ACCOUNTANT, TOWN


The Town Accountant is appointed annually by the Board of Selectmen. He is a full-time Town employee and is responsible for the maintenance of all accounting records related to the receiving and disbursing of Town funds. He conducts pre- and post audits of all Town expenditures. His certification as to the availability of funds is required on all contracts including purchase orders. His accounts are audited annually by the Bureau of Accounts, State Department of Corporations and Taxation. He is an ex-oficio member of the Municipal Contrib- utory Retirement System Board.


AGING, COUNCIL ON


Local Councils on Aging are provided for under the General Laws of the Commonwealth whereby a city or town is permitted to establish such councils for the purposes of coordinating and conducting programs dealing with the circumstances of the aging. By aging it is meant those citizens who are sixty (60) years of age or older. The Andover Council on Aging was organized in 1966 and consists of seven(7) un- paid members. The Chairman and three(3) members of the Council are appointed by the Town Manager with the remaining members being designated by the Chairman .


ANIMAL CONTROL


Animal control services are provided through a dog officer who is appointed annually by the Town Manager. He is responsible for the enforcement of the General Laws of the Commonwealth as they relate principally to the licensing of dogs. He is paid a fixed annual salary and also receives certain fees from the County for the work that he performs. He is a part-time Town employee.


ANIMAL INSPECTOR


Appointed for an indefinite term of office by the Town Manager, the Animal Inspector is a Doctor of Veterinary Medicine. He is paid a fixed annual salary for his part-time services. He is responsible for the inspection of all sheep, horses, goats, swine and dairy cattle to insure compliance with appropriate State Health Regulations. He is also re- sponsible for the quarantining of dogs suspected of being infected with rabies.


APPEALS, BOARD OF


The Board of Appeals is a three-member unpaid quasi- judicial body appointed by the Board of Selectmen for three-year staggered terms. It acts under the provisions of Chapter 40A of the General Laws of the Commonwealth and the Town's Zoning By-Law. The State Zoning Enabling Act establishes and sets forth the powers of the Board of Appeals. The Board may grant an exception or special permit as authorized under Section 4 of Chapter 40A. An exception or special permit is for a use permitted by the Zoning By-Law but which requires approval of the Board of Appeals.


Section 15 of Chapter 40A authorizes upon appeal or petition, the granting of a variance from the terms of the applicable Zoning By-Law where: 1) owing to

APPEALS, BOARD OF - Cont . conditions especially affecting a parcel or building but not affecting generally the zoning district in which they are located, literal enforcement of the provisions of the ordinance or by-1 w would involve substantial hardship, financial or otherwise, to the appellant; and 20 where desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially dero- gating from the intent or purpose of such ordinance or by-law, but not otherwise.


In exercising its powers, the Board may impose limi- tations both of time and use, and a continuation of the use permitted may be conditioned upon compliance with regulations to be made and amended from time to time thereafter.


Its decisions must be unanimous.


ASSESSORS, BOARD OF


As required by law, the Town's assessment program for property tax purposes is administered by a three-man Board of Assessors appointed by the Town Manager. One of the Assessors works on a full-time basis and is a trained professional. The other members of the Board are consulted in the establishment of all values but more particularly on specialized problems. Perhaps the most important function of the Board is to hear appeals to property assessments. Only the Board of Assessors may grant abatements for any and all taxes or betterment assessments including proper- ty, real and personal, motor vehicle excise, and water and sewer betterments. The two part-time assessors are paid a nominal annual salary.


BUILDING COMMITTEES


Although the Town Manager, under the terms of the Town Charter, is responsible for supervising the con- struction of all public buildings, it has been custo- mary for the Manager to appoint a Building Committee to assist him in the discharge of this important duty. In effect, a Building Committee works on behalf of the Town Manager with its decisions being either recommendations or merely subject to confirmation by the Town Manager. In addition to the new Andover High School Building Committee, there are in exist- ence the Southeast Andover Elementary School Building Committee and the West Elementary School Addition Building Committee.


BUILDING INSPECTION


Enforcement of the provisions of the Town Building and Fire Prevention codes or by-laws is the respon- sibility of the Town Building Inspector. He is also the enforcement officer for the Town Zoning By-Law with his rulings on the by-laws subject to appeal to the Zoning Board of Appeals. Building permits are required for virtually all new construction as well as for most additions or alterations to existing structures . New buildings also require occupancy permits which are evidence that a building meets the requirements of the several Town by-laws and is suit- able for human occupancy and use. The schedule of fees for building permits has been established so as to make the Department self-supporting. The Building Inspector is appointed by the Town Manager for an indefinite term of office.

