REPORT OF TOWN CLERK


ANNUAL TOWN MEETING, 1938 HELD ON TWO DAYS Under Authority of Chapter 284, Acts of 1915 March 7, 1938


At a legal meeting of the inhabitants of the Town of Scituate qualified to vote in Elections and Town Affairs held at the High School Auditorium in said Scituate on Monday, the seventh day of March, 1938, at 9 o'clock A. M. order was called by Moderator William J. Roberts.


The warrant was read by Town Clerk, William M. Wade.


Tellers appointed by the Moderator and sworn to their duties by the Town Clerk were: John G. Vollmer, Lester D. Hobson, Donald S. Pitkin, John M. Goodnow, Ralph C. Ackerman, Joseph O. Severance, Jr., and George F. Dwyer.


Article 1


To choose all the necessary Town Officers other than those elected by ballot, viz., Surveyor of Lumber, Meas- urer of Wood and Bark, two or more Field Drivers, one Pound Keeper.


Voted: To elect same officers as in 1937. Surveyor of Lumber, Measurer of Wood and Bark, Ansel F. Servan.

To hear the report of the Selectmen, other Town Offi- cers and Standing Committees, and act thereon.


Voted: To accept reports of Town Officers as printed in the Town Report.


Voted: To accept report of Committee re. Art. 8 of Town Meeting of March 1, 1937 concerning conditions near Town Pier.


A minority report by William A. Davidson, accepted and filed with the Town Clerk.


Voted: To accept report of Committee appointed at Town Meeting of March 1, 1937, re. draining problem at corner of Cudworth and First Parish Roads.


Article 3


Will the Town vote to establish salaries and compen- sation of all elected Town Officers, or act thereon?


Voted: To establish salaries and compensation of all elected Town Officers as follows:


Selectmen: Chairman, $1800.00 and legitimate ex- penses. Other members, $540.00 each and legitimate ex- penses.


Assessors: Chairman, $1620.00 and legitimate expen- ·ses. Other members, $405.00 each and legitimate ex- penses.


Board of Public Welfare: Chairman, $500.00 and legitimate expenses. Other members $100.00 and legiti- mate expenses.


Highway Surveyor: $1980.00, he to furnish his own conveyance while in the performance of his duties and receive $250.00 to cover expense of same.

Town Clerk: $1200.00 and legitimate expenses.


Town Collector: $2000.00 and legitimate expenses, all fees to accrue to the benefit of the Town.


Town Treasurer: $1800.00 and legitimate expenses.


Tree Warden: $270.00.


Water Commissioners: $180.00 for each member and legitimate expenses, to be taken from Water Department budget.


Board of Health: The sum of $1200.00 be paid to the Board of Health for salary, divided as follows: Secretary, $500.00 and legitimate expenses. Other two members $350.00 each and legitimate expenses. This sum shall in- clude their charges for all services performed by them or either of them, other than inspection of plumbing, in- spection of meat and inspection of cattle from appropri- ation for Board of Health.


Park Commission: each member be paid the same amount per hour for work actually performed as is paid laborers in the Highway Department.


Moderator: $10.00 each meeting.

To raise and appropriate such sums of money as may be necessary to defray the expenses estimated for the year 1938, and make appropriations for the following departments:

Resolution re. Hydrant Rental under Article 4


Whereas: The operating costs of the Water Depart- ment are decreasing each year, and the income of the Department is an amount in excess of what is necessary for its operation and ordinary upkeep, and


Whereas: The charges against.the Town for fire pro- tection under the title of Hydrant rental and Inch-foot levy, have reached an amount in excess of any previous year, and are greater than are needed to supplement the income from water rates;


Be it resolved: That it is the sense of this Town Meet- ing that the amount $3,010.00 asked for hydrant rental shall be withdrawn or abated if already charged for the

year of 1938 and that the water rates shall be reduced thus giving the water taker the benefit of the savings accruing to this Department.

Article 5


To see if the Town will authorize the Board of Public Welfare to contract at their discretion for the support of the Town's poor, or act thereon?

Article 6


To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1939, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws. The Selectmen


Voted: That the Town do authorize the Town Treas- urer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1939 and to issue a note or notes therefor payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.

Will the Town instruct its Selectmen to control, regu- late, or prohibit the taking of eels, clams, quahaugs, ra- zor fish, sea worms and scallops within the Town of Scituate in accordance with Chapter 130, Section 84, Gen- eral Laws, as amended by the Acts of 1928, Chapter 113, and raise and appropriate $2,200.00 for the regulations, supervision and equipment for same, or act thereon?

side of Front Street in said town,- said appropriation to be made in accordance with Chapter 235, Sections 1 and 3 inclusive of the Acts and Resolves of the Common- wealth of Massachusetts for 1936, a copy of which is herein set forth below, and under which enactment the town at its annual town election in 1937 voted by a vote of 847 in favor to 351 against, to authorize the Town of Scituate to pay to the said Henry T. Cole a sum not to ex- ceed eight thousand dollars for said labor and materials furnished as aforesaid, and at said election no action could be taken to make appropriation for said payment on account of the fact that all appropriations for the year 1937 had been made the week previous at the annual Town meeting held on the first Monday of March, 1937? 'An Act Authorizing The Town of Scituate To Pay a Sum of Money to Henry T. Cole For Certain Work and Materials.


Be it enacted, etc., as follows:


Section 1. For the purpose of discharging a moral obligation, the town of Scituate is hereby authorized to pay to Henry T. Cole of said town a sum not to exceed eight thousand dollars for work and materials furnished to sa'd town in connection with a contract or contracts for making fill on the waterfront side of Front Street in said town.


Section 2. This act shall be submitted to the regis- tered voters of said town at the annual town meeting in the year nineteen hundred and thirty-seven in the form of the following question, which shall be placed on the official ballot to be used for the election of town officers at said meeting :- "Shall an act passed by the general court in the year nineteen hundred and thirty-six entitled 'An Act authorizing the Town of Scituate to pay a sum of Money to Henry T. Cole for Certain Work and Mater-

ials,' be accepted?" If a majority of the votes cast there- on are in the affirmative this act shall thereupon take effect, but not otherwise.

Article 22


Will the Town raise and appropriate the sum of $150.00 for the annual clean up and appoint a committee to have charge of same, or act thereon. - Scituate Clean Up Committee


Voted: To raise and appropriate $150.00 with same Committee as in 1937.


Article 23


To see if the Town will vote to increase the number of Selectmen from three to five members, to take effect March 1939 at the annual town meeting for election of officers all five members to be elected for a period of one year.
