· Agreeably to the Comptroller General's report, an order was drawn upon the Treasurer in his favor for the sum of fifty pounds, being one quarter's salary due to his clerk on the tenth instant, ac- cording to act of Assembly dated the fourth day of April, 1785.


Upon consideration of the account for pension presented to Council by Eve Wittington, with the Comptroller General's report thereon.


Resolved, That the party applying be referred to the Justices of the Supreme Court for their revision of the proceedings of the Orphans' Court of Berks county, agreeably to an act intituled "An Act to alter and amend an act for the relief of officers, soldiers, and seamen, who, in the course of the late war, have been wounded, or otherwise disabled in the services of this State or of the United States," passed the tenth day of March, 1787, and that an order shall issue for any money, in pursuance of the proceedings of Orphans' Court aforesaid, granting to her the said pension, until a dicision of the said Supreme Court, and the Comptroller General's report thereon be obtained.


Agreeably to the Comptroller General's report, an order was drawn upon the Treasurer in favor of Mrs. Jane Roseborough, for the sum of three hundred and thirty six pounds two shillings and six, payable out of the monies arising from militia fines in the county of Northampton, being the ballance of the half-pay awarded to her by the Orphans' Court of said county, (in right of her hus- band, the Reverend John Roseborough, deceased, late Chaplain of Militia,) according to act of Assembly of the twentieth of March, 1780.

Upon the report of the Committee to whom was referred the ac- count of Colonel Andrew Porter against the State for twenty-four pounds twelve shillings and four pence, being the value and ex- pences of a horse which died in the service of the Commissioners who were employed in running the northern boundary of this State, for which sum a judgment of Court was obtained by Joseph Parke, the owner, against said Colonel Porter, in Chester county.


Resolved, That an order was drawn upon the Treasurer in favor of the said Colonel Andrew Porter, for the said sumn of twenty- four pounds twelve shillings and four pence, agreeably to the Comp- troller General's report.


Upon consideration of a letter from Frederick Augustus Muh- lenberg, Esquire, requesting Council to accept his resignation of the office of Justice of the Peace, in the county of Montgomery,


Resolved, That the said resignation be accepted.


Joseph Chapman and William Bell, Esquires, were appointed and commissionated Justices of the Peace, the former for the dis- trict of the townships of Lower Makefield, Newtown and Wrights- town, in the county of Bucks, and the latter for the district of the township of Milford, in the county of Cumberland, upon returns made according to law, from the said several districts.

In favor of the Honorable William Augustus Atlee, Esquire, for one hundred and fifty pounds, being one quarter's salary due to him as one of the Justices of the Supreme Court, ending the twen- ty-fifth day of December, 1788.


In favor of the Honorable Henry Wynkoop, Esquire, for six pounds, in full of his account for six days' attendance as one of the Judges of the High Court of Errors and Appeals of this State, in September, 1787, and April, 1788.


Upon consideration of the petition of Job Stackhouse and Jona- than Pursell, of Bucks county, and the recommendation in their favor from several of the Justices of the Peace and others, of the said county,


Resolved, That the several fines payable to the use of the Com- monwealth, which have been imposed upon the petitioners by the Court of Quarter Sessions of the said county, upon their being convicted of retailing spirituous liquors without licence, be remit- ted.

A letter from the Attorney General being read, informing Coun- cil that a suit is depending in the Supreme Court between this Commonwealth and the Executors of Messieurs Stocker and Whar- ton, for money paid those gentlemen for a bill of exchange drawn on Davidson and Lees of Quebec, which bill was conditionally ac- cepted, but afterwards lost and never paid.


Resolved, That the Attorney General be authorized to engage, on the part of the Commonwealth, in case of a recovery on this suit, to indemnify the defendants from any demands of Davidson and Lees on account of the said bill.

