Will the Town vote to accept Chapter 636 of the Acts of 1957 titled "An Act Authorizing the Town of Scituate to Con- struct and Operate a System of Sewers" or act thereon.

ARTICLE 55
To see if the Town will raise and appropriate or transfer from available funds a sum of money for the procurement of plans specifications, and working drawings for elementary school housing, and to receive bids to be opened and submitted for approval at the next annual or a future Town Meeting.

ARTICLE 56
Will the Town vote to assume liability in the manner pro- vided by Section 29 of Chapter 91 of the General Laws for all damages to property suffered by any person by any taking of land or of any rights, interest or easement therein within the Town by the Department of Public Works of the Commonwealth for the improvement of tidal and non-tidal rivers and streams, harbors, tide waters, foreshores and shores along public beaches within the jurisdiction of the Town, and further to authorize the Selectmen to execute a form of agreement fur- nished by the Department of Public Works indemnifying the Commonwealth against claims for such damages.

"No automotive type of trailer, whether mobile or im- mobile, raised on cement blocks, or otherwise, shall be oc- cupied for living purposes or business purposes within the Town; except that such trailers may be used as field offices by architects, engineers or contractors engaged in the construction of public buildings or other public works, and, with the approval of the Zoning Board of Appeals by en- gineers, architects and contractors engaged in other con- struction ; provided however that such approval shall not be given for periods in excess of six months' duration.

ARTICLE 75
Will the Town vote to raise and appropriate a sum of money for the purpose of contributing its share to the cost of reconsti- tuting North Scituate Beach under the Reclamation program of the United States Army Engineers to be added to funds raised for said purpose by the County of Plymouth, the Com- monwealth of Massachusetts and the United States.
VOTED: That the Town raise and appropriate the sum of $28,000.00 for the purpose of contributing its share to the restoration and protection of North Scituate Beach by means of placement of suitable sand fill constituting a dike as described in House Document No. 272, 86th Congress, 2nd Session, under the beach erosion control program of the United States Army Engineers, to be added to funds raised for said purpose by the Commonwealth of Massachusetts, the County of Plymouth and the United States ; $8,500.00 to be raised by taxation in the cur- rent year, $19,500.00 to be borrowed at the discretion of the Selectmen for a period not exceeding five years, upon their de- termination that the actual payment of the Town's share of the

ARTICLE 76
Will the Town vote to authorize the Selectmen to purchase or take by eminent domain a parcel of land lying Northerly of Edward Foster Road and being bounded and described as fol- lows:
Beginning at a point 200.00 feet easterly of a concrete bound marking a point of curve in the northerly line of Edward Foster Road, thence running; N. 12°-44'-30"E by land of Quincy Oil Company about 245 feet to the center- line of the channel; thence turning and running in a gen- eral northeasterly, easterly and southeasterly direction by centerlines of channels as shown on a plan hereinafter mentioned about 1522 feet to a point in the northerly line of Edward Foster Road; and thence turning and running N.177°-15'-30"W by said Edward Foster Road, about 998 feet to the point of beginning. Being lot 2 and a portion of lot 1 as shown on a plan entitled, "Plan of Subdivision of Land owned by The Quincy Oil Company, Scituate, Mass- achusetts" dated January 28, 1959 and drawn to a scale of 40 feet to an inch by John E. Bamber, Town Engineer, for dredging and harbor development purposes; and raise and appropriate a sum of money therefore.

VOTED: That the Town raise and approprite the sum of $3,000.00 for the leveling, grading, seeding and general im- provement of the field immediately in back of the Wampatuck School, such work to include the construction of a baseball dia- mond suitable for use by the children of the Town during and after the school year.
ARTICLE 79
To see if the Todwn will raise and appropriate by taxation or otherwise the sum of $12,500.00 for the preparation and con- struction of a playground on Town owned property now known as the Hatherly School site on Country Way in North Scituate, said playground to include two tennis courts, one Little-League- size baseball diamond, swings and other playground equipment ; the entire project to be done in accordance with specifications on file in the office of the Park Department.
VOTED: (1) That in accordance with a letter dated February 28, 1961, written and signed by the School Commit- tee and sent to the Board of Selectmen containing notice that the former Hatherly School site is no longer needed for any school purposes, control of this property be transferred from the School Committee to the Park Commissioner.
(2) That the sum of $6,000.00 be raised and appropriated for the preparation and construction of a playground on Town- owned property formerly known as the Hatherly School site on Country Way in North Scituate, said sum to cover the cost of levelling, grading and seeding the entire area, the construction of one Little League-size baseball diamond, and, to the extend funds are available, the purchase of certain pieces of playground equipment.

ARTICLE 80.
Will the Town vote to accept Section 8A of Chapter 40 of the General Laws and establish a Development and Industrial Commission for the promotion and development of the business and industrial resources of the Town, such Commission to con- sist of five (5) members to be appointed by the Selectmen; and to raise and appropriate a sum of money for the use of such Commission to promote business and industry and for its op- erating expenses.
VOTED: That the Town accept Section 8A of Chapter 40 of the General Laws and establish a Development and Industrial Commission for the promotion and development of the business and industrial resources of the Town, such Commission to con- sist of five (5) members to be appointed by the Selectmen; and to raise and appropriate $300.00 for the use of such Commission to promote business and industry and for its operating ex- penses.

Will the Town vote to accept Section 8C of Chapter 40 of the General Laws and establish a Conservation Commission for the promotion and development of the natural resources and for the protection of watershed resources of the Town, said Com- mission to consist of five (5) members one of whom shall be a member of the Planning Board; and to raise and appropriate a sum of money for the use of said Commission.

ARTICLE 82
Will the Town vote to adopt a new By-Law as follows:
Rules and Regulations for Use of boats in Scituate Harbor :
1. Harbor Speed Limit - 6 knots maximum, all craft. Power boats must reduce speed when in the vicinity of smaller boats, or floats to which boats may be tied.
2. Proper Handling of Boats - Under existing statutes reckless or negligent operation of power boats so that the lives or safety of the public might be endangered is punishable by a fine of not less than $10.00 nor more than $50.00.
3. Racing of boats within the Harbor - Racing is forbid- den within the Harbor, except supervised racing of sailing craft of the Pram or other small Class.
4. Outboard Motor Boats - Must be operated with care and caution and must abide by Harbor Speed Limits.
5. Lights - All boats operating in the Harbor after dark must carry lights.
6. Placing of Lobster Buoys - Must be kept out of con- gested areas, away from floats and out of channels.
7. Embarking and disembarking Passengers for Hire - Persons using Town Public Landings and floats for this purpose shall register with the Harbor Master and shall not be tied up for more than one hour.
8. Dumping of Garbage or Refuse in Harbor - This Prac- tice is strictly prohibited in accordance with existing laws.
9. Boats without their own power - No person in charge of any boat or any type of water craft over 30 feet in length which is not equipped with its own power, or which does not have a sufficiently large crew to properly handle such a craft shall be allowed to anchor or moor such craft in any water under the jurisdiction of the Harbor Master without his approval.
