REPORT OF THE BOARD OF SELECTMEN 1636 - 1961


To the Citizens of Scituate:


Our 325th Anniversary Year was not only a year of cele- bration and pageantry, but a year of progress and growth. For the first time in the history of our Town, five people assumed the role of an elected Board of Selectmen and have given much to the development of Scituate.

SELECTMEN'S REPORT


1961 clearly defined our needs for foreshore protection. Our storm of mid-October reaffirmed the dedicated task of seeking funds for this endless problem. Town Officials find themselves somewhat discouraged when they find so many pro- jects still not activated by the Division of Waterways. It is an additional burden to carry when we realize emergency requests of $38,000 plus a possible new wall construction in Minot and Humarock costing many thousands of dollars must be valued.


The time and effort spent by your Board of Selectmen on matters pertaining to dogs has necessitated a forceful and di- rected program of dog control for the immediate future, and a hope that the degree of severity of this problem will lessen.


It is obvious that the boating enthusiasts have created needs far beyond our expectations. Neeeds of ramps, proper policing of our Harbor, supervision of parking areas surround- ing these facilities are matters for immediate and future dis- cussion.


It is the duty of your Board of Selectmen not only to scruti- nize expenditures, and to seek means of savings, but also to see that proper Government services are maintained and avenues of additional revenues are explored. Your Board of Selectmen have cooperated fully with the vote of the Town and the Ac- cepted Evans Report by preparing for the various changes necessary to the proper operation of the recently installed Ac- counting machine. The future success of this new machine is dependent on cooperative effort in its use, and proper planning in the system employed in its operation.


With a goal aimed at fulfilling the Town's wish of efficiency and economy, we have submitted to the Legislature an Article seeking the creation of an office of Comptroller. This phase should represent the most important step which has been un- dertaken thus far.


To express appreciation to all who have cooperated with your Board during the year, would be endless. Let it be suffi- cient to say that if we have made a better Scituate in which to work and play, - if we have helped to make this a happier com-

munity in which to live and raise our families, - if we have given ourselves justification for the phrase - "A JOB WELL DONE" - we will have served our Town well.

REPORT OF THE TOWN CLERK


SPECIAL TOWN MEETING January 16, 1961


A legal meeting of the inhabitants of the Town of Scituate qualified to vote in Elections and Town Affairs was held at the High School Gymnasium in said Scituate on Monday, the six- teenth day of January, 1961, at 7:30 o'clock P.M. The meeting was called to order by Moderator John Barnard, Jr.


The warrant was read by Town Clerk William M. Wade.


The check list was used. Checkers were: Grace B. McPher- son, Amy C. Bates, Osborne A. McMorrow, Jr., Helen G. McDon- ald, Elden M. Meyers, Jessie M. Story, Elizabeth Y. Robbins, Daniel J. Queeney, Marjorie A. Gately, Priscilla Schott and Alice S. Torrey.


Tellers appointed by the Moderator and sworn by the Town Clerk were: J. Arthur Montgomery, John H. McPherson, Don- ald Prouty, W. Sturgis Evans, Edward P. Horne, Wendell W. Whittaker, Stanley F. Murphy, Ralph W. Sides, Donald H. Whittemore and Louis H. MacDonald.


ARTICLE I


Will the Town vote to amend its Zoning By-Laws:


1. by changing the designation of present section 3-2b to 3-2c, and adding a new section 3-2b as follows :


“b Permitted Uses in Zone "A-4"


In an "A-4" zone the following uses are permitted as of right:


(1) All uses permitted as of right in zones "A-1", "A-2", and "A-3", subject to the same conditions as therein specified.

(2) Marina and incidental facilities and buildings ; shops and facilities for the sale of marine hardware and equipment, gasoline, oil and engine parts for marine use only.


(3) Motel or restaurant. Motels shall not be more than two stories in height, and the individual units thereof shall not be equipped with facilities for the prepar- ation or cooking of food, except that a motel may con- tain one housekeeping unit consisting of not more than two rooms plus a bathroom and a kitchenette- dining area for every ten other units in the same motel. For the purpose of the preceding sentence, all units operated by the same person or corporation on a contiguous property in common ownership shall constitute one motel, regardless of the number of buildings which the units occupy.


Whenever an area in zone "A-1", "A-2", "A-3", "B" or "C" is changed to zone "A-4", the lot area and width, side yard, rear yard, set-back and street frontage requirements for uses other than those listed in paragraphs (2) and (3) above shall con- tinue in force in said area as they were before such change. The side yard, rear yard, set-back and street frontage re- quirements for the uses described in paragraphs (2) and (3) above shall be the same as apply to private residences in the same zone, but there shall be no lot size restriction for such uses. In the case of a lot used for a motel or restaurant, how- ever, the buildings and structures thereon shall occupy no more than fifty per cent of the usable area thereof above high water mark."


