In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and town affairs, to meet in the Town Hall in said Eastham on Mon- day, the Fifth day of February next, at ten o'clock in the forenoon, then and there to act on the following articles in this warrant, and to meet in the Town Hall in said town at 1 o'clock P.M. on Tuesday, the Sixth day of February next, then and there to elect all necessary town officials.


Polls to be opened at 1 P.M. and may be closed at 5:30 P.M.

Article 2. To see if the Town will vote to elect a Town Director for the Cape Cod Extension.


Recommend that the town so vote.


Article 3. To see in what manner the Town will dis- pose of its refunded dog tax.


Recommended that the refunded dog tax be made avail- able to the Public Library.


Article 4. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1945, and to issue a note or notes therefor payable in one year, and to renew any notes or notes that may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Recommended that the Treasurer be so authorized.

Article 5. To see if the Town will vote to raise and appropriate a sum of money for the Public Library. -


Recommended that the sum of $100.00 be appropriated.


Article 6. To see if the Town will vote to raise and appropriate a sum of money not to exceed $1,000.00 for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass., for the care and treat- ment of persons certified by the Selectmen to be residents of the Town and unable to pay for such care and treat- ment, in accordance with Chapter 111, Sec. 74, General Laws or take any action thereto and act fully thereon.


Recommended an appropriation of $300.00


Article 7. To see if the Town will vote to raise and appropriate a sum of money for the protection and propa- gation of shellfish or take any action relative thereto and act fully thereon.


Recommended an appropriation of $600.00 for the fol- lowing purposes : Contable's Salary, $350.00; shellfish pro- tection, $150.00., and propagation, $100.00.


Article 8. To see if the Town will vote to instruct the Selectmen to control, regulate or prohibit the taking of eels and any and all kinds of shellfish, and seaworms, as provided for under the provisions of Section 52, Chap- ter 130, Acts of 1941.


Recommend that the town so vote.


Article 9. To see if the Town will vote to instruct the Selectmen to raise licenses fees for private grants under the provisions of Section 57, Chapter 130, G. L., as amended by Chapter 598, Acts of 1941.


Recommened that the town so vote.

Article 10. To see if the Town will invest the Select- men with the authority to plant and close areas as pro- vided for under the provisions of Section 54, Chapter 130, General Laws, as amended by the Acts of 1941.


Recommend that the town so vote.


Article 11. To see if the Town will vote to authorize the Selectmen to act exclusively as provided by Section 56, General Laws, as amended by Chapter 598, Acts of 1941.


Recommend that the town so vote.


Article 12. To see if the Town will vote to instruct the Selectmen to continue to make a charge on all shellfish permits issued or take any action relative thereto.


Recommend that the Town so vote.


Article 13. To see if the Town will vote to authorize the Selectmen to petition the Commissioner for the right to regulate and control the public alewife fishery in the Town as provided by Section 94, General Laws, as amended by Chapter 598, Acts of 1941.


Recommend that the Town so vote.


Article 14. To see if the Town will vote to authorize the Selectmen to sell property taken by the Town under tax title procedure or take any action relative thereto.


Recommend that the Town so vote and an appropria- tion of $400.00 be made.


Article 15. To see if the Town will vote to pay a bounty of fifty cents for each woodchuck killed within its boundaries during the ensuing year and appropriate the sum of $30.00 for this purpose.


Recommend that no appropriation be made for this purpose.

Article 16. To see if the Town will vote to raise and appropriate a sum of money to pay 1944 bills, under the provisions of Chapter 179, Acts of 1941.


Recommend that an appropriation be made if needed.


Article 17. To see if the Town will vote to appro- priate a sum of money from unappropriated available funds in the treasury to purchase War Bonds and other bonds to increase the Rehabilitation Fund in accordance with the provisions of Chapter 5, Acts of 1943.


Recommend that the appropriation of $2,000.00 be taken from available funds.


Article 18. To see if the Town will vote to raise and appropriate a sum of money to be used for the suppression of tent caterpillars under the direction of Local 4-H Lead- ers, or take any action relative thereto.


Recommend that the sum of $50.00 be appropriated.


Article 19. To see if the Town will vote to accept the layout for an extension of the Town Landing or Com- mon Landing Place on the south side of the Salt Pond as laid out by the Selectmen and filed with the Town Clerk, and to see if the Town will instruct the Selectmen to take by eminent domain, purchase or gift, said landing, and vote to raise and appropriate a sum of money for this purpose or take any action relative thereto.


Recommend that we accept the article as read and raise and appropriate the sum of $1,000.00 for this purpose.


Article 20. To see if the Town will vote to raise and appropriate a sum of money for the purpose of clearing the sedge-grass from the proposed new Town Landing at the Salt Pond and do or act anything thereon.


Recommend that no funds be appropriated.

Article 21. To see if the Town will vote to transfer a sum of money from the Road Machinery Fund to the Road Machinery Operating Account or take any action relative thereto.


Recommend the transfer of $200.00.


Article 22. To see if the Town will vote to raise and appropriate a sum of money toward maintaining and in- stalling lights at Rock Harbor.


Recommend that no funds be appropriated.


Article 23. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the treasury, a sum of money for Chapter 81 Highways, or take any action thereto.


Recommend the appropriation of $2,688.00 as the Town's share and $5,375.00 to be transferred from avail- able funds to cover the State's share which will be re- imbursed to the Town later.


Article 24. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the treasury a sum of money for Chapter 90 High- way Maintenance or take any action relative thereto.


