REPORT OF TOWN COUNSEL


The Honorable Board of Selectmen James J. Drummey, Chairman Norwood, Massachusetts


Gentlemen :


I submit herewith in summarized form the fifth annual report of my conduct of the Legal Department of the Town.


Frequent changes in the laws applicable to municipal government bring requests for interpretation of the law which require constant study of the new legislation in its relation to our activities in order to competently advise those charged with the conduct of our own government.


Much of the service rendered was advisory in nature and was furnished in the various departments of the Town through written and verbal opin- ions upon request therefor.


Additional service was rendered by attendance at hearings and con- ferences, court appearances, drafting of articles for town meeting warrants and motions to be offered thereunder, drafting of deeds, agreements and various other instruments.


The service rendered dealt with practically every phase of municipal activity.


It should be pointed out that in connection with the above activity that many questions arose which required much research to find the proper answers and many hours were applied to this end.


Litigation and Claims


Various claims for personal injuries and property damage were made against the Town arising out of alleged defective conditions in public ways concerning which opinions as to liability on the part of the Town were given and recommendations were made as to disposition of claims.


Selectmen


Because the Town does not carry public liability insurance, all such claims are referred to Town Counsel for investigation and settlement with approval of the Board of Selectmen; and, if settlement cannot be made, then the case is tried in court by Town Counsel.


A number of these cases were on behalf of the Department of Public Welfare and thousands of dollars were recovered, a large part of which came back to the Town treasury.

Without listing all the cases handled, suffice it to say that cases by and against the Town have been brought to a current status with little or no 'backlog", so called.


Conclusion


I am grateful for the privilege of having served the Town as legal counsel. During my period of service I have been constantly aware of the great responsibilities attendant upon this position in a growing community such as ours. The uniform spirit of co-operation and friendliness extended to me by Town boards, committees, officials and friends throughout this past year has greatly aided me in the performance of my duties and I shall be ever mindful of their loyalty and friendship.

REPORT OF COMMITTEE ON INDUSTRIAL DEVELOPMENT

Dear Mr. Blasenak:


The Committee on Industrial Development of the Town of Norwood hereby submits its eleventh annual report.


Industrial progress made in the past year is as follows:


A new brick-faced building, built in two stages and totaling 50,706 square feet, at the Plimpton Press.


An addition to the Nortronics precision products division at 100 Morse Street containing 21,450 square feet.


A new warehouse and office building on Morse Street built by Scovill Manufacturing Company and containing 19,360 square feet is nearing completion.


A 15,000 square foot factory building on Lenox Street built by the New England Metallurgical Corporation to house new heat-treating machinery.

TOWN OF NORWOOD


The Towns of Norwood and Walpole have approved funds for the con- struction of a trunk sewer through a large area of the Norwood Industrial Zone from the M.D.C. trunk line to a point near Route 1 and Union Street.


The Town of Norwood has joined with several other towns along the proposed Route No. 95 to form the Regional Industrial Group Route 95 Association.


During the year 1961 a major improvement has been made to the Ne- ponset River from Traphole Brook to Morse Street lowering the flood level in this area substantially. This improvement has helped all the industries from Bird & Sons Inc. to Route 1 and including also the Cornell-Dubilier Electronic Corporation on Route 1 adjacent to Meadow Brook.


In a letter from M.D.C. Commissioner Robert F. Murphy dated No- vember, 1961, he outlines that the Neponset River from Milton Lower Mills to the Traphole Brook will be developed in three stages, the Norwood end being the third stage. This section would not be under contract for at least twelve months.

The amount of assessed valuation added to the Town of Norwood since the inception of the Norwood Committee on Industrial Development eleven years ago has been substantial: $8,843,700.00 or 16.7 per cent of the total valuation. These companies are paying over $550,000.00 per year in taxes. (Add'l for past 11 years)


In addition to the benefits of substantial support to our town budget, our industries are heavy users of our Municipal power and water facilities from which we derive additional support, plus the advantage of clean working conditions in modern offices, laboratories and factory buildings for our residents.


Our Committee is deeply grateful for the assistance received from our General Committee, from the official town boards and departments and officers of our present industries, who have greatly furthered our aims and accomplishments.

REPORT OF SEALER OF WEIGHTS AND MEASURES

Dear Sir:


I present you herewith, the annual report for the Dept. of Weights & Measures of the Town of Norwood, for the year ending December 31, 1961.

SEALER OF WEIGHTS AND MEASURES


The total measuring devices used commercially that were inspected, tested and sealed during the year were 715 units. The 688 units sealed as correct for use within legal tolerance required 164 adjustments. There were five units not sealed as commercial devices and prohibited for such use, and 22 units were condemned that were removed from service.


