Article 44. To see if the Town will appropriate the sum of two thousand sixty-one dollars and eighteen cents ($2,061.18), or any other sum, for the payment of Vocation- al School Tuition expenses incurred prior to January 1, 1940 ; determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 45. To see if the Town will accept section 13C of chapter 147 of the General Laws as inserted by chapter 419 of the Acts of 1939, which provides that in any town which has a reserve police force under authority of special law, and accepts this section, no person shall after the date of acceptance of this section, be appointed to the reserve police force thereof unless appointments to such force are subject to chapter thirty-one (entitled "Civil Service") and the name of such person shall have been placed, on or be- fore said date, on an eligible list established under chapter thirty-one and the rules made thereunder for such appoint- ments; or will take any action relative thereto.


Article 46. To see if the Town will make an appro- priation for a survey and appraisal of buildings and other property of the Town for insurance or other purpose; de- termine in what manner the money shall be raised and ex- pended; or take any action relative to such survey or ap- praisal.

of the rights and easements of the Town in the parcel of land hereinafter described, including among others the rights and easements of constructing and operating a sys- tem or systems of sewers and sewage disposal and of lay- ing, making and maintaining common sewers and main drains and sewers, described in an order of taking by the Board of Public Works dated December 26, 1939 and re- corded with Middlesex So. Dist. Deeds on December 27, 1939, book 6356 page 461; will make an appropriation for the purpose; determine in what manner the money shall be raised and expended; or will take any action relating to said parcel of land, to any rights and easements therein, to any and all sewers, drains, pipes and appurtenances therein or to anything hereinbefore mentioned.


Said parcel of land is shown upon a plan marked "Plan of Land in Arlington, Mass. Taken for Sewer Purposes. Scale 1" = 40', Dec. 14, 1939. James M. Keane, Town En- gineer", recorded with said order of taking, and is bounded and described as follows:


Beginning at a point on the easterly line of the Metro- politan Sewer Taking 7.5 feet from and at right angles to Metropolitan Manhole at station 32+33.03, and running southeasterly 93.52 feet to a point, thence turning and run- ning in a more southeasterly direction 45.99 feet to a point on the easterly line of the Metropolitan Sewer Taking, thence northwesterly along said Metropolitan Sewer Taking line 137.06 feet to the point of beginning. Containing 834 sq. ft. area.


Article 48. To see if the Town will vote to alter its Zoning By-Law and Map therein referred to so as to change from a General Residence District to a Single Residence District the area bounded and described as follows :


Beginning at a point on the center line of Tufts Street at the division line between the business district and the present general residence district, said point being 100 feet southwesterly of the southwesterly side line of Broadway,

Article 50. To see if the Town will vote to alter its Zoning By-Law and Map therein referred to so as to in- clude in a Business District all of the area now included in a Single Residence District bounded and described as fol- lows :


Beginning at a point on the center line of Mass. Avenue at the present division line between the Business District and the Single Residence District, thence southwesterly on said division line between the Business District and the Sin- gle Residence District to a point on said division line be- tween the Business District and the Single Residence Dis- trict, thence westerly through private lands known as lot B on a line 100 feet south of and concentric with the southerly side line of Mass. Avenue to a point on the east- erly division line of lot D extended southerly, thence north- erly through said lot B, and on said easterly division line of lot D extended southerly to the southerly division line of D, thence westerly on the division line between lot D and lots B and A-2 to the westerly division line of lot D, thence northerly on said westerly division line of lot D, (as shown on a plan by C. Article 52. To see if the Town will make an appropria- tion of the sum of twenty-five hundred dollars ($2500) or any other sum, to be used for the proper reception of the National Convention of the American Legion to be held in Boston and vicinity, September 23rd, 24th, 25th and 26th, 1940. The same to be expended under direction of Arling- ton Post, No. 39, The American Legion ; or take any action relating thereto.

Article 53. To see if the Town will appropriate the sum of one hundred dollars ($100.00) to be expended under the direction of the Board of Park Commissioners for the purpose of erecting suitable benches on the town property bordering Massachusetts Avenue and Broadway ; determine in what manner the money shall be raised; or take any action relating thereto.