Recommend the appropriation of $350.00 as the Town's share and $700.00 to be transferred from available funds to cover the State's and County's shares, whcih will be re- imbursed to the Town later.


Article 25. To see what sum of money shall be taken from available funds towards defraying the tax levy of 1945.


Recommend the amount to be taken be left in the hands of the Assessors.

Article 26. To see if the Town will vote to raise and appropriate a sum of money for the purpose of maintaining a recreation center in the Town Hall under the super- vision of a committee appointed by the Selectmen or take any action relative thereto.


Recommend an appropriation of $100.00.


Article 27. To see if the Town will vote to raise and appropriate a sum of money for repairs on the Old Wind Mill or take any action relative thereto.


Recommend an appropriation of $100.00.


Article 28. To see if the Town will vote to raise and appropriate a sum of money for the making and erecting of signs advertising the Town or take any action relative thereto.


Recommend an appropriation of $150.00 to be left in the hands of a committee appointed by the Selectmen.


Article 29. To see what rate the Town will vote to pay for laborers and trucks for the ensuing year.


Recommend that the Town pay 70 cents per hour for laborers and $1.70 per hour for trucks and drivers for the ensuing year.


And you are directed to serve this warrant by posting attested copies thereof at the packing house of Bernard C. Collins in South Eastham, at the barn of Harry W. Collins in South Eastham, the Post Office in Eastham and the Post Office in North Eastham, seven days at least before time of holding said meeting. Hereof fail not and make due return of this warrant with your doing theron to the Town Clerk at the time and place of holding meeting as aforesaid.

Pursuant to the foregoing warrant the qualified voters met at the Town Hall, warrant calling meeting duly read with the return of the officer who served the said warrant. Tellers appointed Mary Atwood and Clarence E. Walker they being duly sworn the Moderator then placed the article one before the meeting.


Article 1. The Moderator requested the meeting to allow the spokesman for the Finance Committee to explain their recommendations before discussion by the meeting, this request was granted. Voted to accept the budget as printed.

Article 2. Voted to elect a Town Director for the Cape Cod Extension Service. Elected Joseph H. Putnam, Town Director for the Cape Cod Extension Service.


Article 3. Voted that the refunded Dog Tax be made available to the Public Library.


Article 4. Voted to authorize the Town Treasurer, with the approval of the Selectmen to borrow money from time to time in anticipation of revenue of the financial year beginning January 1, 1945 and to issue a note or notes therefor payable in one year and to renew any note or notes that may be given for a period of less than one year, in accordance with Section 17, Chapter 44 of the General Laws.


Article 5. Voted to raise and appropriate the sum of $100.00 for support and maintenance of the Public Library.


Article 6. Article 8. Voted to instruct the Selectmen to control, regulate or prohibit the taking of eels and any and all kinds of shellfish and seaworms as provided for under the provisions of Section 52, Chapter 130, Acts of 1941.


Article 9 Voted to instruct the Selectmen to issue licenses for private grants under the provisions of Section 57, Chapter 130 General Laws, Acts of 1941.


Article 10 Voted to invest the Selectmen with the authorization to plant and close areas provided for under the provisions of Section 54, Chapter 130 General Laws as amended by the Acts of 1941.

Article 18 Voted to raise and appropriate the sum of $50.00 for suppression of tent caterpillars under the direction of the Local 4H club leader.


Article 19 Voted that the Town of Eastham accept an extension of the Town Landing on the south side of the Salt Pond in said Eastham, with the boundaries and measurements as reported by the Selectmen under date of January 19, 1945, and authorize and instruct the Selectmen of the said Town of Eastham to acquire by gift, purchase or eminent domain under Chapter 88 Section 14 of the General Laws of Massachusetts and Chapter 79 Section 1 and any other chapter or section thereof pertaining thereto, in behalf of the Town of Eastham the land or "the interest in the land therein taken" within the lines of said layout for said Town Landing in fee, and for this purpose votes to raise and appropriate a sum not exceeding One Thou- sand ($1,000.00) dollars.


Article 20 Voted to raise and appropriate the sum $150.00 for the purpose of clearing sedge grass from the proposed Town Landing Extension.

Article 25 Voted that the sum of money to be taken from available funds for the reduction of taxes for the year 1945 be left in the hands of the Board of Assessors.


Article 26 Voted to raise and appropriate the sum of $100.00 for the purpose of maintaining a Recreation Center at the Town Hall.


Article 27 Voted to raise and appropriate the sum of $200.00 for the repairs of the Old Windmill.


Article 28 Voted to raise and appropriate the sum $150.00 for the purpose of erecting signs to advertise the town, said work to be done under the direction of a com- mittee to be appointed by the Selectmen.


Article 29 Voted to. pay the following rate for Town hire. 70 cents per hour for labor, $1.70 per hour for truck and driver.


At this time the Moderator announced his appoint- ments to the Finance Committee for three years. Those appointed Carl C. French, Oscar G. Pierce and Henry O. Daniels.

SPECIAL ELECTION JUNE 29, 1945


Pursuant to the foregoing warrant the qualified voters met at the Town Hall Harvey T. Moore, Abbott S. Knowles, George Howard, Maurice W. Wiley appointed Election Officers and sworn by the Clerk.


Voted as follows :


Luther P. Smith had one hundred and six votes.


Harry S. Young had ninety votes.


Blanks, none.


Ballot box stood at opening of polls at 12 noon, none. At closing of polls at 6 P.M. 195 ballots.


Having missed one ballot in registering, total number of ballots cast 196.
