To see what sum of money the Town will vote to raise and appropriate, borrow or transfer for the purpose of the purchase and installation of a six inch water main in Grove Street for a distance of nine hundred and sixty feet, beginning at Dale Street and running in a generally northwesterly direction under the provisions of the water assessments act, or do or act anything in relation thereto.

SPECIAL TOWN MEETING


April 13, 1959


Pursuant to the foregoing warrant the meeting was called to order by the Moderator at 7:30 P.M. and the following action was taken on the articles therein:


Article 1. Voted to authorize the Board of Assessors to appoint one of its members as Clerk of the Board.


Article 2. Voted to transfer the sum of $576.50 from the Road Machinery Fund to the Highway Operating Account to defray expenses of the operation and maintenance of Highway Machinery.


Article 3. Voted that this article be dismissed wherein acceptance of a part of Dale Street between Bridge and Frairy Streets as a public way was asked.


Article 4. Voted that this article be dismissed wherein a sum of $4,500. was sought for the installation of 960 feet of six inch pipe in Grove Street.


Article 5. Voted unanimously to raise and appropriate the sum of $33.60 to pay the International Salt Company for a bill incurred in 1958.


Article 6. Voted to raise and appropriate the sum of $1,200.00 as compensation to the School Custodians for traffic duty at school intersections.


Article 7. Voted that the sum of $1,521,000.00 be raised and appro- priated for the purpose of constructing, originally equipping and fur- nishing a new Junior-Senior High School on land presently owned by the Town of Medfield and lying between Philip, South and Pound Streets, and for the purchase of final plans and drawings for the same, and that to meet said appropriation the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $1,521,000.00 under the provisions and authority of Chapter 645 of the Acts of 1948, as amended, and to issue bonds or notes of the Town therefor payable in accordance with the provisions of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than twenty years from the date of issue of the first bond or note.

be appointed; that said School Building Committee be authorized, in the name of the Town of Medfield, to construct, furnish and originally equip a new Junior-Senior High School on land presently owned by the Town of Medfield and lying between Philip, South and Pound Streets; that they be authorized to enter into contracts for the same including the purchase of final plans and drawings therefor; to approve bills for payment in connection therewith; to determine the location of the building on said land; to accept the building when completed and to transact all manner of business with the Massachusetts School Build- ing Assistance Commission and any other appropriate governmental agency, and in general to do any and all things necessary in connection with the project.


NOTE-The approximately 475 voters present voted to give the School Building Committee a standing vote of applause in appreciation for their extensive work and very commendable job in preparing information and plans for the proposed new Junior-Senior High School voted here tonight.


Article 9. Voted that this article be dismissed wherein a sum of money was sought for the installation of a sewer system to serve the proposed new High School.


RESOLUTION:


Voted to raise and appropriate the sum of $3,000.00 for the purpose of making a sewerage survey in connection with the new High School.


Voted that the meeting be dissolved.

Article 1. To see if the Town will vote to accept as a gift from Natale Sostilio a piece of land located on the Easterly side of Adams Street and the Southerly side of West Street, said land to be used for highway purposes.


Article 2. To see if the Town will vote to abandon as a public way those portions of the Town Layout of 1755 of Winter Street on the North and South sides of said Winter Street as shown on "Plan of Relocation and Widening of Winter Street between North Street and Pine Street, Medfield, Mass." dated February 19, 1959.


Article 3. To see if the Town will vote to adopt the following By-Law:


"No driveway or other access to a public street shall be constructed or altered at the point of intersection with such street unless a written permit is first obtained from the Superintendent of Streets. No building permit shall be issued for construction of a new building or structure unless such access permit has first been obtained".


Article 4. To see if the Town will vote to transfer a sum of money from the Town Treasury for the purpose of paying certain charges incurred in relation to issuing recent School Bonds.


Article 5. To see if the Town will vote to transfer a sum of money from the Town Treasury for the purpose of meeting costs of interest on the Town Debt.


Article 6. To see if the Town will vote to amend the Zoning By-Law of the Town of Medfield, adopted April 21, 1938, as amended to July 1, 1958, by adding to Section II, "AA", "A", "C" residence district uses, Paragraph 8, the following, or do or act anything in relation thereto. (j) Home occupations, any occupation or activity carried on in a dwelling by one or more members of the immediate family dwell- ing therein, and not employing more than one person in addition to such family residing in the dwelling; provided that there shall be no display of goods, visible from the street and no advertising on the premises other than a small sign not to exceed one square foot in area, and carrying only the name and occupation of any occupant of the premises, such as a physician, artisan, beautician, lawyer, architect, engineer, clergyman, accountant, chiropractor, dentist, and similar occupations or professions; provided further that the buildings or premises occupied shall not be rendered objectionable or detrimental to the residential character of the neighborhood due to the exterior appearance, emission of odor, gas, smoke, dust, noise, electrical disturbance or in any other way; and provided further that such building shall include no feature of design not customary in buildings for residential use. Such uses as clinics, hospitals, barber shops, tea rooms, tourist homes, animal hospitals, kennels and others of a similar nature shall not be considered as home occupations.


