REPORT OF TOWN COUNSEL
In closing ten years of public service as Town Coun- sel for this municipality, I can claim some small part in the town's progress and orderly conduct such as per- mitted to counsel working in close harmony with other town officials during this period.
"Of course, we must realize that a so-called Town Counsel is no longer merely an advisor, as the name im- plies, or an attorney in a court case from time to time. His position has become similar to that of counsel for a large corporation, the complexity of whose activities demand constant specialized legal service to avoid un- pleasant entanglements and heavy expenses of special counsel for each new matter. To Scituate, large terri- torially, growing in population, and diverse in its in- terests, suburban and seashore, the above statement is particularly applicable." (Excerpt-Report for 1928, p. 151)
In my first year of service I was called upon to assist in the improvement of the handling of public aid, re- vision of the local traffic regulations, and granting of a franchise for gas light and heat.
In 1930 I rendered gratuitous service in the compila- tion of the town's by-laws, departmental regulations and previously accepted acts of the legislature.
In 1931 we acquired the Scituate Water Company then owned by a Delaware Corporation under New

York control. Early in that year we defeated their ef- forts to almost double water rates before the Depart- ment of Public Utilities. The acquisition of the plant followed acceptance of an impartial report by Honor- able James W. Turner, then chairman of the Board of Selectmen, the late Honorable William F. Smith, Treas- urer, and myself.
In 1932 we took another farsighted step forward in adding to our water system the Humarock Beach Water Company upon the advice of our Water Commission- ers.
In 1933 we were first confronted with problems (old and new) arising out of the new Alcoholic Beverage Act as to liquor sales. Likewise federal and state legis- lation as to relief work and governmental projects ne- cessitated additional legal efforts.
In 1934 the situation then facing us prompted the following statement in my Report:
"Municipal governments, as well as State and Fed- eral, are constantly being required to play a greater part in the lives of our people, in consequence of which more and more legal problems arise. Neglect of these problems only involves the Municipality in more serious difficulties, with greater expense and disturbance. The Town's officials, face to face with these problems, are alone in a position to judge whether or not the services of a lawyer are necessary for the efficient conduct of the Town's affairs."
During the ten-year period referred to herein, notable additions to the town's by-laws are those creating the Planning Board (1929) and Zoning (1936). There have

been created many other new agencies and public du- ties, many of which have fallen upon the Board of Se- lectmen, such as liquor license board, directors of shell- fish activities, custodians of town lands acquired by the Town Treasurer, and the Zoning Board of Appeals. The Assessors now have additional duties in connection with the State Tax Appeal Board; the Welfare Board added responsibilities of Old Age Assistance and of other modes of public aid including relief work on federal projects and distribution of goods to needy per- sons. Among the town's new agencies no doubt the most active is the Water Department under the direction of the Water Commissioners and Superintendent, many improvements and extensions having been made in our water system since that first purchase in 1931.
The requirement of licenses has extended to many ac- tivities such as shellfishing, parking spaces, amuse- ments, Sunday sports, sales of fire arms and of certain other kinds of merchandise. Regulations by State de- partments, too, have increased constantly, even to the recent specifying of wages to be paid to town labor and contractors on local public works.
Probably no special activity of the town, however, has led to so fortunate results as the struggle to eradicate the mosquito nuisance begun in 1930 and continued from 1931 on under special legislature acts providing for the South Shore Mosquito Control project. This work was so efficiently carried out that our community was saved from a real estate slump comparable to that in Florida some years ago. Many thousands of dollars state aid enabled us to carry out this work effectively. No reference to this accomplishment would be com- plete without mentioning Mrs. Elberta Copeland, who led the fight for the necessary action by state and local

agencies, and also the splendid co-operation of the late Honorable Walter Haynes.
We have been particularly lucky in having the confi- dence and generous co-operation of the Department of Public Works and other state officials in such projects. Moreover, the State and County have been generous with us in shore and highway development, erection of sea walls and harbor improvements. In the past year we have been assured about $140,000 from the federal government in addition to a large sum from the State for Scituate Harbor.
In closing, I will comment briefly upon our present difficulties.
The new Zoning by-law has necessitated variance hearings and litigation as to its application. Mandamus proceedings as to Dreamwold Inn, begun early in the past year, were referred by the Single Justice of the Su- preme Court in Boston to an Auditor who heard the case both there and here in Scituate for eleven days in all. It then went again before the Single Justice who sustained the action of our Board of Selectmen (a ma- jority thereof) in having granted a common victual- ler's license to Michael Zullas, et al. An appeal by George R. Paul and other residents of Scituate is now awaiting argument before the full bench of the Supreme Court. A lesson in tolerance could be had in no bet- ter way than in noting the example of the parties in- volved in this litigation who have honestly differed in their views, but who have constantly displayed good will throughout the contest.
The past year has been an unusually busy one for your Town Counsel on account of this case, other mat-

ters referred to herein, and many legal problems such as fire departmental building and equipment; the Peg- gotty Beach Parking space takings, nuisances, and land sales. In cross actions pending between Scituate and Boston on welfare payments, Scituate has already re- ceived one payment of $1,000. in the past year.
It is needless to stress further that our problems of government are multiplying. The above report has pointed out many of them to which Town Counsel has given serious attention throughout these years.
Appreciation by the Selectmen, Advisory Board and by other boards, officials and fellow citizens has ever been an inspiration and incentive to faithful service. I have found much happiness in serving Scituate.

Article 7

Article 9
Will the Town authorize the Selectmen to prosecute, compromise or defend any suit or suits within the Com- monwealth in the name of the Town and to settle any claim against the Town not exceeding twenty-five dol- lars ($25.00) out of any available funds therefor.

Article 10
Will the Town instruct its Selectmen to control, reg- ulate, or prohibit the taking of eels, clams, all other kinds of shellfish and seaworms within the Town of Scituate in accordance with Section 48, Chapter 130, General Laws, as amended by Chapter 329, Acts of 1933 and raise and appropriate $1,500.00 for enforcement of regulations of same and promotion of shell fish in- dustry, or act thereon ? -Selectmen.
Voted, To instruct the Selectmen to control, regulate, or prohibit the taking of eels, clams, seaworms, razor fish and scallops within the Town of Scituate in accord- ance with Chapter 130, Section 84, General Laws, as amended by the Acts of 1928, Chapter 113, and raise and appropriate $1,500.00 for the regulations of same.
Article 11
Will the Town authorize the Selectmen to contract for the part time services of a Public Health Nurse to be employed under the direction of the Board of Health, Board of Public Welfare, and the School Committee and raise and appropriate the sum of $1600 plus $500 to help pay the cost of transportation for schools, Board of Public Welfare and Board of Health work, or act thereơn ? -Selectmen.
Voted, Yes. $2,100.00.
