Greeting :


In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the legal voters of the Town of Arlington, to meet in the

in said Town on


MONDAY THE 14th DAY OF OCTOBER 1940


at 8 o'clock, P. M., at which time and place the following Articles are to be acted upon and determined exclusively by Town Meeting Members, in accordance with, and subject to, the referenda provided for by Chapter 43A of the General Laws.


Article 1. To hear and act upon the reports of the Finance and other Committees heretofore appointed.


Article 2. To see if the Town will make an additional

appropriation or appropriations for public welfare includ- ing Aid, Aid to Dependent Children and Old Age Assist- ance ; provide for all or any of these appropriations by bor- rowing under authority of and in accordance with the pro- visions of Chapter 49 of the Acts of 1933 as most recently amended by Chapter 288 of the Acts of 1939, or the pro- visions of Chapter 72 of the Acts of 1939 as amended by Chapter 453 of the Acts of 1939, or by transfer or other- wise, or take any action relative to all or any of the fore- going.


Article 3. To see if the Town will vote that any un- expended balance of the appropriation of one hundred fifty- four thousand one hundred and six ($154,106.00) dollars made by vote of the Town Meeting on March 13, 1940 under Article 3 of the Warrant for the Special Town Meet- ing held on that date, (said vote being as follows: "Voted : That the sum of one hundred fifty-four thousand one hun- dred six ($154,106.00) dollars be and hereby is appro- priated to defray the necessary engineering, trucking and other expenses and to purchase tools, equipment and ma- terials, for Works Progress Administration projects; and for useful projects to provide employment for the poor ; said sum to be raised by general tax and expended under the direction of the Board of Selectmen as follows : Works Progress Administration

Article 4. To see if the Town will vote to alter its Zoning By-Law and Map therein referred to so as to change from a Single Residence District to a Business District all of the area bounded and described as follows :


Southwesterly by land now or formerly of Fred Gor- don Ellis and William Howard Porter, by the end of Gay Street (a private way), and by the Turkey Hill Reserva- tion so-called, being land of the Town of Arlington, two hundred eighty (280) feet;


Northwesterly by said land of the Town of Arlington four hundred eighty (480) feet;


Northeasterly by land now or formerly of John H. Irwin and William H. Irwin five hundred seventy-two (572) feet more or less; and


Southeasterly by land now or formerly of Bridget O'Laughlin, by the northerly end of Washington Street (a private way), by land now or formerly or M. Grace Knowles, by land now or formerly of Reginald C. and Helen L. Wy- man, by other land now or formerly of M. Grace Knowles, and by land now or formerly of Eleanor E. Jones four hun- dred eighty (480) feet; all as said area is shown on a plan entitled "Plan of Land in Arlington, Mass." dated Septem- ber, 1940, compiled by William S. Crocker, Civil Engineer, successor to Aspinwall & Lincoln, a copy of which is on file in the office of the Board of Selectmen.

Article 5. To see if the Town will amend Section 5 (relative to "Business Districts") of its Zoning By-Law by adding to the enumeration of businesses contained in para-

graph 8 of said Section 5 the words, "Radio broadcast transmitter station" by inserting said words between the word "Publisher" and the word "Roofer."

Article 6. To see if the Town will make an appropria- tion to be expended by the Board of Public Works for the Maintenance of Highways and Bridges, determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 7. To see if the Town will make an appropria- tion to be expended by the Board of Public Works for the purpose of collecting ashes, rubbish and offal, determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 8. To see if the Town will make an appro- priation to be expended by the Board of Public Works for the purpose of maintaining its water system, determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 9. To see if the Town will make an appropria- tion to be expended by the Board of Public Works for the removal of snow and ice, determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 10. To see if the Town will make an appro- priation to be expended by the Board of Public Works for the erection or construction of a fence enclosing any or all of the Town Yard property situated on Massachusetts Avenue and Hobbs Court, determine in what manner the money shall be raised and expended; or take any action re- lating thereto.

To see if the Town will make an appro- . priation to be expended by the Board of Public Works for the purpose of Purchasing Two 50-Kilowatt Generators to- gether with the necessary Generator Panel and Equip- ment, determine in what manner the money shall be raised and expended; or take any action relating thereto.

Article 12. To see if the Town will make an appropria- tion to be expended under the direction of the Board of Se- lectmen for the purpose of purchasing two (2) Trailer-type Pumping Units ; determine in what manner the money shall be raised and expended ; or take any action relating thereto.

And you will notify and warn the voters of the Town of Arlington to meet at the time and place herein specified by leaving at every dwelling house in the Town a printed copy of this Warrant, and also by posting a copy of the same at the doors of the Town Hall, and in a conspicuous place in each of the fourteen precincts of the Town, seven days at least prior to the time of said meeting.