Article 54. To see if the Town will pass an act making it mandatory for all departments to purchase only American made tools and materials excepting when said tools and materials do not compete with American Labor.

To see if the Town will appropriate the sum of four hundred dollars ($400.00) to be expended un- der the direction of the Board of Selectmen, for the pur- pose of providing suitable headquarters for Arlington Post 1775, Veterans of Foreign Wars of the United States, in accordance with Chapter 40, Section 9, under the General Laws of Massachusetts, said sum to be raised by general tax.

Article 56. To see if the Town will construct a build- ing or buildings to be used for the purposes of the Board of Public Works and any other Town boards, officers, or committees, for use as a Reclamation plant or for the dis- posal of rubbish and waste materials or for any municipal purpose or purposes, upon land of the Town known as the

Town Yard at Hobbs Court or upon any other land; will alter or add to the present building or buildings on said land; make an appropriation or appropriations for such construction, including the cost of original equipment and furnishings, and for such alterations and additions; deter- mine in what manner the money shall be raised and ex- pended; or take any action relating to all or any of the foregoing.

Article 58. To see if the Town will acquire by pur- chase, eminent domain or otherwise, for the extension of Mt. Pleasant Cemetery or for any other lawful purpose, all or any portion or portions of the land within the Town hereinafter described, any interests or easements therein, and any rights or easements of way or otherwise as ap- purtenant thereto, and subject to or with any reservations of any rights or easements therein; provide for such ac- quisition by transfer from (Mt. Pleasant Cemetery) Sale of Lots and Graves Fund or otherwise; determine in what manner any appropriation of money shall be raised and ex- pended; or take any action relating to all or any of the foregoing. To see if the Town will amend section 19 (relative to "appeals") of its Zoning By-law (a) by strik- ing out the words "to the Selectmen or to the Board of Ap- peals, if any" where they first appear in paragraph "A" of said section and substituting therefor the words "to the Board of Appeals under the Town's building by-laws, being Article 15 of the Town's by-laws known as the Building Code", and (b) by striking out the words "the Selectmen, or such Board of Appeals," wherever they afterwards ap- pear in said section 19 and substituting therefor the words "said Board of Appeals".

By virtue of this warrant I have notified and warned the legal voters of the Town of Arlington to meet at the times and places and for the purposes herein specified by causing a printed attested copy of said warrant to be left at every dwelling house in the Town previous to the day of the meeting for the election of officers and by posting an attested copy of said warrant at the doors of the Town Hall and in two or more conspicuous places in each of the fourteen precincts of the Town, seven days at least before the day of said meeting. A notice of the times, places and objects of the meetings was published in the local papers.

Arlington, Mass., March 4, 1940.


In pursuance of the foregoing Warrant the legal voters of the Town of Arlington met in their respective voting places in said Town on Monday the fourth day of March, in the year of our Lord one thousand nine hundred and forty at seven o'clock in the forenoon.


The following places were designated as the voting places for the various precincts.


Precinct One, in the Crosby School Building, entrance on Winter Street; Precincts Two and Four, in the Hardy School Building, entrance on Lake Street; Precincts Three and Five, in the Junior High School Building East, entrance on Tufts Street; Precincts Six and Eight, in the Town Hall; Precincts Seven and Nine, in the Russell School Building; Precinct Seven, entrance on Medford Street; Precinct Nine, entrance on Mystic Street; Precincts Ten and Twelve, in the Cutter School Building, entrance on Robbins Road ; Precinct Eleven, in the Highland Hose House, entrance on Massachusetts Avenue; Precinct Thirteen, in the Peirce School Building, entrance on Park Avenue North, Heights ; Precinct Fourteen, in the Locke School Building, entrance on Park Avenue, Heights.


The following election officers, having been duly ap- pointed by the Selectmen, and sworn to the faithful per- formance of their duties, were assigned for duty at the various precincts as follows :