Article 7. To see if the Town will vote to accept as a public way that part of Dale Street from Bridge Street to Frairy Street which extends in an easterly direction for a distance of approximately 2250 feet as established and relocated by the Selectmen and shown on a plan entitled "Plan of Dale Street between Bridge Street and Frairy Street" and on file with the Town Clerk's Office and to authorize the Selectmen to acquire by eminent domain or otherwise such rights, titles and easements as may be necessary to accomplish said purpose, or do or act anything in relation thereto.

Article 9. To see if the Town will vote to raise and appropriate, borrow or transfer a sum of money, in addition to the amount voted under Article 16 of the Special Town Meeting held September 8, 1958, for the purpose of installing pipes, pumping equipment and other neces- sary appurtenances; said expenditures to be under the direction of the special committee appointed under the above Article 16, or their suc- cessors; or do or act anything in relation thereto. Article 10. To see if the Town will vote to raise and appropriate or transfer from available funds in the Town Treasury the sum of

To see if the Town will vote to rescind the approval given under Article 4 of the Special Town Meeting of September 6, 1950, relative to Sewer Assessments, and approve the following Regula- tions of the Water and Sewerage Board, or do or act anything in rela- tion thereto. REGULATIONS RELATIVE TO SEWER ASSESSMENTS


1. The following regulations shall apply to all future extensions of the common sanitary sewer system at the expense of the Town, and to the entry of "particular" sewers into the common sewer sys- tem, except when a variance from these regulations to apply to a specific project is voted at any Town Meeting.


2. The owners of the land on both sides of the street benefited by any common sewer extension in a public wav shall be assessed a total of not more than 75% of the total cost thereof; no assessments shall be made for sewer lines not in a public way, but in a con- nection charge shall be made in accordance with Paragraph 6 below when applicable. Assessments shall be in accordance with the provisions of Section 14 to 24 inclusive of Chapter 83 of the General Laws.


3. Assessments shall be in accordance with the frontage of the land on the public way in which the sewer line is laid. There shall be a minimum assessment based on frontage equal to the minimum width of lot required under the Zoning By-Laws in the area concerned; and these minimum assessments shall act to de- crease the assessments on property with frontage greater than the minimum so that the total assessments shall not be greater than that corresponding to the total actual frontage.


4. There shall be no double or overlapping assessments; a corner lot which can be drained into a common sewer on one street shall

be exempted in assessing for the second street to the extent that all or a portion of the lot is not benefited. At the end of a common sewer extension, all lots which can be served shall be fully assessed, except that no assessment shall be made beyond a line 120 feet from the last manhole. Exemptions from assessment shall be made for property owned by the Town and for rights of way deeded and dedicated to public use. No land shall be assessed which by reason of its grade or other cause cannot be drained into the sewer. These exemptions shall not act to increase the assessments on property not exempted.


5. Assessments shall become liens on the lands benefited, which liens shall be filed in the Registry of Deeds. With respect to land not built upon, or not yet connected to the common sewer system, the time allowed for payment of the assessment together with interest at 4% per annum shall be extended to a date 3 months after the land is built upon or connected, but in no case for more than 10 years. For the purpose of these regulations "land not built upon" shall include any lot or area in one ownership which is suitable for building purposes under the Zoning By-Law, and which is set aside from any other land in the same ownership which is built upon by definite boundaries as shown on a plan or in a description filed with the Water and Sewerage Board within 60 days after the sewer line is available for service.


6. The total cost of laying and connecting an individual or "par- ticular" sewer to the common sewer system shall in every case be borne by the property owner. In addition, when property not abutting on a public way, or not previously assessed for any reason becomes connected to a common sewer line installed by the Town, a Connection Charge shall be made in lieu of an assessment. This Connection Charge shall be equal in amount to the minimum frontage assessment as determined under Paragraph 3 above for the most recent common sewer extension installed by the Town.


Article 14. To see if the Town will vote to raise and appropriate and/or transfer from available funds in the Town Treasury and/or transfer from unexpended balances an additional sum of money for the operation and maintenance of the Water Department for the year 1959, or do or act anything in relation thereto. Article 15. To see if the Town will vote to raise and appropriate and/or transfer from available funds in the Town Treasury a sum of money to install a traffic spotlight at the intersection of North and Main Streets for the purpose of lighting the circle where the police officer directs traffic, or do or act anything in relation thereto. Article 16. To see if the Town will vote to raise and appropriate and/or transfer from available funds in the Town Treasury the sum of $1,500.00 for General Relief or do or act anything in relation thereto. (Board of Public Welfare)

Article 21. To see if the Town will vote to accept as a public way that portion of Hillcrest Road between Station 6 plus 10 to 14 plus 59.57, a distance of about 850 feet, as laid out by the Board of Select- men and shown on a plan entitled "Layout of Hillcrest Road in Med- field, Mass., September 15, 1959", and on file with the Town Clerk's Office and to authorize the Selectmen to acquire by eminent domain or otherwise such rights, titles, and easements as may be necessary to accomplish said purpose, or do or act anything in relation thereto.


Article 22. To see if the Town will vote to authorize the Select- men to make the following adjustment in the salaries of the Building Inspector, Wiring Inspector, and Plumbing Inspector; each inspector to receive 25% of the receipts they collect in excess of their yearly salary, or do or act anything in relation thereto. To see if the Town will vote to appropriate or transfer from available funds in the Treasury the sum of six hundred and fifty ($650.00) dollars for the adjustment of salaries of the Building, Wiring, and Plumbing Inspectors, or do or act anything in relation thereto.
