COMMONWEALTH OF MASSACHUSETTS


NORFOLK, SS.


To either of the Constables of the Town of Medfield, in said County, greeting:


In the name of the Commonwealth you are directed to notify and warn the inhabitants of the Town of Medfield, qualified to vote in elections and in town affairs, to meet at the High School Auditorium in said Medfield on Monday the twenty-sixth day of November A.D. 1956 at 7:30 P.M. then and there to act on the following articles:


Article 1. To see if the Town will vote to amend the Town By-Law ยท of 1926 as amended by the vote taken under Article 8 of the Special Town Meeting of April 4, 1955, by revoking the amendment thereby enacted and substituting therefor the following addition to Article 1, after Section 3, the new section which shall read as follows:


(4) In the event that the Annual Adjourned Town Meeting shall not have been completed by 10:45 P.M. it shall be adjourned to a place and time determined by a majority of the voters then present; how- ever, the Town Moderator shall be authorized to keep any such Annual Town Meeting in session for an additional half hour period, if, in his opinion, the meeting will thereby be enabled to complete the remaining business.

Article 2. To see if the Town will vote to amend the Earth Re- moval By-Law passed at the Special Town Meeting of July 11, 1951, by deleting in the first paragraph the words "from single or general residence districts" and substituting therefor the words "from any district" so that the By-Law will read in its entirety as follows:


"The removal of sod, loam, sand, gravel or stone from any district of the Town of Medfield shall be deemed non-conforming use of premises. Such uses shall be permitted only after special permission of the Selectmen and under such conditions as the Selectmen shall impose. The Selectmen shall not grant such permits as would, in their opinion, adversely affect the scheme of growth laid down in the Zoning By-Law or elsewhere, or the economic status of the Town or tend to impair the beauty of the Town or of the district most immediately affected, or develop health or other hazards. Conditions shall be imposed where needed and made a part of their permit. No permit for the excavation or removal of material shall be granted by the Selectmen for a period of more than seven (7) days from the date of issue but may be extended for additional seven (7) day periods at the discretion of the Selectmen. Permit issued by the Selectmen shall only be issued to an owner of record and shall not be transferable".


Article 3. To see if the Town will vote to amend the By-Laws of 1926 by adding the following new section to Article IV:


Section 27. Owners of land whereon is located an abandoned well or well in use, are required to provide a covering for such well capable of sustaining a weight of three hundred pounds or to fill the same to the level of the ground.


Article 4. To see if the Town will vote to transfer from available funds in the Town Treasury the following sums of money to defray expenses for the following accounts for the remainder of the year:

Article 5. To see if the Town will vote to transfer a sum of money from the Road Machinery Fund to the Highway Operating Account to defray the expense of the operation and maintenance of highway machinery.


Article 6. To see if the Town will vote to transfer from the item Street Lights under Article 3 of the Annual Town Meeting of 1956 the sum of $574.64 due as an unpaid bill to the Boston Edison Company for the payment of Street Lighting incurred in the month of December 1955.

Article 7. To see if the Town will vote to transfer from available funds in the Town Treasury the sum of $575.00 for fire insurance on the addition to the Memorial School.


Article 8. To see if the Town will vote to transfer from available funds in the Town Treasury as additional compensation for land damages awarded by the County Commissioners in the matter of the relocation of High Street the following:

Article 9. To see if the Town will vote to accept as a public way Rocky Lane which extends in an easterly direction approximately 2963 feet from South Street to Granite Street as relocated by the Selectmen and as shown on a plan entitled "Plan Showing the Relo- cation and Widening of Rocky Lane, Medfield" dated August 15, 1956, and on file in the Town Clerk's Office.


Article 10. To see if the Town will vote to accept as a public way a way connecting Rocky Lane to Granite Street and sometimes known as Rocky Lane which extends in a northeasterly direction for a distance of approximately 813 feet from Rocky Lane to Granite Street as laid out by the Selectmen and as shown on a plan entitled "Plan showing the Layout of a New Way in Medfield between Rocky Lane and Granite Street" dated October 19, 1956, and on file in the Town Clerk's Office.


Article 11. To see if the Town will vote to transfer the sum of $205.00 from the "Sale of Cemetery Lots Fund" to defray expenses of the Cemetery Department for the remainder of the year or do or act anything in relation thereto.


Article 12. To see if the Town will vote to transfer from available funds in the Town Treasury the sum of $300.00 to defray the expense incurred in removing excess loam from the Memorial School to the Cemetery or do or act anything in relation thereto.


Article 13. To see if the Town will vote to transfer from available funds in the Town Treasury and/or transfer from unexpended balances and/or borrow in accordance with Chapter 44 General Laws an addi- tional sum of money for the control of Dutch Elm Disease or do or act anything in relation thereto. Article 14. To see if the Town will vote to transfer from available funds in the Town Treasury the sum of $822.00 payable to the Town of Norwood for bills incurred at the Norfolk County Hospital, Braintree. (Board of Health)