There were 545 surprise spot check inspection tests of reweighings made on various essential packaged food items. Such findings indicated 302 units as correct, 51 were under weight and 192 were over weight. Excep- tional findings were ordered to be removed from sale, with appropriate instructions for adjustments and proper merchandising.


The towns standard avoirdupois weights were transported from the town office to the state dept. laboratory in the state house for standardiza- tion and corrections according to legislative mandates, and returned. The sealers' field-working equipment was test-balanced against these standards as required.


The total fees of $457.70 were collected by the sealer and deposited with the town treasurer during the year.


The Planning Board found discrepancies in measurements and place- ments of stone bounds in a development which were not being corrected. The sealer, being a member of such board had the town engineering dept. survey tape standardized and its exact length correctly established and a record thereof presented by the State Div. of Standards. The sealer then info :med the particular development enginer of his failure to comply with Ch. 97 Sec. 3 G.L. and requested him to do so forthwith, make proper bound placements or suffer prosecution by the sealer; all of which he willingly complied with.


Had the sealer not been a member of the planning board, a service from which he reluctantly retires this year. this problem may never have been corrected due to the lack of cooperation, coordination of town depart- ments and the sadly neglected recognition of this most important department, its needs and services which are so pertinent to the equity and lives of all our citizens, business and industry.


I wish to thank the Manager, Selectmen, Police Department, State Department Officials, together with local merchants, industrial representa- tives, and the public, for their respective cooperation with this department thus making it possible to quietly and efficiently realize the achievement of this report.

Gentlemen:


I submit herewith the annual report of the Chief of the Fire Department for the year ending December 31, 1961.


The department answered a total of 647 alarms during the year 1961, classified as follows:

584 Inspections made and permits issued for fuel oil, gases, occu- pancy, blasting as well as numerous complaints investigated. Fire Drills and inspections were made periodically in our public and parochial schools, hospital, nursing homes, and public buildings. In addition 75,840 ft. of various size hose, 1402 feet of ladders, and 1,138,880 gallons of water were used at fires during 1961.


During the year periodic departmental drills were held by the officers of the department. Instructions were given on fire-fighting and rescue evolu- tions as well as fire prevention and first aid.


Membership in and attendance at meetings of the various Fire Chiefs Organizations and numerous Civil Defense meetings, will always be an asset to me in the administration of the department. At these meetings mutual problems are openly discussed and experiences of others explained. Changes in the General Laws of the Commonwealth relating to Fire Depart- ments are also brought to our attention. This information is relayed to the officers and men of the department.


In my recommendation for 1962 I must repeat my previous request for the expansion of your fire department. The reality of Route 95 will defi- nitely mean the development of the Neponset Valley area into an industrial site. This together with the rapid development of the Westover area and the proposed Sumner Street, Route 1 area, calls for immediate action.


1. The present fire station is totally inadequate with overcrowded conditions prevailing in every respect. There is a definite traffic problem, increasing daily and interfering with prompt response to your call. Any

such delay could mean the loss of life and permit fires to gain considerable lieadway.


2. Due to a considerable increase in our population and in the con- struction of new dwellings, industrial and business buildings, large and suiall fires have been constantly increasing for the past number of years without a corresponding increase in the manpower of the fire department. These two factors go hand in hand if the safety of the public is to receive the best of fire protection required.


3. In order to maintain the best efficiency of your department I am again requesting that the manpower be increased by the addition of at least one officer and eight additional fire fighters.


I wish to take this opportunity to publicly express my appreciation to the officers and members of the department, Town officials, members of the public works, Police and Light Departments, as well as the neighboring Fire Departments of Dedham, Westwood, Walpole, Canton, Needham, Brook- line and Boston for their fine co-operation and willingness to assist this department at any time.

Tax Rate for the Year 1961


On May 3, 1961, the Board of Assessors determined the tax rate for the year 1961 to be $63.00 per each one thousand dollars of valuation, a decrease of $1.00 from the 1960 rate of $64.00. The School Tax Rate was determined to be $27.50 and the General Tax Rate $35.00.

Motor Vehicle and Trailer Excise


9,296 motor vehicles and trailers were assessed for the year 1961 and excise in the amount of $364,158.50 was committed to the Collector of Taxes.


The 1961 rate for motor vehicles and trailers was $66.00 per thousand.


Appellate Tax Board Cases


During the year 1961, cight appeals relating to valuations of the years 1958, 1959, and 1960 were settled or withdrawn.


Hearings on six appeals relating to valuations of the years 1958, 1959, and 1960 were held before the Appellate Tax Board in 1961. On all six appeals the Assessors valuations were upheld. Applicants requests for abatements were denied. As of December 31, 1961, there were pending before the Appellate Tax Board the following appeals from valuations determined by the Assessors:
