered; and on the second motion,


Ordered, That the said resolution be rescinded, and that the Comptroller General be furnished with a copy of this proceeding.


The petition of Thomas Cuthbert and Daniel Bickley, the depo- sition of said Cuthbert, and a certificate from William Howell, Isaac Craig, and William Pollard, being read,


Ordered, That such part of two pipes of Teneriffe wine as was, upon seizure of the Excise Officer, forfeited to the Commonwealth, be restored to the petitioners aforesaid.


Upon the petition of Margaret Talbott, it was


Ordered, That the fine to the State, and imprisonment for twelve months, to which she was sentenced upon conviction of lar- ceny, be remitted.


The fine payable to the use of the State by Samuel Marriott, upon his conviction of selling spirituous liquors by small measure, without licence, was remitted.

.On the petition of Henry Revers, convicted of larceny at the July Sessions of the City Court, and sentenced to a fine of six pounds seventeen shillings & six pence, payable to the State,


Ordered, That the fine aforesaid be remitted.


A letter from the Comptroller General, requesting Council to de- termine the allowance to be made to the Agents for the sale of the Barracks & Barrack lotts, was read, and an order taken that the said Agents be allowed a commission of two and a half per cent .. upon the monies paid by them into the public Treasury.

The Comptroller General's report upon the account of Philip Albright, Esquire, late a Captain in Colonel Miles' Rifle regiment, was read and approved.


A message from the President and the Supreme Executive Council to the General Assembly.


GENTLEMEN :- Herewith will be laid before you a number of communications made by Congress and particular States since your last meeting. These we recommend to your consideration, and especially the requisition of Congress for our quota of the Federal supply for the year 1786. It is to the honor of Pennsylvania that she has hitherto been behind none of the States in ready compliance with such requisitions, and we have no doubt but you will take care to provide that this part of our character shall continue un- diminished-the due support of our General Government, and the punctual discharge of our foreign obligations, being of essential im- portance to the welfare and security of the whole Union.


Some farther progress has been made in the negociation with the States of Delaware and Maryland since your last session : Com. missioners have been appointed, an interview proposed, and every inclination to meet this Commonwealth on the ground of reciprocal advantage discovered.

SUPREME EXECUTIVE COUNCIL.


Having observed that the act passed on the twenty-second day of September, 1785, entituled "An Act for the relief of officers, soldiers, and seamen, who, in the course of the late war, have been wounded or otherwise disabled in the service of this State or of the United States," is liable to many and great abuses. That it has, in some instances falling within our own knowledge, been made to operate on very improper subjects. We are of opinion that a revisal thereof should take place as early as possible, and such alteration made as will effectually prevent any misapplication of the benevo- lence of Government.


Among the papers sent you are some which relate to the people of Wyoming.


We expect that these settlers will send agents hither to repre- sent to your Honorable House their present situation. BENJAMIN FRANKLIN.

A report of Willam Bradford, Esquire, on the claims of Mary Jenkins (referred on the 22d instant) to a city lot, was read and filed.

On'motion of Mrs. McLene, James Maxwell, Esquire, was ap- pointed and commissioned President of the Court of Common Pleas, General Quarter Sessions of the Peace and Jail Delivery, and Orphans' Court, of the county of Franklin.


An order was drawn on the Treasurer in favor of Philip Albright, for forty pounds thirty shillings and two pence, ballance due upon his account as late Captain in Colonel Miles' Rifle regi- ment, according to the Comptroller General's report, to be paid out of the fund appropriated to the recruiting service.


A deed was examined and signed by the Vice President, to Ed- ward Bartholemew, Esquire, for a tract of land situate in New- town township, in the county of Chester, containing one hundred and seventy-two late the estate of Matthew Apsden : Sold on the 29th of April last, to said Edward Bartholemew, for the sum of one thousand and ninety pounds. Deed dated this day.