CENTRAL MERRIMACK VALLEY REGIONAL PLANNING DISTRICT


.. The Central Merrimack Valley Regional Planning Dis- trict is a voluntary association of cities and towns formed under the provisions of Chapter 40B of the General Statutes. The District is directed by the law to make careful studies of the resouces, possi- bilities and needs of the area, and based on these studies, to prepare a comprehensive plan of the Dis- trict and make recommendations for the physical, social and economic improvement of the District. cluded within the scope of these plans and recommen- dations should be such things as highways, bridges, parks, recreation areas, public places, sites or public buildings, land use areas, zoning districts, waterways, rail and bus routes, water and sewer facilities and other public utilities.

The District is also directed to assist the local planning boards in the application of District plans and recommendations to their communities.


In furthering these purposes, the District maintains an office and staff at 477 Essex Street, Lawrence, Mass.


Comprehensive studies have been made of the Lawrence sub-region and a comprehensive plan and program recommended for that area. The District is currently embarked on studies of the Haverhill sub-region for the purpose of preparing a comprehensive plan for that area. When completed, the Haverhill sub-region proposals will be combined with a revision of the Lawrence sub-region proposals so as to provide a uni- fied comprehensive plan for the District.


Andover is represented on the District Commission by a member of the Town Planning Board.


CIVIL DEFENSE


Organized for the purpose of developing plans, pro- grams and facilities for meeting natural or military disasters, the Andover Civil Defense organization is composed almost entirely of volunteers. The Director appointed by the Town Manager is paid a token sum in recognition of the requirements of his office and does not reflect the time devoted to the discharge of his duties and responsibilities. The Town has estab- lished and maintains a shelter program which is fully stocked and equipped . The most active elements of the Civil Defense organization are Auxiliary Police and Communications.


CORNELL FUND, TRUSTEES OF .


These Trustees are chosen at a meeting of the Inhabi- tants of the Town of Andover according to the accept- ance by the Town of a legacy of John Cornell which read as follows: "To the inhabitants of Andover, aforesaid, five thousand dollars, in trust, the in- come therefrom to be used in the purchase of wood and coal for the worthy poor of said Andover, and said fund to be held by a board of trustees chosen at a meeting of said inhabitants, and said trustees to apportion said wood and coal." This was accepted at an Annual Town Meeting, March 6, 1893.

COUNSEL, TOWN


Town Counsel is appointed annually by the Town Manager subject to confirmation by the Board of Selectmen. The Town Counsel must advise every Board in Town and every official of the Town. In the course of the past year, every Town Board has called upon Town Counsel for advice. The most frequent requests come from the School Department. the Building Inspec- tor, the Planning Board, the Board of Public Works, and the Town Manager. In some of the cases, the re- quests for advice can be answered orally. In most cases, the answer must be in written form.


The opinions cover all aspects of municipal law, and range in complexity from opinions requiring a few minutes of study, to opinions requiring several days of study.


Town Counsel is involved in litigation on behalf of the Town. The types of litigation are land damage, zoning violations, zoning appeals, and, occasionally, but rarely, probate matters. The litigation is occa- sioned by activities of the Planning Board, Board of Assessors, Board of Appeals, the Police Department, the Fire Department, the Building Inspector, the Selectmen and the Town Meetings.


As part of the exercise of the right of eminent do- main, titles must be searched. Title searches are sometimes involved in betterment assessments and tax foreclosures .


Opinions are required on contracts for all construc- tion, and are frequently required on School Department contracts .


Opinions and advice are requested with increasing frequency on matters relating to collective bargaining and the contracts resulting from that activity.


Town Counsel is paid an annual salary. In addition, he is paid for special services, particularly court appearances on behalf of the Town.


DEVELOPMENT & INDUSTRIAL COMMISSION


The Development and Industrial Commission is charged with the responsibility of encouraging suitable in- dustry to locate in the Town of Andover. Its eight members serve without compensation for four-year terms .


ELECTRICAL INSPECTION


The inspection of all electrical installations is the responsibility of the Electrical Inspector. Appointed by the Town Manager, he issues permits for electrical work and conducts inspections as required.


