TOWN CLERK'S REPORT


SPECIAL TOWN MEETING


January 11, 1950


Meeting called to order at 8 p.m. by Town Clerk, Anna E. Brown. James Kehoe was elected Moderator, pro tem. Warrant was then read by the Town Clerk and the following action took place:


Article 1


To see if the Town will vote to approve a By-Law to prohibit or regulate the removal of soil, loam, sand or gravel from land not in public use in the whole or in specified districts of the town.


ARTICLE XXIV-TOWN BY-LAWS EARTH REMOVAL BY-LAW


1-1. The removal of soil, loam, sand or gravel from any par- cel of land not in public use in the Town of West Bridgewater, ex- cept as hereinafter provided, shall be allowed only after a written permit therefor is obtained from the Board of Selectmen after a public hearing of which due notice is given.


1-2. No permit shall be required for the continuous opera- tion on any parcel of a sand or gravel pit in operation at the time this by-law is adopted provided such operation is not thereafter discontinued for more than one year; and no permit shall be re- quired for the removal of soil, loam, sand or gravel from any parcel of land when incidental to and in connection with the construc- tion of a building on the parcel.


1-3. In issuing a permit under this by-law, the Board of Selectmen may impose such conditions not specifically provided for herein as it may deem necessary for the adequate protection of the neighborhood and the Town. Any conditions imposed by the Board shall be attached to and made a part of the permit. The

Board may in its discretion, require a bond, certified check or other security for compliance with said conditions or as evidence of good faith as to the completion of any proposed construction. The Board may, after a public hearing on proof of violation of any con- dition, revoke any permits so issued. No permit shall be issued under the provisions of this by-law for a period of more than three years.


Removal of Sand and Gravel


2-1. Sand and gravel may be removed from any parcel of land, except within 300 feet of a street or way, and the Board shall issue a permit therefor provided, however, that the Board shall impose such reasonable conditions as to the disposition of top soil and the re-establishment of ground levels and grades as it may deem necessary.


Removal of Soil or Loam


3-1. Soil or loam may be removed from any parcel of land within such parcel determined by the Board. The Board shall, in making such decision, obtain the recommendations of the ap- propriate Soil District Supervisor and the County Extension Di- rector or Agent, or their successors, and their , recommendations shall be made a part of the records of the Board. In issuing a per- mit, the Board may impose reasonable conditions as to the re- establishment of ground levels and grades.


3-2. Notwithstanding the provisions of the above, the Board may issue a permit for the removal of soil or loam from any parcel of land in the Town where such removal is necessarily incidental to and in connection with the construction of a road or other facil- ity involving a permanent change in the use of the land. The Board shall issue no such permits unless it is reasonably satisfied that the construction will be completed and evidence thereof shall be made part of the records of the Board.


Removal within 300 feet of Streets


4-1. Soil, loam, sand or gravel may be removed from any parcel of land within such parcel lying within 300 feet of any

street or way, provided a permit therefor has been issued by the Board after satisfactory evidence that such removal will not be seriously detrimental or injurious to the neighborhood; provided further that the Board shall impose reasonable conditions as to the method of removal, the re-establishment of ground levels and grades and the planting of the area to suitable cover, as it may deem necessary. Removal of soil or loam under authority of this section shall be further subject to the provisions of Section III.


5-1. Whoever violates the provisions of any of these regu- lations shall be subject to a fine of not exceeding Twenty Dollars ($20.00) for each offense.


By vote this article carried and is to be known as Article XXIV of the Town By-Laws. No-30, Yes-340.


Article 2


To see if the Town will vote to authorize the Selectmen to petition the General Court for legislation to borrow an amount outside the present debt limit for the purpose of constructing and originally equipping and furnishing a school building and fencing and grading the property thereof or take any action relative thereto.


Moved :- that the Board of Selectmen be authorized to peti- tion the General Court for authority to borrow in the aggregate not in excess of $800,000.00 for the purpose of constructing, fur- nishing and equipping a school building or buildings. Indebtedness incurred under this vote shall be in excess of the statutory limit.


Roger Burrill, Chairman of the building committee, gave a report of the committee. Moderator then appointed Ralph Fish, Curtis Carrigan, Sherman Perkins and Merton Ouderkirk to act as tellers. By Ballot vote of 220-Yes; 53-No this motion was carried.


Article 3


To transact any business that may legally come before the meeting.

Moved :- that the Town vote to permit the Fire Department to erect a memorial to deceased firemen of the town on the oval in the Town Hall parking lot at no expense to the town.


Upon vote this motion was carried.


Moved the meeting be adjourned.


SPECIAL TOWN MEETING


March 2, 1950


Meeting called to order at 8:05 p.m., by Moderator, E. Marion Roberts. Warrant was read by Town Clerk.


The meeting proceeded as follows:


Mr. Roberts called for a report of the Building Committee. Chairman Roger Burrill made the report for the Committee.