The Attorney General having been consulted on the case of William Barton, Esq'r, agreeably to the minutes of the 18th inst., an order was taken that execution against him for a debt due to the Commonwealth, on a judgment obtained at the suit of the Collector of the Customs, be suspended for the term of two years from the date of this proceeding.

A petition being presented to the Board from James Robinson, representing the great injury which he must sustain from the ope- ration of a resolution of Council of the twenty-third of June last, in favor of Colonel William Butler, and the said petition being ac- companied by a certificate from a number of respectable inhabi- tants of Pittsburg in favor of the character of the said James Ro- binson ; therefore,


Resolved, That the said resolution, as far as it respects the im- proved land upon which the said Robinson resides, be hereby re- scinded, and that the said Robinson be permitted to enjoy the said improvement, with the priviledges he has hitherto had, until other- wise directed by this Board.

The Comptroller General's report upon the account of Lieuten- ant Peter Conrad, for pay and subsistence, while a prisoner, from 1778 to 1781, was read and approved.


Agreeably to the sixteenth section of an act of the General As- sembly intituled " An Act for directing the mode of distributing the donation lands promised to the troops of this Common- wealth,"


The Surveyor General made return to Council of the draught of lots laid down within the limits of the said lands ; upon which it was


Ordered, That the drawing of the lottery for, and the patenting of the said lots, shall commence on the first day of October next, to be continued for one year from the 29th instant.


The consideration of the petition of David Lennox, stating " that in April, 1784, he imported into this State a cargo of rum, sugar, and coffee ; that he afterwards entered part of the said cargo for exportation, and praying to be allowed a drawback upon such part of the cargo as was exported in due time," read on the first of July, 1785, was resumed, and an order taken that the resolution of Council of that day be rescinded, and the prayer of the said pe- tition granted.


The petition of Edward Kenan and others, praying for a settle- ment of their accounts, was read, and referred to the Comptroller General.


An order was drawn on the Treasurer in favor of Frederick Sneider, for fifteen pounds ten shillings, in full for his wages as door-keeper until this day, included.

Colonel Francis Johnston was directed to advertise a further sale of city lots numbered from 1921 to 1982, inclusively, situate on both sides of Market or High street, and between Fourth and Fifth streets from Schuylkill; also eleven lots on the north side of Ches- nut street between Seventh and Eighth streets from Delaware, to be held on Wednesday the 20th of this month, at the old Coffee House.

The Comptroller General's report upon the account of Cooke, jeweler, for seventeen ounces ten penny weights of gold forfeited to the Commonwealth by the non-appearance of A. Boye: before the Supreme Court, upon a prosecution for passing bas metal as gold, was read and approved.


A certificate of the division of the township of Smith, in the county of Washington, by the Court of Quarter Sessions of the Peace held at Washington, for the county aforesaid, on the 5th o January last, was read, and order taken that the division be con firmed, agreeably to the decree of the said Court.

A Message from the Vice President and the Supreme Executive Council to the General Assembly :


GENTLEMEN :- Having observed with the greatest satisfaction, a .. revival of that spirit and those habits which have so highly distin- nguished the militia of this city and its vicinity, and wishing to give them such countenance as will most effectually tend to diffuse them throughout the State, we have, during your late recess, unani- mously appointed Colonel Francis Mentges to the place of Inspec- tor General. Under this appointment it will become his business f to encourage and direct this rising disposition, to mark out and es- 8. tablish a uniformity of appearance and discipline in the several corps, to examine into the state of arms and accoutrements, and to notice and report all abuses of such public property as may fall within his care or observation. In executing this necessary and important trust, some expence must be incurred and much time given. 'Tis, therefore, the object of this message, to request that or these such compensation be made as the House in their wisdom will think proper to direct. e


We take this opportunity of communicating also a letter of the wenty-third ult., from President Sullivan, containing several pa- vers relating to the capture and condemnation of the brigantine

It may also be proper to advise the House that the Agents of the claimants under Connecticut are now here, and wish to be heard by the Legislature.
