At last, we can report that a white oak tree has been found that is large enough to make a shaft for the mill. Several people have been very helpful in trying to locate this shaft. We all realize what a blot on the landscape the old mill has been.


It probably could have been fixed with some kind of a stick. Very few people realize the workings of the mill and that very few kinds of woods can be used in this con- struction. White oak is the best, we have been told by peo- ple who know wood. In the summer when the mill is work- ing there is a great strain on this shaft, also on the person in charge when a large group of visitors are around the mill.

There had to be two special town meetings called this year, the first for several years. Purchase of the fire ap- paratus and unforeseen expenditure called these. It was gratifying to see the turnout of voters at these meetings compared to the interest that voters in other towns took where special meeting were called.


Under an article in the Warrant you will find a re- quest by the Selectmen to take some kind of action on some outstanding notes issued by the trustees of the Timothy Smith Loan Fund. Some of these are twenty-five years old. You will notice by the report that over seven thousand dollars are involved.


The officers are always ready to receive constructive as well as "destructive" criticism and we are glad to have you call on us any time. Do not wait until you have a chip on your shoulder.

Report on Sales of Tax Possession Lands


There have not been as many sales the past year as last year. There could have been many more. The reason is that under a new law the Town can put the lots through land court for a small fee. This fall we did not encourage buying because after the Town has taken this step the Town can increase the price asked for the land. This year we hope to take that step.


The surveying we had to have done is all charged against the sale of land this year.


There are several lots that are staked out that are now for sale. The profit may not look as large as it really is. There are houses being erected on some lots already.


As the Town survey is the "goose that is laying the golden eggs" (not egg), there is need of a clerk to help gather these and larger profits as already stated in the Selectmen's report.

To either of the Constables of the Town of Eastham in the County of Barnstable :


In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in Elections and Town Affairs, to meet at the Town Hall in said Town on Mon- day, the 4th day of February next, at ten o'clock in the forenoon, then and there to act on the following articles in this Warrant, and to meet in the Town Hall in said Town at 12:00 noon on Tuesday, the 5th day of February next, then and there to elect all necessary Town Officers.


Polls to be opened at 12:00 noon and may be closed at 5:30 P.M.

Article 2. To see if the Town will vote to elect a Town Director for the Cape Cod Extension Service.


Recommend that one be elected. Unanimous vote.


Article 3. To see in what manner the Town will dis- pose of its refunded Dog Tax.


Recommended that the refunded Dog Tax be made available to the Public Library. Unanimous vote.


Article 4. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of financial year beginning January 1, 1946, and to issue a note or notes therefor, payable in one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Sec. 17, Chapter 44, General Laws.


Recommended that the Treasurer be so authorized. Unanimous vote.


Article 5. To see if the Town will vote to raise and appropriate a sum of money for the Public Library or take any action relative thereto.

Recommended the appropriation of $300.00; $200.00 of the appropriation to be used for painting and repairs. Unanimous vote.


Article 6. To see if the Town will vote to raise and appropriate a sum of money not to exceed $1,000.00 for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass., for the care and treat- ment of persons certified by Selectmen to be residents of the Town and unable to pay for such care and treatment, in accordance with Chapter 111, Section 74, General Laws, or take any action thereto and act fully thereon.


Recommend the appropriation of $300.00. Unanimous vote.


Article 7. To see if the Town will vote to raise and appropriate a sum of money for the protection and propa- gation of Shellfish or take any action thereto and act fully thereon.


Recommend the appropriation of $400.00 for the fol- lowing purposes : Constable's salary $100.00; shellfish pro- tection, $100.00 and propagation, $200.00. Unanimous vote.


Article 8. To see if the Town will vote to instruct the Selectmen to control, regulate or prohibit the taking of eels, and any kind and all kinds of shellfish and seaworms, as provided for under the provisions of Section 52, Chap- ter 130, Acts of 1941.


Recommend that the Town so vote. Unanimous vote.


Article 9. To see if the Town will vote to instruct the Selectmen to issue licenses for private grants under the provisions of Section 57, Chapter 130, General Laws, as amended by Chapter 598, Acts of 1941.


Recommend that the Town so vote. Unanimous vote.

Article 10. To see if the Town will invest the Select- men with the authorization to plant and close areas as pro- vided for under the provisions of Section 54, Chapter 130, General Laws, as amended by the Acts of 1941.


Recommend that the Town so vote. Unanimous vote.


Article 11. To see if the Town will vote to authorize the Selectmen to act exclusively as provided by Section 56, General Laws, as amended by Chapter 598, Acts of 1941.


Recommend that the Town so vote. Unanimous vote.


Article 12. To see if the Town will vote to instruct the Selectmen to continue to make a charge on all shellfish permits issued, or take any action relative thereto.