ENGINEERING


The Town Engineer provides the plans, surveys, and field layout for many of the Town's projects, parti- cularly in the public works field. He works with the Planning Board in the review of proposed subdivision plans and inspects the subdivision roadway and utility construction. He also assists all other Town depart- ments in engineering matters and maintains the engi- neering matters and maintains the engineering records of the Town.

FINANCE COMMITTEE


Appointed by the Moderator for three-year staggered terms, the seven-member FINCOM functions as the "watch-dog" agency over Town finances. It receives and makes recommendations on the Annual Budget as submitted by the Town Manager. It also considers and comments on all other financial matters or articles which comes before the Town Meeting. No request for the appropriation of funds may be con- sidered by a special Town Meeting without first hav- ing been approved by the Finance Committee. The FINCOM also controls the Reserve Fund established by a Town Meeting and from which transfers may be made to meet situations unforeseen at the time of prepar- ation and adoption of the Annual Budget.


FIRE DEPARTMENT


The Fire Department is maintained to protect the citizen against the loss of life and property by fire. Objectives of fire protection are to prevent fire from starting; to prevent loss of life and property in case fire does start; to confine fire to the place of origin; and to extinguish fire.


The Fire Department installs, repairs and maintains a coded fire alarm system comprising some three million feet (3,000,000) of wiring, both aerial and underground, and associated street boxes and station equipment for controlling this system.


Ambulance service is also provided by the department for both emergency and medical situations requiring the need of this service.


The Department operates from three station locali- ties - Andover Center, Ballardvale, West Andover. Its fifty (50) men use (6) six pieces of firefight- ing equipment, including a recently acquired 1,000 gallon-per-minute diesel powered pumper.


Andover's fire insurance rating is B-4.

Organized under the laws of the Commonwealth of Massachusetts, the Greater Lawrence Regional Voca- tional Technical High School is governed by a seven- member Board of Directors elected from the City of Lawrence and the Towns of Methuen, North Andover and Andover. Andover has one representative on the committee who serves a three-year term of office without compensation. The Town of Andover contri- butes to the support of the Vocational School in proportion to the number of students attending from Andover.


HEALTH, PUBLIC


The Board of Health is comprised of three members appointed by the Town Manager for three-year terms. The Health Department staff - full and part time - provides enrironmental health programs, nuisance control, food and milk sanitation, disposal of gar- bage, enforcement of Health rules and regulations, sanitary codes, plumbing and gas codes, air pollu- tion control, dispensing of biological supplies and testing materials, referral services for crippled children and others afflicted with chronic diseases.

HEALTH, PUBLIC - Cont. Communicable disease control, chest X-ray clinics, and health education are among other functions of the Department.


HIGHWAYS


The Highway Department is responsible for the main- tenance of approximately 160 miles of Town roadways, all public drains, bridges and sidewalks. A crew is also assigned at the appropriate season to the main- tenance of certain Town park areas. A vehicle main- tenance facility is maintained at the Town Yard lo- cated on Lewis Street.


HOUSING AUTHORITY


The Andover Housing Authority is an independent agency of the Town having five members with one mem- ber appointed by the State and the other four elected by the voters for three-year terms. The Authority is responsible for the administration of a low rent Housing Development and one facility for the elderly.


INSURANCE


The Town's insurance program is administered by the Town Manager. He is advised by an Insurance Committee composed of resident insurance agents or agencies . Insurance is placed on the basis of low bid for the coverages required by the Town. At the present time, the Town's insurance program is under- written by a single agency in the form of several master policies. Commissions are paid directly to the one agency and are shared in accordance with a formula established by the committee.


LANDFILL The Town of Andover operates a landfill fifteen acres in size. Town residents and businesses have access to the site at no charge but are required to obtain a facility sticker from the Andover Police Department. The dumping of garbage or other organic waste is not permitted.


LIBRARY


The Memorial Hall Library was built in 1872 and added to in 1926, 1960 and 1966. Its seven-member Board of Trustees is appointed by the Town Manager, with the approval of the Selectmen, for staggered terms of seven years. The Library supplies reading for information and recreation for all ages. It answers questions. It owns 77,231 books, 300 maga- zines and newspapers, 82 framed prints, 1,365 re- cordings, 206 slides and film strips. Through a film cooperative, it loans 16 mm sound films to community groups . Materials borrowed in 1967 totalled 12,525.
