ARTICLE 5. To see if the Town will vote to authorize the Treasurer, with the ap- proval of the Town Manager and the Selectmen, to borrow money in anticipation of the revenue for the financial years beginning January 1, 1968 and January 1, 1969, in accordance with provisions of General Laws, Chapter 44, Section 4, and to renew any note or notes as may be given for a period of less than one year, in accordance with the provisions of General Laws, Chapter 44, Section 17, or take any other action relative thereto.


Upon motion duly seconded, it was VOTED to accept Article 5 as printed in the warrant.


ARTICLE 6. To see if the Town will vote to raise by taxation and appropriate the sum of $54,000 for Chapter 90 Highway Construction, the Town to be reimbursed 50% by the Commonwealth and 25% by the County; and to authorize the Town to acquire the necessary drainage easements by gift, by purchase, or by seizure by right of eminent domain.


Upon motion duly seconded, it was VOTED unanimously that the sum of $54,000 be raised by taxation under Article 6 for Chapter 90 Highway Construction, the Town to be reimbursed 50% by the Commonwealth and 25% by the County; and to authorize the Town to acquire the necessary drainage easements by gift, by purchase, or by seizure by right of eminent domain. Planning Board report on file with the Town Clerk.


ARTICLE 7. To see if the Town will vote to raise by taxation and appropriate the sum of $25,000 to be added to the Stabilization Fund which was established by the Town in 1963 under Section 5b of Chapter 40 of the General Laws.


Article 7 was defeated.


ARTICLE 8. To see if the Town will vote to transfer $50,000 from Overlay Reserve to the Reserve Fund, said Reserve Fund administered by the Andover Finance Committee.


Upon motion duly seconded, it was VOTED to transfer $45,000 from Overlay Reserve to the Reserve Fund, said Reserve Fund administered by the Andover Finance Committee.


ARTICLE 9. To see if the Town will vote to amend the vote taken under Article 11, Sub-section 3, of the Warrant for the Adjourned Annual Town Meeting held March 6, 1965, by substituting for the words "originally equipping and furnishing of a Town Hall" the following:


.... an addition to the Town Hall, the originally equipping and furnishing of the Bancroft Elementary School, the constructing, originally equipping and furnishing of a Public Safety Center and the constructing, originally equipping and furnishing of an addition to the West Elementary School."


Article 9 was withdrawn.

ARTICLE 10. To see if the Town will vote to raise by taxation and appropriate the sum of $25, 000 for the purpose of undertaking necessary repairs and improve- ments to the Town Hall.


Upon motion duly seconded, it was VOTED to raise by taxation the sum of $10,000 under Article 10. Planning Board report on file with the Town Clerk.


ARTICLE 11. To see if the Town will vote to raise by taxation and appropriate the sum of $15, 000 for the purpose of purchasing a Forest Fire Truck.


Upon motion duly seconded, it was VOTED to raise by taxation the sum of $15,000 under Article 11.


Upon motion made by Fredric O'Brien and duly seconded, it was VOTED to adjourn the regular town meeting and take up the special town meeting at 3:25 P. M.


SPECIAL TOWN MEETING


ARTICLE 1. To see if the Town will authorize the Town Manager to contract for the purchase of an aerial platform fire truck for the Fire Department, and to meet the expense to raise and appropriate by taxation the sum of $37,500 and authorize the Treasurer to borrow $37, 500 by notes or bonds of the Town.


Upon motion duly seconded, it was VOTED unanimously that the Town authorize the Town Manager to contract for the purchase of an aerial platform fire truck for the Fire Department, and to meet the expense to raise by taxation the sum of $37,500 and authorize the Treasurer to borrow $37,500 by notes or bonds of the Town under Article 1. Planning Board report on file with the Town Clerk. This article ap- proved by Finance Committee. A quorum was present.


ARTICLE 2. To see if the Town will vote to raise by taxation and appropriate the sum of $9,600, said sum to be added to funds appropriated under Article 12 of the Special Adjourned Town Meeting of November 20, 1967, for the acquisition of land for the West Elementary School Addition.


