ANNUAL TOWN MEETING March 6, 1961 and ADJOURNED TOWN MEETINGS March 7 and 8, 1961


A legal meeting of the inhabitants of the Town of Scituate qualified to vote in Elections and Town Affairs was held at the High School Gymnasium on Monday, the sixth day of March 1961, at 7:00 o'clock p.m. The meeting was called to order by Moderator John Barnard, Jr.


The warrant was read by Town Clerk William M. Wade.


The check list was used. Checkers were: Grace B. McPher- son, Amy C. Bates, Osborne A. McMorrow, Jr., Jessie M. Story, Elizabeth Y. Robbins, Daniel J. Queeney, Elden M. Meyers, Priscilla Schott, Alice S. Torrey, Helen G. McDonald and Catherine E. Levangie.


Tellers appointed by the Moderator and sworn by the Town Clerk were: Wendell W. Whittaker, Charles F. Jenkins, John H. McPherson, Andrews Wyman, Alden H. Mitchell, Mark F. Limont, John E. Bamber, Ralph W. Sides, Stanley F. Murphy, John Hickey and Robert Montgomery.


ARTICLE 1


To hear the report of the Selectmen or other Town Officers and Standing Committees, and act thereon.


VOTED: To accept as printed in the Town Report. Report of the Scituate Library Study Committee was read by Joseph D. Blumenthal, and accepted.


ARTICLE 2


To choose all the necessary Town Officers other than those elected by ballot, viz: Surveyor of Lumber, Measurer of Wood and Bark, two or more Field Drivers, one Poundkeeper.

To see if the Town will authorize the Board of Public Wel- fare to contract at their discretion for support of the Town's poor, or act thereon.

ARTICLE 4


To see if the Town will authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year be- ginning January 1, 1962, and to issue a note or notes therefor, payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Sec. 17, Chapter 44, G.L.


VOTED: That the Town authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1962, and to issue a note or notes therefor payable within the year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, G.L. Unanimous vote.


ARTICLE 5


Will the Town vote to have all the income from the Water Department paid to the Town Treasurer, and estimated receipts used by the Assessors in fixing the tax rate for the current year. VOTED: Yes. Unanimous vote.


ARTICLE 6


To see if the Town will authorize the Selectmen to control, regulate or prohibit the taking of eels and any or all kinds of

shellfish and seaworms within the borders of the Town of Scituate and such other authority as is provided in Sec. 52 of Chapter 130 of the G.L. or take action thereto.

ARTICLE 7


Will the Town raise and appropriate the sum of $100.00 for the payment of dues for a yearly membership in the Maritime Division of the Boston Chamber of Commerce, or act thereon.


VOTED: To raise and appropriate $100.00.


ARTICLE 8


To see if the Town will raise and appropriate the sum of $43,560.60 to cover the expenses and disbursements of the Retirement Systems and Pensions for 1961 or act thereon.

Will the Town vote to raise and appropriate a sum of money to the Reserve Fund or transfer the whole or any part thereof from any available funds, or act thereon.

ARTICLE 26


Will the Town vote to adopt the following By-Law: "All Town officers shall pay all fees received by them by virtue of their office into the Town Treasury, with the exception of fees received by the Town Clerk for performing marriages."

ARTICLE 27


To see if the Town will instruct the Selectmen to petition the General Court to authorize the Town of Scituate to create the office of Comptroller ; such Comptroller to have substantially the duties and powers described in Chapter 223 of the Acts of 1960 and such other and further powers and duties as the Se- lectmen shall deem desirable to promote the efficient conduct of the affairs of the Town.


VOTED: That the Town instruct the Selectmen to pe- tition the General Court to authorize the Town of Scituate to create the office of Comptroller such Comptroller to have sub- stantially the duties and powers described in Chapter 223 of the Acts of 1960 and such other and further powers and duties as the Selectmen shall deem desirable to promote the efficient con- duct of the affairs of the Town.


