ANNUAL TOWN MEETING WARRANT


February 5-6, 1940


Commonwealth of Massachusetts


Barnstable, ss.


To Harvey T. Moore, Constable of the Town of East- ham in the County aforesaid : Greeting.


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and town affairs, to meet in the Town Hall in Eastham, Monday, the fifth day of February next, at ten o'clock in the forenoon, then and there to act on the articles in this warrant, and to meet in the Town Hall, Eastham, Tuesday, the sixth day of Febru- ary next, at ten o'clock in the forenoon, to elect all neces- sary town officers.


Article 1. To act upon the Annual Report, including recommendations of the Selectmen and other Town Officers and Committees.


Article 2. To see if the Town will elect a Town Direc- tor for the Cape Cod Extension Service.


Article 3. To see in what manner the Town will dis- pose of its refunded dog tax.


Article 4. To see if the Town will vote to raise and appropriate a sum of money, provided the State makes a satisfactory allotment, for repairs and maintenance of town

ways under Chapter 81, Sections 26-29, General Laws as amended.


Article 5. To see if the Town will vote to raise and appropriate a sum of money for the Public Library.


Article 6. To see if the Town will authorize the Treas- urer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1940, and to issue a note or notes therefor payable in one year, in accordance with Chapter 44, Section 17, General Laws.


Article 7. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of reimbursement for the financial year, beginning January 1, 1940, and to issue a note or notes therefor payable in one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Chapter 44, Section 69, General Laws.


Article 8. To see if the Town will vote to raise and appropriate a sum of money not to exceed $500.00 for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Massachusetts, for the care and treatment of persons certified by the Selectmen to be resid- ents of the Town and unable to pay for such care and treatment, in accordance with Chapter 111, Section 74, of the General Laws, or take any action thereto and act fully thereon.


Article 9. To see if the Town will vote to raise and appropriate the sum of $150.00 for free band concerts to

be given by the Junior Community Band during the ensu- ing year, or do or act anything thereon.


Article 10. To see if the Town will vote to raise and appropriate a sum of money for the protection and propa- gation of shellfish, or do or act anything thereon.


Article 11. To see what sum of money shall be taken from available funds toward defraying the tax levy of 1940.


Article 12. To see if the Town will vote to raise and appropriate a sum of money to be used by the local W.P.A. or any succeeding Government agency of like nature, for the purchase of material or other expenses.


Article 13. To see if the Town will vote to instruct the Selectmen to control, regulate or prohibit the taking of eels and any and all kinds of shellfish and seaworms, as provided under the provisions of Section 48, Chapter 130, General Laws, as amended by Chapter 329, Acts of 1933.


Article 14. To see if the Town will vote to instruct the Selectmen to issue licenses under the provisions of Sec- tion 57, Chapter 130, General Laws, as amended by Chapter 329 of the Acts of 1933.


Article 15. To see if the Town will invest the Select- men with the authorization provided for under the provi- sions of Section 55, Chapter 130, General Laws, as amended by Chapter 329, of the Acts of 1933.


Article 16. To see if the Town will vote to raise and appropriate a sum of money to be used for the suppression of tent caterpillars, under the direction of the local 4-H Club leaders, or do or act anything thereon.

Article 17. To see if the Town will vote to raise and appropriate a sum of money for the purpose of paying 1938 bills.


Article 18. To see if the Town will vote to instruct the Selectmen to continue to make a charge on all shellfish per- mits issued, or do or act anything thereon.


Article 19. To see if the Town will vote to discontinue the road beginning at Samoset Road and running in a north- westerly direction 300 feet over land of Philip J. Schwind to the Herring Brook Road.


Article 20. To see if the Town will vote to appro- priate the sum of $600.00 from the Sale of Real Estate Fund to be used to help pay off the school note.


Article 21. To see if the Town will vote to transfer $500.00 from the New School Land Taking Fund and $200.00 from the Nauset Beach Land Taking Fund for the purpose of paying off the schoolhouse note, or do or act anything thereon.


Article 22. To see if the Town will vote to authorize the Selectmen to sell property taken by the Town under tax title procedure, or do or act anything thereon.


Article 23. To see if the Town will vote to raise and appropriate a sum of money for the purchase of a power sprayer, or do or act anything thereon.


Article 24. To see if the Town will vote to instruct the Selectmen to acquire land for the purpose of a town way, beginning at the north end of Nauset Light Beach Road and running in a northerly direction a distance of

about 3,300 feet, and appropriate a sum of money for same, or do or act anything thereon.


Article 25. To see if the Town will vote to establish a road machinery account to which shall be credited all receipts received for the use or rental of road machinery, the proceeds to be appropriated as voted by the Town for road machinery purpose, or take any action in relation thereto.


Article 26. To see if the Town will vote to raise and appropriate a sum of money to establish a road machinery fund for the purpose of purchasing, repairing and operating road machinery.


Article 27. To see if the Town will vote to accept as a gift from Mr. Ruben Horton, a parcel of land near Sunken Meadow Landing, so-called, to be used as a public town landing, or do or act anything thereon.


Article 28. To see if the Town will vote to raise and appropriate a sum of money under the provisions of Chap- ter 90, General Laws, same to be used for maintenance of Herring Brook Road, and that the Selectmen be authorized to enter into any contracts necessary.


Article 29. To see if the Town will vote to raise and appropriate the sum of $100.00 for the purpose of purchas- ing a hydraulic snow plow lift, or do or act anything there- on.


Article 30. To see if the Town will vote to raise and appropriate the sum of $500.00 for cleaning up and maintain- ing the Town Dump, or do or act anything thereon.

Polls will be opened for voting on Tuesday, February 6, 1940 in the Town Hall, Eastham, Massachusetts, from 10 a.m., to 6 p.m., and you are directed to serve this warrant by posting attested copies thereof at the packing house of Bernard C. Collins in South Eastham, the barn of Harry W. Collins in South Eastham, at the Post Office in North Eastham and the Post Office in Eastham, seven days at least before time of holding said meeting, as aforesaid. Hereof fail not and make due return of this warrant with your doings thereon to the Town Clerk at the time and place of holding said meeting. ANNUAL TOWN MEETING


February 6, 1940


Meeting called to order at 10 o'clock by the Moderator, warrant calling meeting read by Town Clerk together with return of the officer who served the same.


Tellers appointed : Charles L. Holbrook and Esther F. Tibbals and sworn by the Moderator.


Article 1. Voted to amend the recommended budget by increasing the amount proposed for Aid to Dependent Chil- dren from $1,000 to $1,500.


Amendment to change proposed budget relating to Office Supplies to $400.00 and Officers' Salaries and Ex- pense to $395.00 was not carried.


Voted informally to request the Selectmen to set up in their budget for 1941 an account of Officers' Salaries, Offi- cers' Expense and Office Supplies.


Voted to request the School Committee to itemize their Miscellaneous Account in their report in future years.


Voted that the Town should not buy a dory for shell- fish purposes.


Voted to accept the Town Report as printed with the exception of change in budget figures for Aid to Dependent Children.


The budget submitted by the Finance Committee and accepted by the town for 1940 with the change as voted by the meeting is as follows:

Article 2. Voted to elect a Town Director to the Cape Cod Extension Service.


Elected Clayton O. Horton, Town Director for the Cape Cod Extension Service.


Article 3. Voted to turn the refunded Dog Tax over to the Public Library Account.


Article 4. Voted to raise and appropriate the sum of $3,225.00 for care and maintenance of town ways under Chapter 81, Sections 26 to 29 as amended, provided the State will make a satisfactory allotment to the town for same. (Unanimous vote.)


Article 5. Voted to raise and appropriate the sum of $100.00 for the support of the Public Library.


Article 6. Voted to authorize the Town Treasurer with the approval of the Selectmen to hire money from time to time in anticipation of revenue of the financial year begin- ning January 1, 1940, and to issue a note or notes therefor payable within one year, and to renew any note or notes that may be given for period for less than one year.


Article 7. Voted to authorize the Treasurer, with the approval of the Selectmen, to borrow money from time to

time in anticipation of reimbursement for the financial year beginning January 1, 1940, and to issue a note or notes as may be given for less than one year, in accordance with Chapter 44, Section 69, General Laws.


Article 8. Voted to raise and appropriate the sum of $300.00 for a free bed in the Cape Cod Hospital, Hyannis, Massachusetts, as outlined under Article 8 of the Annual Town Meeting Warrant.


Article 9. Voted to raise and appropriate the sum of $150.00 for free Band Concerts during the coming year, 40 in favor, 3 opposed.