Article 1


To see if the town will vote to raise and appropriate a sum of money for the purpose of constructing a Junior-Senior High School Building and for originally equipping and furnishing the said Building, determine whether the money shall be provided for by taxation, by appropriation from available funds in the Treasury, or by borrowing under authority of Chapter 285 of the Acts of 1949, as amended by Chapter 71 of the Acts of 1950, and under Chapter 44 of the General Laws; or take any action in relation thereto.


Moved :- that the sum of $947,000.00 be raised and appro- priated for the purpose of constructing a Junior-Senior High School Building and for originally equipping and furnishing the said building; and that to meet the said appropriation the sum of $5,000.00 be appropriated from available funds in the Treasury, the sum of $2,000.00 be raised in the tax levy of the current year, and that the treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $800,000.00 under au- thority of Chapter 285 of the Acts of 1949, as amended by Chapter 71 of the Acts of 1950, and the sum of $140,000.00 under author-

ity of Chapter 44 of the General Laws, and to issue bonds or notes of the Town therefor payable in accordance with the provisions of Chapter 44 of the General Laws so that the whole loan shall be paid in not more than 20 years from the date of issue of the first bond or note.


Motion made to amend this motion to read as follows:


That the sum of $968,000.00 be raised and appropriated for the purpose of constructing a Junior-Senior High School Building, and for originally equipping and furnishing the said building; and that to meet the said appropriation the sum of $5,000.00 be ap- propriated from available funds in the treasury, the sum of $3,000.00 be raised in the tax levy of the current year and that the treasurer, with approval of the Selectmen, be and hereby is au- thorized to borrow the sum of $800,000.00 under authority of Chapter 285 of the Acts of 1949, as amended by Chapter 71 of the Acts of 1950, and the sum of $160,000.00 under the authority of Chapter 44 of the General Laws, and to issue bonds or notes of the town therefor payable in accordance with the provisions of Chapter 44 of the General Laws so that the whole loan shall be paid in not more than 20 years from the date of the issue of the first bond or note. Amendment carried as read.


By ballot vote of 438-Yes; 291-No the Moderator declared motion lost as 2/3 majority had not been attained.


Motion made and seconded to reconsider the vote. Question as to the legality of the motion; it was withdrawn.


Moved and seconded the meeting be adjourned.


ANNUAL TOWN MEETING March 13, 1950


The meeting was called to order at 7:30 p.m. by Moderator, E. M. Roberts. The Warrant was read by the Town Clerk.

To see if the Town will vote to authorize the Town Treasurer with the approval of the Selectmen to borrow money from time to time in anticipation of the revenue of the financial year begin- ning January 1, 1950, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.

Moved :- that the sum of $2,200.00 be raised and appropriated for the salaries of the Board of Assessors, and each be paid at the rate of $4.00 per meeting or $8.00 per day, beginning January 1, 1950. So Voted.


Moved :- that the salary of the Town Clerk beginning January 1, 1950 shall be $1,000.00. So Voted.


Moved :- that the sum of $930.00 be raised and appropriated for the salary of the Tree Warden and that he be paid at the rate of $8.40 per day. So Voted.


Moved :- that the sum of $150.00 be raised and appropriated for salaries of members of the Board of Public Welfare, and each member be paid at the rate of $3.45 per meeting or $5.75 per day. So Voted.


Moved :- that the sum of $4,196.00 be appropriated for Moth Suppression and $1,000.00 of this amount be used in connection with Plymouth County's Aerial spray program. So Voted.


Article 5


To see if the Town will vote to raise and appropriate or trans- fer from available funds in the treasury, a sum of money for Chap- ter 90, Maintenance, or take any action relative thereto.


Moved :- that the sum of $1,000.00 be raised and appro- priated to meet the Town's share of the cost of Chapter 90, Main- tenance, and that in addition, the sum of $2,000.00 be appropri- ated from Surplus Revenue to meet the State's and County's share of the cost of the work, the reimbursements from the State and County to be restored upon their receipt to the Surplus Revenue, account. So Voted.


Article 6


To see if the Town will vote to raise and appropriate, or trans- fer from available funds in the treasury, a sum of money for Chap- ter 90, New Construction, or take any action relative thereto.

Moved :- that the sum of $3,000.00 be raised and appropriated to meet the Town's share of the cost of Chapter 90, New Con- struction, and that, in addition, the sum of $9,000.00 be appro- priated from Surplus Revenue to meet the State's and County's share of the cost of the work, the reimbursements from the State and County to be restored, upon their receipt, to the Surplus Rev- enue Account. So Voted.


Article 7


To see if the Town will vote to raise and appropriate the sum of $100.00 for the use of Plymouth County Trustees for County Aid to Agriculture (Plymouth County Extension Service) and choose a Town Director as provided in Section 41 and 42 of Re- vised Chapter 128 of the General Laws and act thereon.


Moved :- that Clifford Carlson be appointed as Town Direct- or and the article as read carried.


Article 8


To see if the Town will vote to authorize the Town Treasurer in his discretion, but with the written approval of the Board of Selectmen, or a majority thereof, to sell any land acquired by the Town through foreclosure of a tax title and to execute and deliver in the name and behalf of the Town all deeds necessary to effec- tuate any such sale.


Upon motion article carried.