ARTICLE 28


Will the Town vote to authorize its Treasurer to act as Collector of Taxes, said authorization to become effective im- mediately following the Town elections of March, 1963; and further to discontinue the office of Collector of Taxes upon the completion of the term now being served by the present Col- lector of Taxes.

ARTICLE 29


Will the Town vote to raise and appropriate a sum of money to purchase a new accounting machine for the Town Hall, or act thereon.

VOTED: That the sum of $5,500.00 be raised and ap- propriated under this article for the purchase of a new account- ing machine for the Town Hall and the specifications to be used for soliciting bids from competitive vendors be those suggested in the memorandum of November 15, 1960 from Charles M. Evans Associates to the Advisory Committee, a copy of which has been filed with the Town Accountant.


ARTICLE 30


Will the Town vote to adopt the following By-Law, to be- come effective January 1, 1962:


"No contract shall be entered into on behalf of the Town of Scituate and no liability or obligation of the Town of Scituate shall be incurred or entered into by any Board or Officer of the Town of Scituate until the Town Accountant has certified that sufficient funds have been appropriated to cover such con- tract, liability, or obligation."

Will the Town vote to authorize and instruct the Advisory Committee to retain a recognized, impartial Municipal con- sultant for the purpose of investigating the public works and purchasing functions of the Town and raise and appropriate a sum of money therefor.

ARTICLE 32


Will the Town raise and appropriate a sum of money for survey of the wage scedules and job classifications of all town

ARTICLE 33


Will the Town vote to establish a Town Specification Board to consist of (1) Lawyer, (2) Engineer, (1) Accountant, (1) Businessman, said Board to be appointed by the Moderator with the prior majority approval of the Board of Selectmen and Town Purchasing Agent if any. The terms of the appointments to be as follows; 3) members for terms of three years; (2) members for terms of two years. It shall be the duties of this Specification Board to examine and approve all specifications for bids which must be submitted to competitive bidding under the existing laws of the Commonwealth and of the town.


VOTED: To indefinitely postpone.


ARTICLE 34


Will the Town vote to amend the Classification and Salary Plan by deleting the provisions of Section 10 thereof and sub- stituting therefor the following:


Section 10. Amendment.


This By-Law may be amended by vote of the Town at any regular or special Town Meeting, except that salary schedules may be amended at an Annual Town Meeting only.

ARTICLE 35


Will the Town vote to create a Purchasing Department by accepting the provisions of Section 103 of Chapter 41 of the General Laws and authorize the head of said department, with the approval of the Selectmen and the Town Accountant, to establish rules, regulations and procedures for the conduct of so

ARTICLE 36


Will the Town raise and appropriate the sum of $125.00 for Channel Markings and regulations of the usage of the North River from Humarock to the sea, or act thereon.


VOTED: To raise and appropriate $125.00.


ARTICLE 37


To see if the Town will raise and appropriate the sum of $8,900.00 for Scituate to continue as a member of the South Shore Mosquito Control Project, said sum to include the amount which may be assessed against the Town for Mosquito Control (Chapter 112, Acts of 1931), or act thereon.


VOTED: To raise and appropriate $8,900.00.


ARTICLE 38


To see if the Town will raise and appropriate, by taxation or otherwise, a sum of twelve thousand dollars $12,000.00) for the construction of a booster station with necessary machinery to be located on Town owned land at the intersection of Mann Lot Road and Chief Justice Cushing Highway to provide ade- quate pressure for First Parish Road, west of Grove Street; Grove Street, Mann Lot and Clapp Roads to the Cohasset line, or take any action thereon.


VOTED: That the Town raise and appropriate, by tax- ation or otherwise, a sum of twelve thousand dollars ($12,000.00) for the construction of a booster station with necessary machinery, to be located on Town owned land at the intersection of Mann Lot Road and Chief Justice Cushing High- way, to provide adequate pressure for First Parish Road, west of Grove Street, Grove Street, Mann Lot and Clapp Roads to the Cohasset line.
