SPECIAL TOWN MEETING
May 9, 1955
Pursuant to the foregoing warrant the meeting was called to order at 7:30 P.M. and after reading said warrant the follow- ing action was taken on the articles therein:
Article 1. Voted to appoint the Town Counsel and two additional members to be appointed by the Moderator to be added to the By-Law Committee appointed under Article 18 of the Annual Town Meeting of March 1952.
Article 2. Voted that the sum of $1,729.64 be appropriated for the purpose of replacing the engine in the Highway Sterling Truck and to meet said appropriation the sum of $1,051.42 be transferred from the unexpended balance of an appropriation voted under Article 14 of the Annual Town Meeting of 1954 and the sum of $351.68 be transferred from the unexpended balance voted under Article 2 of the Special Town Meeting of September 27, 1954 and the sum of $200.00 be transferred from the unexpended balance voted under Article 15 of the Annual Town Meeting of March 14, 1955 and the sum of $126.54 be transferred from the Road Machinery Account.
Article 3. Voted that the sum of $450.00 be transferred from Available Funds in the Town Treasury to be used in ad- dition to the amount appropriated under Article 14 of the Annual Town Meeting of 1955 for the purpose of widening and improving the approaches to the Main Street Railroad grade crossing between Spring Street and Park Street, said money to be used in conjunction with any additional money allotted by the State and County or both for this purpose.
Article 4. Voted unanimously to accept as a public way a strip of land off the easterly side of North Street abandoned by the County Relocation of September 21, 1948, and which extends in a northerly direction from a point opposite Dale Street for a distance of approximately two hundred and sixty- seven (267) feet as laid out by the Selectmen and as shown on a plan on file with the Town Clerk and to authorize the

Selectmen to acquire by purchase, eminent domain, or other- wise, such rights, titles, and easements on such land as is necessary to accomplish said purpose.
Article 5. Voted unanimously to appropriate the sum of $2,208.69 for the purpose of extending the six-inch water main in Winter Street from its present termination an additional distance of approximately 500 feet; and to meet said appro- priation, the sum of $458.65 be transferred from the unex- pended balance of the appropriation voted under Article 7 of the Special Town Meeting of September 27, 1954 (relating to the first water main on Winter Street), the sum of $750.04 be transferred from the unexpended balance of the appropriation voted under Article 8 of the Special Town Meeting of September 27, 1954 (relating to the last water extension on Adams Street), and for the balance the Town Treasurer with the approval of the Selectmen be authorized to borrow the sum of $1,000.00 under authority of Chapter 44, Section 8, of the General Laws, so that the whole loan shall be paid in not more than one year from the date of issue of the first bond or note.
Article 6. Voted to amend the Water Board regulation relating to the portion of cost paid by water takers from new water extensions as approved by vote of the Town under Article 35 of the Annual Town Meeting of 1952, by striking out the words "three percent" and substituting therefor the words "five percent".

In the name of the Commonwealth you are directed to notify and warn the inhabitants of the Town of Medfield, quali- fied to vote in elections and in town affairs, to meet at the High School Auditorium in said Medfield on Monday the 18th day of July A.D. 1955 at 7:30 P.M. then and there to act on the following articles:

Article 1. To see if the Town will vote to transfer a sum of money from the Road Machinery Fund to the Highway Operating Account to defray the expense of the operation and maintenance of Highway Machinery.
Article 2. To see if the Town will vote to transfer from Available Funds in the Town Treasury or from unexpended balances to the Highway Account, a sum of money to defray the costs of repairs to the Nebo Street Bridge, or do or act anything in relation thereto.
Article 3. To see if the Town will vote to accept as a public way, Cross Street, which extends in a southerly direc- tion from Philip Street to Elm Street for a distance of approx- imately 2160 feet as relocated by the Selectmen and as shown on a plan entitled "Plan of Land in Medfield, Massachusetts, Showing Relocation and Widening of Cross Street" on file in the Town Clerk's Office.
Article 4. To see if the Town will authorize the Selectmen to discontinue sending notice of Special Town Meetings, or do or act anything relation thereto.
Article 5. To see if the Town will vote to transfer a sum of money from Available Funds in the Town Treasury for the purpose of repairing the Town Clock, or do or act anything in relation thereto.
Article 6. To see if the Town will vote to amend the Zoning Map of the Town of Medfield as revised to December 10, 1953, as amended, by removing such portions of the after described property as now lies in "A" Residence District to Industrial District, so that all of said premises will lie in In- dustrial District and be subject to the uses permitted in "Sec- tion V Industrial District Uses" of the Zoning By-Law of the Town of Medfield.
A certain parcel of land 150 feet wide situated be- tween the Industrial area, West Street and West Mill Street and being on the northerly side of West Street and the westerly side of West Mill Street extending from the Millis Town Line easterly and northerly to land of Carl H. John- son and being shown as "A" Residence on the Medfield Zoning Map. (Park and Planning Board)
Article 7. To see if the Town will vote to amend the Building By-Law voted at the Special Town Meeting of July 11, 1951, by adding to Section 1, Article 3, subsection "b" which will read as follows:
("b") No building permit for a dwelling house or other inhabited building shall be issued until the Board of Health or its agent has approved the proposed lot as suitable from a sanitary point of view for human habitation. No building permit shall be issued for a dwelling house on an

unsewered street until a permit for a sewage disposal in- stallation has been first obtained from the Board of Health or its agent. (Board of Health)
Article 8. To see if the Town will vote to amend the Building By-Law voted at the Special Town Meeting of July 11, 1951, by adding to Section 3, Article 13, subsection "a" which shall read as follows:
(a) Fees for plumbing permits shall be fixed and determined from time to time by the Board of Selectmen. (Board of Selectmen)
Article 9. To see if the Town will vote to amend the Building By-Law voted at the Special Town Meeting of July 11, 1951, by adding to Section 3, Article 13, subsection "b" which shall read as follows:

(5) No building permit shall be issued for cellars and first floors which are to be constructed with the intention of using the cellar for living quarters unless the Board of Health shall have first approved the site, type and man- ner of proposed construction from a health viewpoint and proposed sanitary sewage disposal facilities. Article 11. To see if the Town will vote to appropriate a sum of money for the purpose of constructing and originally equipping and furnishing an addition to the Memorial School, and to determine whether the funds shall be provided for by an appropriation from available funds in the Town Treasury, and/or by borrowing under the authority of Chapter 645 of the Acts of 1948 as amended, or do or act anything in relation thereto. (School Building Committee)
Article 12. To see if the Town will vote to appoint a School Building Committee and authorize it to construct, fur- nish and equip an addition to the Memorial School; to enter into contracts for the same; to approve bills for payment in connection therewith; to accept the building when completed and to treat with the Massachusetts School Building Assist- ance Commission, or do or act anything in relation thereto. Article 13. To see if the Town will vote to take from avail- able funds in the Town Treasury, the sum of $350 to be ex- pended under the direction of the School Committee for the

purpose of constructing an 8-foot extension on the existing backstop on the baseball diamond at the rear of the High School, or do or act anything in relation thereto. (Sch. Comm.)
Article 14. To see if the Town will vote to raise and ap- propriate and/or borrow or transfer from available funds in the Town Treasury, the sum of $2500 for General Relief, or do or act anything in relation thereto. (Board of Public Wel- fare)
Article 15. To see if the Town will vote to transfer from available funds in the Town Treasury and/or borrow a sum of money for the purpose of the installation of an extension of a water main in Cross Street from its present termination in a northeasterly direction for an approximate distance of 1880 feet, or do or act anything in relation thereto. (Petition)
Article 16. To see what sum the Town will vote to raise and appropriate, transfer from available funds in the Treas- ury or borrow for the purchase and installation of an eight- inch water main in High Street for a distance of 1.65 miles southerly from the present terminus of the water main at South, Spring and High Streets, such purchase and installation to be at no special or particular charge or cost to the water takers, or do or act anything in relation thereto. And you are directed to serve this warrant by posting an attested copy thereof, in the usual place for posting warrants in said Medfield, seven days at least before the time of holding said meeting.