Hereof, fail not, and make due return of this Warrant, with your doings thereon, to the Town Clerk, on or before said day and hour of meeting.

Middlesex, ss:


By virtue of this Warrant I have notified and warned the legal voters of the Town of Arlington to meet at the time and place and for the purpose herein named by caus- ing a printed attested copy of the same to be left at every dwelling house in the Town, and by posting an attested copy at the doors of the Town Hall seven days at least before said day of meeting and by posting attested copies in two or more conspicuous places in each voting precinct in the Town. A notice of the time, place and object of the meeting was published in the local papers.

SPECIAL TOWN MEETING


Arlington, Mass., October 14, 1940.


Pursuant to the warrant of the Selectmen served ac- cording to law upon the inhabitants of the Town of Arling- ton, by a constable of the said Town and notices sent by mail by the Town Clerk seven days before the day of meet- ing to the Town Meeting Members duly elected and quali- fied to act in Town Meetings in Arlington, the Town Meet- ing Members met at the Robbins Memorial Town Hall in said Town on Monday, October 14, 1940 at 8:00 in the evening.


Lists of the duly qualified Town Meeting Members were used at the entrances to the meeting place and were in charge of Philip T. Robinson and James E. Sweeney.

The check lists filed with the Town Clerk at the close of the meeting showed that one hundred and thirty-two attended the meeting.


The Moderator called the meeting to order at 8:15 P.M.


The Moderator administered the oath to Town Meeting Members who had not been previously sworn.


Mr. Estabrook requested that the Secretary of the Board of Selectmen, Mr. Golden; Mr. Smith and Mr. Marsh of the Board of Public Works; and the Town Counsel Mr. White; be permitted to sit with him and it was granted.


The Town Clerk read the Call and the Constable's Re- turn of the Warrant; the reading of the remainder of the Warrant was waived by consent of the meeting.


On motion of Mr. Estabrook, duly seconded, it was unanimously


Voted: That if all the business of the meeting as set forth in the warrant is not disposed of at this session when the meeting adjourns it adjourn to Friday evening October 18, 1940 at 8:00 o'clock.

Voted: That Article 1 be taken up (Reports of Com- mittees).


On motion of Mr. Cousins, duly seconded, it was unani- mously


Voted: That the report of the Finance Committee as presented in printed form be now received.

Voted: That the remaining articles in the warrant be now taken up separately in the order in which they appear in said warrant and that the recommendations of the Fi- nance Committee under said articles as presented in their printed report be considered as now before the meeting to be voted upon without further motion, separately, under the respective articles as they appear in said report.


Article 2 taken up (Public Welfare, Aid to Dependent Children and Old Age Assistance).

Voted: That the amounts hereinafter stated be and hereby are appropriated for the following purposes :


(a) Public Welfare including aid. $18,000.00


(b) Aid to Dependent Children. 7,000.00


(c) Old Age Assistance 10,000.00


and that to meet said appropriations the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of thirty-five thousand ($35,000) dollars, and to issue a note or notes therefore, all under the provi- sions of Chapter 49 of the Acts of 1933 as most recently amended by Chapter 288 of the Acts of 1939; and that all said appropriations be expended under the direction of the Board of Selectmen.


There being no further business under Article 2 the Moderator declared it disposed of.

Voted: That any unexpended balance of the appropria- tion of one hundred fifty-four thousand one hundred six ($154,106) dollars made by vote of the town meeting under Article 3 of the Warrant for the special town meeting on March 13, 1940, be expended under the direction of the Board of Selectmen to defray the necessary engineering, trucking and other expenses and to purchase tools, equip- ment and materials for Works Progress Administration pro- jects and for useful projects to provide employment for the poor, or for any such project.


There being no further business under Article 3 the Moderator declared it disposed of.

Mr. Knight presented the report of the Planning Board, and on motion duly made and seconded, it was voted that it be received.

Voted: That the Town does not amend its Zoning By- Law by altering the Zoning Map therein referred to, so as to include in the Business District that area described in Article #4 of the Warrant for Special Town Meeting, Mon- day, October 14, 1940.

Mr. Wallace moved reconsideration, which was put to a vote and carried :


That the sum of thirty-six hundred ($3,600.00) dollars be and hereby is appropriated for the collection and dis- posal of ashes, offal and rubbish; that for this purpose the said sum of thirty-six hundred ($3,600.00) dollars be and hereby is transferred from the unexpended balances of the following appropriations now in the treasury and expended under the direction of the Board of Public Works:
