ARLINGTON TOWN REPORT


Mr. Homer presented the following report of the Com- mittee to Study Article 8 of the Town By-Laws relating to Membership of the Finance Committee.


(Under Article 4, this subject is included in the War- rant for the Special Town Meeting at 8:30 P. M. this date, March 13, 1940.)


The Town Meeting of March 29, 1939 passed the fol- lowing vote:


Voted: That a Committee of seven, at least two of which shall have been past members of the Finance Com- mittee within the last fifteen years, be appointed by the Moderator to study Article 8 of the Town's By-Laws with particular reference to the membership of the Finance Committee, the qualifications of membership and the meth- od of appointing said members. This Committee to report a draft of any proposed changes at the next annual Town Meeting or at a Special Town Meeting called for the pur- pose. And that twenty-five dollars ($25.) be and hereby is appropriated for the use of said Committee, said sum to be raised by general tax.


The following persons were appointed by the Moder- ator to serve as the Committee :

The first meeting of the Committee was held on Sep- tember 20, 1939 and Mr. Roger Homer was chosen Chair- man and Mr. Herbert A. Snow, Secretary. It was decided

to hold three hearings for the purpose of securing inform- ation from citizens and officials regarding the subject for which the Committee was appointed.


These hearings were held as follows:


Public Hearing at Town Hall, following advertisement and statement in two Arlington newspapers, on October 19, 1939, attended by six citizens.


Hearing for Town Officials, following individual notice to all elected Town Officials, on October 24, 1939, attended by five officials.


Hearing for present and former Finance Committee members, following individual notice to 72 persons, on November 14, 1939 attended by thirty-one.


Following these hearings, the Committee held three meetings, on December 12, 1939, January 11, 1940 and February 2, 1940, at which times, all of the suggestions which had been received were thoroughly discussed and were made the basis of changes in the present By-Laws as proposed in Article 4 of the Warrant for the Special Town Meeting to be held on March 13, 1940.


The Committee made a careful study of the present Massachusetts State Laws governing the selection and functions of such an advisory committee known in Arling- ton as the Finance Committee and its limitations as there- in set forth.


After carefully considering all the criticisms and sug- gestions made to us at the various hearings and spent several meetings in discussing these proposed changes, this Committee has by unanimous vote inserted this Article in

the Warrant for the Special Town Meeting and hereby sub- mits this unanimous report.

In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the legal voters of the Town of Arlington, to meet in the


TOWN HALL in said Town on


WEDNESDAY, THE 13th DAY OF MARCH, 1940


at 8:30 o'clock, P. M., at which time and place the following Articles are to be acted upon and determined exclusively by Town Meeting Members, in accordance with, and subject to, the referenda provided for by Chapter 43A of the General Laws.


Article 1. To hear and act upon the reports of the Finance and other Committees heretofore appointed.

Article 2. To see if the Town will make an appropria- tion or appropriations for the payment to the County of Middlesex of amounts assessed upon or otherwise payable by the Town for: (a) the Town's share of the principal of the bonds issued under the provisions of Chapter 10 of the Acts of 1932 for the Middlesex County Tuberculosis Hos- pital Funding Loan, Acts of 1932, maturing in the current year; (b) any other indebtedness incurred and outstanding under said Chapter 10; (c) the Town's share of the interest and other charges on said bonds and any temporary fund- ing notes issued by the County, due in the current year ; (d) the care, maintenance and repair of said hospital dur- ing the last preceding calendar year, including interest on temporary notes issued therefor in accordance with sections of Chapter 111 of the General Laws applicable thereto; (e) any and all other expenses in connection with said hospital or said loan including expenses under Section 25G (6) (a) of Chapter 32 of the General Laws inserted by Chapter 400 of the Acts of 1936; determine in what manner the money shall be raised and expended ; or will take any action in any way relating to said hospital, loan or any other thing here- in mentioned.


Article 3. To see if the Town will make an appropria- tion or appropriations for Work Projects Administration projects and for the employment of the poor; determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 4. To see if the Town will amend Article 8 of its By-laws, relative to the Finance Committee, by striking out Sections 1, 2, 3, 4 and 8 of said Article and inserting in place thereof the following Sections numbered 1, 2, 3, 4 and 9 and by inserting a new Section numbered 8, all as follows :


Section 1. The Advisory Committee, to be called the Finance Committee, shall be composed of fifteen registered voters of the Town, one from each of the fourteen precincts and one from the Town at large, and, except as hereinafter provided, shall be appointed.

by an Appointing Committee of three members, com- posed of the Moderator, the Chairman of the Finance Committee and the Chairman of the Sinking Fund Commissioners, within twenty days after the final ad- journment of the Annual Town Meeting.