Upon motion duly seconded, it was VOTED unanimously to raise the sum of $9,600 by taxation under Article 2. Planning Board report on file with the Town Clerk. This article approved by Finance Committee.


ARTICLE 3. To see if the Town will vote to raise by taxation or by transfer from available funds and appropriate the sum of $40,000 for the construction and/or re- construction of the playfields or any parts thereof at the new Andover Senior High School.


Upon motion duly seconded, it was VOTED unanimously to transfer from available funds the sum of $40,000 under Article 3. This article was approved by the Finance Committee. Planning Board report on file with the Town Clerk.


ARTICLE 4. To see if the Town will vote to appropriate the sum of $180, 000 for the acquisition of land, constructing, originally equipping and furnishing of a public safety center, said sum to be added to those funds voted under Article 7 of the Special Town Meeting of August 21, 1967, and to determine whether this sum shall be raised by taxation, by transfer from available funds, by borrowing or by any combination of the foregoing, or take any other action.


Article 4 was not acted upon.


ARTICLE 5. To see if the Town will vote to raise by taxation or by transfer from available funds the sum of $10,000 to implement a leash law.


Article 5 was not acted upon.


ARTICLE 6. To see if the Town will vote by written ballot its answer to the fol- lowing question:

"Shall there be established a sanitary district to include the city of Lawrence and the towns of Andover, Methuen and North Andover and the construction, acquisition, extension, improvement, maintenance and operation of a system of water pollution abatement facilities by the said district in accordance with the provisions of a special act of the Legislature to create the Greater Lawrence Sanitary Dis- trict?"


Upon motion duly seconded, it was VOTED by written ballot to accept Article 6 as printed with the following results: YES 614, NO 7 -- voted overwhelmingly in the affirmative.


Upon motion made by Fredric O'Brien and duly seconded, it was VOTED to adjourn the Special Town Meeting action and return to the warrant on the regular town meet- ing at 4:15 P. M.


REGULAR WARRANT


ARTICLE 12. To see if the Town will vote to authorize the Town Manager to call for bids and award a contract for the collection and disposal of garbage for one year and to authorize the Board of Selectmen to enter into a three (3) year con- tract if they deem it advantageous.


Upon motion duly seconded, it was VOTED to accept Article 12 as printed in the warrant.


ARTICLE 13. To see if the Town will vote to appropriate from funds to be made available by the Commonwealth the amount of $34,224.90 for roadway improvements under the provisions of Chapter 616 of the Acts of 1967.

ARTICLE 14. To see if the Town will vote to raise by taxation and appropriate the sum of $20,000 for the purchase of so-called electronic voting machines, pro- vided that no funds be expended until the electronic voting machines have been ap- proved by the Secretary of State for use in all primaries and elections for state and municipal officers and questions which may be submitted to the voters on the ballots of such elections.


Upon motion duly seconded, it was VOTED to raise by taxation the amount of $7,000 under Article 14.


ARTICLE 15. To see if the Town will appropriate the sum of $500,000 for remodel- ing, reconstructing or extraordinary repairs to the East Junior High School, and to determine whether the same shall be raised by taxation, by transfer from available funds, by borrowing, or by any combination of the foregoing, or take any other ac- tion.


Upon motion duly seconded, it was VOTED unanimously that the sum of $400,000 is hereby appropriated for the purpose of remodeling, reconstructing or making extra- ordinary repairs to the East Junior High School, and to meet said appropriation, the sum of $40, 000 shall be raised by taxation in the current year, and the Treasu- rer, with the approval of the Selectmen, is hereby authorized to issue and sell bonds or notes of the Town at one time or from time to time not exceeding in prin- cipal amount the sum of $360,000 pursuant to Chapter 44, Section 7 (3A) of the General Laws, as amended and supplemented, each issue of said bonds or notes to mature in not more than ten (10) years from its date. Planning Board report on file with Town Clerk. A quorum was present.


ARTICLE 16. To see if the Town will vote to install approximately 2550 lineal feet of 8 inch sewer main from Highland Road, through land of Phillips Academy, to Bancroft Road to serve the Bancroft Elementary School; and to appropriate therefor the sum of $50,000 or any other sum; and to determine whether the same shall be

raised by taxation, by transfer from available funds, by borrowing or by any com- bination of the foregoing; and to authorize the Board of Selectmen to acquire all necessary easements therefor by gift, by purchase or by seizure by right of eminent domain; or take any other action, and betterments to be assessed.


