Resolved that the committee and staff of the Scituate Girl Scout Day Camp do hereby extend their appreciation for the use of the Town Forest located on Maple Street as a Conservation and Wildlife Sanctuary.
Resolved to commend Mr. John Ford, our beloved Tree Warden, for his kind- ness and cooperation in behalf of this worthy project - this cooperative effort having contributed to the success of this camp for the past three years.
It is further resolved in humble appreciation of John Ford's love and care of our Town Forest - his devotion to the God - Given Blessings of nature, that we the Board of Selectmen and the Girl Scout Committee do hereby recommend that a proper title be given to a living example of conservation for youth, and that this project be named the PAUL VINCENT FORD MEMORIAL WILDLIFE SANCTUARY, and that a copy of this resolve be spread upon our records.
ARTICLE 30
To see if the Town will raise and appropriate or transfer from available funds, the sum of $12,500.00 for Foreshore Protection to be used in conjunction with any sums already appropriated, or to be appropriated, by the Commonwealth of

VOTED: That the Town raise and appropriate the sum of $37,000.00 for the purpose of contributing its share to the restoration and protection of North Scituate Beach by means of placement of suitable sand fill constituting a dike as described in House Document No. 272, 86th Congress, 2nd Session, under the beach erosion control program of the United States Army Engineers, to be added to funds raised for said purpose by the Commonwealth of Massachusetts, the County of Plymouth and the United States; $8,500.00 to be raised by taxation in the current year, $28,500.00 to be borrowed at the discretion of the Selectmen for a period not exceeding five years, upon their determination that the actual payment of the Town's share of the funds must be made to cause the above described project to be under- taken. Unanimous vote.
ARTICLE 39
Will the Town raise and appropriate a sum of money to erect a new Rest Room on the Town owned parking area at Humarock.

ARTICLE 40
Will the Town vote to take by eminent domain an easement ten (10) feet wide for the purpose of constructing a drain over a portion of lots 264, 265, 266, 267, 268, 269, 270, 271, 272, 277, 278, 279, 280, 281, 282, 283, 284, 285, 242 and 243, all as shown on a plan on file in the office of the Town Engineer, said drain being for the purpose of correcting a dangerous and unhealthy condition between Tenth and Eleventh Avenues and northerly of Tenth Avenue; and further authorize the Board of Selectmen to lay out a drain as shown on said plan and assess better- ments therefor pursuant to Chapter 80, of the General Laws, and to raise and appropriate a sum of money for said purpose.

To see if the Town will raise and appropriate by taxation or otherwise the sum of $4,142.00 for the extension and gravel surfacing of the parking facilities of the Town-owned Peggotty Beach.
VOTED: That the Town raise and appropriate the sum of $4,142.00 for the extension and gravel surfacing of town parking facilities at Peggotty Beach, said amount to be used to provide for a tar-penetrated surfaced parking area for an additional 75 cars and the correcting of the drainage problem existing in the area.
ARTICLE 44
To see if the Town will raise and appropriate by taxation or otherwise the sum of $3,815.00 for preparation and construction of a gravel-surfaced beach parking area on Town-owned property bordered by Egypt Beach Road, Hatherly Road and Massachusetts Bay.

ARTICLE 45
Will the Town vote
(1) to designate a portion of Cole Parkway, approximately 50 ft. by 280 ft., and shown on a plan in the office of the Town Engineer, to be rented, leased, managed, or sold and conveyed for the purpose of providing additional business area in Scituate Harbor; the proceeds of revenue over costs which are derived from any such rental, lease, management or sale to be placed in the Stabilization Fund of the Town.
(2) to authorize the Selectmen to rent, lease, manage, or sell and convey the whole or any part of the aforesaid designated portion in order to carry out the pur- pose of Section (1) of this Article, provided that no lease shall be for a period longer than 40 years and no sale shall be for less than the fair market value of comparable property in the area; and further, to authorize the Selectmen at their discretion to create a "Land Management Board" to act for the Selectmen under the powers of this Article, except that any official action of rental agreement, lease or sale must be executed by the Board of Selectmen. It is suggested, but not obligatory, that any such "Land Management Board" shall consist of 5 business or resident taxpayers.
VOTED: That the Town authorize the Selectmen to sell and convey all of the Town's right, title and interest in and to a parcel of land in the rear of and ad- joining the land of certain stores bordering on Cole Parkway in Scituate Harbor, consisting in total approximately 5,754 square feet for a price of not less than $13,258.00, said parcel being more particularly bounded and described as follows:
Beginning at the Southwesterly corner of the within described premises at the Southeasterly corner of the land now or formerly of Arthur T. Nelson; thence running northerly along land of said Nelson and the land now or formerly of Catherine J. Coveney 115.08 feet to the most southeasterly point of the land