Article 1. Voted, that the sum of $900.00 be transferred from the Road Machinery Fund to the Highway Operating Account to defray expenses for the operation and maintenance of Highway Machinery.
Article 2. Voted, to appropriate the sum of $522.69 to the Highway Account to defray the costs of repairing the Nebo Street Bridge, and to meet said appropriation the sum of $392.00 be transferred from the unexpended balance of an amount appropriated under Article 18 of the Annual Town Meeting of 1955, and that the sum of $130.69 be transferred from the Reserve Fund.
Article 3. Voted, to accept as a Public Way, Cross Street, which extends in a southerly direction from Philip Street to Elm Street for a distance of approximately 2,160 feet as relocated by the Selectmen and as shown on a plan entitled "Plan of Land in Medfield, Massachusetts, Showing Relocation and Widening of Cross Street" by Henry A. Kingsbury, on file in the Town Clerk's Office.
Article 4. Voted, to dismiss this article wherein it was requested that the Town authorize the Selectmen to discontinue notice of Special Town Meetings.
Article 5. Voted, to dismiss this article where it was requested that a sum of money be appropriated for the re- pairing of the Town Clock.
Article 6. Article 11. Voted unanimously that the sum of $426,000.00 be raised and appropriated for the purpose of constructing and originally equipping and furnishing an addition to the Memo- rial School, and that to meet said appropriation, the Treasurer, with the approval of the Selectmen, be and hereby is author- ized to borrow the sum of $426,000.00 under the provisions and authority of Chapter 645 of the Acts of 1948, as amended, and to issue bonds or notes of the Town therefor payable in ac- cordance with the provisions of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than twenty years from the date of issue of the first bond or note.
(a) A report giving proper plans, specifications and estimates of the probable expense of the work therein re- ferred to were submitted to the meeting prior to the taking of this vote.
Article 12. Voted unanimously that a School Building Com- mittee consisting of Henry R. DeForest, Arnold C. Fields, Win- throp B. Johnson, John W. Kellar, Jr., and Henry A. Kingsbury, be and it hereby is appointed; that said School Building Com- mittee is hereby, in the name and behalf of the Town of Medfield, authorized to determine the location of and to construct, furnish and originally equip an addition to the Memorial School; to enter into contracts for the same; to approve bills for payment in connection therewith; to accept the building when completed and to transact all manner of business with the Massachusetts School Building Assistance Commission, and in general to do any and all things necessary in connection with the project.
Article 13. Voted that the sum of $350.00 be transferred from the Reserve Fund to be expended under the direction of the School Committee for the purpose of constructing an 8 foot extension on the existing backstop on the baseball diamond at the rear of the High School.

To see if the Town will vote to rescind the action taken under Article 52 of the Annual Town Meeting of 1952 wherein the School Committee was increased to six members and substitute therefor a School Committee of five members; two to be elected in 1956, two to be elected in 1957, and one to be elected in 1958, all for terms of three years as the terms of the present members of the School Committee expire, and there- after to elect for three years as the several terms expire, the change to take effect at the Annual Election of Town Officers in 1956, or do or act anything in relation thereto. Article 8. To see if the Town will appoint a committee to investigate the possibility of acquiring for school purposes cer- tain parcels of land adjoining the grounds of the Memorial School and bounded on the west by Adams Street and on the north by West Street, said committee to report with recom- mendations at the Annual Town Meeting in March of 1956. (School Committee).
Article 9. To see if the Town will vote to raise and appro- priate and/or transfer from Available Funds and/or borrow a sum of money for the purpose of the installation of an exten- sion of an eight-inch water main and appurtenances in Cause- way Street from its present termination at Main Street in a southwesterly direction for an approximate distance of 650 feet or do or act anything in relation thereto. (Petition).

Gugliotta, Police Officer, for legal fees and expenses incurred by him as a result of his suspension from the Police Department on Octo- ber 2, 1954, or do or act anything in relation thereto. To see if the Town will vote to transfer from Available Funds in the Town Treasury and/or from unexpended balances a sum of money for the purpose of moving the Memo- rial Plaque to the outside wall of the Memorial School and to authorize and instruct the School Committee to accomplish said movement, or do or act anything in relation thereto. Article 12. To see if the Town will vote, in the event that the present tenant does not renew his lease of the Town Hall as a Movie Theatre, to use the second floor of the Town Hall as a youth recreational activities center to be under the super- vision of the Medfield Post No. 6644, V.F.W. and to raise and appropriate from time to time such sums of money as may be necessary to equip and maintain said youth center, or do or act anything in relation thereto.