2. by deleting present section 1-1 and substituting therefor a new section 1-1 as follows:


"1-1. Types of Zones


For the purpose of this by-law, the Town of Scituate is hereby divided into six types of zones, designated as:


"A-1" (Residence 40,000 sq. ft.) "A-2" (Residence 20,000 sq. ft.)


"A-3" (Residence 10,000 sq. ft.)

"A-4" (Residence and Recreational Service)


"B" (General Business) "C" (Commercial)


3. by deleting the last clause of section 1-2 and substituting therefor the following clause :


" "C" zones, and additional or revised "B", "A-1", "A-2", "A-3" or "A-4" zones will be shown on said map as any such area or areas may be made subject to vote of the town at any annual or special town meet- ing."

4. by deleting the present introductory clause of section 3-2c (heretofore designated as section 3-2b) and substituting therefor a new introductory clause of follows.

5. by adding at the end of section 3-4c the following sentence : "The provisions of this section shall apply whenever appropriate to the uses specified in paragraphs 3-2c (2) and 3-2c (3)."


6. by deleting the present introductory clause of section 3-5b and substituting therefor a new introductory clause as fol- lows:


"In an "A-1", "A-2", "A-3" or "A-4" zone, the fol- lowing uses are hereby specifically declared to be cus- tomary accessory uses within the meaning of this by-law:"


7. by adding a new section 3-6c as follows :


"c. Signs in Zone "A-4"


In an "A-4" zone the following exterior signs are permitted :


(1) All signs permitted in zones "A-1", "A-2" and "A-3".


(2) One non-flashing sign not over forty square feet in area pertaining to permitted buildings, struc-

tures and uses on the premises other than dwell- ings and their accessory uses. Signs may be lighted but no neon signs and no colored lights shall be permitted.


8. by deleting the phrase "In a "B" and "C" zone" at the be- ginning of sections 3-7a and 5-4b and substituting therefor the phrase "In an "A-4", "B" and "C" zone."


9. by deleting present section 3-7b (1) and substituting a new section 3-7b (1) as follows:


"(1) Any of the uses permitted in "A-4", "B" or "C" zones, but not pemritted either as of right or on appeal in "A-1", "A-2" or "A-3" zones."


10. by adding the designation "A-4" after "A-3" as it appears in section 5-1.


VOTED: Yes, 811, No 459. Not a 2/3 vote.


ARTICLE 2


Will the Town vote to designate as zone "A-4" an area adja- cent to Scituate Harbor bounded and described as follows:


NORTHERLY by land of the Town of Scituate now used as a public parking lot ;


EASTERLY by Scituate Harbor at low water mark;


SOUTHERLY by the Town pier and the northerly line of Beaver Dam Road; and


WESTERLY by the easterly line of Jericho Road.


VOTED: To indefinitely postpone.


ARTICLE 3


Will the Town vote to authorize the Selectmen to purchase or take by eminent domain a parcel of land with the buildings thereon and the wharves and piers appurtenant thereto, lying easterly of Jericho Road, said parcel being bounded and des- cribed as follows:

Southerly by land now or formerly owned by Arthur and Rosalie A. MacDonald;


Westerly by Jericho Road for a distance of approximately 900 feet to the southern boundary of the town parking area ;


Northerly by the southern boundary line of town owned land now used as a parking area ;


Easterly to low water mark running parallel with Jericho Road;


For the purpose of recreation, for the conservation and preser- vation of the harborside as a natural resource and for the fur- ther purpose of creating a fitting memorial park in the com- memoration of the three-hundred and twenty-fifth anniversary of the founding of the Town of Scituate:


And to raise and appropriate a sum of money for this pur- pose.


VOTED: To indefinitely postpone.


Motion made and accepted to reconsider Article I.


VOTED: Yes 742, No 488. Not a 2/3 vote.