Section 2. The first Committee appointed under this By-law shall be appointed promptly by the Ap- pointing Committee within twenty days after this By- law shall take effect. Of such committee the member from each of the precincts numbered one, four, seven, ten and thirteen shall be appointed for a term of three years; the member from each of the precincts num- bered two, five, eight, eleven and fourteen shall be ap- pointed for a term of two years; and the member from each of the precincts numbered three, six, nine and twelve and the member at large shall be appointed for a term of one year. In any year when the term of any member expires, his successor shall be so appointed for a term of three years. The said terms shall expire on the seventh day after the final adjournment of the An- nual Town Meeting but the members shall respectively continue to act as such until their successors are ap- pointed. All the present members of the Finance Com- mittee shall continue to act as such until the said first Committee of fifteen is appointed as herein provided.


Section 3. If any member of the Finance Com- mittee is absent from three or more successive meet- ings, the other members of the Committee may by the affirmative vote of each of a majority of its members request the Appointing Committee to remove such ab- senting member from his membership and the Appoint- ing Committee may thereafter by a majority vote so remove such member and may notify him by mail of such removal. The Appointing Committee shall then promptly fill the vacancy so created by appointing a successor for the remainder of the term for which such member was appointed.

Section 4. No person holding either elective or appointive Town office other than Town Meeting mem- bership and no Town or other public employee shall be eligible to serve on said Committee.


Section 8. The Finance Committee shall annually appoint a person who is not one of its members as Ex- ecutive Secretary for the term of one year. The said Committee shall define his duties and fix his salary. The position of Clerk of the Finance Committee shall cease upon the appointment of the new Finance Com- mittee of fifteen.


Section 9. Except as herein otherwise provided, the Committee shall have power to elect its own officers. All vacancies in the membership of said Committee shall be filled by the Appointing Committee.


And you will notify and warn the voters of the Town of Arlington to meet at the time and place herein specified by leaving at every dwelling house in the Town a printed copy of this Warrant, and also by posting a copy of the same at the doors of the Town Hall, and in a conspicuous place in each of the fourteen precincts of the Town, seven days at least prior to the time of said meeting.


Hereof, fail not, and make due return of this Warrant, with your doings thereon, to the Town Clerk, on or before said day and hour of meeting.

By virtue of the Warrant I have notified and warned the legal voters of the Town of Arlington to meet at the time and place and for the purpose herein specified by caus- ing a printed attested copy of said Warrant to be left at every dwelling house in the Town previous to the day of meeting and by posting an attested copy of said Warrant at the doors of the Town Hall and in two or more conspicu- ous places in each of the fourteen precincts of the Town, seven days at least before the day of said meeting. A notice of the time, place and object of the meeting was published in the local papers.

SPECIAL MEETING


Arlington, Mass., March 13, 1940.


Pursuant to the Warrant of the Selectmen served ac- cording to law upon the inhabitants of the Town of Arling- ton, by a constable of said Town and sent by mail by the Town Clerk seven days before the day of meeting to the Town Meeting Members duly elected and qualified to act in Town Meetings in Arlington, and advertised in two local papers, the Town Meeting Members met in the Robbins Memorial Town Hall in said Town on Wednesday, March 13, 1940, at 8:30 o'clock in the evening.

Lists of the duly qualified Town Meeting Members were used at the entrances of the meeting place and were in charge of Philip T. Robinson and James E. Sweeney.


The check lists filed with the Town Clerk at the close of the meeting showed that 208 members attended the meet- ing.


The Moderator called the meeting to order at 8:30 P.M


Town Meeting Members not previously sworn were sworn by the Moderator.

Voted: That the sum of ten thousand ($10,000) dollars be and hereby is appropriated to pay the Town's share of the principal of the Middlesex County Tuberculosis Hospital Funding Loan, Acts of 1932 bonds maturing in 1940; that the further sum of ten hundred sixty -- two and 50/100 ($1062.50) dollars be and hereby is appropriated on account of interest and other charges on account thereof; that the further sum of sixteen thousand nine hundred forty-eight and 46/100 ($16,948.46) dollars be and hereby is appro- priated for the Town's share of the net cost of care, mainte- nance, and repairs of the Middlesex County Hospital, in- cluding interest on temporary notes issued therefor, in ac- cordance with sections of Chapter 111 of the General Laws applicable thereto, and expenses under Section 25 G (6) (a) of Chapter 32 of the General Laws inserted by Chapter 400 of the Acts of 1936; and that said sums totaling Twen- ty eight thousand ten and 96/100 ( ($28,010.96) dollars be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 2 the Moderator declared it disposed of.

On motion, duly made and seconded, it was unanimous- ly


Voted: That the sum of one hundred fifty four thou- sand one hundred six ($154,106) dollars be and hereby is appropriated to defray the necessary engineering, trucking and other expenses and to purchase tools, equipment and materials, for Works Progress Administration projects ; and for useful projects to provide employment for the poor ; said sum to be raised by general tax and expended under the direction of the Board of Selectmen as follows :

The Finance Committee recommended that no action be taken on this Article.