Upon motion duly seconded, it was VOTED unanimously that the sum of $50,000 is hereby appropriated for the purpose of constructing approximately 2,550 lineal feet of 8-inch sewer main from Highland Road, through land of Phillips Andover Academy to Bancroft Road, more or less, and to acquire necessary land and easements there- for, and to meet said appropriation the sum of $1,000 shall be raised by taxation in the current year and the Treasurer, with the approval of the Selectmen is hereby authorized to issue and sell bonds or notes of the Town at one time or from time to time not exceeding in principal amount the sum of $49,000 pursuant to Chapter 44, Section 7(1) of the General Laws, as amended and supplemented, each issue of said bonds or notes to mature in not more than twenty (20) years from its date; and fur- ther to authorize the Selectmen to obtain all necessary easements therefor, by gift, by purchase, by seizure by right of eminent domain, or otherwise. Betterments are to be assessed. Planning Board report on file with Town Clerk. A quorum was pres- ent.


ARTICLE 17. To see if the Town will vote to appropriate the sum of $175,000 for the constructing, originally equipping and furnishing of the Bancroft Elementary School, so-called, and to determine whether the same shall be raised by taxation, by transfer from available funds, by borrowing or by any combination of the fore- going; or take any other action.


Upon motion duly seconded, it was VOTED unanimously that the sum of $175,000 be appropriated for the purpose of constructing, originally equipping and furnishing the Bancroft Elementary School, so-called, such sum to be in addition to sums pre- viously appropriated for the same purpose, and to meet said appropriation, $75,000 be transferred from the Stabilization Fund, $75,000 in an anticipated accelerated state school building assistance grant and the Treasurer, with the approval of the Selectmen, is authorized to issue and sell bonds or notes of the Town at one time or from time to time not exceeding in principal amount the sum of $25,000 pursuant to Chapter 645 of the Acts of 1948, as amended and supplemented, each issue of said bonds or notes to mature in not more than twenty (20) years from its date. Planning Board report on file with the Town Clerk. A quorum was present.


ARTICLE 18. To see if the Town will vote to appropriate the sum of $45,000 for the installation of fencing for the several play areas at the new Andover Senior High School and to determine whether the same shall be raised by taxation, by trans- fer from available funds, by borrowing or by any combination of the foregoing; or take any other action.


Upon motion duly seconded, it was VOTED to raise by taxation the sum of $40,500 under Article 18.


ARTICLE 19. To see if the Town will vote to raise and appropriate, by taxation, the sum of not more than one hundred thousand dollars ($100,000.00) for the follow- ing purposes:


To re-grade and re-seed all grassed areas at the new high school, (except the lawn about the building); all topsoil to be removed and screened to eliminate stones, roots and so forth; to purchase additional loam, seed, fertilizer and shrubbery as it may be deemed advisable, and including consultant's fees, in order to make the fields safe; all work to be done by the school department, or as the Town meeting shall direct, on peti- tion of the School Committee.


Article 19 was withdrawn.


ARTICLE 20. To see if the Town will vote to authorize the Board of Selectmen to demolish the Andover Central Fire Station on Park Street and to raise by taxation and appropriate the sum of $20,000 for said demolition.

Upon motion made and duly seconded, it was VOTED at 5 P.M. to temporarily adjourn the meeting to complete the remaining articles and reconvene on Monday evening, March 11, 1968 at 7:30 P. M. in the Memorial Auditorium.


ADJOURNED TOWN MEETING MARCH 11, 1968


The check lists were used at entrance and showed 783 voters admitted to the meet- ing.


The meeting was called to order by Arthur Williams, Moderator at 7:45 P. M.


Unanimous consent was voted to admit four non-voters (two of whom wished to ad- dress the meeting.)