ARTICLE 4


Will the Town vote to amend its Zoning By-Laws:


1. by adding a new section 3-3d as follows


Permitted uses in Zone B Marine


In a B Marine Zone the following uses are permitted as of right


(1) any of the uses permitted as of right in an "A-1", "A- 2" and "A-3" (Residence) zones, subject to the same conditions as therein specified


(2) Motels : individual units thereof shall not be equipped with facilities for the preparation or cooking of food

(3) Any of the following consumer, professional or com- mercial service establishments : dentists, doctors law- yers, real estate, insurance, arts, crafts and dry goods


(4) Restaurant or other place for the serving of food or beverages, outdoor dining areas accessory to a res- taurant on the same premises and serving only per- sons seated at tables


(5) Buildings and shops for the sale of marine equipment, hardware, gasoline, oil, for marine use only


(6) Office building, bank or other monetary institution


(7) Marina


Whenever an area in zone "A-1", "A-2", "A-3", "B" or "C" is changed to zone "B Marine", the lot area and width, side yard, rear yard, set-back and street frontage require- ments for uses other than those listed in paragraph (2) - (7) shall continue in force in said area as they were before such change. The side yard, rear yard, set-back and street frontage requirements for the uses described in paragraph (2) - (7) above shall be the same as apply to private resi- dences in the same zone, but there shall be no lot size re- striction for a motel or restaurant, however the buildings and structures thereon shall occupy no more than (50%) fifty percent of the useable area thereof above high water mark.


2. by deleting present section 1-1 and substituting a new sec- tion 1-1 as follows


"1-1. Types of Zones


For the purpose of this by-law the Town of Scituate is hereby divided into six (6) types of zones, designated as:


"A-1" (Residence 40,000 sq. ft.)


"A-2" (Residence 20,000 sq. ft.) "A-3" (Residence 10,000 sq. ft.)


"B" (General Business)


"B Marine" (Residence and Specified Business) "C" (Commercial)

5. by deleting the phrase "In a "B" and "C" zone at the be- ginning of Section 3-7a and substituting therefor the phrase "In a "B", "B Marine" and "C" zone.


6. by deleting present section 3-7b (1) and substituting a (1) Any of the uses permitted in a "B", "B-Marine", or "C" zones, but not permitted either as of right or on appeal in "A-1", "A-2" or "A-3" zones.


7. by adding to the designation of present section 5 a new section 5 (b) as follows :


Any building or structure in a "B Marine" zone shall be limited to one story in height or 20 feet in height on property adjacent to tidal waters, the height in each case to be measured vertically from the average finished grade of the ground adjoining such building to the highest point of the roof for flat roofs, to the deck line for mansard roofs, and to the average height between eaves and ridge for gable, hip and gambrel roofs.

To see if the Town of Scituate will vote to designate as a "B Marine Zone" the following area; the area on the Easterly side of Beaver Dam Road and Jericho Road from the Town Pier to the Town Parking Lot, and on the Westerly side of Jericho Road from the corner of Beaver Dam Road up to and including the land now or formerly owned by Frank Grady, (as shown on plan filed herewith).


VOTED: To indefinitely postpone.


ARTICLE 6


Will the Town vote to designate all Waterfront Property that is adjacent to tidewater as an A-4 Zone for distance of 350 feet back from Mean Low Water, said A-4 Zone to be as de- scribed by the Town Warrant for the Special Town Meeting of January 16, 1961.


VOTED: To indefinitely postpone.


ARTICLE 7


Will the Town vote to amend the Zoning Map by changing the following-described area from a Residence "A-3" District to a Business "B" District :


"Beginning at a point on the easterly side of the South River and the southerly side of Dartmouth Street, thence running easterly along said Dartmouth Street to the westerly side of Central Avenue; thence turning and running southerly along said Central Avenue to a point 150 feet northerly of Marshfield Avenue; thence turning and running easterly along a straight line 150 feet parallel to and northerly from said Marshfield Avenue to the Atlantic Ocean; thence turn- ing and running southerly along said Atlantic Ocean to a point 150 feet southerly of said Marshfield Avenue; thence turning and running westerly along a straight line 150 feet parallel to and southerly from said Marshfield Avenue to the South River; thence turning and running northerly

Will the Town vote to enlarge the North Scituate Shopping Center by designing the contiguous area on the Northerly side of Henry Turner Bailey Highway as a Zone "B", said area being bounded and described as follows :


Said parcel containing four and one-tenth (4.1) acres, more or less, and beginning at a point on Henry Turner Bailey Highway at the Southeasterly corner of the herein described area and running,


Northerly and Northeasterly on or near the center of Bound Brook and by land of the Town of Scituate to land of the Old Colony Railroad; thence turning and running,


Northwesterly, 720 feet, more or less, by land of said rail- road to land now or formerly of Clarence Hobart; thence turning and running,


Southerly, 615 feet, more or less, by land of said Hobart and land of the Heirs of George H. and Lovell B. Lincoln to a stake or bound; thence turning and running,


Southeasterly, 60 feet, more or less, by land of said Heirs of Lincoln to Henry Turner Bailey Highway; thence turn- ing and running,