Agreeably to the order of the day, a number of the landholders in the district of Southwark and townships of Moyamensing and Passyunk, attended, when Council proceeded to hear the objections of Messieurs Chew, Depui, Poyntell, Keen, Wheeler, Ball and Dushong, to the confirmation of the report of the Commissioners appointed to survey and regulate the said district and townships, under the act of Assembly of the twenty-ninth of September, 1787; and some time being spent in the said hearing, the farther con- sideration of this business was postponed until to-morrow.

Council resumed the consideration of the report of the Commis- sioners appointed by act of Assembly of the twenty-ninth of Sep- tember, 1787, to survey and regulate the district of Southwark and townships of Moyamensing and Passyunk, and having heard the objections of Martin Killhomer, John Lane, Adam Shetzly and Jobn Beltz, it was on motion,

Thomas Clark, Esquire, was appointed and commissionated a Justice of the Peace in and for the county of Dauphine, upon a return made according to law from the district of the township of Bethel, in the said county.


Agreeably to the Comptroller General's report an order was drawn upon the Treasurer in favor of John White for twenty-two pounds three shillings and one penny, in full of his account for riding express by order of Council, to bring forward the returns of elections for Electors.


Upon the second reading of an order of Court of Huntington county, relative to laying off a district for electing Justices of the Peace, it appeared to Council to be defective, and an order was taken that Mr. Cannon, the Member who represented it, have leave to withdraw the same.


Council being informed that Colonel Johnston has received pro- posals from several persons for the purchase of land within the re- served tract, vizt: from William Turnbull for farm number 1 for the sum of two hundred and seventy pounds, and for the farm number 6 at thirty shillings per acre; and from James O'Hara for the high broken ground, at the price of fifteen shillings per acre in certificates.


Resolved, That Colonel Jobaston be instructed to dispose of the above lands agreeably to the proposals aforesaid, on the same terms of payment with the other lands sold at the late sale.

A letter was written and signed by the Vice President, addressed to the Delegates of this State in Congress, requesting them to in- form Council what steps or if any have been taken by Congress to obtain leave from the Governor of Canada or the Commandant at Niagara, for the Geographer General, or any persons under his appointment, to go within the British settlements or lines to make the necessary observations to enable him to begin to carry into execution the surveying and laying off the tract of country lying on the south side of Lake Erie, lately purchased by this State of the United States.

Upon consideration of the petition of John Redman, junior, pray- ing Council to take his assignment of a certain bond and warrant of Attorney, executed to him on the fourth of December, 1788, by William Lawrence and Richard Footman for the payment of sixty pounds, in gold or silver money or in the paper money of the late emission, under the penalty of one hundred and twenty pounds like money, and exonerate him from the debt wherein he is bail to Sharp Delany for duties owing to the State by the said William Lawrence.


Ordered, That the State Treasurer be authorized and instructed to take an assignment of the said bond and warrant of Attorney in discharge of the debt due by the petitioner as bail to the said Wil- liam Lawrence, and that the said Treasurer be authorized to enter satisfaction on the action brought by the Collector of the Customs, against the said William Lawrence and John Redman, they discharg- ing the costs which have accrued thereon.

Upon consideration of a petition from William Hay, of Dauphine county, late Collector of Excise in the county of Lancaster,


Resolved, That the sale of the remainder of his estate for satis- faction of a debt due by him to the Commonwealth be postponed until the first Monday in April next.


Upon application of Doctor Benjamin Rush, in behalf of the Trustees of Dickinson College at Carlisle,


Ordered, That the State Treasurer be authorized and directed to pay to the Trustees of said College the sum of fifteen pounds, be- ing six month interest due in October last, upon certain certificates which are the property of the said College.


Council taking into consideration the petition of Joseph Taggart, convicted of manslaughter at the present sessions of the Court of Oyer and Terminer and General Jail delivery for the city and county of Philadelphia, praying a pardon, and also a recommendation in his favor from the Court and Jury, and the Attorney General,


Resolved, That the said Joseph Taggart be pardoned. On motion, .


Resolved, That Monday next be assigned for the consideration of the message to the General Assembly, and that on Tuesday Council will take into consideration the propriety of continuing the Invalid Guards.