ARTICLE 21. To see if the Town will vote to authorize the Selectmen to acquire for the Town for access to a municipal building or buildings by purchase, by gift, or by seizure by right of eminent domain a fee in lots numbered 68, 69 and 72 shown on As- sessors' Map No. 55 and supposed to be owned by Samuel Resnik and to appropriate by transfer from available funds, by borrowing or by any combination of the foregoing the sum of $85,000.00 for land acquisition and preliminary site development or take any other action.


Article 21 was defeated. The Vote YES 357 -- NO 330 -- less than the required 2/3 vote.


ARTICLE 22. To see if the Town will vote to raise by taxation and appropriate the sum of $7,500, said sum to be used for the demolition of the so-called Andover Play- house Building on Essex Street in Andover.


Article 22 was withdrawn.


ARTICLE 23. To see if the Town will vote to approve the following item which will be presented by written ballot:


"Shall there be established a Water Pollution Abatement District as recom- mended by the Division of Water Pollution Control and approved by the Water Resources Commission, to include the City of Lawrence and the Towns of Methuen, North Andover, and Andover, and the construction, acquisition, ex- tension, improvement, maintenance and operation of a system of water pollu- tion abatement facilities by the said District in accordance with the pro- visions of Chapter 21 of the General Laws?"


Article 23 was withdrawn.


ARTICLE 24. To see if the Town will vote to appropriate $1, 581, 000 or any other sum to construct a sewer for the West Andover Industrial Area from low point near Andover- Lawrence line; along the southern side of the Merrimack River to a point northerly of Laurel Lane; from the Merrimack River interceptor cross country on the west side of Route 93, along River Road; thence cross country to near Chandler Road; cross country from the Merrimack interceptor to Laurel Lane; alo ng Laurel Lane to near River Road; from the low point near the Andover-Lawrence line cross country to said line; then cross country in the City of Lawrence to Wolcott Avenue near Sanborn Street and to determine how any such sum shall be raised whether by taxation, transfer or borrow- ing or by any combination of the foregoing or otherwise, to authorize the Selectmen to apply for and accept any Federal, State or County Aid available or take any other action connected with or incidental to the foregoing and authorize the Selectmen to acquire on behalf of the Town by purchase, by gift, or by seizure by right of eminent domain, temporary construction easements and permanent easements in lands supposed to be owned by:

Upon motion duly seconded, it was VOTED that there be and hereby is authorized the construction of sewers for sanitary and surface drainage purposes, namely, a sewer for the West Andover Industrial Area from low point near Andover-Lawrence line; along the southern side of the Merrimack River to a point northerly of Laurel Lane; from the Merrimack River interceptor cross country on the west side of Route 93, along River Road; thence cross country to near Chandler Road; cross country from the Merri- mack interceptor to Laurel Lane; along Laurel Lane to near River Road; from the low point near the Andover-Lawrence line cross country to said line; then cross country in the City of Lawrence to Wolcott Avenue near Sanborn Street all generally as shown on a plan to be prepared, a copy of which shall be filed with the records of this meeting in the office of the Town Clerk; that the sum of $1, 581, 000 is hereby appro- priated for said purpose, said sum to be exclusive of any federal or state aid avail- able therefor; and to meet said appropriation, the sum of $36,000 shall be raised by taxation in the current year and the Treasurer, with the approval of the Selectmen, is hereby authorized to issue and sell bonds of the Town at one time or from time to time not exceeding in principal amount the sum of $1,545, 000 pursuant to Chapter 44, Section 7 (1) of the General Laws, as amended and supplemented, each issue of said bonds or notes to mature in not more than thirty (30) years from its date; that the Selectmen are authorized in the name of and on behalf of the Town to negotiate with the City of Lawrence to the end that construction of a sewer trunk line along the southern bank of the Merrimack River in that City can be undertaken, said trunk line to be connected to a manhole in Wolcott Avenue so as to discharge sewage from that connection into the sewer system of the City of Lawrence and for reimbursing the City of Lawrence for damages for eminent domain takings, if any be required for such sewer trunk line; that the Selectmen are authorized in the name and on behalf of the Town to apply for and accept any federal or state or county aid available for the project; that the Selectmen are authorized to acquire on behalf of the Town, by purchase, by gift, or by seizure by right of eminent domain, temporary construction easements, and permanent easements in lands supposed to be owned by :