Recommend that the Town so vote. Unanimous vote.


Article 13. To see if the Town will vote to authorize the Selectmen to sell property taken by the Town under tax title procedure, or take any action relative thereto.


Recommend that the Town so vote and an appropria- tion of $300.00 be made. Unanimous vote.


Article 14. To see if the Town will vote to pay a bounty of fifty cents each for woodchucks killed within its boundaries during the ensuing year and raise and appro- priate a sum of money for this purpose or take any action relative thereto.


Recommend an appropriation of $25.00. Unanimous vote.


Article 15. To see if the Town will vote to raise and appropriate a sum of money to pay 1945 bills, under the provisions of Chapter 179, Acts of 1941.


Recommend that the Town so vote and appropriation be made if needed. Unanimous vote.

Article 16. To see if the Town will vote to raise and appropriate a sum of money to be used for the suppression of tent caterpillars under direction of local 4H Club Lead- ers, or take any action relative thereto.


Recomend that the Town so vote and the appropria- tion of $25.00 be made. Unanimous vote.


Article 17. To see if the Town will vote to accept the layout for and extension of the Town Landing of Com- mon Place the North side of Salt Pond, as made out by Selectmen to take by eminent domain, purchase or gift, said landing and vote to raise and appropriate a sum of money for this purpose or take any action relative thereto.


Recommend that the Town so vote and the appropria- tion of $1,000.00 be made. Unanimous vote.


Article 18. To see if the Town will vote to accept the layout for and extension of the Town Landing or Com- mon Landing Place the Southeast side of Great Pond, as made out by the Selectmen and filed with the Town Clerk and to see if the Town will instruct the Selectmen to take by eminent domain, purchase, or gift, said landing and vote to raise and appropriate a sum of money for this pur- pose or take action relative thereto.


Recomend that the Town so vote and the appropria- tion of $100.00 be made. Unanimous vote.


Article 19. To see if the Town will vote to raise and appropriate a sum of money, and appoint a committee for the purpose of purchasing an Honor Roll for World War II Veterans or take any action relative thereto.


Recommend the appointment of a committee of five by the moderator, two of the committee to be World War II Veterans. Unanimous vote.

Article 20. To see if the Town will vote to rescind the action of the Town whereby it was voted to elect a shell- fish constable, which is contrary to the provisions of Sec- tion 98, of Chapter 130, General Laws.


Recommend the passage of this article. Unanimous vote.


Article 21. To see if the Town will vote to raise and appropriate a sum of money for the purpose of dredging Rock Harbor Creek and building a piece of rip rap at the mouth of said creek in conjunction with the State Depart- ment of Public Works.


Do not recommend an appropriation. Unanimous vote.


Article 22. To see if the Town will vote to transfer a sum of money from the Road Machinery Fund to the Road Machinery Operation Account, or take any action relative thereto.


Recommend the transfer of $200.00. Unanimous vote.


Article 23. To see if the Town will vote to raise and appropriate a sum of money for the purpose of creating a stabilization fund under Chapter 124, Acts of 1945, or take any action relative thereto.


Do not recommend an appropriation. Unanimous vote.


Article 24. To see if the Town will vote to raise and appropriate a sum of money for the purpose of purchasing snow fences, or take any action relative thereto.


Recommend the appropriation of $250.00. Unanimous vote


Article 25. To see if the Town will vote to accept the layout of Sunken Meadow Road as made out by the Select- men and raise and appropriate a sum of money to cover ex- penses or take any action relative thereto.


Recommend the Town so vote and appropriate the sum of $50.00. Unanimous vote.

Article 26. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the treasury, a sum of money for Chapter 90, Highways Construction, or take any action relative thereto.


Recommend the appropriation of $1,200.00 as the Town's share and $3,600.00 to be transferred from avail- able funds to cover State's and County's shares which will be reimbursed to the Town later. Unanimous vote.


Article 27. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the treasury, a sum of money for Chapter 81, Highways, or take any other action thereto.


Recommend the appropriation of $3,225.00 as the Town's share, and $6,450.00 to be transferred from avail- able funds to cover the State's share which will be re- imbursed to the Town later. Unanimous vote.


Article 28. To see if the Town will vote to accept the layout of a Town Landing or Common Landing Place the north side of Jemima's pond as made out by the Selectmen and filed with the Town Clerk and to see if the Town will instruct the Selectmen to take by eminent domain, pur- chase or gift, said landing and vote to raise and appropri- ate a sum of money for this purpose or take any action relative thereto.


Recommend the Town so vote and the appropriation of $100.00. Unanimous vote.


Article 29. To see if the Town will vote to raise and appropriate a sum of money for repairs on the Old Wind Mill, or take any action relative thereto.
