It is acknowledged by Jnº White (ye Defend's Attorney) that ye Plaints ffather was Legally possest of Tynnacu Island & p'mises in ye declaracon menconed, by vertue of his purchase from Aringard Prince; But sayth (in regard Ate of ye purchase money was onely paid) that ye sayd Lady Armgard Prince had

The Plaint (by Abraham Man his Attorney) setts forth that hee ye sayd Plaint (who was Heire to ye sª Island) at ye tyme of ye sayª Tryall & Execucon was then und" Age & in Holland & therefore could make noe defence, & further y' the said Heire (this Plaint) was not menconed in ye sayd Tryall; the Accon being Comenced against one Andrew Carre & Prissilla his wife, mistaken in ye Execucon for ye mother of this Plaint, whose mothers name was Margaretta.


The Testimony of Nicholas More Secretary in writing und" his hand produced on behalfe of ye Plaint *:


Shackamackson ye 20th of ye 5th Moneth als July 1683. I doe solemnly declare that about ye month of May last nost of this p'sent yeare ME Otto Ernst Cock of Tynnaeu Island, came to mee at Shackamackson (haveing before spoken to mee of a Tryall y' was to bee at Upland, Betweene M' Lagrange & him- selfe, about ye Island of Tynnacu) and told mee among many other things, that hee wished he had never sold mee ye said Island and said hee, Hee wished hee had lost 50" rather then to have put his hand to eyther my Conveyance, or MF Lagrange Agreemt, saying that hee was undone, Why ? said I; Because, said hee, I have wronged Lagrange Children from their Rights; Well : said I, M' otto: If you beleeve in yo' Concience that ye Island is his let him have it, I will not take any ad- vantage of it, either against him or yo", Yes said hee, it is his, and if you will doe soc & part with it, I shall give you" thanks & repay yo" yo' charges : Well: said I you shall have it, and I will endeav" to make M' Lagrange & yo" ffriends without any wrong: This was in ye p'sence of Major ffenwick, Thomas ffairman & Michael Neelson, all which I attest und" my hand N : More Sceretary

land & p'misses, Deposeth That Lagranges ffather was to give ya sayd Armgard for ye same six Thousand Dutch Guilders, & yt hee knowes there was three Hundred Dutch Guilders thereof pª but knowes of ye paym' of noe more; And further sayth that ye Three thousand Guild's (which is Three Hundred pounds) was to bee paid in this Country by agreemt betweene Jacob Swanson & ye ffather of ye Plaint & further sayth that when the Plaints ffather dyed hee ys sayd Plaint was a litle Child; and further sayth not.


ffop Johnsons Deposition : ffop Johnson being required to declare what hee knowes in ye p'misses, Deposeth, That hee ye said ffop, & ye above menconed Israell, was desired by M's Armgard Prince als Popinjay to demand ye remaind' of y8 sayd Six Thousand Guild's which was Three Hundred pounds of M's Delagrange (ye Plain's mother) And yt shee ye said MT Delagrange (upon ye same demand) sayd shee could not pay it, & further sayth not.


To which ye sayd Plaint replyes (by his afores" Attorney) That if the Def' can make it appeare ye sayª money is unpayd, and can shew their Right to receive it, hee is ready to dis- charge what can be made appeare to remayne due of ye sª Purchace, But denyes yt ye Def hath any legall right to de- mand ye same.


The Juryes V'dict : The Jury finde for ye Plaint and alsoe give him his Costs of Suite, and fforty Shillings damage, the Plaint paying to ye Def Thirty & Seaven pounds & Tenne shillings, according to an agreemt betweene ye Plaint & Deft produced & Read in this Co't & alsoe delivering ye Block house & #ticulers in ye same agreemt menconed :

This Cort Considering the necessity of Defraying the Charge of the Cort House and Prison att Chester by a Publicke levie it was ordered that according to the Law in that Case Provided every man Possessed of Lands should pay towards the Levie after the Rate of one shilling for every hundred Acres withiu this County And every freeman should pay six pence being above sixteen years of Adge and not Exceeding sixty and every Artificer not Exceeding the aforesd Age of sixty and above sixteen 1/6 by the Pole and every Servant three pence as also non residence having land in this County and not Occupying : the same shall pay for every hundred Acres after the rate of one shilling six pence > hundred