now or formerly of Dorothy Yarros; thence turning and running S. 66°-04'- 00"E through the land of the Town of Scituate a distance of 50 feet to a point; thence turning and running S.23°-56'-00"W through the land of the Town of Scituate a distance of 115.08 feet to a point; thence turning and running N.66°-04'-00"W through said land of the Town of Scituate a distance of 50 feet to the point of beginning, containing 5,754 square feet.
Said parcel being part of the land acquired by the Town pursuant to the adoption at the 1926 Town Meeting of Article 32 of the Town Warrant and recorded with the Town Clerk in Book 31, Page 19 with respect to the laying out the "New Town Way," said parcel so to be conveyed not being required for public purposes as declared in an opinion of the Selectmen on file in their office; it being the intent of this vote to convey such parcel under the authority granted by Massachusetts General Laws, Chapter 40, Section 15; such authorization to the Selectmen to be subject to the following conditions:
(1) the minimum amount received by the Town to be placed in the Stabilization Fund if such shall have been established otherwise in the general funds of the Town, and any amount received in excess of said minimum to be available for immediate use by the Selectmen to make repairs, replacements, or alleviate problems of relocation.
(2) the Selectmen shall have received and filed with the Town Clerk on or prior to the date of making such conveyance a written assurance and firm com- mitment from a recognized supermarket operator that it has arranged to construct, or have constructed, and will operate a modern supermarket containing not less than 19,000 square feet floor area.

ARTICLE 46
Will the Town vote to amend Section 6 of the Zoning By-Laws entitled "Lot Size Regulations for Dwellings" by adding after sub-section 6-1. thereof the following:
6-1A Apartment Houses In the "B" and "C" Zones apartment houses composed of no less than three apartments, consisting of not more than four rooms each, may be constructed. The required lot area for each apartment in such apartment houses shall be a minimum of 5,000 square feet and the required minimum lot width for any such apartment house shall be 100 feet. The construction of any apartment house under this section shall be subject to the provisions of section "a" of Section 3-7, of the Zoning By-Laws, which is entitled "Site Plan Approval."

To see if the Town will vote to authorize the Selectmen to grant insofar as they may have the right to do so, to Plymouth County Electric Company and New England Telephone and Telegraph Company, the perpetual and exclusive easement right to construct, operate and maintain electric distribution and telephone lines (one existing pole) with all equipment and appurtenances deemed necessary there- fore over, across and upon a certain parcel of land in which the Town may have an interest, namely: the parcel of land off River Street Humarock Beach, con- taining 16,000 square feet being bounded by Lots C-D-E-H-I-L-M-N-Q-R as shown on Sheet #72 of the Scituate Assessors' Plan. RESOLUTION
Resolved, that the Town of Scituate officially record its displeasure over the continuance of the status quo with regard to the almost total lack of public trans- portation to South Shore communities. Be it further resolved that the Board of Selectmen be instructed to meet with similar bodies of South Shore communities and representatives of the General Court so that a transportation plan may be developed which is acceptable economically and in service to all.
ARTICLE 51
Will the Town vote to amend its Building By-Law by deleting the first sentence of the first paragraph of Article IX thereof, and substitute the following therefor: The Board of Selectmen shall select a BUILDING COMMISSIONER. Appoint- ment shall be made of a person qualified by training or experience as a master builder, or from the field of architecture, engineering or building contracting. Within one year from the date of appointment as BUILDING COMMISSIONER he shall be a resident of the Town of Scituate in order to continue in the office.

Reasonable fees for inspection by the Building Inspector, the Electrical Wiring Inspector and the Gas Inspector, for the purpose of defraying the cost of the Town of providing the services of said Inspectors, shall be established by the Board of Selectmen from time to time.

ARTICLE 53
To see if the Town will authorize the Park Commissioners to appoint them- selves to positions on the labor force of the Park Department for the year 1963.

ARTICLE 54
Will the Town establish a Council for the Aging consisting of the Chairman of the Board of Public Welfare, the Chairman of the Park Commissioners, the Chair- man of the Board of Health, the Superintendent of Schools, or their respective representatives, and not less than three nor more than seven additional members appointed by the Board of Selectmen from the voters and residents of the town. The Chairman of the Council shall be designated from time to time by the Board of Selectmen. Appointees shall hold office until successors are designated.
It shall be the duty of the Council to co-ordinate or carry out programs designed to meet problems of the aging in co-ordination with programs of the Council for the Aging established under section seventy-three of chapter six of the Massachu- setts General Laws.

Any person violating any of the provisions of this Article, except as otherwise may be provided, shall be liable to a fine of not more than $20.00 for each offense, and may be arrested and promptly brought before a magistrate.

Will the Town vote to authorize and instruct the Selectmen to sell and convey to Wasco, Inc. a parcel of land containing 10,530 square feet lying southerly of First Parish Road and shown as Lot A on a plan entitled "Plan of Lots, Pine View Drive, Scituate, Mass." dated January 25, 1963, for the sum of $1.00 and to purchase from said Wasco, Inc., a rectangular parcel of land containing 28,820 square feet lying southerly of First Parish Road and bounded southerly and easterly by other land of the Town of Scituate, shown as Lot B on the above described plan and raise and appropriate the sum of $1.00 therefor.