Article 9


To see if the Town will vote to raise and appropriate or trans- fer from available funds in the Treasury a sum of money for Con- tributory Retirement.


Moved :- that the sum of $461.00 be raised and appropriated to be used with the balance of $437.00 remaining in the account, for Contributory Retirement. Motion carried upon vote.

To see if the Town will vote to accept Oliver Street, off Mat- field Street, or take any action relative thereto. (By Petition).


Moved :- that the Town accept Oliver Street as laid out by the Selectmen, with provision as required by the Selectmen.


Motion upon vote carried.


Article 11


To see if the Town will vote to accept Emerson Avenue, off South Main Street, or take any action relative thereto. (By Petition).


Moved :- that the Town accept Emerson Avenue as laid out by the Selectmen, with provision as required by the Selectmen.


Upon vote motion carried.


Article 12


To see if the Town will vote to authorize the Board of Select- men to purchase a parcel of land off South Elm Street, property of Herbert Holmes, and vote to raise and appropriate a sum of money for its purchase.


Moved :- that the Board of Selectmen be authorized to pur- chase from Herbert Holmes for use as a Town Gravel Pit, a cer- tain lot or parcel of land containing 1.11 acres situated in West Bridgewater southeasterly from South Elm Street, bounded and described as follows: Beginning at point in southerly line of land on South Elm St., owned by the Town, the same being the north- westerly corner of Lot A on "Plan of land in West Bridgewater, February 18, 1949, Hayward, Surveyors," thence southerly by two courses 422.04 feet; thence northwesterly 150 feet; thence north- erly 362 feet to southerly line of said Town; thence easterly by said line 104.67 feet to point of beginning, all said distances to be used as more or less. Same being lot B of the aforementioned plan and containing 1.11 acres and to raise and appropriate the sum * of $100.00 for its purchase.


Upon vote motion carried.

Article 13


To see if the Town will vote to raise and appropriate the sum of $300.00 to be used in the Town Forest for the purpose of clean- ing, pruning, and removing dead wood.


Moved :- that the sum of $300.00 be raised and appropriated to be used by the Tree Warden for cleaning, pruning, and remov- ing dead wood from the Town Forest. Upon vote motion carried.


Article 14


To see if the Town will vote to raise and appropriate the sum of $400.00 for a School Dental Clinic. So Voted.


Article 15


To see if the Town will vote to accept the bequest of $100.00 from Martin Alger for perpetual care of the Nathan J. Alger Lot 10, Pleasant Hill Cemetery. So Voted.


Article 16


To see if the Town will vote to add a By-Law to the Town By-Laws to provide for publishing a list of all taxpayers in the Town Report every three years beginning with the report of the year 1950. (By Petition).


Moved :- that the following section be added to Article VII of Town By-Laws.


Article VII, Section 9


The Selectmen shall have printed in the Town Report each third year beginning with the Report of the year 1950, a list of all taxpayers and amount paid by each.

To see if the Town will vote to raise and appropriate the sum

of $1,602.00 for its liability for Gypsy Moth work in conformance with Section 11, Chapter 660, Acts of 1948.

Article 18


To see if the Town will vote to raise and appropriate or trans- fer from available funds in the treasury the sum of $20,665.00 to be used for the payment of Water Bonds and Interest.


Moved :- that the sum of $17,665.00 be raised and appropri- ated from Water Revenue Receipts and that the sum of $3,000.00 be appropriated from Water Surplus, to pay Water Bonds and Interest. Upon vote motion carried.


Article 19


To see if the Town will vote to raise and appropriate the sum of $500.00 to cover the cost of pruning and destroying all existing dead wood in the town elms.


Upon vote motion carried.


Article 20


To see if the Town will vote to raise and appropriate the sum of $1,998.00 to be used by the Moth Superintendent when called upon to perform work on the town trees in addition to duties pre- scribed in Chapters 660 and 761 of the General Laws.


Moved to pass this article without action.


Article 21


To see if the Town will vote to authorize the Board of Select- men to dispose of town lots at the Pine Hill Cemetery or take any action relative thereto.


Moved :-- to transfer to the Pine Hill Cemetery Association a number of lots now owned by the Town and enter an agreement whereby the town will retain 4 lots, provided permanent care will be given all lots in which the town has an interest. So Voted.

Article 22


To see if the Town will accept Chapter 529 of the Acts of 1949 regarding the appointing of an Inspector of Wires.


Moved :- that the Town authorize the Board of Selectmen, at their discretion, to appoint an Inspector of Wires, or join with one or more towns in appointing an Inspector, and raise and ap- propriate the sum of $300.00 to pay expense of such inspections. Upon vote motion carried.


Article 23


To see if the Town will vote to transfer to Surplus Revenue several unused balances remaining from Special Appropriations.


Moved :- that the sums remaining in the following Special Appropriations be transferred to Surplus Revenue:


Resuscitator and Cutting Unit, Fire Dept. $90.36


School, Special Repairs 137.19


Purchase of Land So Voted.

To see if the Town will vote to use unexpended balance of 1948 appropriation for Keenan Street Construction for Sealcoat- ing town roads.