In an Industrial District no building or premises shall be erected, altered, or used for any purposes injurious, noxious, or offensive to a neighborhood by reason of the emission of odor, fumes, dust, smoke, vibration, or noise or other cause," and substituting in place thereof the following: SECTION V. INDUSTRIAL DISTRICT USES. In an Industrial District no building or premises shall be erected, altered or used for dwelling purposes, or for any purpose injurious, noxious, or offensive to a neighborhood by reason of the emission of odor, fumes, dust, smoke, vibration, noise, or other cause. Article 16. To see if the Town will vote to amend the Zoning By- Law for the Town of Medfield, Mass. as amended, by deleting the first sentence of Paragraph Number 5 of Section VII. AREA REGULATIONS and substituting in place thereof the following sentence:

Article 18. To see if the Town will vote to appropriate a sum of money by borrowing, transfer or otherwise, for the purpose of purchas- ing for school purposes the following described parcel of land from Myron R. Brennan and Eunice K. Brennan:


A certain parcel of land in Medfield, Norfolk County, Massachusetts, and bounded and described as follows:

SOUTHWESTERLY by other land of the Town of Medfield, eighty- two and 55/100 (82.55) feet;


NORTHWESTERLY by land now or formerly of Bois, fifty-three and 31/100 (53.31) feet and SOUTHEASTERLY by other land of Myron R. Brennan and Eunice K. Brennan (formerly of Willard F. Pear) ninety-four and 89/100 (94.89) feet.


Said premises contain 2,194 square feet of land and are shown on a "Plan of Land in Medfield, Mass." dated December 5, 1955, drawn by McCarthy Engineering Service, Inc. and recorded with Norfolk Deeds as Plan No. 1685 of 1955 in Book 3438, Page 250. (School Building Committee)


Article 19. To see if the Town will vote to appoint Leon N. Bowden to the School Building Committee created by the action taken under Article 12 of the Special Town Meeting of July 18, 1955. (School Building Comm.)


Article 20. To see what sum the Town will vote to raise and appropriate, transfer and borrow for the purchase for school purposes of the following three tracts of land:


Parcel 1. Land belonging to Byron Bristol shown on a plan of land drawn by McCarthy Engineering Service, Inc. dated July 11, 1956, and comprising lots No. 508, 422, 423, 425 and a part of lot No. 426 as shown on the Assessors Maps of the Town of Medfield containing 30.93 acres.


Parcel 2. Lands belonging to Esther B. and Byron Bristol and being lots No. 421 and 428 as shown on the Assessors Maps of the Town of Medfield and containing approximately 22 acres.


Parcel 3. Lands of William Blackett off Pound Street shown on a plan of land drawn by McCarthy Engineering Service, Inc. dated August 2, 1956, and comprising lots No. 420 and a part of Lot No. 403 as shown on the Assessors Maps of the Town of Medfield and con- taining 7 acres, more or less.


and to see what Board or Committee the Town will authorize to con- sumate said transactions, and to see what instructions the Town will give such Board or Committee or do or act anything in relation thereto. (Land Acquisition Committee)


Article 21. To hear and act on the report of the School Committee appointed under Article 58 of the Annual Town Meeting of 1956 to study the most advisable location of the sidewalk on North Street referred to in Article 24 (namely; from Dale Street to the new school entrance).

To hear and act on the report of the Swimming Pool Committee appointed under Article 52 of the Annual Town Meeting of 1953 to make a survey of the feasibility of constructing a swimming pool on the town land on Green Street shown on the Assessor's Maps as Lot No. 120. Article 23. To see if the Town will vote to appoint a Swimming Pool Committee to make a study of the cost of a swimming pool on Lot No. 120 on Green Street, to report and make recommendations at a future town meeting and to transfer a sum of money from the Item "Bathing Beach" appropriated under Article 3 of the 1956 Annual Town Meeting or from available funds to accomplish such purpose or do or act anything in relation thereto. Article 24. To see if the Town will vote to transfer the lands here- inafter described from their present Zoning Classifications and to place the same under the Classification of "C" Residence Districts:


The land in Medfield, bounded and described as follows:


Beginning at the point where Nebo Street intersects Main Street, thence easterly along Main Street to the point where Main Street is intersected by Hartford Street, thence northerly along Hartford Street to the Medfield and Dover Town Line; thence southerly along the Medfield and Dover Town Line to the beginning of the Medfield and Walpole Town Line, thence southerly along the Medfield and Walpole Town Line to the point where it intersects Foundry Street; thence northerly along Nebo Street to the point of beginning; in each instance where streets are mentioned, the center line thereof to be the line of description,

Article 25. To see if the Town will vote to transfer from available funds in the Town Treasury and/or borrow a sum of money for the purpose of an installation of an extension of a water main in Adams Street from its present termination in a northwesterly direction an approximate distance of 570 feet, or do or act anything in relation thereto. Article 26. To see what sum the Town will vote to raise, appro- priate and/or transfer for the purpose of surfacing Causeway Street with asphalt from a point at or near the intersection of Claypit Road and Causeway Street for a distance of 1,800 feet more or less toward the Norfolk Line to a point 100 feet beyond the residence of Peter C. SPECIAL TOWN MEETING November 26, 1956


Pursuant to the foregoing warrant the meeting was called to order by the Moderator at 7:30 and due to the length of the warrant it was voted to dispense with the reading of the whole number of articles and to read and act on each one individually.


Article 1. Voted to amend the Town By-Law of 1926 as amended by the vote taken under Article 8 of the Special Town Meeting of April 4, 1955, by revoking the amendment thereby enacted and substi- tuting therefor the following addition to Article 1, After Section 3 so that the new section shall read as follows:
